When does H1B Visa 2018 Season Start ?
Update : USCIS accepted H1B Petitions for FY 2018 starting from April 3rd, 2017 until April 7th. They updated that H1B Cap was reached on April 7th, 2017.
Typically, USCIS accepts H1B petitions for next fiscal year starting from April 1st. So, for FY 2018, the start date for accepting applications would be April 1st, 2017. But, for FY 2018 season, April 1st falls on a Saturday, so USCIS will accept applications starting from Monday, April 3rd, 2017. If you were wondering why called 2018, when in 2017, it is the fiscal year dates that dictate that. USCIS fiscal year is from October 1st to March 30th. So, technically the fiscal year for 2018 starts from October 1st and they accept petitions for the same 6 months before the start date and it would be April 1st, 2017. What is H1B 2018 Quota ? Regular Cap vs Master’s Cap Quota ?

To get some background, read H1B Quota – Regular vs Masters . There have been many speculations on increasing the H1B Cap due to extremely high demand and bills proposed for the same in the past, nothing made it through. As of writing of this article, below is the H1B cap quota. We will keep this article updated as new changes come in. The total H1B Quota as of today is 85,000 and it is split like below.

When to plan for H1B 2018 Application – What should be your strategy ?
It is never too late to start planning…Depending on your situation, you may fall in one of the below categories and the suggestions are described below.
- F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
- Working Professional from outside USA : If you are a working professional outside US, planning to work in US, especially on H1B visa, your best bet is to find Multinational companies ( MNCs) that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it. There may be many people already in-line for these visas, you need to plan carefully so that you are given a slot in the company’s filing for your next season application.
- Other H4, L1 Visas : If you are on these visas living in USA, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How to find H1B Visa Sponsor for FY 2018 quota ?
This is probably the most asked question by everyone. It can be a tricky decision, you need be very careful to avoid fraud.
- If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.
- If you are professional planning to arrive in US from outside America, it can be really tricky. If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies. The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.

What is H1B Visa 2018 Fee ? How much does it cost for the company ?
The H1B fee varies by the size of the company..As of FY 2017 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee. On December 23, 2016 , USCIS increased the H1B fee component of base filing fees, which was $325. The below table is updated with the latest fee updates from USCIS. H1B 2018 Lottery Results – Checks Cashed, Receipts :
One of the most asked questions is when will I get to know the lottery result for my petition. Well, this depends on many factors and there is no set SLA or date. To put things in perspective, last year, USCIS did a news alert indicating that they have returned all the rejected H1B petitions on July 8th, 2017. So, you can expect the last date for receiving final lottery decision around mid July 2017. …As we had about same number of petitions filed for FY 2018, it may be slightly earlier or even later in July or even early August 2017… Few of the ways you would know, if you are selected in lottery is that, if the check that was filed with your H1B petition was cashed, or your employer gets the actual physical receipt notice in mail to them. If you filed under US masters quota, SEVIS update is another indication that you were selected in H1B lottery for FY 2018. Ideally, your receipt numbers should arrive within 1 to 2 months…but, you never know, until you get a reject notice to be sure !

New President Trump Administration Impact on H1B Visa 2018 Quota?
We do not know, if this news release is directed by Trump administration or not…but, on April 3rd, 2017 the start date of H1B season, there were set of new announcements made by USCIS to report and prevent abuse of H1B program. Besides this, as of the today ( article updated date), nothing has been officially ordered or specifically implemented by New President Trump Administration. In my project on got selected mail from FDFU – Chennai .The rest got awaiting lottery result mail from fdfu.
Only Chenani FDFU giving out the results ? Other FDFU says no info with them.

Do not keep any hope if that is the case. Even, I got the same reply from ISU RMG. They will have three in Excel Sheet. Not Selected, Selected and Awaiting Lottery Results. By now, all the lottery results have been shared to ISU RMG’s and Very Slim Chances if anything missed. If selected, the reply should be Selected rather than Awaiting Lottery Results. I don’t have any hopes now.

Does anyone have a rough idea how many petitions are approved till now for 2018.i mean some websites were keeping track right…many people are saying these time things r fast but I think this time is simply like all other times…no change of status for long..God knows what are they doing closing the PP

I would say roughly 1-2% of petitions would have got approval. Since the PP was suspended, we all expected it to be much more later. But to see a few approvals, it is a boost for the rest of us who are waiting that some day ours will be picked and we would know result sooner.
That’s incorrect.. Check out worktheme.com.. almost 15 percent applications approved. and this year trend is approvals are coming sooner for regular cases as we don’t have premium processing.
@GP, wortheme.com site tracks form I-129. This primarily may not be new H1B applications. It can be H2, TN and other visa too. It can even have H1B amendment and transfers applications. Though you can see overall trend, statistics there may not be accurate.
Again incorrect. they don’t count other applications in the total count. it is very easy to keep them out. Go check H1bstat.ru as well. they also remove all other applications.

There is no way to filter out a H1B petition just by the status that you see on USCIS status check page…The data includes all other petition types…

I am using uscis app and i got a notification saying “CASE SIMILAR TO “WAC17********” GOT UPDATES” and the update says RFE was mailed. But my status shows Case was Received.
So my question is Is this my case status or some other case status similar to me?

In your notification the number you mentioned WAC17***** is it your case number or a different one? If it’s a different one, then the RFE is for the case number mentioned in notification and not yours.

Its my case number but says similar cases got updated. Found in play store that it is a feature of that app to show similar case status updates. I got some five case status updates till now.

I myself use that app and I find it pretty simple. If you are confused by the app updates and not sure about the notifications, you should rather not use the APP at all. Uninstall it and wait for your case updated from USCIS site or from your employer.
My status is Case received since a month.
When can I get an update, whether it is Approved or will get an RFE?
No ETA on that, its all random, when your case is picked up by an officer for adjudication. You will get and updated in a few days, weeks of even few months. There is no guarantee. All you can do is wait.
Has anybody heard about H4 to H1B COS result? My husband is on H1B.So, I applied for COS.I called the employer. They are still saying they do not have any update regarding my petition.
There are no separate results for COS. Both COS and consular petitions are considered new petitions and undergo same lottery process.
I would say there is slim to none chance, that your petition was selected in the lottery. You need to wait until your employer/attorney receives the returned petition.

I was wondering if anybody could help me with a clarification: I was notified yesterday that a request for additional evidence was mailed on May 30 and USCIS would take no further action until I respond. Today I get another notification informing me that another request for evidence was mailed to me on May 31.
I was under the impression that USCIS would stop working on my case when they are awaiting an RFE response. Therefore I was wondering if anybody knew if it is possible to receive two RFEs in consecutive days and if so under what circumstances.

Yes, it happens when they want to double screw petitions, nowadays the screwing is at its peak…. I see the impact would be results/final approvals would be delayed up to a level where your employer stops showing interest in you & hires a local.

Thanks Ram. Actually this is my first attempt and I got RFE. Also I noticed many Capgemini folks got RFE. Based on your experience what are the chances of RFE getting approved. I have around 11 years in IT (Consulting) and 85K salary (LCA). All 11 years with same organization (Leading US based MNC).
If you submit the right response for the RFE, there is nothing worry. Your petition will get approved easily. So make sure you provide the right response.
Talk to your Employer/Attorney. Get to know the RFE details. If possible help them prepare response. There is nothing to worry about. Good luck to you 🙂

I remember USCIS announced that they will publish a report of all the applications submitted.
But they started following the routine approach of lottery, sending receipt notice and they have now started (supposedly) sending rejection notice.
And their initial announcement of publishing report for each and every application is lost.

My employer informed me that they have recieved RFE for my case, but when am checking in uscis site its still showing case recieved on 11th April. Ram can you pls suggest.
Few are facing discrepancies in status update in site. Ask your employer to share RFE notice copy so that you could be sure.
RFE has become common these days. So get to know what they have asked for and prepare response well. I am sure you will clear it. All the best !

I am able to locate my previous post, which was posted sometime back. Hence posting again.
Anybody in this group still waiting for receipt notice and check has been cashed? My employer told my check was cashed 4 weeks back and no receipt notice yet. When i asked them to check on the backside of check for any receipt no, they said its not clear! and they are telling USCIS has transferred many cases from 1 service center to other and hence delay in receiving notice. They mentioned they will wait till this weekend and then contact USCIS. I am not sure whether to believe them. After multiple follow ups/phone calls i got to hear this. Anybody in the same boat?

Anybody in the the group, with check en-cashed and no receipt notice received yet? I am non_AD. Employer told check attached to my case was en-cashed 4 weeks back. Number written on the back of the check is not clear, but no receipt notice received and they told USCIS has transferred some cases from one service center to other service centers and that might be the reason no RN received and HR told they will wait till this weekend and then contact USCIS. I am not sure whether to believe them as after multiple follow ups, i got to hear this. PS – I never paid money for H1b and working with same employer for 2 years.

As far as I know, transferring of a case has no connection to receipt notice. Not all cases are transferred. So may be your receipt was not delivered properly. It’s good to contact USCIS. Good luck !

I am on H1b, My spouse applied for COS(to H1B, no update yet). I got an email from fragomen to share dependent approval notice, while my petition/amendment were approved long back. What could be the reason?
I feel better to check with them rather than speculating. It could be that her H1B picked and has some RFE related to her stay here or could be for extension ( if you have applied for it)

Hi , I got my H1 visa last year since i had personal issue i couldn’t travel. Now my visa is expiring in 9 months please let me know what is the last date to enter into US , so that my extension will not get affected.
Until the date of expiry, you can travel to US. You can also apply extension from your home country.

Yeah you can, provided it has not been withdrawn.If you have doubts, You can check with your Attorney.
PP is suspended, so it might take time I agree. But I don’t see any pitfalls for extension if you have not travelled.
If the current visa expires before the decision arrives, you can’t travel. You have to wait till the extension approves.

Looks like USCIS has started returning unselected petitions back, did anyone receive rejection notice from them.
4 Years 4 failed attempts and yet luck didn’t favored me.
Technically unless you get back your petition back you have a narrow hope left. But still it’s better to work on your alternative plan.

@Ram Cheque hasn’t cached yet and USCIS has already confirmed about data entry is completed for 2017-18. So what better to expect at this stage, last year by June rejection notices were sent by USCIS to petitioner, so expecting same to happen this year too.

@Nandan here some people have talked about rejection notices have been sent, so checking if someone have received same.
Mostly all have received receipt number except for few companies who are withholding the result for some reason. After this getting a receipt number is slim.
Work on Alternative plans like different countries or any other visa for US.

They did not get any email at all about submitting the application. They directly received the receipt numbers. Very Strange!!!! And have seen for some people the case in INSZoom is closed by May 1st and they did not receive any receipt. For me its still Open and Fragomen confirmed that they did not receive any update on my case so far!!!!!
Not sure how they are updating and informing…for everyone flow is different.

Yeah Sure!!!! Me too….. Based on past 2 years of experience on this process, there is no link between INSZoom case status, but am also still hoping the same. Heard from one of the case Manager saying that, last year they have seen receipts coming in till June. So lets see.
One of other reason being case open in INSZoom will be, that the case manager may not be in IBM. Check whether your case manager still within IBM. For me , looks like my case manager moved out of IBM

Today i checked with fdfu bangalore. They told only 1 set of lottery results. So no phases. Dont believe RMG. If you not hearing anything means you are not selected.

Please don’t assume things. Which quarter results you are referring to? This is my third time and I know the timelines very well.The complete results are already with your GL’s.

When did your status got updated to RFE? is it on AssignPro or USCIS site?
I got RFE on 22May, but AssignPro still in Recieved status. Case worker told me it will take atleast 2-3 weeks for them to receive the RFE reason details, and they will require documents from me accordingly. So the alert may be for the same. Keep me updated about your reason for RFE and what document CG immigration team is asking, thanks !
RFE in USCIS Site not in AssignPro , yes will keep you posted on the reason , I believe most of the CG folks are running thru RFE , atleast lets share the information about it which could help many !!

I got 221g from Chennai consulate and the required documents has been submitted on march 18. Now it’s almost 2months home and I couldn’t get any updates from the consulate. Meanwhile my employer asked me to sign G28 form to proceed via their attorney.
Is there any hope to get positive reply from consulate in this case any time soon.

If I resign from my current organization and join another organization will my H1B case still be valid? Or I have to wait till approval & stamping before leaving my current organization. Any information will be very helpful.
I’m assuming that u r in Your home country, either ways your case will be considered withdrawn if you switch your employer in the middle of your petition evaluation. My advise is stick to your current employer till it gets approved and consequently stamped, and then you can try to convince your new employer to transfer the H1B petition and convince your clients to accept that transfer. Cause without client affirmation, u’ll be trying to pull strings out of a nickel. Cheers
Yes your H1B will be valid unless your employer withdraws the petition. If your employer withdraws the petition, then it can never be used again.

I understand ur trepidation.. That depends on the new administration here. From what I understand there is a lot of pressure from Indian political leaders and IT sector in the White House not to make changes. But time ll tell if the president wilts under pressure, or considers change. One thing is for sure, even if there is change, it will be America first under the current administration. So don’t expect it to magically benefit applicants. Hope I answered to ur conundrum. Cheers

Also, as per last year timelines the unselected petitions would have started coming back to Attorney.

My company has filed H1B for me with project in LCA as internal, now I need to look for a project and file for amendment, but I have no idea how to go ahead with the same and no help from my company.
Not sure if I should just go and give the interview and file for the amendment after I get it stamped or if I should wait till I find a project before I go for stamping.
Any help would be appreciated.
This is just my suggestion: You can go ahead get stamping and then search for project, file for an amendment and travel with receipt number. if other way, then to get the result amendment will take about 6 months, then stamping. It might take time.
Either way it can be done. check which option works for you as some project may have immediate requirement. Currently note that amendment approval takes 6 months in regular processing.

I am currently in India. My H1B petition got approved and Stamped for the client A. Then applied for H1B Extension/Renewal with change in client (Client B) and it got approved as well. But now i might need to work for the Client A. So do i need to apply for Amendment again OR Can i work for Client A by withdrawing the petition of H1B Extension/Renewal?

You cannot with withdraw an already approved petition. If you do want to work for client A , then file for another amendment. Cheers

I got receipt # on 9 May from employer, and now status showing Case was received saying we received your form I-129 petition. Just plz give me confirmation that approx how many days it will take to get approve this petition. Center is EAC.
Normal Processing takes around 4-5 months. Premium can be done within 15 days, but for this year PP is suspended for approx 6 months. This year petition approval scrutiny will be tighter. All the best.

I contacted the FDFU of my branch. I was told that they ll get updates only by mid of june. So either your GL ll have the results or we have to wait for VTS update. My PL also told me that they have got RFE notifications only and they are responding to that

Correct.. ISU RMG have results in Excel sheet.. For my email, they responded me with the row having my record.. status in their sheet is ” Awaiting lottery results”. It should be game over or there may be delay internally. Also they said me contact GL going forward for results..

USCIS has started returning the unselected petitions. I think, By June second or third week all unselected petitions would be returned.

There is a possibility that you might have been picked in the lottery and your employer is not sharing your Receipt no, because mostly all the packages have already been returned.
Hi my employer told me that he has received my approval letter a week back. Also he told me that the letter will be given to me when I go for stamping. But the problem is uscis is still showing my case as received.pls let me know how much time it takes to update… anyone facing same issue ????
Couple of people faced this issue. It should be updated in few days.
Well, online system can sometimes not be updated. If your employer has really got the update, you should ask them to share the letter so that you are clear on the reality.

They shared the approval notice. It is approved. They told in Jul I can go to Chennai for stamping . And I can travel by Oct 1 st week. Can i believe my employer ? Can this be data entry issue in USCIS. Just one number prior to mine is showing as approved but not mine.

Approval notice carries your name in it. So if it has your name and says Approved. You have made it!!! Congrats:)
It is very common data issue, as long as you have the copy of the approval notice, then you should be fine…We have seen some cases where online status is not updated well. You can ask your employer to check with USCIS customer service as well.

Hi, I am facing the same issue and I hope it is not a big issue. It might be a fact that system error in updating online status. My employer shared me the copy of approval notice.
Occassionally, the system is not updated but it might be they are still not sure what to do next
