If this is your first year of H1B visa filing, you must read What is H1B Visa, Requirements, Process . Not to scare you, Last year, there was lottery for H1B season and for FY 2017 USCIS received 236,000 applications .

When does H1B Visa 2018 Season Start ?
Update : USCIS accepted H1B Petitions for FY 2018 starting from April 3rd, 2017 until April 7th. They updated that H1B Cap was reached on April 7th, 2017. 
Typically, USCIS accepts H1B petitions for next fiscal year starting from April 1st. So, for FY 2018, the start date for accepting applications would be April 1st, 2017.  But, for FY 2018 season, April 1st falls on a Saturday, so USCIS will accept applications starting from Monday, April 3rd, 2017.   If you were wondering why called 2018, when in 2017, it is the fiscal year dates that dictate that. USCIS fiscal year is from October 1st to March 30th. So, technically the fiscal year for 2018 starts from October 1st and they accept petitions for the same 6 months before the start date and it would be April 1st, 2017.  You may read USCIS Press release for H1B 2017 Start Date 

What is H1B 2018 Quota ? Regular Cap vs Master’s Cap Quota ? 
Update : USCIS confirmed the below quota cap numbers in latest press release for FY 2018. 
To get some background, read H1B Quota – Regular vs Masters .  There have been many speculations on increasing the H1B Cap due to extremely high demand and bills proposed for the same in the past, nothing made it through. As of writing of this article, below is the H1B cap quota. We will keep this article updated as new changes come in.  The total H1B Quota as of today is 85,000 and it is split like below.

Regular H1B Quota  65,000
Master’s H1B Quota ( Only US Masters Degree Eligible) 20,000

Out of the above 85,000 quota, 6,800 are set aside for Singapore and Chile citizens as part of the free trade agreement between them. Also, check out the article with history of maximum H1B Cap from 1990 to 2017 

H1B 2018 Lottery Predictions ? 
It used to be a speculation whether we would have lottery in previous years, but in the past 4 years, lottery has become common. It is very likely that we would have lottery aka random selection for H1B 2018 season.  We have been writing predictions over the years and all of them have been accurate so far. When to plan for H1B 2018 Application – What should be your strategy ?
It is never too late to start planning…Depending on your situation, you may fall in one of the below categories and the suggestions are described below.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Working Professional from outside USA : If you are a working professional outside US, planning to work in US, especially  on H1B visa, your best bet is to find Multinational companies ( MNCs) that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it. There may be many people already in-line for these visas, you need to plan carefully so that you are given a slot in the company’s filing for your next season application.
  • Other H4, L1 Visas :  If you are on these visas living in USA, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How to find H1B Visa Sponsor for FY 2018 quota ?
This is probably the most asked question by everyone. It can be a tricky decision, you need be very careful to avoid fraud.

  • If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.
  • If you are professional planning to arrive in US from outside America,  it can be really tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.

What is H1B Visa 2018 Fee ? How much does it cost for the company ? 

The H1B fee varies by the size of the company..As of FY 2017 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee. On December 23, 2016 , USCIS increased the H1B fee component of base filing fees, which was $325. The below table is updated with the latest fee updates from USCIS.  There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary from FY 2017 quota.  If any changes, we will update this accordingly.

H1B 2018 Lottery Results – Checks Cashed, Receipts : 
One of the most asked questions is when will I get to know the lottery result for my petition. Well, this depends on many factors and there is no set SLA or date.  To put things in perspective,  last year, USCIS did a news alert indicating that they have returned all the rejected H1B petitions on July 8th, 2017. So, you can expect the last date for receiving final lottery decision around mid July 2017. …As we had about same number of petitions filed for FY 2018, it may be slightly earlier or even later in July or even early August 2017…  Few of the ways you would know, if you are selected in lottery is that, if the check that was filed with your H1B petition was cashed, or your employer gets the actual physical receipt notice in mail to them. If you filed under US masters quota, SEVIS update is another indication that you were selected in H1B lottery for FY 2018.  Ideally, your receipt numbers should arrive within 1 to 2 months…but, you never know, until you get a reject notice to be sure !

New President Trump Administration Impact on H1B Visa 2018 Quota?

We do not know, if this news release is directed by Trump administration or not…but, on April 3rd, 2017 the start date of H1B season, there were set of new announcements made by USCIS to report and prevent abuse of H1B program. Check out USCIS New measures to report, prevent H1B Fraud  . Besides this, as of the today ( article updated date), nothing has been officially ordered or specifically implemented by New President Trump Administration. There are many speculations on how H1B program will become tougher with higher wages, quota limits, etc… but, nothing has been officially signed. We will update the article as new updates come in.

Various H1B Bills  in US House and Senate  – Will they be passed for FY 2018 ?
There are few bills that are introduced in 2017 and at various stages in both house and senate. There are many confusions regarding the same bills like the minimum wage will go up to $130,000 USD, etc.  Fact is that nothing has passed and there are very slim chances for them to get passed before start of FY 2018 season.     I just called up my school DSO to check my SEVIS status…she said there has been no change…is it safe to assume my application was not selected ?…This year is my last attempt

      You need to understand two things
      1) Change of status will take place if you qualify for cap gap. USCIS is in the process of updating it.
      2) Change of status will take place if you don’t qualify for cap gap but you made it to the lottery. In this case change of status happens when USCIS provides receipt number to your DSO through sevis account.

      And there is still a very good chance of your petition being selected in the lottery. Just believe in yourself and stay positive.

      My lawyer got a receipt but there is no change in my SEVIS status. SEVIS updates are quite inconsistent; I wouldn’t give up hope yet.


    On April 18, President Trump new Executive Order titled “Buy American and Hire American,” which, among other things, addresses the H-1B Specialty Worker program.

    First, we want to clarify that no immediate changes will occur with H-1B or other employment-based regulations due to this executive order.

    Instead, the relevant government agencies will begin reviewing employment-based visa programs and propose new rules and/or guidance, if appropriate. The order also calls for reforms to help ensure that H-1B visas are granted to the most skilled or highest paid applicants in an effort to create higher wages and employment rates for U.S. workers. Changes to the actual immigration regulations require compliance with federal rulemaking procedures, which can take months or years to unfold.

    The most immediate change may be an increase in government enforcement efforts, as the executive order directs the departments of Homeland Security, Justice, State, and Labor to crack down on fraud and abuse.

    Since 2010, the USCIS Fraud Detection and National Security unit (FDNS) has conducted both announced and unannounced inspections of the H-1B worksites. The revenue generated from $500 anti-fraud fees funds the FDNS unit. The goal of these site visits is to verify that the petitioning employer (e.g. Emory University) and the foreign beneficiary (e.g. H-1B employee) are fully complying with the terms of the previously approved employment petition. Government officials may visit with the employee at the worksite indicated in the H-1B petition, their supervisor, ISSS, or central HR as they handle H-1B LCA’s. Although it could be nerve wracking, site visits are not something that you should worry about as long as both the hiring department and the employee have stayed consistent with the exact terms and conditions of the previously approved H-1B petition.     The order also calls for the review of all trade agreements in regard to their impact on the domestic economy. It is too early to understand the possible impact of such reviews to the TN or E-3 categories. If there are future changes to those programs, they are likely to happen over a long period of time.

How stressed do you have to be to take this seriously? To make things even worse, I couldn’t care less if it’s check or cheque, cash or encash, because I’m a non-native English speaker myself.

    As per the latest update from USCIS, the guys who have mentioned ‘check’ instead of ‘cheque’ in this forum without actually being in USA (since its acceptable only in US) will not be shortlisted in the H1B screening process. Good luck… 👍

    This forum is only and only talking about ADs….. Every other..not even other… 3 out of 5 guys seems AD… People says 3rd time 2nd time… and keeps adding on numbers on applications…doesnt that mean out of 199k.atleast 100k would be AD this time??? I am so sure if they seperate this AD and NON AD lotteries without merging one in to another, the picture would me far better clear…

      No doesnt have to be. My DSO said that it may take up to 3-4 weeks for USCIS to update all the AD cases on SEVIS. So no need to panic until May 5.

        Bro the executive order is signed by Trump which is phase 1 i guess. In order for what he proposed to be effective there has to be approval for congress which takes time. This is not a one day thing and the lottery has already taken place, no one gets affected by this order for fiscal year 2018.

        Also you don’t even know the order is called executive order. You don’t even know the name “Buy american’s hire american” so this shit is on a different level and beyond you can understand as a matter of fact beyond any h1b applicant. including me.

    I am currently on H4 visa. I have filed a H1B this time through an employer. I am not sure if my application is picked. Can I travel to India in June ?

          H4 visa EAD holders can work full time or part time for any employer in any position or in any field. They can even start their own business of any kind.

            And if a computer programmer is really bad and low skilled (may be like few H1B’s), yes, McDonalds or KFC is the right place for him/her. On the other hand, I have seen many H4 and L2 EAD people working in US tech giants, all because of their skills and talent.

            “They can even start their own business of any kind”. That’s even better, they are actually creating jobs.

            Are you suggesting the H4 and L2’s are stealing jobs at McDonalds and KFC?

            Okay, so as you have made a generic comment for H4 holders, let me get some reality check for you since even I belong to H4 category.

            I came to India few months back leaving my 4 years of IT experience as I got married (leaving a job at Germany and my recent job where I was offered a skip level promotion ). I’m sure people would think why would someone leave such an offer, but yes I did and I’m proud of my choice today .

            Post coming to the United States, I was interviewed by several companies and out of which 4 were willing to file my visa and please note none of them were fake. However, since I knew I would be saying “yes” to only one, I refused others and chose only the one which was based out in our current location and wage level 3.

            I’m not AD, but I have a master’s degree in Computer Engineering which is like 18 years of education and a University topper. I have publications in International journals and conferences. I’m currently planning to pursue a research in US irrespective of whether I get H1B or not.

            And even now if you think I don’t deserve to apply for H1B, then all I’d say is “good luck to you”, you need to get sorted 🙂

            Very well said prerna..God knows what these h1b visa holders think of themselves…most of them I am very sure cant even write a single piece of algorithm and then say what not…and these Indian MNC s also use these resource s just to earn big bucks..so many deserving h4 s are there they should replace all these illiterate h1B s..

            Very well said Prerna. One can not make the generic statement about H4 holders as “People like you are ruining the chances for the hardworking genuine candidates”.

            Considering my friend case, she has got 7 years of experience in IT and worked with client at onsite (UK) and has the hand on of experience on the latest technology. Recently she moved to US on H4 and was interviewed by MNC company and they were willingly to apply for her Visa. So does it mean those people are not hard working genuine candidates. Well completing master in US and having five years of experience is equal to 7 years of experience in any industry.

            So one can not categorized, as H4 holders are also applying and due to which the chances of picking up the application is lessen for rest of the visa.

      If you applied for consular processing, yes, you can travel.

      If you applied for Change of Status(COS), you should’t travel until you get a confirmation on COS approval or non-selection in lottery. Doesn’t matter it is June or July or some other time.

      Better check with your attorney.

      USCIS announced on May 2, 2016, that it has completed data entry of all fiscal year 2017 H-1B cap-subject petitions selected in our computer-generated random process.

      So let’s wait till May first monday (May 1′ 2017) for checks to get cleared…or sevis to be updated..

      If you travel while extension is pending, the same will be abandoned due to I-94 change. Maybe you can return from your trip and then file for extension. I assume the visa is still valid.

        No, please do not give incorrect info.
        You should be in country while extension is being filed but can travel while it’s pending. I did the same and after my return I received my approval receipt. I traveled on advise of my attorney.

          Extension includes of 2 parts – 797 extension and I-94 extension. The former is not impacted by travel while the latter is abandoned if one leaves US while it is pending. That is why it is suggested not to travel while extension is pending. In case of H-4, it is only I-94 extension as the 797 is driven from H-1 holder’s status. So filing H-4 extension and then leaving US makes the extension irrelevant.

          In your specific case, the new approval receipt should have arrived w/o I-94 attached and another I-94 extension would have been applied.

    Hi, I am in F1 now. Today I called the DSO and asked if there was any change in my SEVIS. He said that he sees a change of status pending. Does that mean that I am selected in the lottery? Or could it be for other reasons? Thanks.

      Sevis page will also state the reason for change of status : i guess you automatically got cap gap which is the reason behind change in status. Check your status expiry date for opt/stem whatever you are on. it will say 09/30/2017 on sevis page. Good Luck

          i can only talk about students on F1 visa as i am one of them. The status changes for people n opt/stem. Two scenarios – DSO will update the status to pending if they qualify for cap gap extension which can be seen early in the h1b process. Scenario 2 if the opt/stem expires after 09/30/2018 the status change will only happen when the dso gets a receipt no for h1b case this happens later in the process may end to mid june. this is all i know so far. what is your current status ?? visa wise ?

Sure I agree that not everyone who comes to study in the US is as or more skilled than people from other countries but you fail to see the bigger picture that there are also candidates who are skilled with a bachelor’s master’s or even PhD degrees from the US who are unfortunate to secure visas just because those “MNCs” in India are exploiting the visa. We cannot blame people here. Everybody wants to achieve their dreams and nobody has the right to take it away from them. Blame the companies who are ruining the chances of the real talent (may it be in the US or abroad) just so that they can make more money. If these MNCs really care about their employees, they should pay them well enough to be competitive in the US market. You think these MNCs take a pay cut to send people to the US? NO! The US companies are still paying 100k for an Engineer 2 role. THese MNC culprits take away the majority of the pay leaving everyone to think that “cheap labor is replacing US workforce.” And if you think you know it all? Then you’re no more than a joke. Because these body shops will never ever tell you how much are you “ACTUALLY” getting paid. You are a fish in the ocean of MNCs and body shop predators. They catch you, they xploit you and they hang you out to dry.

    So stop blaming each other. Start blaming the companies that are in control of our future. Merit based visas will stop these companies from underpaying their employees. Sure the number of applicants might drop in the first few years but soon these MNCs will realize that it’s only hurting them to not send people to the US. And stop beating around the bush with AD and non AD crap. We all have the right to dream and live that dream. You think investing 30k in an advanced degree gives you the right to get a visa??? News flash: I paid about 85k to complete my undergrad in the US and still repaying the loans. I am not rich. I took two loans and worked my ass off taking 15-17 units a semester and working 2-3 jobs just to be at par with the cost of living. And this is my third attempt and I still have no idea if i would get the H1 or not.

    SO stop with the hate and hope that these so called reforms help genuine candidates get visas. May that be people in the US or abroad.

      To add to your point, someone’s dreams should not be dependent on some lottery. So the only feasible thing that can replace a lottery is merit based visas. And merit shouldn’t be automatically given to AD holders with STEM. We should have different pools. One for STEM and other for Non STEM. Because of course STEM is paid more. And then have criteria to allot visas for each pool. And give wage and degree equal importance. Because I know people with just a bachelors earning more than people with masters.

      But good going. I am with you on this. Its high time that we see some reforms.

      There are only two types of people; those who got picked and those who did not. Regardless what your story is, how skilled you are, or how much you deserve it compared to others. Fairness? Nothing is fair. Thats life… quit crying and deal with it.

    H1B (AD) – Has anyone heard from your immigration HR/lawyer that your case has been picked in lottery or the checked was cashed? The lottery was done last week…Y is it taking so much time for them to get the check cashed?? Please chime in your thoughts. By when can we expect that the data entry is completed? AD guys havent herad anything so far does that mean we did not get selected in lottery. One of my friends collegue heard from her lawyer on Monday… Im losing hopes! Please share your exp/thoughts.

      I am in the same boat, I contacted my attorney and she told me they haven’t heard anything about AD and Non AD both, and she feels its weird this time as she didn’t even heard from any of her peers too yet . She told me its taking time and I need to have more patience this time. Lot of my friends got receipts for AD last year in June and July too.
      So hope for the best and stay positive.
      Don’t need to panic by seeing some people post of cheque cashed, our numbers will come soon ,

      I got the receipt 2 days back. This is the 3rd time I am applying for the visa (AD cap). In my experience, it does take time to get the receipt, so don’t get worried. Its been only few days and there is no premium processing. So it can take sometime.

      Last year, receipts were issued well into May end (or maybe it was early June). So it would take time and patience is your best friend in such a situation.

      I haven’t heard anything from BAL and I guess they are pretty slow on this. This is my 3rd year experiencing with them and they are little behind on updates depending on the attorney assigned.

      Hope for the best.

          Jack, honestly I don’t know. I was not selected in previous years but if I remember some of my company’s folks say they got some info in couple of weeks.

          So sit tight, the rumor is May 11 the last day for receipt so let’s see.

    By reading all the desperate and negative comments on blog, I have got negetive feelings about the whole ‘working in US’ program. Now, it won’t bother me if I would not get selected in lottery… Mind peace… (^_^)v

      Wish you had come to this decision before sending in your H1B application in the first place. Would have given some others peace of mind.
