What is the H1B Visa 2019 season start date ?
Update : USCIS will start accepting H1B Petitions starting from April 2nd, 2018 as per their official update on their website. In general, USCIS starts accepting applications for the next fiscal year exactly 6 months before the start of the next fiscal year. USCIS fiscal year for 2019 starts from 1st October 2018, which means they should accept applications for FY 2019 from April 1st, 2018. As April 1st is a Sunday, USCIS should accept applications for H1B 2019 season from April 2nd, 2019.
What is H1B visa 2019 Quota for Regular and Masters filings ?
As of the date of writing of article, the H1B quota is as below. This is also called the H1B Visa Cap. You can read more at What is H1B Cap ? Regular vs Masters quota ?
- H1B Regular Quota : 65,000 visas
- H1B Master’s Quota : 20,000 visas. ( only US Masters eligible)
Also, of the overall 85,000 visa cap, every year 6,800 visas are set aside for the citizens of Singapore and Chile as part of the Free Trade Agreement with them. There were few bills part of Comprehensive Immigration Reform that are not active in Senate that were proposed from Obama administration days to change the cap count to 110,000 and Masters to 25,000, including potential to make H1B cap extend up to 180,000. But nothing has moved and all are dormant. Nothing new has been proposed by the new Trump Administration regarding changing cap count. When is H1B Visa 2019 Lottery Date ?
Update : USCIS Conducted Lottery for FY 2019 on April 11, 2018.
There are two things, one is when the H1B petitions are accepted for the lottery and second is when the actual lottery is done. H1B visa petitions for next fiscal year would be accepted by USCIS from April 2nd, 2018 for 5 working days until April 6th, 2018 to be part of the lottery. Now, the actual lottery date depends on various factors depending the volume of petitions and USCIS load. It can be anywhere in second week of April. For FY 2018, the actual H1B Lottery was done on April 11th, 2017 . We can expect anywhere around the same date like April 11th or April 13th.
How to find H1B visa 2019 Sponsors ?
It can be very hard to find a good employer and convince them to sponsor H1B to work in US with major unknown like H1B Visa lottery. Anyways, you would be in one of the three scenarios, if you are seeking a H1B Sponsor.
- F1 Student in US : You can find an internship or co-op at an employer who can sponsor H1B visa and ask them to sponsor your H1B. You can continue to work on OPT once you graduate as well. You find the list of H1B Sponsoring companies using the tool
- International Professionals : If you are outside of US, it can be tricky with all the latest rules by Trump administration. Your best bet is to find an multi-national company ( MNC) and work through them to sponsor H1B visa. 3 year model y= 0.3853 * a + 0.3398 * b – 1909.72
5 year model: y = 0.5999 * a + 0.3350 * b – 63102

LCA for FY2019 is lowest as its not counting the applications from April 2019 to Sep 2019. Can we correlate that with FY2014 ? as we still have atleast 5 months of applications that we can count in ?

Strictly speaking about the Linear Regression Method used by LCA.
If you will put the 1-1 LCA and 1-Multiple LCA points for all the years on a graph, you will see that FY 2014 and FY 2015 data points will be a bit of an anomaly while you try to get a linear line for all 5 data points. Therefore, when you use the regression method in order to take into account the data points for those 2 years, you will get you an intercept of (-63102) . Because of this low value, it will drag the values down to 130K . You can consider this your lower end of the limit.
When you will only take those 3 data points excluding those years, the linear relationship will fit in a better way with an intercept of (-1909) . Therefore, you will get value around (150 K) .
So according to this method of his, range is coming 130 K – 148 K

Here is some food for thought, shall your life be subjected to a random lottery, or in other words, should you allow a random lottery to decide your life for you?
You are not from some third world country where you would have to work on farms if you went back. India has decent opportunities and from what I know and see, people get paid about 40-50% of the US salary (MS, Google, Qualcomm etc.) in India. I am friends with a number of people who moved back and want to move back to India after their doctorate. But that is the financial side of it. If you want to be in the US for the quality of life, you could get the same standard of living in Canada, EU, or Australia, among other countries. Sure, it is not easy to relocate but it is better than crying about a lottery over which you or anyone else has no control.
Lastly, in the coming years, there ought to be some reforms to the legal immigration system. A lottery is just horrendous that has no certaininty. No business like to base their projects and work-force to chance. So, even if this might be your last chance to apply for H1B while being in the US, it is not the end, you could apply later, relocate, or go back to school in the US.
You took a chance five years back, moved to the US, risked your future, in the end, it all worked well. You never left it to chance, did you? A random chance didn’t decide that you would get an admit, get a job, among various other achievements that you might have. Stop whining and self-pitying over a random lottery. It has never decided your career neither it will unless you let it. It doesn’t matter if you get selected in the lottery or not.

The regressional meth does put the number at 131k-ish. Even if we give more weight to recent LCAs (since last minute ones are more likely to be new employment) it’s 140k. So there is hope for that for sure.

The year 2018 is an outlier and it does not follow the trend. There is no economic slowdown, no particular reason for it to be an outlier except the immigration policy changes. There shall not be a change in the number of renewals between FY 2016,2017, and 2018. The reduction in the number of LCAs shall be reflected in this year’s filings.
There is a constant increase from 2010 to the year 2016, earlier years being marred by the recession and slow recovery. Nonetheless, it has the positive trend till year 2016 and then the negative trend starts with the administration change. There is a definite slump this year.
(PS: Yes, I ignored the multiple LCAs and blah, blah! And, yes, I am employed but then it is friday evening and I just couldn’t resist finising it before the happy hour!)

Petitions filed for current H-1B workers who have been counted previously against the cap, and who still retain their cap number, will also not be counted toward the FY 2019 H-1B cap.?????
Someone posted the LCA data last year (H1B FY 2018), same day: (please see below)
But all the calculations we have this year considers total LCA count for FY2018 as 552K, but last year the count on Apr 6th, 2017 is 414,005.
This year we have the same count of LCA for FY2019 as of today – 415,330.
Will the applications be same as last year or am I going wrong somewhere ?

FY2017 = Total LCA’s registered (554,953) > Top 30 employers LCA registered (167,841) > H1B applications (236,000)
FY2018 = Total LCA’s registered (414,005) > Top 30 employers LCA registered (106,449) > LCA’s filed with Job title – Computer Programmer = (9197)
– Total LCA filings = down 25%
– Top employer LCA filings = down 36%
FY2018, H1B application estimate in the range of 188,800 – 200,600 (roughly 15 – 20% lower than FY2017)
I noticed this post too, since this guy got the results right.
He did not specify the date range he used to collect the data.
If you compare his FY17 data to ours, you see he has 554,953 for FY17 while we have 659,945.

USCIS is looking to conduct the lottery next Tuesday or Wednesday, once the requisite data entry has been completed (not the full data entry, just the minimum required to conduct the lottery). Probable date of announcement of numbers – Apr 13th or 16th.
My friend works at an immigration law firm, she says the fastest way to know if you are selected is to ask your company’s accounting department whether the check has been cashed by USCIS or not.

Dude, forget about H4 work permits. We are not even getting h1b visa and h4 is not even a problem here. There is another way to get get a work permit for h4. They can enroll in a school and get the master degrees and then they can work. The problem with them is they want to get everything in free. I have my friend who came here on h4 and he did the same thing. He did his master and now he is working. People should realize now that we should stop demanding things in free. Nothing is free in the USA.

What do you mean by free? At times with married people its a joint decision to pursue an opportunity. If one person is sacrificing their career for the betterment of other’s career, it is not something they are getting for FREE.

I haven’t posted a thing for the past 2 days. All those people who are posting things with my name, grow up. And people who just scold me based on those comments, pls do understand how a real comment would be. And some guy has commented saying Lets do a dodo with my name. But still u guys believe that it was posted by me? And thats an example why I say World is not an easier place for women. Seriously guys. Get a job rather than posting something with my name.

This is my third time with this process and I really need the lottery, trying to convert from L1b, GC in process and a promising career here. I work directly at the employer and haven’t used any of these shenanigans to boost my chances.
I just hope USCIS finds a way to weed out these people before the lottery is , so that the all genuine guys get it.

Just got a bunch of FedEx and UPS packages unloaded, there’s gonna be another FedEx truck in a few hours. If we count all these packages in, I would say 180k-200k
good count, going to be a tug of war then., hopefully from Tuesday we should be seeing the checks getting cleared.,

A question about unselected applications for those who are working on cap gap status -from which date are you supposed to stop working if not selected in the lottery? Is it from the date you receive the returned petition or is there any other notification that occurs before this? What if the law firm notifies you later, for example a day after they receive the unselected application?
You don’t have cap gap if you are not selected. You stop working the day your OPT/CPT expires.
Cap gap only kicks in if you are later notified that you are selected in the lottery.
Is there any official published information regarding this? I found the following information in Murthy Law Firm’s website:
“Under the cap-gap provisions, if an employer timely files a cap-subject H1B petition for a change of status for an October 1st start date (i.e. filed before the OPT period ends), then a foreign national in F-1 status may continue working between the expiration of the employment authorization (as indicated on the employment authorization card) and October 1st. If the H1B petition is not selected in the lottery, or if the petition is denied, the cap-gap period generally terminates.”
“If the H1B petition is not selected in the lottery”.
This happens on the lottery day. It doesn’t say “If the beneficiary is notified that he/she is not selected”.
It is hard to believe you work for USCIS. A friend just sent me the following link – “https://www.uscis.gov/i-9-central/745-cap-gap” which mentions the following information:
Extensions of F-1 status and OPT
If a student is in F-1 status when you file an H-1B petition with an October 1 start date and is currently participating in post-completion OPT, they will receive an automatic cap-gap extension of both their F-1 student status and their authorized period of post-completion OPT.
Automatic extension is not given beyond June if you havent received a response. Speaking from first hand experience. Had several talks with lawyer and DSO last year.
Extensions of F-1 status and OPT.
If a student is in F-1 status when you file an H-1B petition with an October 1 start date and is currently participating in post-completion OPT, they will receive an automatic cap-gap extension of both their F-1 student status and their authorized period of post-completion OPT. If the H-1B petition is selected and remains pending or is approved, the student will remain authorized to work as an F-1 student with OPT through September 30.
So basically: this automatic extension ends by Sep 30 if your petition is selected and pending or approved, or on the day of denial if your petition is selected but denied, or on the lottery day if you are not selected in the lottery.
@Fake USCIS-Insider, Whatever you are saying directly contradicts whatever is mentioned on the USCIS website. It clearly says that once the visa is filed, both OPT and F-1 are extended. Not sure what you get out of spreading false information.

This means one guy can file multiple petitions with different employers, but one employer shud not file multiple petitions for the same guy…

Don’t have high hopes for the filtering those petitions taking place prior to the lottery. It will be a painstaking thing to do. Unless you are holding onto straws. I don’t see it happening.

They have zero incentive to filter before the lottery. They will likely not filter before the lottery because then that means they can reject more applicants after the lottery is completed and ultimately have fewer approved petitions = what they want.

Their main idea is to reject them after the lottery during the approval process so the number of approvals reduce and they bring lesser immigrants to the United States for this fiscal year.

Last year USCIS conducted lottery on April 11th, the announcement of the lottery was done in press release on April 17th. You can read the USCIS press release 2017
You can expect number of petitoons on monday 16th of april.

USCIS is looking to conduct the lottery next Tuesday or Wednesday, once the requisite data entry has been completed (not the full data entry, just the minimum required to conduct the lottery). Probable date of announcement of numbers – Apr 13th or 16th.

In my offer letter the date of reporting is October 1st , where as the LCA shared by my employer shows the employment begin date as mid august 2018. Is it fine with different dates in offer letter & LCA?

LCA can usually be applied only six months before. But h1b start date is always October 1st. It’s practically impossible to apply with Oct 1 LCA date because six months prior would mean April 1st which is when H1b filing period would begin.

It’s totally normal. It is practically impossible to get an LCA to start on October 1st. If you did, you might end up missing the lottery.
Alright Guys, Mainly related to US Grads with respect to big companies :
Ran LCAs for major US based companies (like Google , facebook , IBMs , Ebay ) . It is not looking like that the LCAs have been reduced for these companies. Infant saw around 10% rise in few places. These are almost all 1-1 LCAs so the conversion rates are always high.
There has been major shift in IBM policy it seems. Not getting people from IBM India at all but sharp rise in IBM CORPORATION. Overall effect still seems to be positive.

It seems that part of this finding is consistent with what the Capgemini guys who just posted below.
Never ever knew that I would follow this blog. I didn’t know such a blog existed around 10 days back. I am feeling 100% confident now that the count is gonna be less than 150k. It can seriously be 130k. Cheers to all the one petition applicants. I am in my last attempt with 35 more days in my OPT. Im thoroughly thrilled to know how my future is going to be. I am very confident now all genuine applicants gonna get picked up this time.
