H1B 2018, 2019 Season is over, H1B 2020 Season Starts on April 1st, 2019.  Check out H1B Visa 2020 – Start Date, Fee, Lottery – FAQs 

If this is your first year of H1B visa filing, you must read What is H1B Visa, Requirements, Process . Not to scare you, Last year, there was lottery for H1B season and for FY 2017 USCIS received 236,000 applications .

When does H1B Visa 2018 Season Start ?
Update : USCIS accepted H1B Petitions for FY 2018 starting from April 3rd, 2017 until April 7th. They updated that H1B Cap was reached on April 7th, 2017. 
Typically, USCIS accepts H1B petitions for next fiscal year starting from April 1st. So, for FY 2018, the start date for accepting applications would be April 1st, 2017.  But, for FY 2018 season, April 1st falls on a Saturday, so USCIS will accept applications starting from Monday, April 3rd, 2017.   If you were wondering why called 2018, when in 2017, it is the fiscal year dates that dictate that. USCIS fiscal year is from October 1st to March 30th. So, technically the fiscal year for 2018 starts from October 1st and they accept petitions for the same 6 months before the start date and it would be April 1st, 2017.  You may read USCIS Press release for H1B 2017 Start Date 

What is H1B 2018 Quota ? Regular Cap vs Master’s Cap Quota ? 
Update : USCIS confirmed the below quota cap numbers in latest press release for FY 2018. 
To get some background, read H1B Quota – Regular vs Masters .  There have been many speculations on increasing the H1B Cap due to extremely high demand and bills proposed for the same in the past, nothing made it through. As of writing of this article, below is the H1B cap quota. We will keep this article updated as new changes come in.  The total H1B Quota as of today is 85,000 and it is split like below.

Regular H1B Quota  65,000
Master’s H1B Quota ( Only US Masters Degree Eligible) 20,000

Out of the above 85,000 quota, 6,800 are set aside for Singapore and Chile citizens as part of the free trade agreement between them. Also, check out the article with history of maximum H1B Cap from 1990 to 2017 

H1B 2018 Lottery Predictions ? 
It used to be a speculation whether we would have lottery in previous years, but in the past 4 years, lottery has become common. It is very likely that we would have lottery aka random selection for H1B 2018 season.  We have been writing predictions over the years and all of them have been accurate so far. When to plan for H1B 2018 Application – What should be your strategy ?
It is never too late to start planning…Depending on your situation, you may fall in one of the below categories and the suggestions are described below.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Working Professional from outside USA : If you are a working professional outside US, planning to work in US, especially  on H1B visa, your best bet is to find Multinational companies ( MNCs) that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it. There may be many people already in-line for these visas, you need to plan carefully so that you are given a slot in the company’s filing for your next season application.
  • Other H4, L1 Visas :  If you are on these visas living in USA, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How to find H1B Visa Sponsor for FY 2018 quota ?
This is probably the most asked question by everyone. It can be a tricky decision, you need be very careful to avoid fraud.

  • If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.
  • If you are professional planning to arrive in US from outside America,  it can be really tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.

What is H1B Visa 2018 Fee ? How much does it cost for the company ? 

The H1B fee varies by the size of the company..As of FY 2017 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee. On December 23, 2016 , USCIS increased the H1B fee component of base filing fees, which was $325. The below table is updated with the latest fee updates from USCIS.  There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary from FY 2017 quota.  If any changes, we will update this accordingly.

H1B 2018 Lottery Results – Checks Cashed, Receipts : 
One of the most asked questions is when will I get to know the lottery result for my petition. Well, this depends on many factors and there is no set SLA or date.  To put things in perspective,  last year, USCIS did a news alert indicating that they have returned all the rejected H1B petitions on July 8th, 2017. So, you can expect the last date for receiving final lottery decision around mid July 2017. …As we had about same number of petitions filed for FY 2018, it may be slightly earlier or even later in July or even early August 2017…  Few of the ways you would know, if you are selected in lottery is that, if the check that was filed with your H1B petition was cashed, or your employer gets the actual physical receipt notice in mail to them. If you filed under US masters quota, SEVIS update is another indication that you were selected in H1B lottery for FY 2018.  Ideally, your receipt numbers should arrive within 1 to 2 months…but, you never know, until you get a reject notice to be sure !

New President Trump Administration Impact on H1B Visa 2018 Quota?

We do not know, if this news release is directed by Trump administration or not…but, on April 3rd, 2017 the start date of H1B season, there were set of new announcements made by USCIS to report and prevent abuse of H1B program. Check out USCIS New measures to report, prevent H1B Fraud  . Besides this, as of the today ( article updated date), nothing has been officially ordered or specifically implemented by New President Trump Administration. There are many speculations on how H1B program will become tougher with higher wages, quota limits, etc… but, nothing has been officially signed. We will update the article as new updates come in.

Various H1B Bills  in US House and Senate  – Will they be passed for FY 2018 ?
There are few bills that are introduced in 2017 and at various stages in both house and senate. There are many confusions regarding the same bills like the minimum wage will go up to $130,000 USD, etc.  Fact is that nothing has passed and there are very slim chances for them to get passed before start of FY 2018 season.   2. Can somebody report this Indian based consultancy to USCIS fraud detection website -WalkWater Technologies Inc, San Jose, CA.
    This consultancy hires people with non-IT background and zero industry experience, it does faking resumes and fake interviews and places its candidates in big clients in Bay Area, CA and other locations.
    They have good reviews on glassdoor, google, myvisajobs, facebook etc because they themselves write reviews! And candidates are asked to pay the amount for H1b. This is genuine Information. Please report.

          The address of the employer/company or location of the H-1B worker(s), including the city and state
          A description of the alleged violation, abuse, or suspected fraud

          Any other information that may be useful to investigate the alleged fraud or abuse
          Individuals are also encouraged to report allegations of employer fraud and abuse by submitting a Form WH-4 to the Department of Labor’s (DOL) Wage and Hour Division. The public may also contact U.S. Immigration and Customs Enforcement (ICE) by completing the HSI Tip Form.

    I also a victim of H1B 2018 AD VT lottery. So far i haven’t heard from my employer or attorney. Per DSO there is no update. I think there is no point of me waiting any long since my OPT will be ending in Dec.
    My Q is can ask my employer to file for Greencard while I’m on OPT? Is that possible? Can we directly file for green card without H1 in place? What status will i be after Dec if my greencard is in the process under EB2 until I get my i140 approved???

    Appreciate your help.

    • Opt is a non immigrant visa. So you cannot apply for green card. You need to be either on h1/l1 as they are non immigrant visas with dual intent.

      • No your company can apply. It’s just more risky. I know of people who have gotten it this way.
        But if you’re Indian I don’t think it’s a viable option..

          My friend’s company applied for her greencard last year after she did not get through the H1B lottery. She is not from India or China though. Once again, this is not legal advice. :/

    • You can get your PERM (1st step into green card processing) done on OPT, but it’s not possible to get I-140 without H1.

        • Assuming If you are not from India and China, and if you have 2 to 3 years of OPT then getting EB2 Green card is possible provided if you are not getting any RFE’s. However, if you are from India or China then it is not possible. If you are applying in EB1, then, there is a chance to get it within a year, but again without any RFE’s. This is a personal opinion based on previous cases from friends and up course it is not a legal advise.

    • I feel its better to talk to an Attorney and proceed in your case.
      As far as I know OPT which is an extension of F1 is not a dual intent visa.

    • Let me tell you a general case, To file in EB2 , it takes 4-6months for PERM approval (Provided an advertisement for your position is already given) and then i140 can be done in premium processing. If you are from India or China to get I-485 approved its going to take 8-10years of time.

    I am still waiting for the RN as I got confirmation from my employer/consultancy that my check got en-cashed on 3rd May, but they continuously saying need to wait, as process is slow and take time to get RN. But again my question how long i need to wait while everyone is getting the RN ? Does it really take too much time as consultancy is saying? can they have false commitment from candidate?

      Just an idea for you, Lottery is picked up in Apr 11, notice send on the same day but the employer received the actual paper RN on May 19, 2017.

    • It can be slower. you can wait for an week or so, then you ask your attorney to check with USCIS if they are sure that your check is en cashed.

    • Receipt number is printed at back of the check you can ask your employer / consultant.
      Btw – Did you pay for your petition? If so (since you mention consultancy) there is a possibility of fraud.
      Will be glad if proven otherwise!

      • i am in same boat as you. Employer told me, 3 weeks back check was cashed for my case and still receipt notice is not received. I am not sure whats happening?
        I never paid money for H1b. Its a small consulting firm.

      I asked them to check with attorney on backside of the check for any receipt number. HR told, attorney has not got back yet.
      I am just wondering was there a mistake from attorney/HR in communication about check cashing for my case or am i really picked in lottery and somehow there is a delay?
      PS – i am just asking opinion from other people in this forum. Please don’t post judgmental comments!

  7. The Request for Evidence (RFE) for H1 cap 2018 is already sent to my Employer on 19th of May. When inquired regarding the same, they aint providing proper information. Is there anyone out there facing the similar issue ?? Throw some light please …

    • Every1 in CG got rfe as per my understanding. Let’s see when they receive the mail from uscis, then they can update us

    • Hi, It takes nearly 2 weeks for the RFE notice to reach the Attorney/Employer. Since it has moved to RFE only by 19th May, I think we can wait for one more week. I am sure next week or week after you can get the RFE details from the immigration team.

    • Receiving a receipt notice does only mean that your petition was selected in the lottery. Congratulations. Any approval/RFE/denial is still outstanding as they are yet to review your petition in detail.

    • It means you have been picked in the lottery. Now you got to wait until USCIS reviews your application and provides a result. You can get the Receipt number from your employer and track the case progress in USCIS case status site.

    When I check my case status it shows ” we mailed your Document for I-129, petition for a non immigrant worker , receipt number WAC17xxxxxxxx.

  12. I have a question guys. After lottery selection, there was a spelling mistake in my receipt notice. Attorney send correction request to uscis. On May 11th the status changed to “Name was updated on may 11”. Now I see the status changed to “Name was updated on May 18th”.

    Why this two times name update? what does it mean?

  13. My petition pass through lottery. When I filed I applied with my old passport and now I renewed in between in order to add my spouse name in it. Will it be a problem during visa interview?

    • I don’t think it will be a problem as long as you carry both your old and new passport. Don’t forget to mention the old and the new one in DS160 while going for stamping.
      Please do check with your Attorney regarding this.

    Like posted earlier – “My last name was misspelled in the receipt notice and it was applied for correction my my Attorney on first week of May” as per your advice. Since then the updates were like this|

    4th May – Requested to Correct Error
    10th May – Assigned to an officer for response
    15th May – we sent a response to your request to correct an error on your document or notice
    15th May – You request for correction of error completed

    But my Update is still as “Case was received” – it was not moved to “Name was updated” as it should

    Does that they have not corrected the error ? or Was the error not their fault ?

    • Hi Nish, As you have mentioned there was some response sent by the USCIS to your Attorney on 15th may, you can get that response notice and check what it is really for. if that is for your name correction, your problem is solved. If not, you can talk to your Attorney regarding it. But usually Requested to Correct Error status is for correcting typographical errors only. So I feel your name has been corrected. Anyways we can re confirm it with the response sent by USCIS.

  16. I’m yet to receive rejection notice from attorney or HR. I got a new job offer today. Can I accept the offer and move on? Please advise as I’m very confused that what happens if I get my receipt number (eventhough there is less than 1% chance for that)

    • Hi Edgar,

      If you really like to take the new job, then take it!

      As you said yourself, chances are low you’ll be getting a receipt by now. However, if it should happen, then you can quit your new job again. Simple as that!

    Has anyone received mail from approval notice team saying case has been approved. I have received an email from them but in USCIS my case is still shown as received . Now dont know if it really approved or not. Anyone facing this issue?

    • There are people who are still waiting for their result in Infy (Avanavan kavala avanuku) So these things will take time.

      The mail which you got must the one which says I 94 has been received. You would have replied to it by now. They would send those hard copies to Banglore office. Then you can see a status change in GICS or when your DC GI team receives the copy from Banglore.

      Anyways, you wont be stamping before July. So stay calm and relax.

      • I doubt if any Smart Infoscions are waiting!! Why are you still waiting??? What for?? Lets be realistic. The results were out in 1st week of May and GICS is already updated for those who made it through the lottery. For others the status has not changed given that rejection notices take time.

  22. Does any guys from CTS received any receipt notices recently ? I hope one guy received on 18th. Does it worth waiting… GM doesn’t give any proper updates and ask to wait till mid of June.     • This is something I don’t like about TCS . When you have the results what are you waiting for ? Just release it so that we can decide what to do next in our careers which we are entitled to.Holding results like this doesn’t make any sense to me.

      They fear people quitting after results. But that’s going to happen one way or the other. Now or 2 months later.

    I have applied h1b petition during 2016. I have client letter for only 7 months and client not willling to give more than that as it’s already May this month. As my employer asked the USCIS already for 3 years in the petition, will now my petition be approved for 7 months ? And I hope it would take more than 2 months for approval and I hardly I would left with 3 to 4 months for extension. As my petition already denied is this now the right move to go with MTR ?

      BTW , I already had 2RFEs and got denied for the third time. I hope may be my employer didn’t give any satisfactory answers. Can I trust him and go ahead with the MTR now ? And that too with 7 month client letter . And also he has to prove that mine is a speciality occupation also .

    • it is approved?, if not, stay calm until it gets approved. you cannot even say it will get approved before Oct1.. dont lose your hair by thinking lot of scenarios…think about your wife H4 now, mostly employer will take care both together, you can ask your attorney. if they are not willing to do, you can check with someone outside.

    • If you travel before your COS is approved, then your i94 changes. So your COS may not be approved but H1B visa will be approved as consular processing. Then you will have to apply COS from scratch again to use your H1. It’s also good to apply H4 for dependents ASAP. You can check with your Attorney for this procedure.

      • Else you have to go out of the country n get stamping for H1B and then start using it. This is an alternate approach of not applying COS all over again.

    • You are good to travel once h1 approved along with cos.you can come back on your l2 or l1 without issue and on 1st oct u will auto convert to h1.

      This is personal experience from my spouse who got h1 approved with cos in July and traveled in august.

    • if i am you, i will wait till get it approved and work for some months with H1 status and then come back because so many guys getting slips during amendment.
      if you planning to travel for same client/employer and location there wont be issue. even guys who located in USA getting RFE during amendment.

      • You would be receiving the receipt notice with your receipt number in it. Then, you can start tracking the case using the receipt number in the Case status Site. The USCIS would process the case and update the status in the site.

        • Thank you. In my case- only lottery selection has been received so far as status update. No information on RN. Shall i stay hopeful ?

          • Along with that RN number is usually provided. Kindly check with your employer/Attorney and get the Receipt number. Once you know got to know that you are through lottery, congrats ? You have cleared the first step!

    My employer told me that my check was encashed on 3rd may. But still i haven’t received RN.

    Please let me know how long i need to wait for RN
