What is the H1B Visa 2019 season start date ?
Update : USCIS will start accepting H1B Petitions starting from April 2nd, 2018 as per their official update on their website. In general, USCIS starts accepting applications for the next fiscal year exactly 6 months before the start of the next fiscal year. USCIS fiscal year for 2019 starts from 1st October 2018, which means they should accept applications for FY 2019 from April 1st, 2018. As April 1st is a Sunday, USCIS should accept applications for H1B 2019 season from April 2nd, 2019.

What is H1B visa 2019 Quota for Regular and Masters filings ?
As of the date of writing of article, the H1B quota is as below. This is also called the H1B Visa Cap. You can read more at What is H1B Cap ? Regular vs Masters quota ?

  • H1B Regular Quota : 65,000 visas
  • H1B Master’s Quota : 20,000 visas. ( only US Masters eligible)

Also, of the overall 85,000 visa cap, every year 6,800 visas are set aside for the citizens of Singapore and Chile as part of the Free Trade Agreement with them. There were few bills part of Comprehensive Immigration Reform that are not active in Senate that were proposed from Obama administration days to change the cap count to 110,000 and Masters to 25,000, including potential to make H1B cap extend up to 180,000. But nothing has moved and all are dormant. Nothing new has been proposed by the new Trump Administration regarding changing cap count. Will there be Lottery for H1B 2019 season ? Lottery Predictions ? Filing Numbers ?
Update : USCIS had lottery for FY 2019 quota and received 190,098 petitions.

When is H1B Visa 2019 Lottery Date ? 
Update : USCIS Conducted Lottery for FY 2019 on April 11, 2018.
There are two things, one is when the H1B petitions are accepted for the lottery and second is when the actual lottery is done. H1B visa petitions for next fiscal year would be accepted by USCIS from April 2nd, 2018 for 5 working days until April 6th, 2018 to be part of the lottery. Now, the actual lottery date depends on various factors depending the volume of petitions and USCIS load. It can be anywhere in second week of April. For FY 2018, the actual H1B Lottery was done on April 11th, 2017 . We can expect anywhere around the same date like April 11th or April 13th.

How to find H1B visa 2019 Sponsors ? 
It can be very hard to find a good employer and convince them to sponsor H1B to work in US with major unknown like H1B Visa lottery. Anyways, you would be in one of the three scenarios, if you are seeking a H1B Sponsor. 

  • F1 Student in US : You can find an internship or co-op at an employer who can sponsor H1B visa and ask them to sponsor your H1B. You can continue to work on OPT once you graduate as well. You find the list of H1B Sponsoring companies using the tool
  • International Professionals  : If you are outside of US, it can be tricky with all the latest rules by Trump administration. Your best bet is to find an multi-national company ( MNC) and work through them to sponsor H1B visa. You may have hurdles inside the company with all the internal process, many waiting, etc. But, it is up to you to negotiate and ask them to take a chance. Many try the IT body shop route, where they ask them to file H1B. Rules have changed in the last few years and it is very risky move and can jeopardize your US hopes. What is H1B 2019 Filing Fee ? 
H1B visa petition filing involves USCIS fee towards certain things and attorney fees, which varies by company size, and attorney involved for the case.  As of FY 2018 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee.  In year 2016, for FY 2018, the H1B base filing fees, increased from  $325 to $460.     I finally received the H1B Approval notification today!

    Center – California/WAC
    Notice date – April 25
    Approval date – August 6
    AD, Wage level 2, FT Employee, No RFE

    I surprisingly received both phone and email notifications today early in the morning that USCIS has taken action on my case. I’m yet to receive the approval notice from my lawyer though.

    case received on 12th May. USCIS status says “We received your case” . Employment starts in early October. Relocation partner reaches out to me regularly about the Visa status to start the relocation. Did this delay exist every year ? Since I need to give a visa interview, not even sure i can complete all the formalities by September ?

      Oh man… I am in the same boat (non-AD, WAC and same date).
      I am living in Europe now, waiting, and I’ve been extending my accommodation month by month, seeing things are not gonna get solved on time. Yesterday I just extended one more month until October, so I really lost hope that all paperwork will be solved so I can travel to the US October 1st…
      This is definitely too much… 🙁

      You can get Premium Processing on Sep10th. If you don’t get an RFE, you’ll get approved before Oct. That’s what I’m planning on doing. I’m wac ad, so maybe I’ll get some news before…

          They did it last year. I don’t see any reason why they wouldn’t do so, specially because it would be a big inconvenient for US companies

    Hey folks, I have a question regarding myaccount-uscis-dhs-gov site. I created my account there with my WAC number, but I haven’t verified identity, so I was wondering if that is necessary to really get the latest updates on the process? Or is it fine having just the application number?

    I also wonder why there’s 2 places where I can check the status (I have an account on egov-uscis-gov too), and if I can really rely on both websites, or only one of them or none of them xDDD.

    I am checking every single day even knowing is a bit useless to check because I’ve heard many people saying they got they approval/RFEs receipts and the websites are still not updated… 🙁

    I had approved visa with company A till june 30 2018.But i switched company A to B on january 2018 on uscis recipet and till my petition is not approved. Company A revoked my base petition on febrauary 2018 . My question is, will my 240 days period start from febrauary 2018 or June 2018?

    Looking at worktheme updates, It seems Vermont center is either just issuing RFEs or rarely approving the cases for which RFE response has received. No direct approval for past couple of weeks. Scary.
    Thing at Cali center are opposite. A lot of approvals and few RFEs.

        More than 19K by California so far.

        REFs 15K+ by vermont
        Around 8K by California.

        So generally speaking California is quite generous compared to vermont for approvals

    As of 8/1/18 we’ve received approvals in 10% of our selected cases. We’ve received RFEs in about 48% of our selected cases 🙁 . The remaining 41% have not had any action taken by USCIS yet. –

      I don’t buy her data as I doubt her petitions are most of those risky ones. Direct approval rate should be at least 50%, according to my friend circle. So, if you are a genuine applicants, do not worry about RFE.

    So… I was wondering, for people who has experience or data based on other years… how likely is that applications get approved before October 1st? (being positive and not considering a rejection).
    I wonder how many people gets their cases extended over time, not being able to really start working the 1st of October.

    Since we are already in August, and thinking that after an application is approved you still have to receive the papers, make an embassy appointment and do some bureaucracy there, I can see that getting everything sorted out for the 1st of October it is a bit unrealistic now… right?

      According to ImmigrationGirl, about 60% of selected petitions have received actions from USCIS. I am on cap-gap, so I am wondering if all of the 60% are cap-gap cases as well? I guess not. This is weird that if USCIS don’t process cap-gap cases first.

      WAC received my case on April 17, and I have not heard anything yet too.
      There is a comment below with a case received at WAC on April 12 and approved on July 27.
      So, we both should expect to hear back in the following 1 or 2 weeks if USCIS is tackling them in the sequence they receive and there are no delays…

        There are plenty of people with Submitted date after mine who already got approved.

        I have a friend – WAC AD – who got his RFE response approved last Monday

    Oh dear… the wait for Approval/RFE is killing me again (after the waiting for a receipt notice). I am non-AD, WAC center. USCIS websites says “We received your case” and I started to get the automatic notifications every 2 weeks that they are still reviewing the case.

    ImmigrationGirl blog has a very low % of approvals yet, so I guess things are going pretty slow, which somehow makes me think all this hell of a waiting is normal…

      I cannot able to see the status (https://egov.uscis.gov) online as it shows “Receipt number not recognized” then I was able to create an account (myaccount.uscis.dhs.gov) and can see “Case is received”
      Till today, case number has not been updated in (https://egov.uscis.gov) website. 🙁

      Is there somebody with the same situation and got approved?

    I received a notice for not being selected in the lottery this year. I have one more attempt at it next year. Notice date on the receipt is July 11th. But I received information from my HR only yesterday.
    Advanced Degree, Mechanical Engineering. I’ve been working on OPT for a year and a half as a Mechanical Engineer.

    I have an important question. How does USCIS decides to process a change of status application to F1 from L1? The processing time in California is 1.5 weeks to 4 months and in Vermont is 11 months minimum.

    I cant afford 11 months on my current status. How can I make sure that my application goes to California. My school is in Texas.

      If the employer not willing to share then it is not possible for you to get the hard copy. One option you could explore is trying with Freedom of Information act. However it would take at least a year to get response from them due to long backlogs.

    My employer had recently responded to the RFE and when i check the https://my.uscis.gov/ it shows as approved however when i check in https://egov.uscis.gov/ the status should Response to USCIS Request for evidence was received.

    Some positive/good news for people who are waiting in a long never ending queue for getting their Green cards- Bill
    HR392 has been added as an amendment to 2019
    DHS appropriation & info bill. Last time, HR 392 was added to DACA/Goodlatte bill but unfortunately it didn’t see the light. This time, this bill has got lot of support from lawmakers and DHS appropriation bill along with HR392 amendment should pass and become law within a very short period of time. So what this basically means for people waiting in long GC queue is (with I140 approved):
    1) there will be no country limit for issuing GC.
    2) 85% of 140K GC, per year, will used to clear the long queue/backlogs (India/China) immediately.
    3) USCIs will process the GC applications on first come first serve basis.
    4) PD will become current for most years for EB2/EB3.
    5) this bill is expected to pass by July end, in next few days, and within a month after President signs it, it will become law.

    Finger crossed. Hope we (GC backlog community) all will have something big to celebrate by next weekend.

      The Bill is real but It’s naive if you think it’s gonna pass. Considering the administration immigration policy as well as the reasons behind having country limits, I wouldn’t be positive about it.

      This DHS funding bill is passed by committee only and still it has to pass Full House floor in house of representatives, and then should pass again in capacity of Full Senate Members, IF, both houses passes the bill then only it goes to president to by signed in as a law.
      Some experts saying that already democrats are planning to rip of this country cap h.r 392 bill from funding bill in House of representatives, even if it passes there, then in Senate the No 1 – racist person is chairman of senate, Chuck grassley, who already stopped this bill in 2011, will stop it again. So in my view chances are 1 in a million, considering the racists in both houses. For outside world and to Indian govt, US says stories saying they are best friends and all, but from inside, they do not want to pass the bill. and some group of demoracts and senetors will desparately will try to stop it.

I’m going to start next school year on 8/27/18. Can I visit my country between now and 8/26 and come back?       That’s great news! All those waiting on the approval and tenterhooks on Day 1 CPT must have been stressful. What a relief for you that it was a minor rfe!

        Yes! I know! With a lot of people being negative about Day1CPT as if it is a crime it was hard for me to wait too. And even if it is not recommended (although USCIS does not seem to think so as my case got approved) those people act as if they have lived a PURE life. It is clearly stated in USCIS’s own website that Day1 CPT is allowed in certain executive format courses. Now obviously some people might get RFEs (depending on where are they doing this CPT) but I have a feeling they give an RFE for Day1 CPT only if they see anything ELSE that is weird or suspicious in the application (maybe working for clients or something like that). So they would bundle up the reasons for the RFE and send it. Again it is my guess.

        I am a Full Time Software Developer. And I am not sure what SOC means?

    I know that if our packet is not selected in the lottery then will be getting back amount…how about the scenario, if my petition got picked in lottery and rejected/denial during the process..in this case will i get back my amount….

      If denied after RFE, or withdrawn – no refund

      Why do you care anyway, it’s your company’s money. Unless of course, you’re one of the many losers who has to pay for his own petition.

      No you will not for cases rejected/ denied during the process. The refund is only for applications not selected in H1B lottery.

        Petitions have RFE/denials based on their own merit.

        Just because there is a bigger backlog in CA has nothing to do with a higher % of RFEs from CA in the future. There are no RFEs quotas. The number of selected petitions has to do with last year’s rejection rate

    I am on initial OPT now and my OPT will expire on 4th Sept. I am eligible to apply for OPT extension but I have not applied yet. My employer Filed H1b this year and last week I got receipt I-797 A which mentioned H1b approved with start date Oct 1st. I believe I will be covered on cap gap between 5th sept. to 30th sept. My question is do I have to apply for change of status? Is there any website where I can see my status of H1b from Oct 1st other than I 797A? Last question : Do i have to apply for opt extension?

      If your employer has applied for COS (change of status), your status will automatically change to H1 from F1 on Oct 1st.

    Hi All,

    I am currently working in the US on H1B Visa.
    I am looking for a job change and have 2 offers.
    Is it ok if both companies start my H1 transfer process and I join whichever get the approval first?
    I m doing this as I am not sure that both of them will get approval seeing a lot of denials nowadays.
    Please suggest is it ok to proceed like this.

      Rahman,
      It’s my understanding that H1B transfer takes about 3-5 months and premium processing is not available anymore. Are you sure those companies will wait that long for you on the first place!?

        Premium processing is not available for fresh applications.
        It’s still available for transfer and extension application.
        My case is transfer.

          Good to hear.

          I’m not a lawyer, but I don’t think transferring it to both companies is a good idea.
          I’d either pick one, or make one of the companies to wait one month for me before I accept their offer (during which I can wait for the h1b result of the other company). Otherwise, I’d speak to a lawyer.

    Any nonAD got updates from CA center today? I feel, CA is running behind and not sure when it will start sharing the status.

      I’m WAC AD, submitted date Apr25 and still waiting.

      CA is way behind. All non-AD’s that I’ve heard getting some action are VT

      Sorry but if you’re non-AD CA I’d guess you still have some waiting to do. Maybe consider PP in Sep
