As many of you know, H1B Visa 2015 quota was over in the first week and a whopping 172,500 H1B petitions were received in first week by USCIS.  H1B Lottery / random selection was held by USCIS to select 85,000 H1B petitions to fulfil the work permit cap. Many of the unlucky ones are already wondering about next year H1B Visa quota. Also, some of you are planning for H1B visa for next year, you also would be wondering regarding the same. This article addresses many of the common questions, it will be updated constantly, whenever any changes to info.  Bookmark this page !  To start with, firstly the news updates on this season, followed by many commonly asked questions.

When will the H1B season for fiscal 2016 begin ?

USCIS will accept petitions for H1B Visa 2016 season starting from April 1st, 2015.  USCIS did a press release on March 12th outlining the details. Read summary of press release by USCIS on H1B 2016 .

Will there be lottery again for H1B Visa 2016 ? Predictions ?

We had lottery for FY 2015 and FY 2014. The total number of petitions filed for FY 14 were about 125,000 and for  FY 2015, there were about 172,500 petitions… As H1B Quota did not increase for FY 2016, and the demand does not seem to decrease, we would very likely have lottery for FY 2016.  Read H1B Visa 2016 Lottery Predictions, Dates, Results

What is the H1B Visa quota Cap Count ? Would there be any changes to H1B 2016 count ?

H1B Visa quota cap count is the total number of petitions that USCIS will accept for a fiscal year to provide temporary work permit for highly skilled workers.  For the 2016 fiscal year, the cap count is as below :

  • Regular H1B Quota : 65,000
  • H1B Masters Degree Quota ( only US Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

As per the press release in March 2015, the quota did not increase.  To give some background, as per the Obama executive action in Nov 2014, no changes were announced to the H1B Cap count. There was proposal in 2013 to increase H1B cap from 65,000 to 110,000 and Masters quota to increase from 20,000 to 25,000 did not go through as of March 2015. At least, for this FY 2016 season, the quota is fixed and it will be as above and no changes.

When should I start planning for H1B Visa 2016 ? What are the steps ?

It depends on your situation. Below are few scenarios and your plan.

  • If you are a student on F1 Visa in USA, you need to plan for your internship/ CPT or OPT employment  at a company that can sponsor your H1B Visa for FY 2016. In my view, you should start now to find something for the fall 2014 and continue that for next spring so that you can file for FY 2016
  • If you are in other country and planning for H1B, it is good to start your process around the end of this year 2014. It will give you enough time to find sponsors, search for job, etc.
  • If you are on H4, L1 or other visa in USA and planning for H1B for FY 2016, you also should consider looking around end of this year i.e. December 2014.

Most asked Question – How do I Find H1B Sponsors for FY 2016 ?

This is a million dollar question !  One of the biggest challenges is to find a good sponsor that can offer you a job and wait for you to start work after 6 months of filing your petition.  You should review the detail article on How to find H1B Sponsors for FY 2015. What about Comprehensive Immigration Reform ( CIR) – H1B Visa Changes ? What are they ?

There have been some proposed changes to the H1B Visa program to cater to the demand in the  US economy as part of the Comprehensive Immigration reform. Below are some of the proposed changes.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

These were proposed in 2013, but nothing has moved significantly and all the above are just proposed rules. We are not sure when they will be implemented. You can read  Summary of CIR – Immigration reform – H1B Visa and Green Card  to get an idea. The latest update is that Obama has taken executive action on Immigration in Nov  2014  and none of the below are included as part of that.  Stay tuned for updates.

H1B Visa 2016 Fees – Any changes ? How much does it cost ?

There are various components of the fee. The H1B Application filing fee could range anywhere from $1,600 USD to $4,400 depending on the size of the company. The attorney fee can range from $500 to $3000 depending on the attorney. If you apply for premium processing that is another $1,225. The fees has not changed in the past couple of years for FY 2014 and FY 2015. Unless USCIS revises fee based on immigration reform, it should be same. We will keep you all posted. H4 Visa EAD rule impact on H1B Visa 2016 Season ?

As you know, certain H4 visa holders are now eligible for EAD. The H4 Visa EAD Rule Passed earlier in 2015 and is effective from May 26, 2015.  USCIS will start accepting applications for EAD from those eligible H4 visa holders starting from May 26th. The question is that will that have an impact on number of H1B petitions for this fiscal year  ?  It very likely will have certain impact on the number of H1B applications that are filed for this year 2016 quota. Many of the H4 holders, who would now be eligible for EAD, may not apply for H1B visa, just because it gives them more flexibility to work and more choices to work as well. We would have to wait and see, how much of an impact that would have, but it is very straightforward and no brainer for eligible H4 visa holder to avoid the H1B processing.

H1B visa Premium Processing Changes to H1B Visa 2016 quota ? 

USCIS updated in their press release that the premium processing will be accepted for FY 2016 quota and they will only begin that “no later than May 11, 2015”. What it means for the petitioners is that the official 15 day premium processing clock starts from May 11th, 2015 and their petition could be adjudicated within 15 days from May 11th, which would be May 26th, 2015.  USCIS can process them earlier as well, but their new timeline is just indication for setting the right expectations to meet the stipulated time frame for premium processing.

  1. As you have notice on this forum that I am not the only one to file multiple applications. Expect advance degree applications to be in the range of 50K – 60K and total applications in 220K – 250K due to be announced anytime today. Ouch!

  4. Folks, does anyone know a case where USCIS cashed the check then refunded previously? How do people know that check cashed means lottery selection? Thinking again it looks they can cash the check while intaking petitions for lottery. Just wondering as I cannot see how people are so sure about this?

    • the check can only get cashed when you get selected in the lottery otherwise why will they en cash the check…they are supposed to return all applications that never got selected.

    • This kind of action significantly reduce legal worker who has specialized knowledge and only submitted one petition to get the visa. If don’t prevent these cheaters, fewer innovative workers are able to go to US and will weaken US’s science & economic power and ruin US ethic & legal system.

    If there isn’t it might be a good thing. USCIS might be cracking down those fake applications and those fraudsters better brace themselves. Tremble! Do not forget to sign the PETITION everybody!! Even if it did not work out this year, it might help future applicants! Uncle Sam won’t give a d*** if we do not fight for it.

    • At least it will get the response from White House if it crosses 100k signatures, and at that point we may see some news on internet mentioning this petition, and those people who plan to take this illegal step next may have to rethink carefully before making such unfair and unethical decision

        • My brother is a law student in top school. He said that that one person is signing many times this is not legal at all.

          There is no authentication of the people that one sign is equal to one person.
          Secondly this page is meant for the US citizen and not the one who are not the citizen.

        • Dude… I think there is no wrong in applying multiple petitions from multiple employers, there is no law to prevent that unless if they are duplicate, fake offer letters, fake details… If they, USCIS definitely track them down and will take an action… Understand what i said in above comment…

        • We worked hard in our master’s, presented so many technical papers, worked on our master’s thesis while some of those brats doing nothing and waiting to join a consultancy after their graduation. We have gone through so much hell during our job search while these rats were busy preparing their fake resumes. And when it comes to H1B time, they just simply file multiple applications through some cheap consultancies just to increase their chance in the lottery and knocking away our opportunities. I’m not going to stop this issue here irrespective of the lottery results.

  8. I have put 6 applications from different employers. 2 employers who had premium told that my check is en-cashed.
    Now I have 4 left -3regular 1 premium…I’m crossing my fingers..!! Hope they get picked as well

  17. Last year aournd 10th apr , news came about lottery and numbe rof petitions. Lets hope by today EOD we get to know this info. Also there is a planned maintainence activity in USCIS for their systems etc. If not today than next week we should get some news. Also every company that participates in the program gets a fair chance in lottary. If this is true than certainly whereever there is a company applying limited number of visas for that company the probability is better. Also my guess is that USCIS must be coming up with some percentage formula, for e.g if number of companies and petions are large than from each company pick lets say 30% of applications. If number of particiapting companies and total petitions is less than take more percentage from each company. At the end of the day USCIS has to distribute 85000 visas among all the participating companies and not individuals. Here “Company” is the key.
    This is just my guess, but really don’t know if this is correct.
    But again if USCIS gives a fair chance to all particiapting companies than , don’t you guys think my presumption stands atleast half correct. 🙂

    • Yes ! I am also seeing the same trend from last few years. Every company get some percentage of H1B.

      Last to last year in my company 50% of the candidates were selected and last year the ratio was around 40%.

      I never saw any employer big or small didn’t get no lottery.

      • Well if that is the case than less the number of petitions from your company more the chances of you getting the visa. I am jus trying to make a guess on the lottery algorithm.

      • Moreover if it is computer generated lottery than there must be an algorithm, there must be some logic based on some input parameters. Lets think it this way…… pick candidates from this pile of data while ensuring atleast one candidate is picked from each company.
        Also if USCIS is doing a check on fake/multiple petitions after lottery than that means lottery is fair for all companies.

    • Last year, my company filed h1b for me. It was the only h1b petition from my company. But I did not get through in the lottery. So I dont think USCIS gives equal chances to all the companies. Its just a random lottery. Otherwise my application would have picked last year itself..

  18. I have two requests for the USCIS

    (1) Please stop the fake multiple petitions. There are few correct cases please take care of them.
    (2) The people who are signing on the page as said in these blogs. There is no authentication as many people are signing by creating fake logins. Please do not treat that page as legal. This is good who has created that page has given a link of this blog website. If by any chance the Obama administrator look into these blogs they all came to know every one is fake and they have to decide and create good laws so that there is no flaw in the H1B lottery.

  19. I think the USCIS is going to inform today. The results and lottery which was already done has communicated to every one by today.

    Keep your seat belt tight. The USCIS plane is going to take 85000 candidates to US and for few to change the status from Opt to H1B.

  21. I had signed 100 times and even last year also the same process was started. Nothing has happened.

    Tell me one thing, most of the guys who are filling for the H1B is not in US they are filling outside US except the candidates are on OPT or on working on different VISA’s.

    Any government created a page for their citizens and not for others like Russian guys are not suppose to ask the government of US how they have to work and how they have create the laws.

    Please use your MIND as this is just a waste of time and effort. The best is to called USCIS who own this process and know every thing. But only attorneys or the employers can raise this voice.

    Please use the MIND and than work further. Rest every one is free and good to take the right decisions.

    • It should not matter. You just try your best and if the result is not as you expected, you still feel that you do something good for yourself and other honest people. I’m sure even if we reach a 100000 signature mark and the government does not give us a satisfied answer, it still makes them do more scrutiny on unfair activities

        One person has to sign once but most of them signing many times like one employee more petitions and one person signing many times.

    • Since most people filing multiple petitions are from overseas, per I know many honest students inside US (whose hard working got or will get hurt because of such petitions) are signing it. These honest people (including honest ones not present in US yet) also most likely get green card sponsorships and become future US citizens comparing those who fake petitions.
      In addition, some of my green card holder and US-born friends also signed and shared this because they witnessed friends losing jobs at Silicon Valley to lottery and understand the pain (how surprise someone not just thinking about themselves!).

      I only spent 5 sec signing it with my real name and email, so I’m not losing much if it doesn’t get thru. People who claim having signed 100 fake ones (actually I don’t believe they did) and then complaining it’s a waste time just deserve it. No one is forcing you doing that.

      As for Russians and other non-citizens taking over US legislations, pew, let the Republicans worry about it.

    USCIS know the rules and regulations as they said they are filling from years and know each and every thing.

      Obama administration is not going to share the email ids with anyone or going to take any action just because you signed a petition. I have never heard anybody afraid of signing any petition here in US.

This petition might be bs but I think the whole point of democracy is allowing people standing up for their own benefits… So the big brother gets honest ideas from every stakeholder and make decision that benefits the most. The personnel from USCIS might get annoyed by your call, but if they avenge you because you question how they function… Well then I’ll just go back to my home country. Sounds no difference there :/

        • I don’t know how White House is going to prevent the fake signatures. Anyone, including US citizens filing for other petitions could fake on this website (perhaps some people in this forum are more interested into faking things).
          However, I don’t think White House is dumb enough to not consider this. They could have simply asked people to sign based on SSN but they didn’t so I guess they do works behind the scene. You are welcome to create a petition concerning this though.

    • There is nothing wroing signing this petition. There was even the case people signed the petition asking the White House to file a lawsuit against Obama’s administration. I’m sure if this petition reaches 100,000 signatures then it has pretty strong weight on the way USCIS considering multiple filings. Even later on they can revoke the approved petitions and apply a stricter rules. It’s not bullshit but a very appreciative step

  23. McKain is a fraud guy. He is saying every one to sign but he is one of the coward person in this whole blogs.

    He asked us to call in the USCIS helpline and I called them. They had collected all the details and called my attorney.

    Please do not believe on this guy known as McKain. Folks use your mind before doing a small step.

    Even though we had filed one petition please please do come in the words these spy people.

    • If you filed your visa legally, then you attorney should not be afraid of being called by USCIS.

      I cant see any logical correlations. You called USCIS and they want to call your attorney so you think that sir is fraud?

      Did he say if you call USCIS they will never record details and call your attorney?

      Besides, you have no proof.

      So pls, sit back and enjoy, stop spreading rumors, stop saying others are fraud.

      • USCIS said that we know the rules and regulation. Stop calling us and collect my complete details.

        If you need to check, please call to the USCIS helpline and tell this whole process which we had started. This gives you the confirmation whether who is wrong and who is fraud.

        I had also signed on that page 100 times by different accounts so that the signature number is going to increase.

    • Why are you so afraid of giving your details when you haven’t done anything wrong? I’m assuming that whoever tried to call USCIS have genuinely filed their H1B petition. So please stop spreading rumors. And I request all the others to atleast sign the petition if you dont want to call USCIS. I think its working well.. lets move forward..

  24. I’ve been working in US for last 5 years. i know my grammar is little poor.( it was more worse when i landed in US 5 years ago :>) .
    People are here trying to signal their expertise, because being able to identify mistakes indicates that you know more about something than the person who committed the error. Would be using the wrong form of there be considered bad grammar? in my whole experience none of the US citizens tried to correct my grammar. that’s the Indian attitude. If you think, speaking good English is the only way to enter US, then please change your mind. if so they don’t need Indians. In US even the beggars speak English. They need Indians bcos of our brain, programming skill, mathematical knowledge, the way we are solving problems. ENGLISH IS A LANGUAGE NOT A KNOWLEDGE.

  26. USCIS will not not waste seats

    Employer can select employee and employee can select employer. Employer and Employee has equal rights. Be patience & this is USA, you will get justice.

    If 5 employers visa got approved for same candidate still it is counting as one.
    It will subtract/minus one from quota.
    Uniqueness maintained by composite/candidate key “passport number, Date of Birth and Country of citizenship”.

      They do not even have lottery for their states. You can directly get the visa for few states in India.

  27. Alright…Say whatever you want after reading this, but here is an authentic peice of news USCIS will be announcing-
    All the Advannced petitions not selected this year in the lottery will go into the pipeline for next year’s visa allocation. So they will have a priority over the fresh applications next year.
    But the important thing to note here is that this is only valid for Advanced petitions, not for regular.
