As many of you know, H1B Visa 2015 quota was over in the first week and a whopping 172,500 H1B petitions were received in first week by USCIS.  H1B Lottery / random selection was held by USCIS to select 85,000 H1B petitions to fulfil the work permit cap. Many of the unlucky ones are already wondering about next year H1B Visa quota. Also, some of you are planning for H1B visa for next year, you also would be wondering regarding the same. This article addresses many of the common questions, it will be updated constantly, whenever any changes to info.  Bookmark this page !  To start with, firstly the news updates on this season, followed by many commonly asked questions.

When will the H1B season for fiscal 2016 begin ?

USCIS will accept petitions for H1B Visa 2016 season starting from April 1st, 2015.  USCIS did a press release on March 12th outlining the details. Read summary of press release by USCIS on H1B 2016 .

Will there be lottery again for H1B Visa 2016 ? Predictions ?

We had lottery for FY 2015 and FY 2014. The total number of petitions filed for FY 14 were about 125,000 and for  FY 2015, there were about 172,500 petitions… As H1B Quota did not increase for FY 2016, and the demand does not seem to decrease, we would very likely have lottery for FY 2016.  Read H1B Visa 2016 Lottery Predictions, Dates, Results

What is the H1B Visa quota Cap Count ? Would there be any changes to H1B 2016 count ?

H1B Visa quota cap count is the total number of petitions that USCIS will accept for a fiscal year to provide temporary work permit for highly skilled workers.  For the 2016 fiscal year, the cap count is as below :

  • Regular H1B Quota : 65,000
  • H1B Masters Degree Quota ( only US Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

As per the press release in March 2015, the quota did not increase.  To give some background, as per the Obama executive action in Nov 2014, no changes were announced to the H1B Cap count. There was proposal in 2013 to increase H1B cap from 65,000 to 110,000 and Masters quota to increase from 20,000 to 25,000 did not go through as of March 2015. At least, for this FY 2016 season, the quota is fixed and it will be as above and no changes.

When should I start planning for H1B Visa 2016 ? What are the steps ?

It depends on your situation. Below are few scenarios and your plan.

  • If you are a student on F1 Visa in USA, you need to plan for your internship/ CPT or OPT employment  at a company that can sponsor your H1B Visa for FY 2016. In my view, you should start now to find something for the fall 2014 and continue that for next spring so that you can file for FY 2016
  • If you are in other country and planning for H1B, it is good to start your process around the end of this year 2014. It will give you enough time to find sponsors, search for job, etc.
  • If you are on H4, L1 or other visa in USA and planning for H1B for FY 2016, you also should consider looking around end of this year i.e. December 2014.

Most asked Question – How do I Find H1B Sponsors for FY 2016 ?

This is a million dollar question !  One of the biggest challenges is to find a good sponsor that can offer you a job and wait for you to start work after 6 months of filing your petition.  You should review the detail article on How to find H1B Sponsors for FY 2015. What about Comprehensive Immigration Reform ( CIR) – H1B Visa Changes ? What are they ?

There have been some proposed changes to the H1B Visa program to cater to the demand in the  US economy as part of the Comprehensive Immigration reform. Below are some of the proposed changes.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

These were proposed in 2013, but nothing has moved significantly and all the above are just proposed rules. We are not sure when they will be implemented. You can read  Summary of CIR – Immigration reform – H1B Visa and Green Card  to get an idea. The latest update is that Obama has taken executive action on Immigration in Nov  2014  and none of the below are included as part of that.  Stay tuned for updates.

H1B Visa 2016 Fees – Any changes ? How much does it cost ?

There are various components of the fee. The H1B Application filing fee could range anywhere from $1,600 USD to $4,400 depending on the size of the company. The attorney fee can range from $500 to $3000 depending on the attorney. If you apply for premium processing that is another $1,225. The fees has not changed in the past couple of years for FY 2014 and FY 2015. Unless USCIS revises fee based on immigration reform, it should be same. We will keep you all posted. H4 Visa EAD rule impact on H1B Visa 2016 Season ?

As you know, certain H4 visa holders are now eligible for EAD. The H4 Visa EAD Rule Passed earlier in 2015 and is effective from May 26, 2015.  USCIS will start accepting applications for EAD from those eligible H4 visa holders starting from May 26th. The question is that will that have an impact on number of H1B petitions for this fiscal year  ?  It very likely will have certain impact on the number of H1B applications that are filed for this year 2016 quota. Many of the H4 holders, who would now be eligible for EAD, may not apply for H1B visa, just because it gives them more flexibility to work and more choices to work as well. We would have to wait and see, how much of an impact that would have, but it is very straightforward and no brainer for eligible H4 visa holder to avoid the H1B processing.

H1B visa Premium Processing Changes to H1B Visa 2016 quota ? 

USCIS updated in their press release that the premium processing will be accepted for FY 2016 quota and they will only begin that “no later than May 11, 2015”. What it means for the petitioners is that the official 15 day premium processing clock starts from May 11th, 2015 and their petition could be adjudicated within 15 days from May 11th, which would be May 26th, 2015.  USCIS can process them earlier as well, but their new timeline is just indication for setting the right expectations to meet the stipulated time frame for premium processing.

      • on an average you need 3333.3 petition signatures a day to reach that target goal. Given that most people on these forums have signed for them, thats a tall order to reach, but if we have same number of applications as last year and if everyone signs this, we might be upto something.

To all Non Advance Degree folks out there, please attend a course of GRE/TOEFL/IELTS to enter this land. Don’t make it another India, speaking in Hindi, Telgu, etc in office while sharing the room with native Americans. You have come here for a living and not to advertise regional languages.

  11. Last year i was cheated by my employer, i thought he had applied my H1b but he didn’t later i came to know that. I was waiting for my receipt all through April and never received it(had rough nights couldn’t sleep). Employer finally told me that we are no more receiving receipts for AD PP, told me that your application was not picked in the lottery better luck next year. This year i applied again and it is my last chance. I have no interest in going back to school, i will be happy if my application goes through the lottery even if it doesn’t i will accept it and go back to INDIA and find a job which suits my profile. I have realized that working in USA is not the only thing in life there is much more beautiful life ahead. I will carry all the memories and experiences in my heart if i had to go back all the rest of my life which made me a strong and better person. Just thought to share with all the beautiful people out there.. All the best for everyone

      AD din’t said that Lottery is Finished. He just gave us a fake NUMBER, without any proof. He said it’s an official news…. how official it is? No updates on USCIS website.

      And if your application was selected in the Lottery, you would be jumping like crazy.. (and if the amount is withdrawn/cashed out. .. then the application is selected and processing on that application is started. But you can again say.. ” I think the lottery is done” .. You are not sure? ..

  16. Hey Guys, Just wanted to share my joy. I applied 10 H1B petitions this year from 10 different employers as I had 10 different offers from MNCs and to my pleasant surprise all 10 got selected in the lottery. I had job offers from these MNCs

  18. Every year, apart from 85K applications, USCIS will also select few applications (around 20K, not sure on exact count) and put them in waiting list.
    Waiting list application will get selected in two cases below
    1. Waiting list application will get selected if any of H1B application is rejected which are selected in lottery.
    2. If multiple applications submitted by one person, finally he can choose only one. Other employers who filed H1B will cancel his/her applications .Those who are in waiting list, will get selected when his/her other applications cancelled.
    So the bottom line is do not loose your hope until you receive the H1B package back. You never know your application will be selected at the last minute as well.

      • Hi.. I don’t want to discourage you but last year one other guy started the exact similar petition. It got 3k – 4k signs only. We do need 100k signs.

        P.S. :- I filed h1 last year. didnt made it through the lottery. This year also i filed again. I am US AD.. i also singed the petition last year and i also i signed it again today…

    If 5 employers visa got approved for same candidate still it is counting as one.
    It will subtract/minus one from quota.
    Uniqueness maintained by composite/candidate key “passport number, Date of Birth and Country of citizenship”.

    • Well. But here people are filing multiple for better chances. Mostly by paying to Desi consultencies.

      Of course multiple applications improve chances compare to single in lottery.

      my friend who is last in my class ( completed degree in 7 years ) got through lottery system and in US now. He had applied thru 3 consultencies. USCIS computer / immegration system says he is the best? Its completely broken system.

      I have applied again this year. Same single petition. Will see if selected.

      I don’t where my other post disappeared. But I am posting it again.

      I am planning on sending a letter to the white house and ICE regarding the current immigration trend( multiple petitions, Universities offering CPT from day 1, SAP consultancies etc..). People who are genuine and concerned about whatever is happening here, please spend 1 hour of your time and send a note to USCIS and ICE. If we generate enough interest and if USCIS and ICE gets enough letters, we might be able to get their attention and they might do something. I am going to send the letter today.

    • I dont think this will help you. Stop Infosys(applied 25000 applications), TCS(22000 applications), Wipro(14000 applications) applied H1b last year. These are the big MNC’s misusing the quota.

    Last year, I heard two cases.

    1. A person who applied two petitions, one as RP, one as PP and both accepted.

    2. A person who applied two petitions, and both got rejected.
    Reason for rejections: RFE : Why did you choose two employers and what is your preference to both the employers, he replied I prefer A company over B, then USCIS again asked question why did not you choose this employer before applying H1.

    Finally USCIS not satisfied with the answer he has given and both got Rejected.

    So, in my opinion, these multiple employers issue is person to person who approves the petition.

        • agree.. wish we had something like when injustice happened over the years and we suffered a lot due to the fact of multiple filing, my wife two jobs due to lottery in consecutive years, she is been jobless though top banks in US were ready to hire her and applied the visa as well but no one could do much due to so many people are desperate and spoiling a lot of careers than some of the dummy consultant. I agree the workforce comes from lottery may be not be 100% deserving people. I have seen here, some people don’t even deserve to be in country but they came and surviving.. good initiative. Noble approach

    But whats the issue when multiple company apply for same alien.

    This is petition is absolutely wrong and you guys do not understand the ground rules. See my reply below I posted it already.

    Guys, I have been seeing there are so many perceptions from everyone on duplicate filings from different employers.
    I would say that these applications are not going to be scrutinized (except fake consultancies) . It is absolutely valid. Bear in mind, according to USCIS H1b is not for EMPLOYEES, its for the US EMPLOYERS who can avail the foreign workers when there is no availability of local workers. In that way USCIS should give equal chance to all the employers in the lottery and whoever got luck will get selected. So there is no way of neglecting the duplicate applications if comes from different employers until unless it is found fake. Hope you understand guys!!!.

            The law permits a foreign national to be the beneficiary of more than one cap-subject H1B petition, provided that there is a legitimate and actual business need for each petition. This means, for example, that two unrelated companies could file H1B cap-subject petitions for the same beneficiary for separate positions. This also means that two related companies may be able to file for the same beneficiary. These two companies, however, must each be prepared to establish that there was a legitimate, actual business need for filing both petitions. If they cannot establish such a need, both petitions typically would be denied, and/or prior H1B approval could be revoked by the U.S. Citizenship and Immigration Services (USCIS).

        • Yes the law permits because it has to consider special some cases as it states. But it also leaves space for dishonest people to utilize the breach. Such things happen to every law. I don’t think USCIS should ban entirely due to the special cases, but I also don’t think it is right for people to utilize the breach for their own sake.
          Both companies would have right to get the candidate, that’s why they can interview them, making offers and negotiating compensations. All these should happen before H1B petition. If it is true that the petitions is only for employer’s sake and has nothing to do with individuals, the lottery should happen even before they recruit any specific person… Then Microsoft and 600 for example Google get 620 and they could find qualified candidates to fill out these slots. If they need more sorry they are bad luck; if they don’t need that many the slots get wasted (as they are now), or ideally re-allocate to companies that need them.

      • @Vijay: Hey buddy….we are not against multiple petitions ,in case you din get that yet!! We are against fake duplicate applications, and I think that is completely against the rule! IF ITS A LOTTERY, USCIS HAS TO ENSURE THAT ONLY GENUINE APPLICATIONS GETS IN THERE…or some other action that can yield a similar result where everything is fair and square…Thats what we are shouting for…

      • Guys.. I am pretty sure this is a known issue with USCIS.. getting enough signatures to show support is the right way to go about this issue in the long run. We as stakeholders need to show we do care about this problem and want the governing body to do something about it.. Having said that, calling may not get the desired results, as its a more long term thing, I feel.. good luck!

    I am also going to send a letter to White House, USCIS and ICE about the current immigration trend . If these organizations receive one letter they might ignore it. What if they receive 1000s. People please spend 30 minutes of your time to send a letter or an email to any or all of these organizations.

    I don’t know if this will work. But I am going to try. I encourage people to give this a shot.

    I can sign as many times on it ? What is an authentication of this report ? Please explain so that this report can become LEGAL ?

      • But its too late and who can authenticate that one candidate signed on this page. I can sign many time. How can this be authenticated that one person is signing once ?

        • I think it accepts only one signature from one IP address.. But not sure..

          Yeah I know that its too late.. atleast if we could gather enough signatures, they might look into this issue and plug this loop hole.. Just spread this msg to as many people as you can.. thats all we can do.

        • I’m sure White House has thought about it already. That’s why you need to submit First and Last Name, Email addr, and verify through your email account… Of course any good hacker could hack through the system though… maybe you could prove your skills through this…

    • I think you misunderstood the petition…Its not against multiple applications but against fake/multiple fake applications. These applications doesnt even deserve to be in the lottery…thats what we are shouting for!!

    • Yeah let’s think from the employer’s side. Microsoft filed for an employee so they can get a good skilled talent. They got the permissions from US government. Instead of showing up and creating value for Microsoft, this talent wrote an email saying sorry, I am going to Amazon and screw you. So for the employee, he still get a job at a reputed company, high payrate and potentially green card slot; However as an EMPLOYER, Microsoft gets nothing but wasted months of time and effort recruiting this dishonest person. So based on your explanation, all companies should ally to sign this petition and I am sure we will reach the required signature number easily.
