What is the H1B Visa 2019 season start date ?
Update : USCIS will start accepting H1B Petitions starting from April 2nd, 2018 as per their official update on their website. In general, USCIS starts accepting applications for the next fiscal year exactly 6 months before the start of the next fiscal year. USCIS fiscal year for 2019 starts from 1st October 2018, which means they should accept applications for FY 2019 from April 1st, 2018. As April 1st is a Sunday, USCIS should accept applications for H1B 2019 season from April 2nd, 2019.

What is H1B visa 2019 Quota for Regular and Masters filings ?
As of the date of writing of article, the H1B quota is as below. This is also called the H1B Visa Cap. You can read more at What is H1B Cap ? Regular vs Masters quota ?

  • H1B Regular Quota : 65,000 visas
  • H1B Master’s Quota : 20,000 visas. ( only US Masters eligible)

Also, of the overall 85,000 visa cap, every year 6,800 visas are set aside for the citizens of Singapore and Chile as part of the Free Trade Agreement with them. There were few bills part of Comprehensive Immigration Reform that are not active in Senate that were proposed from Obama administration days to change the cap count to 110,000 and Masters to 25,000, including potential to make H1B cap extend up to 180,000. But nothing has moved and all are dormant. Nothing new has been proposed by the new Trump Administration regarding changing cap count. Will there be Lottery for H1B 2019 season ? Lottery Predictions ? Filing Numbers ?
Update : USCIS had lottery for FY 2019 quota and received 190,098 petitions.

When is H1B Visa 2019 Lottery Date ? 
Update : USCIS Conducted Lottery for FY 2019 on April 11, 2018.
There are two things, one is when the H1B petitions are accepted for the lottery and second is when the actual lottery is done. H1B visa petitions for next fiscal year would be accepted by USCIS from April 2nd, 2018 for 5 working days until April 6th, 2018 to be part of the lottery. Now, the actual lottery date depends on various factors depending the volume of petitions and USCIS load. It can be anywhere in second week of April. For FY 2018, the actual H1B Lottery was done on April 11th, 2017 . We can expect anywhere around the same date like April 11th or April 13th.

How to find H1B visa 2019 Sponsors ? 
It can be very hard to find a good employer and convince them to sponsor H1B to work in US with major unknown like H1B Visa lottery. Anyways, you would be in one of the three scenarios, if you are seeking a H1B Sponsor. 

  • F1 Student in US : You can find an internship or co-op at an employer who can sponsor H1B visa and ask them to sponsor your H1B. You can continue to work on OPT once you graduate as well. You find the list of H1B Sponsoring companies using the tool
  • International Professionals  : If you are outside of US, it can be tricky with all the latest rules by Trump administration. Your best bet is to find an multi-national company ( MNC) and work through them to sponsor H1B visa. You may have hurdles inside the company with all the internal process, many waiting, etc. But, it is up to you to negotiate and ask them to take a chance. Many try the IT body shop route, where they ask them to file H1B. Rules have changed in the last few years and it is very risky move and can jeopardize your US hopes. What is H1B 2019 Filing Fee ? 
H1B visa petition filing involves USCIS fee towards certain things and attorney fees, which varies by company size, and attorney involved for the case.  As of FY 2018 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee.  In year 2016, for FY 2018, the H1B base filing fees, increased from  $325 to $460.     • I have not received any thing yet. April 27th WAC on cap gap AD.
      This is really stressful as my job is at stake now. Not sure how many days my employer is going to wait for my H1B to be approved after Sept 30th 🙁 🙁

  1. The cap-gap folks are the ones that are most affected by this as we don’t have any option but to sit and wait without getting paid while still having to pay all our bills here (for those whose companies do not have positions internationally)

    • Most of cap gap people should also have student loans on top of these regular bills.. and for MBA students (like me) that loan check is a specially FAT one.

        • Are you guys exploring temporary international transfers? Better to be paid less than paid nothing. The only catch will be a switch from COS to consular processing.

          • @WACADWaitingCapGap – My company does not have operations in other countries for my specific team / skill set so I have no option but to wait on unpaid leave until I get a decision (at this point, no idea when that will be or what the decision will be)

  2. Moving the goal post!

    until last week they had processing time range of 1.5 month to 4 months for EAC center and inquiry date up to april 28th

    despite issuing tons of RFEs they still cant apparently touch all applications so now they not only show increased processing time window of 5 months but also moved the inquiry date to april 17th.. so you cant even inquire about the case..

    Pretty convenient for USCIS..

      • And the receipt day they have for inquiries in WAC is January 30, 2018!!!
        That is crazy. We’ll be lucky if we have our visas sorted out by 2020…
        They are def treating us very badly. Like I can’t believe USCIS is overwhelmed, the process has a closed number of applications USCIS has to review, how come now suddenly they can’t manage that load? No man, I don’t buy it. It’s just making the process slow & stressful on purpose…

        I’m tired of this wait, and at the same time I feel I’m a chicken because I couldn’t say “ok, leave it, say ciao and try better places maybe in Europe”. Too bad, too bad…

        • Yup, this was my 4th and last attempt.. was very happy that finally the wait ended but turns out USCIS had other plans.

          this is surely a deliberate attempt at deterring companies from employing foreign workers.. but in the process they are also creating an extremely stressful environment for the employees and their families.

    • From what number of law companies have said, it has virtually come to a standstill over the last month. Pretty sure this is a all a deliberate attempt to push everyone to leave and hope that they get tired of waiting to come into the country.

    • I havent updated my number there but if you want to update mobile number – you can get a skype or voip US number and have it forward text to your india number. inexpensive and simple solution.

  5. Just wait till 11/9 and then you will see hundreds of rejections/RFE and some approval as well. Neither Califorinia nor Vermont is processing enough as of now, they are just waiting for the new rule to comes in to the picture. my application too pending since April and no update.

  8. Hi Ram/3rd timer,

    Am currently working with employer A in H1B (H4 to H1B ->COS) on july we sent a response to amendment RFE and waiting for USCIS decision. I got an offer from employer B due to latest premium processing suspension and they are planning to file my case in normal processing. Once employer B is filed my case with USCIS, am planning to go back to my home country for visa stamping for my current employer A. Please advice on below questions.

    1.Is this advisable to go for stamping when employer A amendment is in RFE evidence received case status?
    2. What will happen to my employer B case filling?
    3. My current contract with client ends on december last week(this year) with employer A, whether it will impact anyway for my visa stamping?
    4. Working in EVC model now, what about the current trend of visa stamping in consulate?

  11. Hi all, any news regarding adjudications from the California Service Center? I responded an RFE around August 9th, and I am still waiting to hear back. As October 1st gets closer, I am more and more nervous. Thanks!

    • Atleast you are lucky. My case Received April 12th and Receipt Date 19th. Advance Degree And still no change in status in both website and ontop of it I am on CAPGAP. Will loose work authorization on Sep 30th and I do not want to join Day 1 CPT to continue working as it can cause issue infuture. Congrats on your RFE. I am hoping some action can be taken on my case approved, RFE or Denied.

  13. I need to know in details what is meant by H1-B Petition approval validity date. I believe my visa will be valid till the expiry date of my H1-B Petition? What will be a good time to renew it before the Petition expires?

    • Read US Visa vs Status . Your petition approval date is something that is given by USCIS on your approval notice, but visa expiry date is something that is on your passport. If you do extension, without traveling out of US, you may have expired visa in passport, but you may have approved petition and in valid work visa status…You should renew 6 months before your petition expires to be safe.

  14. It’s long wait …Cases Received on 12th April 2018 / Non AD/ VT center and it’s more than 4.5 months today (3rd Sep 2018) and still case status is showing “Case was Received” in both :

    – https://myaccount.uscis.dhs.gov/

    Based on USCIS VT center H1 B processing time : 3 Months to 5 Months, let see if there will be any update on my case on 12th Sep 2018 because on that day it will be 5 months of case received.

    I signed up for a Case Inactivity Notification on 7/27. However, I have not recd any of the bi-weekly mails till now. The status of my petition still shows as “Received”. Would anyone be able to throw any light on this?

  16. Just got this news on FB h1b page that a CEO of two IT companies in US -both companies in Bellevue / Seattle was arrested charged of multi year visa scheme- his name is Pradyumna Kumar Samal . I hope nobody here is affected by this type of schemes. the whole article @ slice of real life .com

  17. USCIS issues RFE only when they think that there is something suspicious in the petition. Many applicants have got direct approval. CA has higher approval rate than Vermont.

    • Yes, may be, If i check data provide by IG, the condition is comparatively better this year wrt no. of approvals and RFE.. As last year it was very 1st order of BAHA, they must have scrutinize thoroughly. this year hope for the best..

    • It’s not about “suspicious “, it’s more about clarification / justification provided is not up to the mark / their guidelines and then they request for evidence so that based on that they can approve the case.

  18. Vermont center is just randomly issuing RFEs.. Now more than before..

    i was checking cases around my receipt and every update made yesterday is an RFE. About 30 updates for series
    EAC18143ABCEF and all RFE. ( http://h1bstat.ru/all-stats/EAC143.html )

    They may have a target to ‘process’ a number of applications each day and this is how they meet the target.

      • I can see lot of approvals on USCIS site in California center for receipt number starting WAC18167 which must be for receipt date of 11 may .

          • Yes mine is WAC18165XXXXX.Received is 12apr,n9may receipt. 160,161,162 … is based on receipt date but looks likes USCIS is processing application randomly as I said there are lot of approval cases for WAC18167 which is after our receipt date.

          • Same with EAC as well, Received date 12th April and Notice date 7th May….still case status “Case was received ” .

            On WAC center processing duration is longer than EAC center as per

            – EAC : 3 Months to 5 Months [This duration is based on case received date, in most of H1 b cap cases this date is 12th April ]
            – WAC: 5.5 Months to 7.5 Months [This duration is based on case received date, in most of H1 b cap cases this date is 12th April ]

      • @Luck2018, dude all H1 B caps lottery date is 12th April and recept dates vary, the date they assign a case number to the picked packet. so May 01 is receipt date and 7.5 months from that will be ~ Dec 15., so just chill and have fun,

  19. Guys, just relax and watch ! you are not the only one going through this. I know one of my friend, who got selected in 2015, received RFE in Sep, Approval in Nov15 and travelled US in Apr 16. The other one Selected in 2016, RFE by Sep, Approval by Nov16 and Traveled by AUG 17. 😀 .. Being in same field I am expecting RFE by Sep 18, Approval by Dec 18 and may travel by Aug 2019..

  21. Two different receipt date in egov.uscis.gov and myaccount.uscis.dhs.gov for my receipt number. The receipt date was April 12, 2018 in both places till last week.

    What does it mean? why two different receipt date for same receipt number?

      • I confirmed from couple of friends and from IG website and as per them most of H1 B cap cases received date is : 12th April which is mentioned in https://egov.uscis.gov/casestatus/landing.do.

        So ignore “received date” mentioned in https://myaccount.uscis.dhs.gov

    Got RFE for H1B for typical regular H1B visa processing of typical software enggs on Aug 17th . They asked for 4-5 letter .
    Hike letter, Joining letter,sow,end client letter,Job description,project organisaonal chart …
    7yrs exp . BE .

  23. Got RFE on specialty occupation. Attorney is saying, he needs to do an integration expert report on specialty occupation and beneficiary’s occupation. What is that mean? What kind of RFE is this? anyone on same boat?

  24. PP suspension has nothing to do with backlog. USCIS knew all along they were lying when they said they expected it to last only until Sep.

    Their sole purpose is to make the process as time-consuming, exhausting, expensive, and uncertain as possible so that fewer companies will apply to the visa.

    USCIS sent an inquiry to my client manger( Working in 3rd party location ) about my job duties and my role last month end and my manager responded immediately to USCIS. Its been almost a month my manger submitted the request back and I still don’t see any change of status(H1B – AD). So wondering if anybody here faced the same situation to know how long does USCIS normally take to process the request after the inquiry as I see my application was already opened based on this ( Was not issued any RFE and they reached out directly to my client manager via email )

  26. I think suspension of premium processing is good for people who are in H1B cap process.

    • You think so? My 1st thought yesterday was “daaaammmmiiit”, because I was hoping my company would upgrade my application to PP since that was the initial intention when we applied.
      Then I chilled and I started thinking that maybe it is actually better for us in the cap, since this way Cali and Vermont centers won’t have the pressure of PP, and they will have more time to dedicate to this year H1B cap applications, since they are def overwhelmed now.

      But… I don’t know, I guess I’m trying to be positive…

        • He means that regular processing time might shorten. But the point is once you are past Sep 30, you’re out of job and need to make alternate arrangements. Because there’s no guarantee when the application will be approved.
          Also, expect all these extension / amendment / transfer cases to flood California and Vermont with their applications under premium processing before September 11. So there’s virtually no chance that regular processing will speed up anytime soon.

          • Exactly what I am thinking. I find it hard to believe that they did not anticipate this. They should have ideally allocated more people to get the work done faster!

USCIS is extending the previously announced temporary suspension of premium processing for cap-subject H-1B petitions and, beginning Sept. 11, 2018, will be expanding this temporary suspension to include certain additional H-1B petitions. We expect these suspensions will last until Feb. 19, 2019, and will notify the public via uscis.gov before resuming premium processing for these petitions.

    Recently i got an RFE for my Amendment Request, my employer submitted the response back and actually the request is in Premium. The response was submitted on 20th of august, but i am not able to see any update in USCIS case status or in myaccount.uscis site as “Response received”?

    is there any known delay?

      • @WellWisher, he said he got an RFE for his Amendment Request, he doesn’t belong to H1B 2019.

        @Vinay, just relax, usually there will be such delays in updating those sites, did your fedex/ups updated the packet receieved and recd date? (check that), once your RFE reaches, you clock will start ticking again…!

  29. Did anyone got mail communication from SeyFarth on documentation needed to respond to RFE, I got an RFE on 31st July and still there is no ask on any documentation on my end. I believe it should be related to firm documents then.

    • so many of us.. It’s hardly 25,000 AD and Non-AD approvals we had so far. From the USCIS stats around 95,000 from Master’s got picked in the lottery combined. Assuming 30 percent of them in cap-gap would still be around 29,000 roughly. There should be thousands literally waiting for the result on cap gap… Hope we get to know before the end of cap gap.

      Have to be prepared in case you do not get to know.. either wait 60 days or immediately enroll in school to be on F1 to continue status and iif possible get work auth to continue with job..

    Is working remote allowed on H1b? I am currently working in city A. My employer is ok with me moving to a new city (in a different state) and work remotely. My company does have a policy like this but i am not sure if my visa status allows me to work remote.

    • USCIS has started doing random checks. They send their officers to location mentioned in LCA to verify that employee is getting salary mentioned in LCA, his job duties are aligned. USCIS is currently targeting consultancy firms.

  31. I got my H1B approval notice today from my company lawyer’s (Fragomen).
    I was AD (advanced degree), case picked up April 12th, California center.
    As of now, neither DHS.gov, nor egov.uscis indicate any changes (they both say Case received).

    • Last year USCIS opened the PP on first week of September. Based on that everyone hoping USCIS will open the PP this year too around that time.

  34. My I-129 was selected but still waiting for approval. My client is backing out due to project risk. As a result, I am going be stuck in the UK for at least another year or two until my company finds me another assignment.

    – Will my I-129, if approved, still be valid at that point?
    – Can I transfer I-129 to another client before approval?

      –However, There are people also reported that USCIS may reject if the original petition is not stamped for COS (Change of status case, like yours). But its is worth to try to transfer.

    This year my regular H1B got picked & approved and not stamped yet.My question is that I am planning to apply for reissue of passport as spouse,address need to be change.Stamp would be come on which passport i.e new one or old passport ?and any negative impact on H1b visa stamping?

    • I’m not an expert. But just thinking – you’ll have a different number on your new passport. So it should be better to first get the stamp on existing one and then carry the new one along with the old one wherever you go. They anyway staple both passports together when they issue a new one. And the CBP officer puts a “VIOPP” (visa in other passport) stamp on your new passport when you enter the US.

        • The passport details really do not matter. You might as well get the visa stamping on the new passport as that’s what you will be using and active. It is misconception that you should use the same passport that was used at the time of filing.

    • No issue, my wife applied for new Passport to my add my name in order to apply for my new born baby passport. We completed DS-160 with new passport and visa stamped on the new passport.
      But, still I-797 is with old passport. You are good as long as you carry both passports and you can go for visa stamping before or after your new passport.
