When does H1B Visa 2018 Season Start ?
Update : USCIS accepted H1B Petitions for FY 2018 starting from April 3rd, 2017 until April 7th. They updated that H1B Cap was reached on April 7th, 2017.
Typically, USCIS accepts H1B petitions for next fiscal year starting from April 1st. So, for FY 2018, the start date for accepting applications would be April 1st, 2017. But, for FY 2018 season, April 1st falls on a Saturday, so USCIS will accept applications starting from Monday, April 3rd, 2017. If you were wondering why called 2018, when in 2017, it is the fiscal year dates that dictate that. USCIS fiscal year is from October 1st to March 30th. So, technically the fiscal year for 2018 starts from October 1st and they accept petitions for the same 6 months before the start date and it would be April 1st, 2017. What is H1B 2018 Quota ? Regular Cap vs Master’s Cap Quota ?

There have been many speculations on increasing the H1B Cap due to extremely high demand and bills proposed for the same in the past, nothing made it through. As of writing of this article, below is the H1B cap quota. We will keep this article updated as new changes come in. The total H1B Quota as of today is 85,000 and it is split like below.

When to plan for H1B 2018 Application – What should be your strategy ?
It is never too late to start planning…Depending on your situation, you may fall in one of the below categories and the suggestions are described below.
- F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
- Working Professional from outside USA : If you are a working professional outside US, planning to work in US, especially on H1B visa, your best bet is to find Multinational companies ( MNCs) that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it. There may be many people already in-line for these visas, you need to plan carefully so that you are given a slot in the company’s filing for your next season application.
- Other H4, L1 Visas : If you are on these visas living in USA, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How to find H1B Visa Sponsor for FY 2018 quota ?
This is probably the most asked question by everyone. It can be a tricky decision, you need be very careful to avoid fraud.
- If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.
- If you are professional planning to arrive in US from outside America, it can be really tricky. If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies. The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.

What is H1B Visa 2018 Fee ? How much does it cost for the company ?
The H1B fee varies by the size of the company..As of FY 2017 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee. On December 23, 2016 , USCIS increased the H1B fee component of base filing fees, which was $325. The below table is updated with the latest fee updates from USCIS. H1B 2018 Lottery Results – Checks Cashed, Receipts :
One of the most asked questions is when will I get to know the lottery result for my petition. Well, this depends on many factors and there is no set SLA or date. To put things in perspective, last year, USCIS did a news alert indicating that they have returned all the rejected H1B petitions on July 8th, 2017. So, you can expect the last date for receiving final lottery decision around mid July 2017. …As we had about same number of petitions filed for FY 2018, it may be slightly earlier or even later in July or even early August 2017… Few of the ways you would know, if you are selected in lottery is that, if the check that was filed with your H1B petition was cashed, or your employer gets the actual physical receipt notice in mail to them. If you filed under US masters quota, SEVIS update is another indication that you were selected in H1B lottery for FY 2018. Ideally, your receipt numbers should arrive within 1 to 2 months…but, you never know, until you get a reject notice to be sure !

New President Trump Administration Impact on H1B Visa 2018 Quota?
We do not know, if this news release is directed by Trump administration or not…but, on April 3rd, 2017 the start date of H1B season, there were set of new announcements made by USCIS to report and prevent abuse of H1B program. If the documents submitted for the application is all genuine and perfect, you will get approval. There is no specific deadlines for regular cases. All we can do is watch the progress patiently.

What is name was updated status
It means your name was updated. If you check your receipt notice, your name would have had some typo. Hence your Attorney/Employer would have raised an request to update it. This has resulted in the above status. Nothing to worry, it will not inhibit the normal processing in any way.
One of my frnd was informed by FDFU about his selection. So I checked with my manager, he hinted that the chances are very very slim now.

If you have the FedEx /USPS tracking number, you will know the exact date the package was delivered to USCIS.
The status update in Inszoom might be internal to your company. They would have sent the package through FedEx or usps with delivery date as April 3rd. So rather than getting confused, better to check with the tracking number.

April 3rd means the actual date when USCIS receives your petition.
It was the perfect date to express mail the petition on March 31st (Friday). Since USCIS was not open during weekend.
My current employer processing me L1 and also through consultancy I have selected for H1B. Most probably I will take L1 interview at the end of july. If I got selected for L1 can I attend H1b interview?

If you get H1, why would you want to go attend L1 interview? Once your H1 is approved, you can transfer it to your current employer, get the stamping and travel.

Yes if you can find an employer to initiate a transfer for you, you can transfer it to another company. Currently in normal processing it takes 5-6 months to get a transfer approved.
Can the current company stop the transfer/invalidate the h1 in any way if transferring before stamping?
None can stop the transfer process. But they can withdraw your current H1 application.
As far as I know, At a time you can have either L1 or H1. So choose which one works for you.
I am presently on STEM_OPT valid till Dec, 2018 and my H1 is picked for 2017 and approved on Jun 1st 2017 with future start date Oct1st, 2017, COS i797A – EAC17146XXXXXX

Your H1B would have been filed as COS, if so from oct 1,2017 your OPT might become invalid. So better to check with your Attorney. Had u filed it as consular processing, you could have started using H1B at later point of time.
May be filing an amendment with future start date would work? I am not again sure.. please check with your employer. But I am bit curious, why would you want to use OPT completely?

Yes, there are always chances, no guarantees. I believe you applied for COS. Then you have to wait for approval, whenever that happens.

I am reading all comments mentioned here regularly. I got rcpt # and waiting for approval. I agree now it may take 4 to 5 months for approval. Is there again any possibilities that approval may take 1 year or 1.5 year as premium processing is not there and also seen one comment that one of guy got approval now and lottery done last year. Isnt it???
Yes Rajen there were few cases ( last year) which got approval after 1-1.5 years of wait time and few still awaiting results. Probably they were all struck due to some extra background verification process. But if you worry so, once PP is resumed again, you can always upgrade it to premium processing. You can check with your employer regarding this.
Typo : stuck due to additional background checks. Most of such cases got RFE too. If we get RFE, it will always take more time to get result.

I also know of people who got approval earlier by June or July last year. There are few who has their case in received status for past 15 months. So it varies case to case. Right now all we can do is wait patiently till October and see if we get any updates. If not we can always request our employer to raise service request or upgrade it to premium processing.
I know loads of other factors depend on this one decision, but still there is nothing much we can do unless they bring more transparency in what’s being done.

Any updates from RFE team for CG guys. I tried contacting them, they are saying they haven’t received anything yet.
It seems, the petition takes about 3-4 weeks of time to reach the RFE Team. so, check after 4 weeks of the date mentioned.

Completely depends on whether you want it to do it or not. If you are genuinely qualified for the job I don’t think there is any issue in obtaining visa or extension.
Is Still Indian MNC guys like TCS CTS WIPRO INFY are waiting with hope.. Lottery is used as tool to retain people and give less hike.. For FY1617 cap, only 10000 allotted to top 7 that means even we take top five would have got 2000 each and in that if we neglect the counts for renewal and extension ( around 500 to 1000) they might be applying only 3000 petitions only and this yr FY1718 will less.. Don’t get confused with LCA count.

Is it just me ..or did anyone else notice the huge difference between EAC and WAC in terms of RFE vs Approved. Every single series under WAC has more RFE than Approved and exactly the opp for EAC . Barely any RFEs and so many approvals!!! I wonder why so..

It was same last year. Slowly EAC caught with WAC and started issuing more RFE too.

MakB, please hold on. All cases are filed in regular processing. So there is no defined deadlines. Be patient and keep tracking your case. Your turn would soon come. H1B Visa process is a game of patience!

Is it possible to transfer H1 to a new employer before stamping?
Yes It is possible..But first you should get approval from Emp A. Then transfer to Emp B, means the transfer also should get approved. Based on the approval notice from Emp B you can go for stamping. However, there is a confusion about how to transfer from A to B, like when to initiate a transfer, whether before OCT 1 st but after approval from A or After OCT first. After October 1st means if you need 3 pay slips if you are not working in Emp A etc. So you need clear guidelines from your Attorney. Conclusion, it is possible.

Opps..i am not that clear in my answer..but the answer to the original Q is “it is possible” with approved transfer petitions from Emp B who is not an original petitioner. And i believe most of them know that the original approval and subsequent transfer approval will come from USCIS.
Once your H1B is approved, you can initiate a transfer. If you have the approval copy it would be better. If not, receipt number would suffice.

I read somewhere that the employer who filed can cancel the H1B in case they find about that I am transferring. Is it true?
Your employer can withdraw the H1B application at any point of time.
This precisely is the reason there is a random lottery year after year. They don’t have work for people who already have h1b, but are applying more, just to get a pool ready. That wasn’t the way it was supposed to work. If companies only applied when there was a need, every deserving candidate with a real offer would get a visa. Not blaming you personally.

You can get another employer to file a petition claiming cap exempt status based on your approval notice. If you ask I forums, many will try to scare you saying the new rule is that you should start working for the original petitioner in h1b before transferring. However, it is not a “rule” just a guidance that us is primarily enforced in 2014 mainly. Now, the risk is if your current employer knows about your attempt to leave and revoked the visa before Oct 1st. Then your second petition will be in jeopardy. I would recommend finding another job and starting the process, and get it converted to premium whenever that option is available again. Then, once the new petition is approved,and preferably after Oct 1st resign and trace for the new job.

If I read/interpret correctly then US PHD holders will not be cap-subjected or counted towards 85000 limits. However, the bill to become law is very limited, i.e, it is probable if not impossible. I would say may be after 2020 if all the branches of govt controlled by same party. Currently, Senate doesn’t have (technically the threshold of 60 votes). So, no chance at least near future.
There are god knows how many bills regarding h1bs. This is just one of them. Don’t have any hopes for now.
Anyone here who got the petition returned? I hope that USCIS returns all non-selected petitions asap so that we can continue with plan B.
I feel they might return in batches. Our company might inform it much later as they will be waiting to get all the petitions.

Sri, if you feel your employer has withheld the result of all employees, you still hold a chance else the chances are bit slim right now.

The select ratio for the over all petitions from banglr is 31% which is a good number and almost on par with outside and they r not expecting any more additions and the list looks to be final. Its 1:3 for you.

May be your job designation is computer programmer. They might have issued an rfe to check is this is a speciality occupation.

This means your case has been transferred and the transferred office has jurisdication. Your employer will also receive a transfer receipt. You can refer it for further details.
Typo: the office has jurisdiction. Mostly your case would have transferred to Texas or Nebraska center

Did anyone get a rfe for 2 applications from different employers that were picked in the lottery?
If you got one RFE from one of the employers, it would be same as other RFE’s, if proper evidence is provided, it wouldn’t be any problem.
If you got two RFE’s, one from each of the employers, there is something about both of your petitions that USCIS didn’t like. This need to be handled more carefully, or it will end up being denied.
Having said that, it all depends on the reason of the RFE.

So far I haven’t received rfe for either one but was just wondering if an rfe can be issued just because they are 2 different applications for the same person (different employers of course). Also, is it advisable to ask one of them to withdraw the application at this point or just wait till they are approved etc.
I feel your RFE won’t be related to two applications at all. It may be for different reason.
You can request your employer to withdraw at any point of time. Right now, I feel it’s better to wait n get one approval. Then withdraw other. Just to play safe.

After lottery results, ( hope you have your RN, n u have verified all info in receipt notice) we need to patiently wait and keep tracking our case for any update.
There are couple of approvals or RFE provided for some other new H1B applications. The ball has started rolling, So we got to wait for our turn.

After the lottery results no update in GIS or any emails from ISG. I got the status from the DU SPOC after that no update. What would be the next step?
ISG might have all the selected candidates receipt numbers. But you will get the details during your stamping time. They will regularly track all the cases and update you on the status of case is approved or RFE. if it is RFE, they will request the additional documents or else they will proceed on the next step of stamping initiation from October.
The above mentioned details are collected from last year batch members.

Yes they will notify the rejection and when is the big question mark. One of my friend case is updated after 18 months. They will give very least preference for rejected case.
