What is H1B visa 2019 Quota for Regular and Masters filings ?
As of the date of writing of article, the H1B quota is as below. This is also called the H1B Visa Cap. You can read more at What is H1B Cap ? Regular vs Masters quota ?

  • H1B Regular Quota : 65,000 visas
  • H1B Master’s Quota : 20,000 visas. ( only US Masters eligible)

Also, of the overall 85,000 visa cap, every year 6,800 visas are set aside for the citizens of Singapore and Chile as part of the Free Trade Agreement with them. There were few bills part of Comprehensive Immigration Reform that are not active in Senate that were proposed from Obama administration days to change the cap count to 110,000 and Masters to 25,000, including potential to make H1B cap extend up to 180,000. But nothing has moved and all are dormant. Nothing new has been proposed by the new Trump Administration regarding changing cap count. Will there be Lottery for H1B 2019 season ? Lottery Predictions ? Filing Numbers ?
Update : USCIS had lottery for FY 2019 quota and received 190,098 petitions.
Looking at the historical trend of H1B filings, cap reach dates, it is quite possible that we would have lottery for FY 2019 quota.  We have written a detail article looking at historical data, Trump administration new policies like ‘Buy American, Hire American’, students on OPT, H4 EAD removal rule, etc. factors. When is H1B Visa 2019 Lottery Date ?
Update : USCIS Conducted Lottery for FY 2019 on April 11, 2018.
There are two things, one is when the H1B petitions are accepted for the lottery and second is when the actual lottery is done. H1B visa petitions for next fiscal year would be accepted by USCIS from April 2nd, 2018 for 5 working days until April 6th, 2018 to be part of the lottery. Now, the actual lottery date depends on various factors depending the volume of petitions and USCIS load. It can be anywhere in second week of April. For FY 2018, the actual H1B Lottery was done on April 11th, 2017 . We can expect anywhere around the same date like April 11th or April 13th.

How to find H1B visa 2019 Sponsors ?
It can be very hard to find a good employer and convince them to sponsor H1B to work in US with major unknown like H1B Visa lottery. Anyways, you would be in one of the three scenarios, if you are seeking a H1B Sponsor.

  • F1 Student in US : You can find an internship or co-op at an employer who can sponsor H1B visa and ask them to sponsor your H1B. You can continue to work on OPT once you graduate as well. You find the list of H1B Sponsoring companies using the tool
  • International Professionals  : If you are outside of US, it can be tricky with all the latest rules by Trump administration. Your best bet is to find an multi-national company ( MNC) and work through them to sponsor H1B visa. You may have hurdles inside the company with all the internal process, many waiting, etc. But, it is up to you to negotiate and ask them to take a chance. Many try the IT body shop route, where they ask them to file H1B. Rules have changed in the last few years and it is very risky move and can jeopardize your US hopes. Read comments on this H1B Companies Reviews article  to get an idea and  beware of such consulting companies to avoid fraud.
  • Important Note : We, as RedBu2US, DO NOT Provide any H1B sponsorship or guide anyone using professional services or fee. If anyone approaches you by saying our name, it is pure FRAUD…beware !

    1. H1baspirant

Green card is sponsored by employer. If your new employer is not willing to sponsor green card, you cannot stay beyond 6 year completion on H1b. You need to find a new employer who will sponsor your green card

    1. CPTer

      Hi Sam,

Per your link, does it mean all OPT and CPT who waiting H1b update should stop working from Sept 30?

I remember I asked Kumar few weeks ago, and he confirm that this rule only affect to OPT, not CPT. But it may change day by day.

Hope to hear advice from Kumar.

    Hello All,

Does anyone know what this could mean? I received an update from USCIS gov site. Please let me know.

Notice Explaining USCIS’ Actions Was Mailed
On September XX, 2018, we began reviewing your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number WAC18XXXXXXXX. We mailed you a notice informing you of the action we intend to take on your case. Please follow the instructions in the notice and submit any requested materials. If you do not receive your notice by October XX, 2018, please call the USCIS Contact Center at 1-800-375-5283. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

  5. Changed

USCIS has changed the timelines today for I-129 petitions.

4 Months to 6 Months H-1B – Specialty occupation – Visa to be issued abroad April 07, 2018 (EAC)
4 Months to 6 Months H-1B – Specialty occupation – Change of status in the U.S. April 07, 2018 (EAC)

Morning it was 3 to 5 Months for both – May 08, 2018.

6.5 Months to 8.5 Months H-1B – Specialty occupation – Visa to be issued abroad January 20, 2018 (WAC)
6.5 Months to 8.5 Months H-1B – Specialty occupation – Change of status in the U.S. January 20, 2018 (WAC)

Morning it was 5.5 to 7.5 Months for both – February 18, 2018.

Again it’s going to be too slow.

  6. WhoTo Believe

EAC18139XXX case received since April 12, egov says RFE sent Aug. 28, myaccount.uscis.dhs.gov still shows case received and keeps sending notification that I will be notified when status changes, Company is not saying anything.

    1. 3rd Timer

It is normal but in previous years USCIS reinstated the premium processing option at around September first week. Since that option will not be available until at lest Feb 2019 this year, we should expect further delay.

    2. administrator

Well, I guess, it is definitely slower because of all the new regulations and additional things they check now…The official processing times, reflect the same.

  7. Badly_Needsome_Advise

    Hello friends,

I recently got an RFE for employer-employee relationship and worksite. My attorneys have not yet responded to the RFE. I have travel plans to India in mid oct due to a family emergency. Any advice would be really helpful. I am in a bad situation. I haven’t booked my return ticket yet. Not sure when to come back to USA.
FYI – I am a FT employee with a valid EAD until 2020(f1 visa OPT STEM)

    1. StillWaiting

Your H1 might have been filed as COS (change of status) as you are already present in US.
H1 is filed as Consular-Notification if someone is not present in US.

As much as I know there is an option to convert application from COS to Consular-Notification. Basically if you leave US right now, you will have to convert your application from COS to Consular-Notification.

Please talk to your attorney. He would be able to advise you better.

      1. StillWaiting

        Correcting my statement.
Filing H1 as Consular-Notification is optional if someone is in US already i.e. it can be filed as COS as well as Consular-Notification.
The difference is H1 gets implemented immediately after approval if filed as COS and one has to go to home country for stamping if filed as Consular-Notification to get it implemented after approval.

        1. Badly_Needsome_Advise

Okay lets assume I am in india and still I havent recieved my h1b approval. If I travel back to the USA and after that if it gets approved what should I do? Should i immediately depart USA for my stamping or is there time period?

          1. 3rd Timer

My understating is if it was approved while you are in India then it will only approved as Consular even though it might have requested as COS. This is because there is nothing to change the status due to you are not present in US at the time of approval.

OTOH, If it is approved after you come back to US then it will most probably approved as COS as requested unless the original petition itself requested as CP. In very rare cases it may approved as CP as well event though it was requested for COS.

In case it is approved as CP then you may not required to travel immediately as your F1 STEM Opt is still valid till 2020. Good luck and all the best for your visa approval and also safe travel.

    2. Anushka Devansh

Dude, if you EAD until 2020, happily travel to India and comeback, just make sure you carry travel I20 and necessary travel doc’s.

  8. Cap gap

    Hi Kumar,

I am currently on CAP GAP and my H1B status is still “Case Was Received”. I was confirming with my college about the situation after Sept 30th and I found from my DSO that my case was approved on June 19th for EAC18********. We both were surprised because I haven’t heard anything from the lawyers neither my dhs account or my case status showing me approved. Do you know what case it might be?

I am not keeping any hopes but this seems weird to me.

    1. anonymous

Even I came to know my application got approved on May16. But still haven’t received any notification. My lawyer has not received approval notice and they have sent request to USCIS to resend a duplicate. I don’t know what is going on 🙁

          1. New_H1B

Hey , did you hear about your approval notice? Also, how did you find out about the status of application?

    2. administrator

Interesting…Check with your attorney and ask them to reach out to USCIS on the same. Maybe some systems are updated, some not…It is weird, but online systems have shown inconsistent info in the past, so should check with USCIS on the same.

    1. Patience

How will it helpful? Your case would be different from others. So just wait for your decision. Prepare for the worst and hope for the best.

  9. h1bAspirant

Hi Guys, I see the receipt number before me got denied. I m just wondering that the receipts from the same company will be in serial? Need to know whether that denial is from my company or not.

  10. H1b waiting

Happy to see the rejection of those who applied multiple petitions and hijacked the lottery systems…..because of you people ,most of the deserving candidates are still waiting for the results.

    1. ADWaitingCapGap

I think USCIS already factored in such cases – that’s why they selected 117K applications in the lottery as against the 85K limit. Those extra 32K have to come from somewhere, right? So statistically speaking, I don’t think any deserving candidates got left out.

That said, I do not like people filing multiple petitions. It just hurts the image of all H-1B people and the H-1B visa system itself.

  11. KishoreGadde

Hey I din do anything wrong. I interviewed multiple client and got job offer because of my skill.
If you are skill enough, go and interview 100 company. It is legal to also work 80 hrs on H1b you know ?

Before cursing other people, try to understand reality. My 3 applications are pending. Now only 2. I don’t know how employer will prove ‘they are not related’. Both different employer.

Please give proper response and experience before abusing. Thanks to you

    1. lol

Ofcourse! you dint do anything wrong. U got three offers and u were planning to work for all the three simultaneously. We all know why you made this unethical move. Good luck in replying the RFE “together or separately”. You should be worried more about getting blacklisted from all the three employers.

    2. My foot

Yes…you are the only skilled person in the whole universe…your concerns clearly proves the jobs might be related..update us once all your petitions gets rejected..j…a…

    3. Confusing

Dude..two applications for better chance of approval…..I don’t understand your statement..are they desi consultancies..if so no matter what you give in your response..your petition will still be denied…the third petition will still be considered for decision though it is withdrawn..talk to your attorney!!!!

  12. KishoreGadde

My H1 receive RFE intent to revoke coz of multiple name in three application.

But USCIS also asking – ‘prove all three employer are not related’.
How we can prove this ?

Should all 3 send separate or together ? I ask 1 emplyer to revoke but I want at least two application to forward next step for better approval chance .

Anyone else in same boat ? What you do ? What employer will respond ?

I am thinking Day 1 CPT to kepp status alive. Please helo. Help.

      1. #instant karma

First of all I would like to congratulate for your RFE for all applicants. I believe you might have done this with 3 different desi consultancies and at least 2 are paid one. Neither one of them would be willing to respond to your RFE coz they feel like you betrayed them. I am very happy for you to see in such a situation. This is a nice example for applying multiple petitions. This is one of abusing done by applicants other way we all know is done by companies. It doesn’t matter you are AD or Non-AD, output and abusing is same. No matter what, this is one of the reason USCIS is reacting like unfair.

Who ever was successful in abusing welcome to the H1b suffering. You are still a lucky guy in this way.

    1. Roop Ghosh

I think that as a educated and hopefully aware person you should know better than to file multiple petitions. And if not, then the appropriate first step is to consult a lawyer and really understand the meaning of multiple petitions.

    2. Just a thought

      Hi Kishore,

Of all the three pts you can decide which one is best suited according to your skills and get other two revoked. That should be your best chance for approve

    3. N Patel

Get ready for all 3 denial. Your situation clearly says that.
I dont understand why people do like this when they are confident enough for their skills.

  13. Urgent_Amendment_Denial

Re-post. Yet to get any guidance 🙂

    Hi All,

My amendment for Client A was denied after Specialty Occupation RFE. I am in home country and my Visa will expire in June’2019. Can you please let me know if we can raise Amendment again for the same Client A. Mine is Computer System Analyst role in LCA. Is it possible to raise Amendment for same client with a different role now.

  14. Sam

If any of you get updates on your cases, please do share it more info so that it will be helpful for others to see how things are progressing.. probably with more info like below, i know i’m bit annoying here,, but remember guys who got approval too were looking for detailed info like this before you know the outcome.

Whenever someone with result posts update, there are lot of followup questions which in most cases are not responded.. this should probably help everyone.

Receipt number: WAC/EAC (share first 4 or 5 numbers of your receipt#)
    Appln Type: Ad / Non-AD
    Notice Date
    Approval or RFE received date
    How did you get notified
Approvals showing up in myaccount / egov?

These were some of the follow up questions i have seen that are asked by people when an update is posted.

  15. Question

I am a teacher. Is it possible to apply to two different schools and have both schools apply for you h1b?or is that considered multiple applications? its two different schools.

    1. Ash

If both schools fall under same school district, then they might consider as multiple applications as they are from single entity…as long as they are different, then they are treated as different applications..

  16. Sam

Can you explain what is “Case Was Reopened For Reconsideration”. My attorney has received a notice with this status and also “Case was approved” notice on the same day.

In the DHS account, I first received an update with case was reopened status and after 3 days got the approval status.

Do you know what this means?
    Please help

    Thanks in advance

    1. administrator

Some status are intermediate that are updated as part of system updates and sometimes may not be consistent with the actual status. As long as your attorney has a physical copy of the approval, it is the final status. You can call USCIS to validate the same as well.

  17. Trump_Ka_Deewana

I have my few friends in TCS,CTS and in Wipro and i am from HCL. I came to know that not a single approval came for any of the person mentioned above Organizations. It seems it is a deliberately move and something is surely going on in UCSCIS. Not sure but they may reject major chunk out of these applications. How could this be possible that no one got approval yet from these 4 big consulting firms. I checked around 7-8 application no ahead from my WAC167***** and backwards.. I am surprised to see 90% of the petitions either approved or in RFE status but around 1 or 2 still sitting on “Received status”

    1. MarryMe

To come to a conclusion like that, you seem to know like 10,000 people who filed H1 from those 4 firms.
You are just so so so so amazing !!

  18. Urgent_Amendment_Denial

    Hi All,

  19. Anxiously Waiting

    Service center: Vermont
    Received date: 12-April
    Notice date: 04-may-2018
    receipt no. EAC181515****
Since notice date is now before “Receipt date for a case inquiry” Should I submit an “outside normal processing time” service request online?

Should I do it myself or ask employer/attorney?
anyone here has done this before? please advise.

    Ref: https://egov.uscis.gov/processing-times/

  20. KishoreGadde

Yes. I receive confirm from three employer attorney. All three different client but now only working for client 1 on OPT.

Can you suggest how I can prove companies are not related ? Will attorney take care ?

  21. KishoreGadde

Admin Kumar, why you disable comment ?

My H1 receive intent to revoke coz of multiple name in three application. USCIS ask to justify if each of client have work. This they will do because easy.

But USCIS also asking – ‘prove all three employer are not related’.
How we can prove this ?

Should all 3 send separate or together ?

    1. Sinha

WAC or EAC, Have you filed 3 petition and all three selected that’s surprising.
Does they have any common client letter or altogether for different entity.

If it’s for all 3 different entity why a NOID?

    2. h1baspirant

You are saying that “My H1 received intent to revoke” . Petition can be revoked only by employer not by USCIS. USCIS can issue NOID (Notice of intent to deny). Just double check the notice from USCIS.

  22. GAK

Got RFE Sep21, WAC non-AD. not sure what they have asked, need to check with Company,
Looks like many of my friends got RFE this year. Hope all cases are getting updated

  23. PastInformationPlease

    Hello everyone,
Is there any experienced person who knows how the last year trend was? Did all the approvals happen before Oct 1st ? If not how long did the new petitions take which were picked up at the end (for this year it is mid may).Is the process made slow this year ? Almost hopeless as my start date is approaching and the case is still received.

  24. WACADWaitingCapGap

For the cap-gappers planning to transfer to international offices (and in effect moving from COS to consular processing) –
Let’s say you get your approval while you’re outside US. Then you get your visa stamped based on an offer letter from your company’s US office. Do you know if it’s possible to file a transfer to a new employer before the 1st day of your H-1B visa?

    1. h1baspirant

USCIS has suspended premium processing. Even if you apply for a transfer after your H1b approval, it may easily take around 6 months to get the decision.

  25. Waiting_Infinity

Is it usual for USCIS for having so long processing time? I wonder how was it last time around ? I expected at least by October to have the result. Now i am not sure if it will come this year. Non AD, WAC , 8TH MAY RECEIPT DATE

    1. Venkat

Yes, it is usual to USCIS for taking these long waits to process the applications. I was on same boat last year For (H1B 2018) April 2017 application i got my final update on March 2018 almost a year.

So, wait until your turn. Good luck for your approval!

  26. YouAreTearingMeApartH1B

    Any nonAD WAC updates?
I assumed and accepted I’m not going to be back in October for sure, but I am wondering how long can this take, without any news at all… My receipt day is May 5th.
What do yo guys think? September is almost done, and I’m afraid this wait could maybe last full October, November… maybe more?
It’s really heartbroken to live day by day without knowing anything and only thinking about that moment of getting some good news.

    1. MR

      Hi Bro,
I verified some other site (http://www.worktheme.com/#/welcome19 ), from CA center they have not started verifying, with my case series, around for 700 applications I am seeing only 35 RFE and 140 as approved rest all are showing Received state.
I know this is not going to approved so soon, but unable to stop verifying my case status. Everyday I am verifying to see the same status “Case Was Received” 🙂
      This is very painful waiting.

      1. YouAreTearingMeApartH1B

I checked my series, it says:
Received: 350 RFE Req Mailed: 28 RFE Resp Recv.: 21 Transferred: 0 Decision Notice: 7 Approved: 255

Well… not that bad, right? Haha I just want someone to tell me I’m going to know soon and feel I can trust that… xD

      2. YouAreTearingMeApartH1B

Also, based on that site, it seems that last day there was a lot of movement in both EAC & WAC. Maybe we are close to know something, guys. The website gave me some hope… haha Thank you!

  27. Indu

Received NOID from USCIS for multiple petition in my name. Both are genuine from two high paying consultancy.
    Anyone else receive this ?
Why they issue NOID instead of RFE ? This is not fair.
    Please advise me.

    1. Cnfg

It should not be filed for the same location or same client.
Also there are several factors considered.. if there is a relation between employer a and b based on the contracts.. common applicants.. previous client letters etc. I could not frame this correctly but USCIS have notified early March on how they would classify them as duplicate or multiple petitions that can lead to denial. If you are still confident try MTR which would sometimes work but that has to be filed within the first 30 days.. you can get 30 more days for documentation once filed..

    2. Multiple H1b Sucks

I don’t think, now the companies who filed for your H1b will do anything after knowing that you had applied from multiple positions……

    3. TheTruth

Because you were not supposed to have Multiple Petitions filed…….. Sorry for you but you literally just wasted a spot for someone else who deserved it!!! I dont get people like you…. thats so selfish!!!!

    4. Sinha

Has both consultancies filed for same end client? I believe you still have a chance to respond.

I have also heard in one of the facebook live of IG is that this year all multiple petition has been picked up. Not sure how true it is.

Some people also told that both of their petition certifiied. There must be something related between the two if they have given NOID.

    Hi Kumar,

I am currently on Cap Gap till Sept 30th and my H1B status is still in Received. I am planning to apply for H4 and H4EAD in the meanwhile. If my H4 or H4EAD gets approved prior while my H1B status is still in Received or pending, do i have to file an amendment with H1B saying my status is now changed to h4?

    Please advise.

    Thank you,

    Hi Kumar,

My husband is having H4 visa till Aug 2019 and he was in India when his H1b was filed and picked up in lottery. So far, we have not received any update on his case.
Now he wants to travel to US on H4 visa,
    1) Do you see any problem if his case gets approved while he is in US?
    2) Is there anyway we can know if his H1B filed with Change of status or Consular processing?

FYI, We have his I797C(Receipt Notice) and Consulate/POE is empty.

    Thanks in Advance

It shouldn’t be problem while travelling in H4 Visa. Once it’s approved you can change the status from H4 to H1. But only one point I want to mention here, In Port of Entry suppose if a question is asked that you have filed H1 your answer should be yes and still pending with approval.

What if he goes to India back for stamping after approval, since he has to go back to resign from his current employer. During stamping, do you see any issue like they may ask while you were in US why you didn’t start working and all that stuff etc.

    2. Tiger_Zinda_Hai

There should not be problem because your husband current status is H4 and H1 B just picked but nor approved. But as soon as H1 b will be approved then H4 will automatically be revoked because person can hold on visa (either h1 b or H4 or anyother).

At same time if your husband in India and H1 B gets approved in that case he will have to travel on H1 b with stamping in India.

Hope this will help you !!! But it always better to take opinion from attorney at safer side.

    Hi all,

Here non AD, Vermont center, Notice date April 30th. Haven’t heard anything back yet. could i check with USCIS about my case or the only alternative is to wait?

    1. 3rd Timer

Two weeks. But if it is taking more than 30 days then your employer/attorney are allowed to contact the USCIS and ask for a copy. If you try to inquire before 30 days then they will ask you to wait at least 30 days before contacting them.

Dear Friends whose receipt number is not recognized. Did you get any update either approval or RFE?
I can see my status as “case received” in myaccount website and error in e.gov website
    Receipt date : May 1
    WAC Center.

Also please feel free to post suggestions. It will help everyone a lot.

        Same issue but not cognizant.
It’s just weird that I don’t even get emails from inactivity in my account after signing in for that.

I think there is something going on with CTS vs USCIS
Last year they rejected CTS petitions like crazy..
This year there are no updates.. can’t even see the receipt number on egov..
No case inactivity notifications on myaccount.

Thanks! AD, STEM OPT was set to expire in 05/2019. I’m not sure about the exact documents USCIS was expecting – all I got from my HR and the immigration team was that they would handle it and would reach out to me if any additional information was required. And from what I heard from my manager, it was probably close to “Specialty Occupation” type of RFE.

  33. Surprised

Got my H1B approval last week, no RFEs and received the H1B approval notice today.
My L1B visa expires May 2019 & my H1B approval notice is showing valid from Oct 1st 2019 – May 2020 – i.e. they gave me a H1B visa for exactly 12 months only after my L1B expiry. Anyone I have asked has never seen this before. Wishing everyone else luck

    H1B Timeline:

    4/25/2018 – Case was received
5/21/2018 – Request For Additional Evidence Was Mailed
8/10/2018 – Response to USCIS’ Request For Evidence Was Received
    9/14/2018 – Case Was Approved

Still waiting on a confirmation from the immigration team.

I just noticed my reply got posted in the main thread. But here it is again, to keep it organized:
