H1B 2018, 2019 Season is over, H1B 2020 Season Starts on April 1st, 2019.  Check out H1B Visa 2020 – Start Date, Fee, Lottery – FAQs 

If this is your first year of H1B visa filing, you must read What is H1B Visa, Requirements, Process . Not to scare you, Last year, there was lottery for H1B season and for FY 2017 USCIS received 236,000 applications .

When does H1B Visa 2018 Season Start ?
Update : USCIS accepted H1B Petitions for FY 2018 starting from April 3rd, 2017 until April 7th. They updated that H1B Cap was reached on April 7th, 2017. 
Typically, USCIS accepts H1B petitions for next fiscal year starting from April 1st. So, for FY 2018, the start date for accepting applications would be April 1st, 2017.  But, for FY 2018 season, April 1st falls on a Saturday, so USCIS will accept applications starting from Monday, April 3rd, 2017.   If you were wondering why called 2018, when in 2017, it is the fiscal year dates that dictate that. USCIS fiscal year is from October 1st to March 30th. So, technically the fiscal year for 2018 starts from October 1st and they accept petitions for the same 6 months before the start date and it would be April 1st, 2017.  You may read USCIS Press release for H1B 2017 Start Date 

What is H1B 2018 Quota ? Regular Cap vs Master’s Cap Quota ? 
Update : USCIS confirmed the below quota cap numbers in latest press release for FY 2018. 
To get some background, read H1B Quota – Regular vs Masters .  There have been many speculations on increasing the H1B Cap due to extremely high demand and bills proposed for the same in the past, nothing made it through. As of writing of this article, below is the H1B cap quota. We will keep this article updated as new changes come in.  The total H1B Quota as of today is 85,000 and it is split like below.

Regular H1B Quota 65,000
Master’s H1B Quota ( Only US Masters Degree Eligible)20,000

Out of the above 85,000 quota, 6,800 are set aside for Singapore and Chile citizens as part of the free trade agreement between them. Also, check out the article with history of maximum H1B Cap from 1990 to 2017 

H1B 2018 Lottery Predictions ? 
It used to be a speculation whether we would have lottery in previous years, but in the past 4 years, lottery has become common. It is very likely that we would have lottery aka random selection for H1B 2018 season.  We have been writing predictions over the years and all of them have been accurate so far. When to plan for H1B 2018 Application – What should be your strategy ?
It is never too late to start planning…Depending on your situation, you may fall in one of the below categories and the suggestions are described below.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Working Professional from outside USA : If you are a working professional outside US, planning to work in US, especially  on H1B visa, your best bet is to find Multinational companies ( MNCs) that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it. There may be many people already in-line for these visas, you need to plan carefully so that you are given a slot in the company’s filing for your next season application.
  • Other H4, L1 Visas :  If you are on these visas living in USA, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How to find H1B Visa Sponsor for FY 2018 quota ?
This is probably the most asked question by everyone. It can be a tricky decision, you need be very careful to avoid fraud.

  • If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.
  • If you are professional planning to arrive in US from outside America,  it can be really tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.

What is H1B Visa 2018 Fee ? How much does it cost for the company ? 

The H1B fee varies by the size of the company..As of FY 2017 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee. On December 23, 2016 , USCIS increased the H1B fee component of base filing fees, which was $325. The below table is updated with the latest fee updates from USCIS.  There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary from FY 2017 quota.  If any changes, we will update this accordingly.

H1B 2018 Lottery Results – Checks Cashed, Receipts : 
One of the most asked questions is when will I get to know the lottery result for my petition. Well, this depends on many factors and there is no set SLA or date.  To put things in perspective,  last year, USCIS did a news alert indicating that they have returned all the rejected H1B petitions on July 8th, 2017. So, you can expect the last date for receiving final lottery decision around mid July 2017. …As we had about same number of petitions filed for FY 2018, it may be slightly earlier or even later in July or even early August 2017…  Few of the ways you would know, if you are selected in lottery is that, if the check that was filed with your H1B petition was cashed, or your employer gets the actual physical receipt notice in mail to them. If you filed under US masters quota, SEVIS update is another indication that you were selected in H1B lottery for FY 2018.  Ideally, your receipt numbers should arrive within 1 to 2 months…but, you never know, until you get a reject notice to be sure !

New President Trump Administration Impact on H1B Visa 2018 Quota?

We do not know, if this news release is directed by Trump administration or not…but, on April 3rd, 2017 the start date of H1B season, there were set of new announcements made by USCIS to report and prevent abuse of H1B program. Check out USCIS New measures to report, prevent H1B Fraud  . Besides this, as of the today ( article updated date), nothing has been officially ordered or specifically implemented by New President Trump Administration. There are many speculations on how H1B program will become tougher with higher wages, quota limits, etc… but, nothing has been officially signed. We will update the article as new updates come in.

Various H1B Bills  in US House and Senate  – Will they be passed for FY 2018 ?
There are few bills that are introduced in 2017 and at various stages in both house and senate. There are many confusions regarding the same bills like the minimum wage will go up to $130,000 USD, etc.  Fact is that nothing has passed and there are very slim chances for them to get passed before start of FY 2018 season.     I am new to all of this and have been checking the blog everyday since the beginning of this years process. I wish you all the best and everything that is worthwhile takes time!

    I have not received any updates from my attorney yet and will travel outside the US soon. My OPT expires May 31,2017 and would like to know if by leaving the country I will not be able to re enter due to my OPT expired?

    Please correct me if I am wrong but I read that if you are under cap-gap and leave the country while your application is pending or have no updates the officials will not let me in at the airport because my work permit will be expired.

    • Non AD/NM,

      If your OPT has expired and you are in cap-gap, the general advise is to avoid travel. Cap-gap doesn’t give the person ability to travel out and return to US.

        Absolutely Wrong, back in 2014, one of my friend she worked for fortune 100 company and she had to travel in July in Cap-Gap extension and she came back fine.

        So again it is not advised to travel but people have gone and came back in same period of time.

          I made some assumptions and should have expanded on that in my previous response. A person can travel on cap-gap if H-1B has already been approved w/ COS and the student is other permissible to enter US. I made the assumption that H-1B wouldn’t have been approved in time as PP is pending.

          If H-1B is pending and person is on cap-gap, leaving US would abandon COS which in turn would end cap-gap. However, after H-1B has been approved w/ COS, leaving US would have no impact on approved future dated COS, and hence person can return on cap-gap.

          In your friend’s wife’s case I assume COS was already approved.

  3. DSO just confirmed of SEVIS status update with receipt attached to my record. My lawyer said that he had not received the official receipt from USCIS. I hope that it will come in the mail soon. This is my second attempt at H1B visa. Best of luck to everyone!

    AD/no OPT/ last chance

    I am seeing a few dates here, people are saying we shouldn’t panic till either May 4th, May 7th and May 12th.

    I am just wondering the source of these dates, and if I should move on and look for jobs in other countries if I don’t get any notification by early May.

      Last year USCIS made an announcement about completion of data entry and that was a good indication to know what’s the last day(s) to expect receipt. I assume they would make similar announcement this year. There is still few weeks to go. [All this is based off historical data]

        I’ll start job searching again after early May. But technically speaking, is there still a chance to get your receipt after USCIS announced all data entry is completed?

        My DSO was telling me someone only received their receipt in early July right around when people got their rejection notices last year.

        How much hope should people preserve after May 4th? less than 5%?

        • Last year my employer informed me that cheque got encashed on 15june and got receipt from back side. They got receipt copy by june end. Non AD case. So i will say people should wait until they receive rejection notice.

      • Gonna try to convince the partner who hired me to see if they can send me to Canada or Europe. And if my firm doesn’t care about newly hired first year associates that much and rescind my offer, then my first choice would be China, since I am Chinese. Second choice would be UAE, specifically Dubai, since it’s an economic booming region and a tax free zone, third choice would be Canada.
        Also depends on the jobs I guess.

  6. Finally got approval on my petition from last year. Waited for exactly 1 year and 23 days for this. Got selected in lottery in May last year. Petition got rejected in August. Filed Motion to Reopen in September. Finally got approval on 24th April this year after multiple followups.

      Could you please let me know the Service Center in which your application was Filed/Rejected/Reopened/Approved & Reason For rejection. Can you explain with whom you did multiple Follow-ups – Employer or with service Centre? I am also in the same boat. Waiting for MTR response file in Feb.

      • My case was Non-AD filed in CA. This is the sequence of events:

        1. May 2016 – Got selected in lottery.
        2. August 2016 – RFE received. Reason: speciality occupation and working location resource.
        3. Sept 2016 – Responded to RFE and upgraded to Premium processing.
        4. Sept 2016 – Petition rejected.
        5. Oct 2016 – Filed MTR along with new evidence i.e. new client’s contract etc.
        6. Jan 2017 – Petition approved. Waiting for approval mail.
        7. Feb 2017 – Still waiting for approval notice mail. Attorney followed up with USCIS.
        8. Mar 2017 – Still waiting for approval notice mail. Again follow up.
        9. Apr 2017 – Finally got the approved I-797 (attorney had to pull some strings)

  8. I got to know that for many associates, the VTS status is “SSG cancelled”. Also, if the status is “petition filed”, it is not sure that the petition is actually filed or not. Heard a rumor that many petitions have not been filed for TCSers and only a few have been filed. Although the status shows “petition filed”, but in reality, it is not. Time to seek clarification from FDFU.

  9. Hi. Just wanna share my experience and things learned. I was part of the lucky ones who got picked from last year’s crazy 260+++ H1B applicants. I arrived here in the US last January, got my apartment and got my car 🙂

    Tip:
    1. Don’t be anxious, relax, if it will come, it will come 🙂
    2. Don’t expect too much, else, you go back to tip 1
    3. It doesn’t matter if AD/Non AD, from MNC or SME companies. So many people last year got crazy asking about this. It’s simple, if you got picked, good, if not, move on!
    4. It’s a WAITING GAME, so be patient and WAIT.
    5. Those who got picked, this site helped me alot on tracking the progress of H1B status changes – https : //h1bstat.ru/
    – This site tells you the trend. This info tells you more or less how much more waiting you need to do.

    1) By what time does USCIS finish cashing in the checks?

    2) Is it the case that, USCIS first cash in check for AD candidates and then for non AD?

    • 1. It may continue until July. There is no specific deadline, so keep calm.
      2. It’s true that they start with AD, but then they move on to the non-AD without finishing AD first. So from now on AD and non-AD will continue simultaneously.

    Does the check gets deposited first or the SEVIS gets updated as soon as the lottery done??? I have been waiting too.. I have no update so far from my DSO or my employer and lawyer also don’t have any updates.. And this waiting is so frustrating.

        • There is no specific order for check cashing, SEVIS updates, and receipt notices. Any one of these may happen first or last. And this may continue well into June.

    Happy Monday to everyone. I have small clarification, I appreciate if anyone could enlighten me. I was just checking my application status through INszoom. Now I see that there is a receipt number on my account which was not there last night or last week. I checked the receipt number on USCIS website, it says Name was updated and below message.

    On April 13, 2017, we updated your name for your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number EAC17137

    I was wondering if this is how the message you get when your application being picked or is this just a name change?

    Its time to ban all these fake consultancies who are giving only 80K salary, the top recipients of the H-1B visa are companies like Tata, Infosys, Cognizant alleged abuse of the H-1B temporary visa programmer , there are thousands of local experienced high skilled programmers with latest technologies.

    • Its officially clarified that only 6 of the top 20 recepients of visa are Indian companies. Tcs/infosys only got an avg of approx 7400 visas per year which is 8.8% of the quota.

      Let us not bias against Indian companies. Cmon, I have been working wih some folks who are as good as if not better than anybody in the market.

      I think its plain rhetoric being played. Numbers are telling a different story. We need to dig deeper though before concluding abuse. Yes, I do agree on pay but even that is like 85k which is 35% more than avg grade of 60k as per the scale.

      These numbers are quoted by Nasscom which is a governance body in India. These are official numbers.

    • Are you sure..? Since we got FedEx tracking Id along with the application document I dont think this can be true. Bcoz we are able to track the delivery of the application.

      Is there any cts guy who did not get FedEx tracking Id ?

      • Yes dude.. they provided.. FedEx didn’t have your name right.. Its should be a kind of bulk booking.. (may be I am wrong)

        Also, they might have changed their mind at last minute, after taking all prints..

    official website? ( This time they seem to be releasing the detailed data
    regarding the h1b filings ) The earlier they release the data less would

      As of now receipts notices are not started reaching employer.
      Infy is huge, even though they receive it, it will take a week to update the status.

      Every one with big corporate please stop asking update you will get to know from internal portals.

  20. I would request all genuine applicants to have faith and stay strong. This is just the start of the process and a process where not much is in your hands.

    Instead lets invest time in figuring out alternative plans. (Job in India, Canada etc.) Remember to introspect and you will find equally good alternatives somewhere else.

  21. Does anyone know if an AD applicant is selected in the non-AD/general lottery, does USCIS prioritize his/her case and send the receipt before the selected non-AD applicants? This is my last try (AD/VT) and my check wasn’t cashed until last Friday (April 21). I have to make a few decisions hence, the question. Any help would be greatly appreciated. Thanks.

      USCIS has not mentioned anything about notification priority. Last year, one of my AD colleague got his receipt in May. A Non-AD colleague got his receipt in June(this was a surprise).

      We can’t assume anything until we get official communication.

    Tierd of waiting, at least I would happy to know that my petition didn’t made into lottery this time also.

    I can plan and work on other career opportunities if this h1b drama is ended.

    • They will keep sending receipt notices for the next month or so, so you can receive your unselected petition back in June or July.

    • Yes same boat bro, My petition initially started with TCS now the 4th time over a US employer. This process has slowly brought me in to depression state. I am unable to concentrate in anything now.
