When does H1B Visa 2018 Season Start ?
Update : USCIS accepted H1B Petitions for FY 2018 starting from April 3rd, 2017 until April 7th. They updated that H1B Cap was reached on April 7th, 2017.
Typically, USCIS accepts H1B petitions for next fiscal year starting from April 1st. So, for FY 2018, the start date for accepting applications would be April 1st, 2017.  But, for FY 2018 season, April 1st falls on a Saturday, so USCIS will accept applications starting from Monday, April 3rd, 2017.   If you were wondering why called 2018, when in 2017, it is the fiscal year dates that dictate that. USCIS fiscal year is from October 1st to March 30th. So, technically the fiscal year for 2018 starts from October 1st and they accept petitions for the same 6 months before the start date and it would be April 1st, 2017.  You may read USCIS Press release for H1B 2017 Start Date

Update : USCIS confirmed the below quota cap numbers in latest press release for FY 2018.

When to plan for H1B 2018 Application – What should be your strategy ?
It is never too late to start planning…Depending on your situation, you may fall in one of the below categories and the suggestions are described below.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Working Professional from outside USA : If you are a working professional outside US, planning to work in US, especially  on H1B visa, your best bet is to find Multinational companies ( MNCs) that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it. There may be many people already in-line for these visas, you need to plan carefully so that you are given a slot in the company’s filing for your next season application.
  • Other H4, L1 Visas :  If you are on these visas living in USA, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

For FY 2017, we have put together a Step by Step Plan on How to apply for H1B 2017 Quota, it gives a guideline on the planning and what steps exists.

How to find H1B Visa Sponsor for FY 2018 quota ?
This is probably the most asked question by everyone. It can be a tricky decision, you need be very careful to avoid fraud.

  • If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.
  • If you are professional planning to arrive in US from outside America,  it can be really tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.
  • Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. If someone claims that, it is pure fraud and they are trying to trick you, we are not responsible for that. Please be careful

We have an article that we wrote for previous season, you may read article How to find H1B 2017 Sponsors to find out various options.

What is H1B Visa 2018 Fee ? How much does it cost for the company ?

The H1B fee varies by the size of the company..As of FY 2017 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee. On December 23, 2016 , USCIS increased the H1B fee component of base filing fees, which was $325. The below table is updated with the latest fee updates from USCIS.  There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary from FY 2017 quota.  If any changes, we will update this accordingly.

H1B Fee ComponentFee in USD
 Base filing fee$460
AICWA Fee$750  or $1,500
Fraud prevent & detection fee$500
Fee based on Public Law 114-113 ( if applicable)$4000
Premium processing fee (Optional)$1,225

H1B 2018 Lottery Results – Checks Cashed, Receipts :
One of the most asked questions is when will I get to know the lottery result for my petition. Well, this depends on many factors and there is no set SLA or date.  To put things in perspective,  last year, USCIS did a news alert indicating that they have returned all the rejected H1B petitions on July 8th, 2017. So, you can expect the last date for receiving final lottery decision around mid July 2017. …As we had about same number of petitions filed for FY 2018, it may be slightly earlier or even later in July or even early August 2017…  Few of the ways you would know, if you are selected in lottery is that, if the check that was filed with your H1B petition was cashed, or your employer gets the actual physical receipt notice in mail to them. If you filed under US masters quota, SEVIS update is another indication that you were selected in H1B lottery for FY 2018.  Ideally, your receipt numbers should arrive within 1 to 2 months…but, you never know, until you get a reject notice to be sure !

New President Trump Administration Impact on H1B Visa 2018 Quota?

We do not know, if this news release is directed by Trump administration or not…but, on April 3rd, 2017 the start date of H1B season, there were set of new announcements made by USCIS to report and prevent abuse of H1B program. Check out USCIS New measures to report, prevent H1B Fraud  . Besides this, as of the today ( article updated date), nothing has been officially ordered or specifically implemented by New President Trump Administration. There are many speculations on how H1B program will become tougher with higher wages, quota limits, etc… but, nothing has been officially signed. We will update the article as new updates come in.

Various H1B Bills  in US House and Senate  – Will they be passed for FY 2018 ?
There are few bills that are introduced in 2017 and at various stages in both house and senate. There are many confusions regarding the same bills like the minimum wage will go up to $130,000 USD, etc.  Fact is that nothing has passed and there are very slim chances for them to get passed before start of FY 2018 season. You can check H1B Bills Tracker to get more details on current status. We will keep the article updated as new things are passed.

I agree… count might stay same but being picked in lottery wont be enough this time. Getting an approval after that will be challenging if not done by fair means. Many consultants I know decided to not file visas this year due to same issue. Last year itself , many RFEs from consultancies got rejected. I am applying this year through my own employer only -one fair clean attempt and would suggest others to keep caution too. Good luck all !

        1. H1Btracker

If you think a number of consultancies decided not to petition this year then why do you think the numbers won’t decrease. Logically it should, right? Also, if you scroll down, a number of comments indicate that the big h1b guzzling Indian tech companies are also going for lesser petitions this year. Both us based tech consultancies and Indian tech firms will try to be careful not to spark a debate in the congress that will kill once for all their future opportunities wrt h1b. So I guess the numbers will be around of petitions will be 125k to 150k.

          1. H1 hopefull

Because every one I know in USA is doing more than one application thinking this might be their last time . I feel That alone will push the applications up .

          2. consultancies deserve an end

This is extremely unfair. If you have found a proper job with an established company there is no way you can send in more than one application. It’s simply not an option! So you are laden with disadvantages for doing the right thing? But a guy who didn’t manage to secure a job increase his chances by paying money to multiple consultancies? How is that even fair? I absolutely don’t understand why USICS won’t bust these “consultancies” particularly the ones that take money from the applicant to fine their H1B petition. That is down right illegal. To an extent, I can make peace with India tech companies for flooding the H1B pool. At least they are going by the rule book even though they exploit the loophole. But these consultancies deserve an end. Hopefully they are taught a lesson this year.

        2. H1 Hopeful

I hope that happens. Me and my husband work for good companies and doing one attempt only. I was wondering the same, why does USCIS even approve these consultancies ? Is there a way we can report them to USCIS?

          1. consultancies deserve an end

Sometimes I am torn between who to blame USCIS or those who take advantage of the sloppy rules. Firstly, I don’t understand why should scrutinization of petitions happen after the lottery. Why can’t they scrutinize the petitions before and run the lottery only for the petitions that is cleared. Secondly, details of these consultancies is not a secret. How they operate and how they make money is an open (and disgusting) fact. One can easily purchase a list of such consultancies in the internet for as low as $20. I don’t think USCIS is not aware of it that someone has to report it. It’s just a matter of time. The previous Obama administration was easy on them but the Trump administration will surely clamp them down. I will have my last laugh that day!

    1. Brace for new record

In all probability the count will be much more than last year, drastically more!

Reason being since for this year at least there has not been any policy change however that may change in near future, therefore companies may want to have as many as their employees with H1B petition in hand.

That’s a possibility looking at the trend and ambiguity.

      1. Robanne

That simply does not make any sense. I don’t see any reason for any consultancy to jeopardize themselves and got caught under these circumstances. Even the major consultancies are filing less petitions this year, what we don’t know about is the small ones. But why would any consultancy want to take the risk since it is obvious that Uscis intends to catch all these frauds and reject most of the multiple petitions this year. I am pretty sure this will impact the number of petitions this year. And another factor is that there wont be as many recent grads (opt holders) as it was in last years since the companies hired more US citizens this year due to Trump administration

  1. Pablo

It´s kinda unfair that, applications are swamped over by Indians. People from other parts of the world apply, but under such avalanche, it´s almost impossible to aim for a H1-B.
There should be a better way to distribute such scarce source.
Each country should have a maximum application quota, otherwise others won´t have same odds, unless the US wants to be flooded by Indians.
    Just sharing my thoughts.

      1. doubt

Employers petitioning for H-1B workers who work off-site at another company or organization’s location.

Means applying through employer A but working in employer B will be disqualified ?. Planning to join employer A soon…

        1. administrator

If you are referring to the April 3 press release, then that announcement doesn’t invalidate this arrangement. What it says that such work arrangements would be closely scrutinized and will be prone to site visits to ensure the arrangement is same as what was petitioned.

  2. 3rdtimeAD genuine

Do you believe that suspension of PP will affect applicants with multiple petitions (more rfe/denials)? Do you estimate the number of the petitions similar to last year?

    1. AlertIfYouTrust

I feel your original company application only will be useful. other petetion you would have appied from consultency most probably will get RFE. Also h1b transfers will take long time and may not allow premium processing.

Another fact whats going to happen is, the people who is going to apply via consultency and want to search job here will turn to be an unsuccessful case. Because, getting job on h1b is tough as congress most probably will pass that bill to have preference to local workers first. they expect clear documentation on that. So my conclusion is going with consultencies is waste of time and money this year. I bet this gonna happen. In the otherhand situation is becoming worst, i heard another incident today.

      1. Be careful

Its true…these incidents increased these days…..

        1. Toh1bfreek2

Hard times even for indian grooms https://qz.com/926214/once-indias-most-sought-after-grooms-h1b-workers-face-grim-marriage-prospects-thanks-to-donald-trump/

  3. H1b Expert

H1b premium processing temporarily suspended stating from 3rd April. This will also affect H1B filing for 2018.

This year uscis will pay extra attention to all the applications. I will suggest don’t apply H1b with any consultancies this year. Apply H1B only through genuine employers. You will just waste your time and money with consultancies.

Most Important: If uscis finds out that you have given money to these consultancies your future genuine chances will also be impacted so stay away from consultancies.

      1. Clarity

Another reason for suspending was to avoid h1b approvals before reform process finalize. They will take enough time and after finalizing h1b reform process, they will continue process regular processing. I am got this from one of attorney.

        1. Dr Ron

          1) president trump has put hiring freeze. Usually during the h1b processing dhs hires contractors to complete the processing. So because of that they can’t have premium processing this year
          2) more scrutiny into fake consulatancies applying h1b.

    1. Reply

No, but they use premium processing work force to scrutiny the regular h1b cases. They may take out the cases from consultencies and send rfe.

  4. J

It’s incredible the English typed and spoken by Indians. Terrible tenses and kindergarten level English. Well I hope with the elimination of the premium processing the number of applications from the Indian body shop consultancies will reduce to give chances to students with advance degrees and regulars a chance and route to remain in the US. It is quite sad how Indians in India are damaging their reputation and chances for other fellow Indians here in the US. Is there like a rite of passage for all Indians in India to use consultancy to emigrate to the US? Is it a curse or something. The salaries should be increased indeed to $130k so the madness can truly end.

      1. J

So you believe it is your God given right to get h1b for IT skills. So you are saying one who wishes to get h1b to teach English in the US isn’t entitled to it and should go look for work in their home country to do so right? I wonder what you use to communicate at your place of work. Hindi? I think there should be a language test alongside with the H1b to weed out people like yourself.

        1. Poor J

Your thinking is not going to help you. No one takes care what you think. And don’t worry about my language usage. I know how to take carr of myself. And stop ranting..

  5. Anna

F1 student graduating May 2017, found a private practice employee who’s willing to do anything to file a H1B for me but she hasn’t done that before and does not know how. Please advise.

No premium processing from this year

      1. ReplyArjun

Yes temporarily and it also says for 6 months starting April 3rd. This implies for this years H1B, No premium processing. That’s exactly what I have posted. Please read the news properly before accusing me of posting incorrect information. H1B 2018 filing can not be done with premium processing.

        1. Arjun

There is a big different between, saying no premium processing from this year to saying no premium processing for this year.

        2. Rahul

You mentioned “No premium processing from this year”. The correct information is “No premium processing for this year’s H1B petitions”.

    1. Next Steps

The reason for this was to do more scrutin on all h1b applications. They dont want to put employees to do premium processing. USCIS can do more efficient job if they avoid premium processing. They have clear plans what to do. More focus on consultancies.

  7. Rahul

Merit based system will surely help applicants with advanced skills. Though the definition of merit can vary, it should be better pure chance of luck.

  8. Optimist

This is my last chance. I work in a highly specialized field with masters from a top university. I came to the us with a full scholarship and now I work for a top firm. How fair is the deal if I have to go back because people spam the system. The worst part is a big number of petitions get rejected after getting picked and some employees of Indian outsourcing firms don’t even use their h1bs! I’ve always grown up with the idea that the limit of my success is how hard Im willing to work but for the first time I’m feeling otherwise. Just a little irritated with everything.

    1. One fair question

One fair question. When you went for F1 interview for masters, did you say to VO that you plan to work and settle down in US after your masters. Be honest

      1. Optimist

Haha. I can see what you’re getting at. But let me tell you honestly that the VO did ask me a word except wishing me good luck with my education.

        1. One fair question

I am not against anyone. I already got h1 last year while working with big product company in india. But one of my friend who completed hus MS in US didn’t take it lightly. He was like how could i get it and he didn’t.i didn’t understand his argument. How come doing MS in US makes him more skillful than me and he was the guy who during his F1 interview said that he would come back. So i just asked. Don’t mind bro.

    2. Reply Optimist

Hey, whoever you are, I wish we could talk. Exact same situation. Masters from a top firm, full scholarship, graduation with GPA 4.0 and then job at a top firm. 3 consecutive failed attempts . Last chance now! I really liked what you wrote at the end, I used to believe the same, hard work defines success and not luck which is the case here sadly. Don’t lose hope, I am prepared, USA alone can not determine our success. We can find more options in other countries instead of rotting here . Its F1 first then if no H1 people do first masters, second masters, work on cpt /opt etc. Then if you get H1B -wait for green card for 10 years . Without green card issues switching jobs /transfer etc. Buying a house or starting a business or taking a sabbatical for a while , nothing is possible without green card. Good luck still, hope we make it and then we can decide if we want to wait for green card for 10 years or not. If not, just know something amazing is in store for you elsewhere and this is God’s way of pushing you towards it 🙂

      1. Reply Reply Optimist

Great writeup. Highly encouraging. Belief in good things, will make them happen. Or will be rewarded by other means.

      2. Reply

Just an alternative view to your replies regarding the lottery/luck thing. I had an option to take up a job after my masters in the US and depend on my luck to get an H1B later but I found out all this luck and lottery system and decide to go for PhD instead of waiting for my luck to click in H1B. PhD is hard very hard compared to most jobs in the software industry but at least then things are only dependent on your hard work and not on the luck in H1Bs. But that being said, US is not the only country, people that don’t get H1Bs can get very good opportunities in other countries as well. I wish luck to all of you for this year’s H1B. It looks like with Trump this year the chances could be better.

      3. Optimist

Thanks for your wishes. I really appreciate the time you took to write this response. I wish you all the best. I hope we make it.

  9. girish yadhav

Any on applying throw kellton tech , or already applied in past years.?
Please share your experiance/suggestion whether to go with this or not.

        1. Karma

Do two things first. 1. Improve your English, 2. Stop spamming the H1B system. There are many, many guys out there, who are very well deserved than you.

          1. Nagging bi***h

Nagging b****h. People like you don’t have any other work except barging into some others way. This is not some international English language test to write perfect English , we don’t have that much free time to judge other people.

    1. KelltonTech

Their reviews are not so good . When I asked about the details in the process they are not ready to give sounds suspicious to me

    2. Surekha shalab

I had applied last year through kelton. They said that my application wasn’t picked. They wouldn’t share any tracking information . In fact many people had the same issue with them last year. They will show some receipt from other people saying they have successful h1b. It’s fake to my knowledge.

      1. WellWisher

Why you guys want to spam H1b. Find some job first, then employers job to file your H1B. Simply apply through some consultancy and go there and wait for job. Because of you guys, system got spammed and hence everybody focused on it today. So, some genuine guys suffering today. And even already moved guys fearing.
        Please don’t spam.
Its open if you get offer.

      1. Reply to VS

        Hi VS,

I have applied through Kellton Tech for my spouse. Heard about the lottery yesterday. Are you aware of the delivery ETA of the receipt notice if selected? I am sure its not based on the reputation of any company, but would dispatching the notices be based on the company criteria?

  10. Ready For Tech Interview

Wow…….this is hights of checking……be prepared guys…..check below. A software engineer asked at border to prove whethere he is really engineer…
Qs are check b tree is balance and about abstract class. 🙂

    1. Implications

People from 2 of the Southern Indian states probably need to take their proxies also along when traveling to answer PoE technical questions. Dowry increases by 0.25 kg gold to compensate.. so no issues.

        1. Tech Interview

I have interviewed at least 20 candidates for a position here in the US. 18 of them were from these states, and none had no clue about their own experience quoted in their resumes. When asked to appear in Skype in the middle of telephonic interview, they suddenly will have network issues. Clear difference between how a candidate took telephonic interview and how he struggles in Skype. Totally different voice and tone. And 2 of those 20 candidates had the same content in their resumes. One did the same project for a client in SFO in April 2010 with some roles and responsibilities. Another did the very same project, with very same responsibilities (and very same grammar mistakes in the description) in August 2012.
Call me a racist or whatever you wish to.. but that is not going to change facts.
BTW – you need to understand what exactly is racism and read my message again.

Will this be an issue when i go for drop box in April. ?

  12. looking for H1b sponsorship

currently i am looking for consultant who can sponsor my h1b visa. i am on h4 visa. so please let me know if any one know consultant who are still open for h1b visa sponsorship.

    1. Harry Ralte

Sadly this year not any genuine consultants looking to file H1B as USCIS is actively busting consultants and people who are filing through them.

  13. Krish

One of my friends marriage in trouble now. Bride’s side, they are asking my friend to come back to india….they afraid so much after the recent incidents……now option turned as risk. I am still thinking whether to try or drop….

          1. H1 hopeful

I disagree. With so many companies not hiring or sponsoring H1B this year and many fake consultancies being blacklisted , everyone is reluctant and careful for applying. Just my opinion, applications will stay same, maybe not reduce but not increase either.

          2. Reghu

I happen to be a recuiriter and trust me the filing has incrased 600% in our company this time. FYI we filed 6000+ application last year

Companies may not file more than last year as it will invite unnecessary attention of abuse. Either they will stick with last year numbers or will reduce.

          4. Reply Reghu

Last year filing count by companies: http://www.myvisajobs.com/Reports/2017-H1B-Visa-Sponsor.aspx

By your claim of 6000+ last year and 600% increase, you are suggesting a minimum of 36000 from a single company.

Looks highly unlikely and will surely invite the attention of USCIS.

          5. Reply Reghu

Don’t want to be mean, but please stop spreading rumors like these. You cant spell ‘Recruiter’ and ‘increase’ and we should believe you . hmm , use logic folks and stop believing nonsense.

          6. Reghu

Or it could be just that replying from a phone using big fingers could lead to typo ?
Don’t believe me, but all i am saying is don’t be surprised when you see the visa applications this time around.

          7. 4th timer

So Reghu, you mean to say your firm is applying 36000 Visas ? wow, this is my 4th time applying and I have a masters degree from Ivy league, 4.0/4.0 GPA and working for Fortune 500 top 10 firm. This is exactly why actual skilled people don’t get picked because firms like yours clog the system with excess applications. Now don’t tell me all 36,000 are equally skilled . Its the systems fault, not yours. Firms like yours only exploit this screwed system for their benefits.

      1. sav

My Employer say he would apply this time again as my case got rejected on 27th Feb 2017. Reason ” Initially I would work in house and later would be send to client location” Though client letter was provided. Thus rejected and options” now are there any options left ?

  14. 4th timer

Is there anyone here who has been unlucky in the H1B lottery 3 or more times in a row? I am a 4th timer and was wondering if there are others like me 🙁

    1. FromInfy

No man….not sure going to get or not. My manger said 6 months ago that they will file h1 this year for me . But he seems dropped the plan..not sure…waiting if any positive comes….but no hope for this year…..I also lost interest looking at the situations…..bad things are happening……all the best guys if some one looking to go USA

    2. InfyR

H1B Process already started in Infy. Only JL 5 and 6 got mail.Feb 2nd week they got mail and process is going on.This time very very less people they initiated H1B.

      1. Infysp

It’s not like that 4,5,6 are der but sorry to say that the window of nomination is closed now…..You should receive mail by now else no chance…..
I dropped AHD as mine was not der till 9th and that was last day….I connected with my DM and get that done on same

        1. Infyemp

nomination has gone. When did you receive the mail. I havent received the mail yet. Wen i had asked DM last month. he told its in process. Is there any chance of receiving mail this week?

          1. Infyemp

As i said,I am waiting for mail. My DM confirmed he has sent the nomination, but i have not got any mail yet.So want to know if people are still receiving mails or not?

      1. Riyaz

I am from TCS Banking domain….the nonimations from TCS are very low in numbers…This time it was very limited to 2 or 3 people from a Account, who are very close with the managers…I lost hope.

      1. Wipro1

I work for Wipro, & I haven’t got any mails from Gims yet, even though the manager says that he has nominated me…. He said to wait for GIMS mail…

    1. Captain Jack

Wipro has initiated H1b for very less people .From my account numbers went down from nearly 200 last year to 24 this year .

  15. Waiting_Big_MNC_though

This is very clear that USCIS is deliberately Denying so many cases off late for these last few weeks,
Earlier success rate was Almost 80% wheras now it is just 20%.

So those whose cases got handled earlier were lucky, Expecting people have to go through this very suffocating path forward !
    What you say?

  16. Waiting_Big_MNC_though

We can also guess that USCIS might be looking at way to downsize Number of Approved people count, Like Approving H4 (dependents of H1B), Pre-Approved L1B holders etc. So that you can reduce number of people have VISA whereas Approval counts still counts on, Just a guess !

  17. Waiting_Big_MNC_though

There could some good news !
    1) Mr. President is hosting a meting with Giant MNCs today
    2) A team of Congressmen (more than 25) are planning to visit India soon this month end
Lets wait and see, outcome !

    1. decent

It is a decent salary if you are not going to be put up in a major metro city. This is the range most MNCs start you with (some even low). So don’t get discouraged and make your move.

    2. venkat

Hey , No worries man, its decent pay, Even i got same around this number, got approved… Be confident, All Indian MNC offers sames. All the best.

    3. KiranMurthy

If you are looking for savings then dont waste time on it. Get some 80-100k , then its at least worth coming here. Otherwise you can easily earn this in india. If you just want to come here….just try :-)……..
      Good luck on ur decisions.

Last year I got my h1b and visa stamped on December’16, But There was no project so far in my current company CTS . Can anyone suggest me what all option I have to get a job on H1B . Few points I would like to mentioned .

    Primary Skills :- Base SAS/Advance SAS/Macros /SQL
Secondary Skills :- Big Data (Hive), Statistical Analysis with SAS( Linear and Logistic Analysis )
Domain :- BFS (Credit Card Domain)
    Exp.:- 6+ year

    1. Curious

CTS files h1b with out any project confirmed? Pretty bad policy. This consultency companies simply flood the applications like this i think.
Btw, try other companies who can be ok to transfer h1b. But i am not sure about the case without even joining on ur first company in US. Worth discussing with some immigration lawyer
      Good luck.

      1. Antonio Zuniga

Most companies are not willing to hire H1B or transfer because of the increase in scrutiny. I was in the job market for H1B transfer and had a tough time finding a full time job .

      2. Ravi

It’s not like that I had a project while I was undergoing with all visa process but last December my client plan to move out with CTS and I am left with h1b but no project…so I thought I should get some suggestions here with some h1b expert

        1. CTS

It just means that you are not pushing yourself within CTS. There are plenty of onsite opportunities and many projects are looking for internal travel ready resources. You need to speak to your supervisor and make yourself released to the CDP. Or your supervisor can talk to other managers from projects looking for resources with Visa.

    1. ReplyRahul

It would come soon. Once the travel ban thing settled, new things related to h1b will come.
If you are planning to get H1, my strong recommendation is to get permanent roles job…dont go with any consultencies…they will be caught and would be rejected surely….

        1. Antonio Zuniga

Shouldnt be an issue. Just make sure that the company is legit and filing is legit !
The application will be heavily scrutinized this time around .

(INFOSYS)Guys just to update you all this time they are filing only for JL5/6 .they are only in P0 category .JL 4 is in P2 category…ALL THE BEST..

  19. Hopeforbest

Hello, has anyone heard of Oncorre Inc, NJ?
They are asking for $4500. I could not find any negative reviews about them. But out of 319 LCAs filed over the last few years, only 3 were withdrawn/denied.
Could anyone advise any genuine consultancy to go it? Have not been lucky in the last 2 years and want to try my luck for the last time.

      1. Genuinely

This year pretty risk with any consultency in my opinion. Because they can direct dhls to find consultencies and deny as they are looking outsourcing as main threat to them. This can be done with out any bill. So I strongly recommend to find a job directly in so company and try. Or come and do ur masters and then go as intern and process goes smooth. Anyway double double check with ur steps this year. No clarity on whats going to happen.

        1. Hopeforbest

@Genuinely – thanks for your reply….Unfortunately I don’t see companies willing to sponsor directly, especially for people who are at present in India.

          1. Genuinely

The fact is, even if you are in USA, it is tough time to get job as companies announcing to recruit local guys more. It started happening already as I heard from many.
            Good luck!

        1. ScamAlert

Please do not trust consultancies which ask for money. First of all it is illegal and secondly you have no guarantee they will process H1. Do not get caught in such scams.

    1. H1B Pro

If I’ll be in your position I won’t waste my $4500 and valuable time with consultancies this year.

Even if everything goes as per your plan and consultancy files your H-1B and you get selected in lottery, chance of getting RFE with consultancies is 99% and for consultancies to clear RFE is a daunting task.

        1. Genuinely

Also I was interweaving coyple of interns last weeks. All resumes we got from hr was local guys…all explicitly mentioned in their resume that ‘American’. I never saw such thing before. So this means getting job also becomes tighter as they are preferring locals. Coming on consultency and waiting for job may be a risky thing at this stage…until you have clear job in hand dont take risk.

    1. Karan

People are just wasting their time and money by trusting stupid fake consultancies. They are making fool of themself.

Some of the fake consultancies which have been banned: http://redbus2us.com/h-1b-debarreddisqualified-list-of-employers-in-usa/

Most of the consultancy companies take money and they don’t even file H-1B. Please be aware folks!!

  20. Rashmi

    Hi Saurabh/Team,

    Hope you are doing well.

My case was approved on Dec 9th’2016. However I have not received approval notice from my employer yet. When asked for same, I was told that they need some more time as they are in process to take care of all required documentation in order to ensure smooth process at stamping and port of entry due to new president administration. I am not sure what’s going on, I feel it’s too late as it’s been 3 months since I received approval. Could you please answer my questions below:

    1. What exactly I should ask my employer at this point of time to proceed further?
    2. In what cases, amendment is applicable?
    3. Do I need to face any difficulties if my employer doesn’t send me I-797 before 01st Apr’2017 (or) if the visa interview is not scheduled before 01st Apr’2017?
    4. Till what time, petition approval is valid. Since I received approval in Dec’2016, until what time I could attend visa interview?
    5. I am afraid as my employer is not responding properly and the time for h1b 2017 filing is approaching. What would be possible difficulties I need to face if my employer continues to delay the process?

Thank you very much in advance!

    1. David

You have a legal right to get your approval notice, especially the bottom half is meant to be given to you. Contact a immigration lawyer and ask his/her opinion. It’s worth paying their consulting fee.

  21. H1B Expert

Don’t plan for H1B through consultancies and waste your money. Even though we may get lucky in lottery but RFE is certain for all the consultancies. Fake consultancies won’t be able to clear the RFEs.
My 2 cents don’t give your hard-earned money to fake consultancies.

    1. Best of luck

Yes it may cross 2L this year as well bill risk until coming here…may expect lot of scrutiny while stamping. For sure tough time for consultencies…

  22. H1b

No changes to H1b this year. Confirmed by senator.

My J1 visa is only valid until July 2017. If I apply for H1B visa on April, Would I need to go home to my home country after July and just wait for the result at home?

  25. VJ

Don’t plan for H1B through consultancies and waste your money.. Even Though if we get visa after passing through lottery process, we won’t get job in US because of proposed bill for wage increase. 130K. For this amount they can hire 2 local employees..
We can plan for some other country where the visa process is easier than US.

    Purely my suggestion..

    1. H1 Hopefull

I agree with you. I had friends who got picked through consultancies last year, forget getting a job, they got picked, got RFE which never got cleared . so whats the point? Why waste money?

      1. 2nd timer

should have hired a good attorney who can understand the RFE case to respond to USCIS and process it in premiuim for quicker results,

        1. H1 Hopeful

No matter how good the Lawyer is, if the case is weak and the consultancy is a fake (doing H1B after taking money with no client ready) nothing can save you bro

    2. 2nd timer

130 K bill is one of many bills being presented by senators to the congress, this came to limelight to scare the h1 aspirants, I strongly believe this bill is not going to be accepted. but wait for mid march for new amendments and new rules.

      1. VJ

Nope.. it doesn’t seem like that.. most of the MNCs applied visa only for senior folks.. for e.g heard from my friend in Infosys TLs and PM only.. Then only they can get paid from client if there is wage increase.. So it seems 130k bill is having possibilities to get passed..

    1. Surinder

This is great news. Fake consultancies and fake people getting arrested. I have personally started reporting some consultancies in California, Texas, Virginia and Illinois. I have even started sending emails to US consulates in India (Hyderabad, Chennai, Bangalore,) to look into applicants closely that mention different clients. I would be happy to see people getting arrested for this. More emails today to Consulates in India. about people I know who may be involved in faking resumes and working at client locations.

      1. All the best.

        Best of luck guys.
No one knows until you get some permanent job…its all changed these days.

    2. Ram

Dont go with consultencies. Try getting offers in right way and apply h1b through them. Thats only the safest option in current situation
Fake consultency guys will be caught for sure.

  26. H1b 2012

Guys beware, lot of fake consultancies asking for your money to file h1b . Last year many people fell into the trap and ended up loosing 1000’s of dollars . DHS is actively catching the fake shell companies , many Indians from jersey, Virginia , Texas and California have been convicted !

  27. iampks

Guys, I know a lot has changed since last few weeks. Can someone with true experience with H1B predict if there is going to be a lottery this year or will be like 2008-12 where quote did not get filled up till mid of the year. While talking to some of my friends I came to know that most of the big Indian MNC’s like Infy/TCS/Wipro/HCL/Accenture are not filling many H1’s this year. Is this true? I also spoke to few consultants who have been doing H1B’s but said that are not going to do this year? Does this seems to be reasonable and if true there is very slight chance of having a lottery?

    1. H1b_helper

Dont you think you are expecting too much… H1B visa application mostly depends on market situation. Now it is good. For sure there will me more than 85k. May be even more than last year.

This is the last chance to do based on existing limitation. If Mr.T changes the law based on recent bills (both house and senate are now under Mr.T’s control), next year will need to adhere to that and that could reduce the number… but it might also be tougher to find clients because of pay requirements…

      Best of luck…

      1. MyOpinion

But if I apply now and picked, will there be any situation not getting job because of wage changes may be next year as you are thing that?
Some friend saying many resumes coming with local people there and mentioned in resume as ‘american’ it seems.

    2. Infy_SP

Infosys started filing h1b visas but this time its seems to be lesser count.
My manager applied 11 visa last year out of which 2-3 got selected. This year the count is 3 from the same project.

Even there is another account which applied only 5 visas this time however last year its 15+
This time might be Infosys will file lesser visa as compared to last year. Not only because of Mr. T but this yr even all Quarter results are also not that good as compared to last year.

TCS has also same issue, the profit numbers are not good this year…

But here that doesn’t matters even if count is 1L to 1.5L still you need LUCK factor……AND YES the lottery will be there….It might not be 2L+ but it will go to 1.5L which I think

    3. 2nd timer

I have heard many wiproites are being deported if they don’t have any projects handy, few of my neighbours working for Wipro are vacating their apartments this monthend and travelling back to India. I see message from Narayanamurthy for considering not to participate in this year’s H1. I see this year count might come down to 120-150 k compared to last years 226 K

    4. iampks

I think most of you guys are correct in your observations. The number of petitions from big MNC’s will definitely be lot lesser than prior year but it might still end up in lottery because of Advance Degree petition/Dependent of EAD holders. I think one of the proposal is to eliminate the additional 20K for advance degree and also stop dependents of EAD from working and as per me these two categories of people might fill up the quota.Again, nothing is for sure till the end of filing period but I hate being in lottery.

    1. John

Sounds like making doors close. It may be risk this applying H1B? I heard some news about that upcoming changes can hurt more than the bills introduced so far. any one has any ideas. Also many companies taking safe steps that not go for H1B and hire locals. Looking all these, is it really risk applying H1B this year?

The thing is that president can direct DHS to perform ‘wages based selection’ instead of random lottery. This can happen with out any bill, this can be a direct executive order anytime before April. One another possible option is, if the executive order delays, then random lottery may happen and while stamping visas, they can be reject based on wages. In this case, applicants may not even get their fee refund as this is VISA rejection.
