What is H1B visa 2019 Quota for Regular and Masters filings ?
As of the date of writing of article, the H1B quota is as below. This is also called the H1B Visa Cap. You can read more at What is H1B Cap ? Regular vs Masters quota ?

  • H1B Regular Quota : 65,000 visas
  • H1B Master’s Quota : 20,000 visas. ( only US Masters eligible)

Also, of the overall 85,000 visa cap, every year 6,800 visas are set aside for the citizens of Singapore and Chile as part of the Free Trade Agreement with them. There were few bills part of Comprehensive Immigration Reform that are not active in Senate that were proposed from Obama administration days to change the cap count to 110,000 and Masters to 25,000, including potential to make H1B cap extend up to 180,000. But nothing has moved and all are dormant. Nothing new has been proposed by the new Trump Administration regarding changing cap count. Will there be Lottery for H1B 2019 season ? Lottery Predictions ? Filing Numbers ?
Update : USCIS had lottery for FY 2019 quota and received 190,098 petitions.
Looking at the historical trend of H1B filings, cap reach dates, it is quite possible that we would have lottery for FY 2019 quota.  We have written a detail article looking at historical data, Trump administration new policies like ‘Buy American, Hire American’, students on OPT, H4 EAD removal rule, etc. factors. To know the prediction numbers and details, read the article:  H1B Visa 2019 Lottery Predictions – Analysis, Graphs .

When is H1B Visa 2019 Lottery Date ?
Update : USCIS Conducted Lottery for FY 2019 on April 11, 2018.
There are two things, one is when the H1B petitions are accepted for the lottery and second is when the actual lottery is done. H1B visa petitions for next fiscal year would be accepted by USCIS from April 2nd, 2018 for 5 working days until April 6th, 2018 to be part of the lottery. Now, the actual lottery date depends on various factors depending the volume of petitions and USCIS load. It can be anywhere in second week of April. For FY 2018, the actual H1B Lottery was done on April 11th, 2017 . We can expect anywhere around the same date like April 11th or April 13th.

How to find H1B visa 2019 Sponsors ?
It can be very hard to find a good employer and convince them to sponsor H1B to work in US with major unknown like H1B Visa lottery. Anyways, you would be in one of the three scenarios, if you are seeking a H1B Sponsor.

  • F1 Student in US : You can find an internship or co-op at an employer who can sponsor H1B visa and ask them to sponsor your H1B. You can continue to work on OPT once you graduate as well. You find the list of H1B Sponsoring companies using the tool
  • International Professionals  : If you are outside of US, it can be tricky with all the latest rules by Trump administration. Your best bet is to find an multi-national company ( MNC) and work through them to sponsor H1B visa. You may have hurdles inside the company with all the internal process, many waiting, etc. But, it is up to you to negotiate and ask them to take a chance. Many try the IT body shop route, where they ask them to file H1B. Rules have changed in the last few years and it is very risky move and can jeopardize your US hopes. Read comments on this H1B Companies Reviews article  to get an idea and  beware of such consulting companies to avoid fraud.

I doubt about lottery. In 2017,thosewho have 4/4 OGPA in masters degree, with tier -1 company placement .

  1. BeStrong was suggesting that maybe the last 3 year’s trend is different, and a model that disregards FY14 and FY15 may work better in our prediction.

Just to play with this idea, I did linear regression with only FY16, 17 and 18’s data:

FY 1-1 1-M Total Predict Error
    FY14 180000 234592 414592 147159 23159
    FY15 217638 314989 532627 188979 11979
    FY16 284500 368604 653104 232960 40
    FY17 299341 360604 659945 235960 40
    FY18 291092 261092 552184 198967 33
    FY19 203000 213544 416544 148868 ???

It’s noticable that this model gives a higher prediction of FY19. At the same time, it also overestimates FY14 and 15.

Compared to the previous model we used (that use data from FY14-18):

FY 1-1 1-M Total Predict Error
    FY14 180000 234592 414592 123468 532
    FY15 217638 314989 532627 172980 4020
    FY16 284500 368604 653104 231052 1948
    FY17 299341 360604 659945 237275 1275
    FY18 291092 261092 552184 198990 10
    FY19 203000 213544 416544 130215 ???

    • I forgot to supply the linear equation resulted in the regression analysis:

      3 year model y= 0.3853 * a + 0.3398 * b – 1909.72
      5 year model: y = 0.5999 * a + 0.3350 * b – 63102

      with a = 1-1 and b = 1-Multiple LCA positions.

      • LCA for FY2019 is lowest as its not counting the applications from April 2019 to Sep 2019. Can we correlate that with FY2014 ? as we still have atleast 5 months of applications that we can count in ?

        Reply
        • Indu,
Strictly speaking about the Linear Regression Method used by LCA.
If you will put the 1-1 LCA and 1-Multiple LCA points for all the years on a graph, you will see that FY 2014 and FY 2015 data points will be a bit of an anomaly while you try to get a linear line for all 5 data points. Therefore, when you use the regression method in order to take into account the data points for those 2 years, you will get you an intercept of (-63102) . Because of this low value, it will drag the values down to 130K . You can consider this your lower end of the limit.

When you will only take those 3 data points excluding those years, the linear relationship will fit in a better way with an intercept of (-1909) . Therefore, you will get value around (150 K) .

So according to this method of his, range is coming 130 K – 148 K

I understand your point , but i just asked him to get a range of the prediction. All the data is getting covered in the your low limit of the prediction.

    • Here is some food for thought, shall your life be subjected to a random lottery, or in other words, should you allow a random lottery to decide your life for you?

You are not from some third world country where you would have to work on farms if you went back. India has decent opportunities and from what I know and see, people get paid about 40-50% of the US salary (MS, Google, Qualcomm etc.) in India. I am friends with a number of people who moved back and want to move back to India after their doctorate. But that is the financial side of it. If you want to be in the US for the quality of life, you could get the same standard of living in Canada, EU, or Australia, among other countries. Sure, it is not easy to relocate but it is better than crying about a lottery over which you or anyone else has no control.

Lastly, in the coming years, there ought to be some reforms to the legal immigration system. A lottery is just horrendous that has no certaininty. No business like to base their projects and work-force to chance. So, even if this might be your last chance to apply for H1B while being in the US, it is not the end, you could apply later, relocate, or go back to school in the US.

You took a chance five years back, moved to the US, risked your future, in the end, it all worked well. You never left it to chance, did you? A random chance didn’t decide that you would get an admit, get a job, among various other achievements that you might have. Stop whining and self-pitying over a random lottery. It has never decided your career neither it will unless you let it. It doesn’t matter if you get selected in the lottery or not.

“It matters not how strait the gate,
How charged with punishments the scroll,
I am the master of my fate,
I am the captain of my soul. ” — William Ernest Henley

That’s true! its not the end of the world 😀

Few US based companies in India are paying well! I heard people earning 40%-50% of the salary that they get in US.

      • Here is an article that corroborates what the above says and underscores the fact that many foreign students are indeed moving back to their home country in search of better pastures.

        Excerpt from the article:

For decades the United States has attracted some of the best and brightest. Now some are starting to see the reverse happen. Vivek
Wadhwa, a distinguished fellow and adjunct professor at Carnegie Mellon University’s College of Engineering and author of The Immigrant Exodus: Why America Is Losing the Global Race to Capture Entrepreneurial Talent, said that in his current class at Carnegie Mellon, not one of the foreign students is looking to stay. Foreign students from India, China and elsewhere who used to stay are now returning to their home countries to start businesses. This is alarming because it will adversely impact U.S. innovation, Wadhwa said.

          2011 314,162
          2010 262,344

The year 2018 is an outlier and it does not follow the trend. There is no economic slowdown, no particular reason for it to be an outlier except the immigration policy changes. There shall not be a change in the number of renewals between FY 2016,2017, and 2018. The reduction in the number of LCAs shall be reflected in this year’s filings.

There is a constant increase from 2010 to the year 2016, earlier years being marred by the recession and slow recovery. Nonetheless, it has the positive trend till year 2016 and then the negative trend starts with the administration change. There is a definite slump this year.

(PS: Yes, I ignored the multiple LCAs and blah, blah! And, yes, I am employed but then it is friday evening and I just couldn’t resist finising it before the happy hour!)

This is why we ask not to trust pathetic FedEx.

Next year, please use UPS trucking for on time delivery.

I am sorry FedExTruck missed your delivery this year.

          • Your you trucks are too small to carry the burden of heavily skilled specialty occupation workers from India and Andhra.

You may want to order one of Tesla’s new truck for next year. Do you have money?

          • People with Amazon prime could have used 2 day delivery for H1B.
If you are in Vermont or california, you qualify for 1 day delivery if you send 5 packets. So ask your neighbours and colleagues.

          • It is because of these cheap USPS Trucks that eligible and well experienced DHL Trucks get delayed in the traffic. USPS has just flooded their trucks on the roads. With FedEx, UPS is following their lead, it is so hard for poor DHL trucks to find a parking spot at the USCIS office.

This year we have the same count of LCA for FY2019 as of today – 415,330.

Will the applications be same as last year or am I going wrong somewhere ?

I did my own little math after reviewing data from various sources:

    FY2017 = Total LCA’s registered (554,953) > Top 30 employers LCA registered (167,841) > H1B applications (236,000)
    FY2018 = Total LCA’s registered (414,005) > Top 30 employers LCA registered (106,449) > LCA’s filed with Job title – Computer Programmer = (9197)
    – Total LCA filings = down 25%
    – Top employer LCA filings = down 36%

    FY2018, H1B application estimate in the range of 188,800 – 200,600 (roughly 15 – 20% lower than FY2017)

If you compare his FY17 data to ours, you see he has 554,953 for FY17 while we have 659,945.

      FY17 299341 360604 659945 237275.00
      FY18 291092 261092 552184 198989.91
      FY19 201786 213544 415330 129486.66

My explanation is that he used a narrower data range than we did.

    • Dude, forget about H4 work permits. We are not even getting h1b visa and h4 is not even a problem here. There is another way to get get a work permit for h4. They can enroll in a school and get the master degrees and then they can work. The problem with them is they want to get everything in free. I have my friend who came here on h4 and he did the same thing. He did his master and now he is working. People should realize now that we should stop demanding things in free. Nothing is free in the USA.

All the best to all new h1b candidates.

      • Yeah. H4 wives come here for free because husband did all the Hardwork. Now they enjoy same lifestyle just by marrying.

Now, they will demand free work permit also ! This is pure entitlement mentality.

        Reply
        • What do you mean by free? At times with married people its a joint decision to pursue an opportunity. If one person is sacrificing their career for the betterment of other’s career, it is not something they are getting for FREE.
And what cost are you paying for this? Sitting on your ass while your manager files the visa for you and 10 other on the team? Or get into a god forsaken university just to land here in US? There are smarter people who had to leave their jobs for the family and if they can get the opportunity there is nothing wrong in it. I am an H4 EAD worker, went to a great school, ended up at the top of the class, Work with a reputed firm and command a salary higher than level 4 wage. So dont give me that BS.

          • Who cares about you academic excellence and your wage level salary? Are you feeding me or my family? We are just expressing our thoughts. Why do you need h4 work permit if you’re claiming to be the excellent candidate in your class? You should have got OPT time and then you should have applied for h1b. We all are on a same boat. Did US government asked you to sacrifice your career and marry a person who was in the USA? Have some sense about the matter I just spoke in my post. Don’t just put your negative thought process on the post and criticize others. Sorry, it’s about entitlement mentality as Bojo said.

          • Hey H4 wife, before commenting about ones that completed Master’s in US, look at your gender first.

Not only women are demanding free work from US govt, they exploit all the guys to enter US without doing anything worthwhile.

What contribution to family ? Sitting at home, whining and complaining about no work ead ?

Why don’t you just marry guy working in India then, if you have such a great brilliant career ? Ah… You want to settle in US without doing any work !

Let me guess, you broke up with your Indian boyfriend, dumped him as soon as you got some Uncle guy 10 years older than you because he had GC !

Nowadays Indian women don’t even want to marry H1 guys. They will even marry some grandfather if he has GC !

            Pathetic leeches !

          • What logic ?

If married people take joint decisions, why is 98% H4 full of women ?

Taking easy way out without putting any effort. Blindly marrying uncles after dumping Indian boyfriends for US entry tickets. Golddiggers.

  11. I haven’t posted a thing for the past 2 days. All those people who are posting things with my name, grow up. And people who just scold me based on those comments, pls do understand how a real comment would be. And some guy has commented saying Lets do a dodo with my name. But still u guys believe that it was posted by me? And thats an example why I say World is not an easier place for women. Seriously guys. Get a job rather than posting something with my name.

This is my third time with this process and I really need the lottery, trying to convert from L1b, GC in process and a promising career here. I work directly at the employer and haven’t used any of these shenanigans to boost my chances.
I just hope USCIS finds a way to weed out these people before the lottery is , so that the all genuine guys get it.

  13. A question about unselected applications for those who are working on cap gap status -from which date are you supposed to stop working if not selected in the lottery? Is it from the date you receive the returned petition or is there any other notification that occurs before this? What if the law firm notifies you later, for example a day after they receive the unselected application?

    Reply
    • You don’t have cap gap if you are not selected. You stop working the day your OPT/CPT expires.

Cap gap only kicks in if you are later notified that you are selected in the lottery.

      Reply
      • Is there any official published information regarding this? I found the following information in Murthy Law Firm’s website:

“Under the cap-gap provisions, if an employer timely files a cap-subject H1B petition for a change of status for an October 1st start date (i.e. filed before the OPT period ends), then a foreign national in F-1 status may continue working between the expiration of the employment authorization (as indicated on the employment authorization card) and October 1st. If the H1B petition is not selected in the lottery, or if the petition is denied, the cap-gap period generally terminates.”

        Reply
        • “If the H1B petition is not selected in the lottery”.

This happens on the lottery day. It doesn’t say “If the beneficiary is notified that he/she is not selected”.

          • It is hard to believe you work for USCIS. A friend just sent me the following link – “https://www.uscis.gov/i-9-central/745-cap-gap” which mentions the following information:

Extensions of F-1 status and OPT
If a student is in F-1 status when you file an H-1B petition with an October 1 start date and is currently participating in post-completion OPT, they will receive an automatic cap-gap extension of both their F-1 student status and their authorized period of post-completion OPT.

          • Automatic extension is not given beyond June if you havent received a response. Speaking from first hand experience. Had several talks with lawyer and DSO last year.

        • Extensions of F-1 status and OPT.
If a student is in F-1 status when you file an H-1B petition with an October 1 start date and is currently participating in post-completion OPT, they will receive an automatic cap-gap extension of both their F-1 student status and their authorized period of post-completion OPT. If the H-1B petition is selected and remains pending or is approved, the student will remain authorized to work as an F-1 student with OPT through September 30.

So basically: this automatic extension ends by Sep 30 if your petition is selected and pending or approved, or on the day of denial if your petition is selected but denied, or on the lottery day if you are not selected in the lottery.

          • @Fake USCIS-Insider, Whatever you are saying directly contradicts whatever is mentioned on the USCIS website. It clearly says that once the visa is filed, both OPT and F-1 are extended. Not sure what you get out of spreading false information.

“Once a timely filing requesting a change of status to H-1B on October 1 has been made, the automatic Cap-Gap extension will begin and will continue until the H-1B petition adjudication process has been completed. If the student’s H-1B petition is selected and approved, the student’s extension of status will continue through September 30. If the student’s H-1B petition is denied, withdrawn, revoked, or is not selected, the student will have the standard 60-day grace period from the date of the rejection notice or their program end date, whichever is later, to prepare for and depart the United States.”

The agency will reject and return filing fees for all unselected cap-subject petitions that are not prohibited multiple filings (PDF, 119 KB, https://www.uscis.gov/sites/default/files/USCIS/Laws/Memoranda/2018/2018-3-23-PM-602-0159-Matter-of-S-Inc-Adopted-Decision-Package.pdf).

    • An employer may not file, in the same fiscal year, more than one H-1B petition on
behalf of the same alien if the alien is subject to the numerical limitations of section
214(g)(1)(A) of the Act or is exempt from those limitations under section 214(g)(5)(C)
      of the Act.

This means one guy can file multiple petitions with different employers, but one employer shud not file multiple petitions for the same guy…
      Any tricky thing here??

      Reply
      • Don’t have high hopes for the filtering those petitions taking place prior to the lottery. It will be a painstaking thing to do. Unless you are holding onto straws. I don’t see it happening.

        Reply
          • They have zero incentive to filter before the lottery. They will likely not filter before the lottery because then that means they can reject more applicants after the lottery is completed and ultimately have fewer approved petitions = what they want.

        • I know wishful thinking. Sigh
Their main idea is to reject them after the lottery during the approval process so the number of approvals reduce and they bring lesser immigrants to the United States for this fiscal year.
Now that sounds something that Lee Cissina would like to hear.

      • Ya. This doesn’t mention multiple filings people will be filtered out in lottery. Just that they might get RFE with a most likely a rejection.

  24. Hi,

In my offer letter the date of reporting is October 1st , where as the LCA shared by my employer shows the employment begin date as mid august 2018. Is it fine with different dates in offer letter & LCA?

    Reply
    • LCA can usually be applied only six months before. But h1b start date is always October 1st. It’s practically impossible to apply with Oct 1 LCA date because six months prior would mean April 1st which is when H1b filing period would begin.

This is my first time filling H1b. I noticed that on my LCA, the start date is Sep 21 2018 instead of Oct 1st 2018. Did the lawyer make a mistake?

It’s totally normal. It is practically impossible to get an LCA to start on October 1st. If you did, you might end up missing the lottery.

  25. Alright Guys, Mainly related to US Grads with respect to big companies :

Ran LCAs for major US based companies (like Google , facebook , IBMs , Ebay ) . It is not looking like that the LCAs have been reduced for these companies. Infant saw around 10% rise in few places. These are almost all 1-1 LCAs so the conversion rates are always high.

There has been major shift in IBM policy it seems. Not getting people from IBM India at all but sharp rise in IBM CORPORATION. Overall effect still seems to be positive.

    IBM CORPORATION
    FY 2018 – 948
    FY 2019- 2813

    IBM INDIA PVT LIMITED
    FY 2018 – 4,438
    FY 2019- 90

Unless, i see a lot of renewals taking place for these companies. I dont see much drop for US grads hiring at least among these companies.

But then i search for Capgemini America too . I am not sure they mostly hire Grads or undergrads . Found a big drop in there LCAs too

    FY 2018 – 5839 ( total LCA count )
    4270 ( 1-1 LCA)

    FY 2019 -2057 ( All 1-1 LCA )

I hope this helps painting a better picture !
