H1B 2018, 2019 Season is over, H1B 2020 Season Starts on April 1st, 2019.  Check out H1B Visa 2020 – Start Date, Fee, Lottery – FAQs 

If this is your first year of H1B visa filing, you must read What is H1B Visa, Requirements, Process . Not to scare you, Last year, there was lottery for H1B season and for FY 2017 USCIS received 236,000 applications .

When does H1B Visa 2018 Season Start ?
Update : USCIS accepted H1B Petitions for FY 2018 starting from April 3rd, 2017 until April 7th. They updated that H1B Cap was reached on April 7th, 2017. 
Typically, USCIS accepts H1B petitions for next fiscal year starting from April 1st. So, for FY 2018, the start date for accepting applications would be April 1st, 2017.  But, for FY 2018 season, April 1st falls on a Saturday, so USCIS will accept applications starting from Monday, April 3rd, 2017.   If you were wondering why called 2018, when in 2017, it is the fiscal year dates that dictate that. USCIS fiscal year is from October 1st to March 30th. So, technically the fiscal year for 2018 starts from October 1st and they accept petitions for the same 6 months before the start date and it would be April 1st, 2017.  You may read USCIS Press release for H1B 2017 Start Date 

What is H1B 2018 Quota ? Regular Cap vs Master’s Cap Quota ? 
Update : USCIS confirmed the below quota cap numbers in latest press release for FY 2018. 
To get some background, read H1B Quota – Regular vs Masters .  There have been many speculations on increasing the H1B Cap due to extremely high demand and bills proposed for the same in the past, nothing made it through. As of writing of this article, below is the H1B cap quota. We will keep this article updated as new changes come in.  The total H1B Quota as of today is 85,000 and it is split like below.

Regular H1B Quota  65,000
Master’s H1B Quota ( Only US Masters Degree Eligible) 20,000

Out of the above 85,000 quota, 6,800 are set aside for Singapore and Chile citizens as part of the free trade agreement between them. Also, check out the article with history of maximum H1B Cap from 1990 to 2017 

H1B 2018 Lottery Predictions ? 
It used to be a speculation whether we would have lottery in previous years, but in the past 4 years, lottery has become common. It is very likely that we would have lottery aka random selection for H1B 2018 season.  We have been writing predictions over the years and all of them have been accurate so far. When to plan for H1B 2018 Application – What should be your strategy ?
It is never too late to start planning…Depending on your situation, you may fall in one of the below categories and the suggestions are described below.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Working Professional from outside USA : If you are a working professional outside US, planning to work in US, especially  on H1B visa, your best bet is to find Multinational companies ( MNCs) that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it. There may be many people already in-line for these visas, you need to plan carefully so that you are given a slot in the company’s filing for your next season application.
  • Other H4, L1 Visas :  If you are on these visas living in USA, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How to find H1B Visa Sponsor for FY 2018 quota ?
This is probably the most asked question by everyone. It can be a tricky decision, you need be very careful to avoid fraud.

  • If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.
  • If you are professional planning to arrive in US from outside America,  it can be really tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.

What is H1B Visa 2018 Fee ? How much does it cost for the company ? 

The H1B fee varies by the size of the company..As of FY 2017 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee. On December 23, 2016 , USCIS increased the H1B fee component of base filing fees, which was $325. The below table is updated with the latest fee updates from USCIS.  There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary from FY 2017 quota.  If any changes, we will update this accordingly.

H1B 2018 Lottery Results – Checks Cashed, Receipts : 
One of the most asked questions is when will I get to know the lottery result for my petition. Well, this depends on many factors and there is no set SLA or date.  To put things in perspective,  last year, USCIS did a news alert indicating that they have returned all the rejected H1B petitions on July 8th, 2017. So, you can expect the last date for receiving final lottery decision around mid July 2017. …As we had about same number of petitions filed for FY 2018, it may be slightly earlier or even later in July or even early August 2017…  Few of the ways you would know, if you are selected in lottery is that, if the check that was filed with your H1B petition was cashed, or your employer gets the actual physical receipt notice in mail to them. If you filed under US masters quota, SEVIS update is another indication that you were selected in H1B lottery for FY 2018.  Ideally, your receipt numbers should arrive within 1 to 2 months…but, you never know, until you get a reject notice to be sure !

New President Trump Administration Impact on H1B Visa 2018 Quota?

We do not know, if this news release is directed by Trump administration or not…but, on April 3rd, 2017 the start date of H1B season, there were set of new announcements made by USCIS to report and prevent abuse of H1B program. Check out USCIS New measures to report, prevent H1B Fraud  . Besides this, as of the today ( article updated date), nothing has been officially ordered or specifically implemented by New President Trump Administration. There are many speculations on how H1B program will become tougher with higher wages, quota limits, etc… but, nothing has been officially signed. We will update the article as new updates come in.

Various H1B Bills  in US House and Senate  – Will they be passed for FY 2018 ?
There are few bills that are introduced in 2017 and at various stages in both house and senate. There are many confusions regarding the same bills like the minimum wage will go up to $130,000 USD, etc.  Fact is that nothing has passed and there are very slim chances for them to get passed before start of FY 2018 season.   2. Case approved for EAC-17-150-51000 on May 11, 2017.

    Not sure if this was an H1B application done this year or something else totally.
    But the ones before and after seem to be H1B cases for this years lottery based on similarity of dates of receipt.

    @Saurabh – what is your opinion – I know it is too early for approvals but still thought of checking with the group here.

    • The one before and after this one both shows “case received April 11, 2017”
      i.e. EAC-17-150-50999 and EAC-17-150-51001

      Again as I said, these may not be the H1B in the lottery , but chances are high for it to be one.

      • I am not sure of the case mentioned above but I do see (few confirmed it too) couple of approvals and RFE for few cases for FY2018 cap subject cases. I think FY2018 applicants should be happy to see some progress. Sooner the result, better it is to plan for things to follow. As far as I know, we should hope that our case gets picked sooner and gets approved . But I have no idea what is going to happen for pending cases of FY2017.

        • It is disheartening to see FY2017 cases still getting stuck and getting approvals now (atlast!).
          Logic says they should address FY2017 cases (straight forward ones) first and the start the FY2018 cases.
          But as you said, fingers crossed for receipt number first and then approvals.

    • Yes there won’t be any more check encashing. Some employers/Attorney withhold the information and release it late by may last week or June first week. Ideally, you can wait unless you get a notification ( either a receipt number or unselected in lottery notification)

    • I don’t think that will be any check en-cash by now, as far as I know when data complete entry is announced all checks should’ve been en-cashed..

  4. Finally got my stamping done today. My visa petition Non-AD/RP/CA was filed in 1st April 2016 and went through numerous problems (RFE, Rejection, MTR and finally Approval in April 2017).

    I had an embassy appointment today and after a fairly simple interview, I was told my visa is approved. Thanks to everyone @ RedBus2US. This forum helped me a lot.

  6. It’s only over when your petition is returned, however chances to receive RN are rather low from now on I would say. But 1 in 1000 might still get a RN till mid of June, who knows…

    • I got my receipt notice on 23rd May last year. There are still very good chances of people getting receipt notices.

        Having said that, last year we had PP but this year we don’t have. If anything, 99% of guys should have their RN by now.

        I would slightly rephrase. There are some chances but getting worst by the minute

  9. Hello Saurabh,

    My H1B petition was picked in last years (2016- Apr) lottery. However USCIS is yet to approve it. My petitioner was not my current employer. I am not sure if this petition will ever be approved.

    Now , my current employer has filed H1B petition on behalf of me for this year’s lottery ( 2017 -Apr)
    Assuming I get selected in this year lottery also (I am yet to get an update),
    1) Is filing two petitions a problem ? As I already mentioned, they are from different companies.
    2) If the previous years petition does get approved, will USCIS cancel my petition for this year ?
    3) Can both get approved ? If so, can I select one of them ?

        I am really living my dream now, so yeah , you can say I am in Dream world!! 🙂

        As for approval of my 2016 petition, my prospective employer looks very disinterested in pursuing its status. I guess they have settled for losing the money they spent on my Visa petition . Trump effect maybe ? I don’t know. So I had to start looking for other plans and hence my attempt to try another round.

        My current employer usually issues formal communication on Visa petitions only in early June. So I think I still have a chance.

        I would really like to get answers to the questions I asked above.
        In case I get picked this year, I need to know if a late approval of my last year’s approval would dampen my chances this year. As a matter of fact, I would like to stay on in my present company.

          I am also in the same boat. Even my last year petition is in RFE and this year my current employer filed the petition.
          May I know the name of consultant who filed your visa last year. Is it pegaframe?

    • Hi Rahul,
      Ideally filing two petitions from two different employers is allowed. If your previous year petition is approved, you need to notify your employer to immediately withdraw the current year petition( if picked in lottery). I am not sure whether both will be approved, there are more chances that this year H1B would go to RFE if your previous year H1B gets approved. It’s better to consult an immigration specialist .

    • Hi Rahul,

      You don’t need to worry regarding two different petitions at same time. Remember H1B is Employer’s not Employee’s so one company should file one application for one candidate. In USCIS terminology one petitioner must not file more than one application for a beneficiary. Petitioner here is employer and beneficiary here is employee. In your case it’s two different petitioners applying for you which is totally legal. If your 2016 application gets approved it is not mandatory that you should withdraw from current years petition if picked. See, it is your choice for which company to work. Lot of companies can you offer a job, try to file H1B and once on it’s approval they can start you job from October 1st or the date which petition is approved which ever come later. So once it is approved it is your choice with whom you want to work. Don’t stop any other petition or revoke any other petition depending on outcome of one petition as they both are independent. Once H1B starts it totally depends on your employer if they want to keep that H1B active or revoke depending on your choice of company.
      Let’s say your H1B 2016 company name is A and H1B 2017 company name is B. If 2017 application is also picked and both applications are approved. You can choose either company A or B to work. If you choose company B, then company A will decide whether to close your H1B of 2016’s or it has right to hold that visa for 3 years or until the time it gets approved initially which ever is lesser time.

    I got receipt notice 2 days back. The notice has my first name and middle name however my middle name is truncated. Instead of full middle name which is 14 characters long, the notice only has 8 letters. Please let me know if this will cause any issue.

      Look at the filed I-129. If that has the correct name, then just ask attorney to contact USCIS and inform them about it. Maybe it was intentionally truncated due to lack of white space.

  13. I am student and on OPT this was my second chance at H1B lottery. My school mates SEVIS has been updated. I want to know if my SEVIS has not been updated till now does it mean that my chance at 2018 H1B lottery gone down the drain. Also, I dont have the case number because I applied through Fragomann.

  14. I am on OPT which expires in mid July 17. My employer a MNC bank filed for H-1 through Fragomen and I have not heard anything back.

    My mails to Fragomen only get a response of ” not heard anything yet. ”

    I am a bit concerned. Should I keep hope for some time longer.

    • Even my company(one of the big 5) had applied through fargomen. AD/CA I was informed on 21st April that my case was received along with RN. It was even reflected on their portal. My collegue received RN mail from fargomen on 8th May

    • They actually hit the USCIS site and do get the data on real time. It’s just an overall picture on how the process goes for all the case series.

  16. My petition is showing as approved, but I have offer from a leading organisation with 60%+ hike and a lot better role.

    Now, looking at the inconsistent future in US and the time it will take me to find a US client, I am really confused if I should wait for H1 or not.

Therefore your petition is denied. ” I got the denail reason as above. Is there any chance of getting approved if I submit the client letter having the specified years of work in the petition ? or can i change the client and the attorney now ?

    • H1B DENIAL,

      Talk to your employer/attorney if they have enough evidence to argue this decision. If yes, only then file an Appeal or MTR.

      Employer can change attorney, if they want. However, changing client may not be possible as the location would change which in turn would make filed I-129 ineligible.

    • Hi, is this kind of denials are normal or they have been introduced freshly to strengthen the consultancy entries in US this year? Have we heard such cases earlier also? Best luck for poor guy , hope something good way he still holds to get out of bad luck patch..

        It’s quite normal for USCIS to have such tough screening process. Since such body shopping petitions are on the raise recently we are finding more denials.

      Applying 4times in a single draw its wrong.

      Unneccessary crowd in foregion country makes their people to hate us.
      And real beneficieries are impacted becauae of this .

      I am a 3rd time, regular Non-AD applicant for H1B, from the same employer, for the past 3 years, a total IT experience of 8+ years. People like you should be garlanded and should travel around the country as in Bahubali.

  20. Here’s my story: I been following Red2Bus since 2014. After bouncing from one grad school to another since 2007, doing couple masters, I finally landed a job. The year 2014 and 2015 both saw record high H1B applications. All through the grad school H1Bs were low and when I needed, the luck wasn’t there in lottery. Like most my family created matrimony profile for me on Shaadi, Bharat Matrimony, etc. All with potential girls that would only make my life harder as a immigrant and theirs as well. I was all set to enroll in MAVNI program in the reserve in US military. For year during that time, I was dating an american girl. The only time I been faithful to anyone and took it seriously. I decided not to enroll in MAVNI as long distance would end my relationship with her. Shortly after I married the love of my life. I don’t have US citizenship via MAVNI but I have conditional green card and most importantly a loving wife. It does work out in the end. Sure apply for H1B but it isn’t the end all be all. Definitely not worth your sanity.

    Is it possible to use the petition?
    am i eligible(apply) for cap exempt?

    • It is most probably invalid. In any case, when you will fill up DS160, you will automatically know whether it will work or not. If it does, go for it.
      But be prepared for questions or additional documentations.

    • Try to find some good employer who is ready to transfer. Since you never got it stamped hence its luck if transfer is approved. Worth a try…..

    • I think you are eligible for cap exempt. You will have to renew your visa first and then go for stamping. Talk to your employer/ immigration team, they Ll know what to do

    Most of EAC in range 136-139 are transferred to WAC
    Some cases are already in RFE and Approved statuses

    • Not yet buddy.. Status is still Case was received.. very few have got their status approved I believe.. Now as most if EAC petitions are transferred to WAC (California) I believe it would take more time for it to be processed

    • Process already started according to USCIS (Alert from 05/03: https://www.uscis.gov/news/alerts/uscis-completes-data-entry-fiscal-year-2018-h-1b-cap-subject-petitions) *USCIS will now begin returning all H-1B cap-subject petitions that were not selected.* This can take well until end of June (according to a few articles). Furthermore, on Immigrationgirl’s blog, someones lawyer already received his/her petition package back.

  26. Don’t fall for the fake updates… As far as I know next update in assignment pro is scheduled for next weekend… FS/TS doesn’t matter… I saw one person claiming to have received receipt… but he doesn’t provide the first 3 digits after the year… it appears he is fake and spreading panic…
    Do not expect any system updates this weekend… wait for next week

      There is no reason to provide fake updates. From my team 2 out of 6 have got updates so far. Expecting more updates in the following days.
