As many of you know, H1B Visa 2015 quota was over in the first week and a whopping 172,500 H1B petitions were received in first week by USCIS.  H1B Lottery / random selection was held by USCIS to select 85,000 H1B petitions to fulfil the work permit cap. Many of the unlucky ones are already wondering about next year H1B Visa quota. Also, some of you are planning for H1B visa for next year, you also would be wondering regarding the same. When will the H1B season for fiscal 2016 begin ?

USCIS will accept petitions for H1B Visa 2016 season starting from April 1st, 2015.  USCIS did a press release on March 12th outlining the details. Read summary of press release by USCIS on H1B 2016 .

Will there be lottery again for H1B Visa 2016 ? Predictions ?

We had lottery for FY 2015 and FY 2014. The total number of petitions filed for FY 14 were about 125,000 and for  FY 2015, there were about 172,500 petitions… As H1B Quota did not increase for FY 2016, and the demand does not seem to decrease, we would very likely have lottery for FY 2016.  Read H1B Visa 2016 Lottery Predictions, Dates, Results

What is the H1B Visa quota Cap Count ? Would there be any changes to H1B 2016 count ?

H1B Visa quota cap count is the total number of petitions that USCIS will accept for a fiscal year to provide temporary work permit for highly skilled workers.  For the 2016 fiscal year, the cap count is as below :

  • Regular H1B Quota : 65,000
  • H1B Masters Degree Quota ( only US Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

As per the press release in March 2015, the quota did not increase.  To give some background, as per the Obama executive action in Nov 2014, no changes were announced to the H1B Cap count. There was proposal in 2013 to increase H1B cap from 65,000 to 110,000 and Masters quota to increase from 20,000 to 25,000 did not go through as of March 2015. At least, for this FY 2016 season, the quota is fixed and it will be as above and no changes.

When should I start planning for H1B Visa 2016 ? What are the steps ?

It depends on your situation. Below are few scenarios and your plan.

  • If you are a student on F1 Visa in USA, you need to plan for your internship/ CPT or OPT employment  at a company that can sponsor your H1B Visa for FY 2016. In my view, you should start now to find something for the fall 2014 and continue that for next spring so that you can file for FY 2016
  • If you are in other country and planning for H1B, it is good to start your process around the end of this year 2014. It will give you enough time to find sponsors, search for job, etc.
  • If you are on H4, L1 or other visa in USA and planning for H1B for FY 2016, you also should consider looking around end of this year i.e. December 2014.

Most asked Question – How do I Find H1B Sponsors for FY 2016 ?

This is a million dollar question !  One of the biggest challenges is to find a good sponsor that can offer you a job and wait for you to start work after 6 months of filing your petition.  You should review the detail article on How to find H1B Sponsors for FY 2015. Your first place of start is to find the H1B Sponsors in an area or by company. Use our H1B Visa Sponsors Database to search and filter. What about Comprehensive Immigration Reform ( CIR) – H1B Visa Changes ? What are they ?

There have been some proposed changes to the H1B Visa program to cater to the demand in the  US economy as part of the Comprehensive Immigration reform. Below are some of the proposed changes.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

These were proposed in 2013, but nothing has moved significantly and all the above are just proposed rules. We are not sure when they will be implemented. You can read  Summary of CIR – Immigration reform – H1B Visa and Green Card  to get an idea. The latest update is that Obama has taken executive action on Immigration in Nov  2014  and none of the below are included as part of that.  Stay tuned for updates.

H1B Visa 2016 Fees – Any changes ? How much does it cost ?

There are various components of the fee. The H1B Application filing fee could range anywhere from $1,600 USD to $4,400 depending on the size of the company. The attorney fee can range from $500 to $3000 depending on the attorney. If you apply for premium processing that is another $1,225. The fees has not changed in the past couple of years for FY 2014 and FY 2015. Unless USCIS revises fee based on immigration reform, it should be same. We will keep you all posted. H4 Visa EAD rule impact on H1B Visa 2016 Season ?

As you know, certain H4 visa holders are now eligible for EAD. The H4 Visa EAD Rule Passed earlier in 2015 and is effective from May 26, 2015.  USCIS will start accepting applications for EAD from those eligible H4 visa holders starting from May 26th. The question is that will that have an impact on number of H1B petitions for this fiscal year  ?  It very likely will have certain impact on the number of H1B applications that are filed for this year 2016 quota. Many of the H4 holders, who would now be eligible for EAD, may not apply for H1B visa, just because it gives them more flexibility to work and more choices to work as well. We would have to wait and see, how much of an impact that would have, but it is very straightforward and no brainer for eligible H4 visa holder to avoid the H1B processing.

H1B visa Premium Processing Changes to H1B Visa 2016 quota ? 

USCIS updated in their press release that the premium processing will be accepted for FY 2016 quota and they will only begin that “no later than May 11, 2015”. What it means for the petitioners is that the official 15 day premium processing clock starts from May 11th, 2015 and their petition could be adjudicated within 15 days from May 11th, which would be May 26th, 2015.  USCIS can process them earlier as well, but their new timeline is just indication for setting the right expectations to meet the stipulated time frame for premium processing.

    I have been reading through the blog posts everyday….several times in a day. This is my 2nd attempt this year. Last year i applied under Non-AD/RP/VT and was not lucky to get through. This year i was hopeful and positive to get through under Non-Ad/PP/VT however still haven’t heard anything yet. Is it game over for PP candidates? Some are telling me to wait until May 11th. Disheartened…..luck is more important than hard work apparently…..

  3. USCIS cashed the checks on April 27th but have still not received a receipt. I did only one application. How long does it typically take to get the receipt after the check are cashed?

  4. Cognizant Global Mobility team is giving goosebumps by sending emails with subject “H1B Conversion Notification”, “H -1B Visa – Important Update !” today. Opened the emails expecting a good news, but both turned out too be a broadcast message to everyone!!!

    • Same status here. My colleagues in same project received the selection mail . I have not received. Its Vermont/RP/NonAD. Seems no chance for me 🙁 . seems long wait ended in rejection only.

    • I’m also from Cognizant. How do we know that whether they filed in Vermont or California? Does our H1B Nomination APP Show that? And, by the way, what i see in this forum, Vermont usually delays in sending receipts.

    • My manager told me that Onsite OOC has already received receipts .Next week they will send mails.I think managers know who are selected .they are not sharing .

    Please help me understanding if I got a receipt number something like W..15….(13 digits), is my application already selected in lottery(as it seems from some comments) or they give it to everyone.

  8. NonAD/RP/VT – Cheque encashed yesterday. I think for RP it has just started. Employer told that just 4 out of 45 have cheque encashed till now. But not a single receipt received yet. So don’ worry guys.

    • Hi! Thanks for your comment. The average number of candidates that will be selected out of the 45 from your company is 13.5 assuming that the lottery has a 30% success rate (the mean of a binomial distribution with N people and p probability is Np). If only 4 people from your company had their checks cahsed so far, that means the Vermont Service Center is roughly 30% done with NonAD/RP (dividing 4/13.5).

      Bottom line: NonAD/RP/VT candidates that haven’t heard anything still have hope. This is not a surprising result, given that we’re not even in May, but it’s good to confirm with some numbers.

  11. AD/RP. Got selected in the lottery. My employer informed me yesterday that my petition was selected and they will send me the recipt in a few days. I wish everyone luck.

  12. Got my PP approval email from my attorney today.

    Interesting information is, I never received my receipt number mentioning my petition was picked in the lottery. I was totally believing that I did not get the visa this year. But, somehow got the “approved” email yesterday.

  13. Having a backup plan B always helps

    1. If you are Masters STEM with OPT left. Just extend and stop crying here.
    2. If you are Masters STEM but NO OPT left. Come on still don’t cry. Any person doing masters spends max 50K to 70k including all expenses. If you worked for 29 months your annual salary will be atleast 60k so you must have recovered and also save some. So take up a second masters and work your way. It’s not that bad.
    3. If you are non stem then extending OPT would be difficult but still you have enough money to pay back for your 1st masters and spend some money to maintain status in some not so costly university. Trust me there are many.
    4. If you are in India just stop crying you already have a job there. You can come next year
    5. If you are stem bachelor’s then same applies to you as stem masters. Only difference is you would have saved much less or even nothing. But you can do masters and it will add lot of value to your profile.
    6. Non stem bachelor’s I know life is unfair. But you guys have to live with it. Try doing masters. If someone should definitely get an h1b you guys are at worst position. Spending 4 years and just 12 months of OPT.
    7.if you fall in the category of h4. Don’t worry yaar there is h4 ead.
    8. If your spouse is here and you are out. Just get an h4 and take EAD and work (if he has applied for green card)
    9.if I left anyone i can still suggest plan B.

      • How about you start your masters degree this fall ? Given your experience it should be easy for you to find an internship next year on CPT and eventually when you graduate you can start working full time on OPT. While all these are going on, try for h1 again next year.
        Once you get your h1b, its upto you whether you want to discontinue your masters or better just complete it and get a degree.

      I Have 8+ Years of Genuine experience with top Indian MNC.I was on L1 till last year, my company applied H1 last year it did not pick .My Wife works for the same company she was also on L1 till last year our company applied H1 last year and it picked. I moved to H4 ;not working from last OCT.

      I applied this Year NON – AD/RP/VT no update till now.I don’t believe in praying and crying I would like to know whats best Plan B?

      As you already know for applying EAD on H4 you need I-140; Our company doesn’t process green card. Even if we move to some Consultancy if they start green card process immediately it may take one more year to get I-140

      Its not about money but siting idle in home doing nothing is the worst thing and the last thing I wanted t do

      I really liked your approach towards the problem with 360 degrees view what your thoughts on my case?

    I got selected by a company in US and they applied my H1B under Non-AD/REG processing. I called them last week and they said they haven’t still started receiving NonAD receipts.

    Now after reading the comments that majority of the NonAD-Reg candidates have started getting the receipts, I am very worried. This opportunity is very important for me and I am getting very nervous now on not hearing from my Employer.

    Till when should I have hopes?

      • Thanks for replying.

        I didn’t want to call my employer again and again or frustrate them through load of emails. Though they mentioned no matter what time they get the confirmation they will just give me a call and let me know, but I am the one getting impatient.

        They offered me H1b in 2012 when I refused due to some family issues, there was no Lottery for H1b at that time. God knows why am I so unlucky but I hope to get it this time

            @Raam, are you sure CTS didnt receive any from California or GIT didnt process yet.. please give more info in this.. my application went to CA.

    • No Buddy. Seriously waiting for NONAD-RP-VERMONT. i got fedex number from HR last week. I checked it in FEDEX.com and saw my name and it says my package reached USCIS vermont service center on 1-april-2015. Thanks to AITC for atleast filing my petition.

    • At the time of filling DS 160 for you ( for H1b Stamping visa) , Mention 1 Dependent , then and there a new DS 160 for Dependent=Wifewill open ( after you fill ds 160 for you)

      Fill Ds 160 at that time for wife and fix both appointment for Visa interview together and the you both can go together for H1 and H4 visa interview ( fee need to be paid for both = * 2 times)
      H4 does not need any addition document if going with H1 person for Visa stamping

      • If you are from a direct employer in USA, you have a right to comment like that. If you are from an Indian MNC like Infy or Wipro, please get off the high horse. Applying thousands of petitions and then sending those who get through in any random project that come, whenever they do, is no better than what a consultancy does. The consultancy first gets the VISA and then finds the project, which is EXACTLY what your Indian MNCs do, although in a veiled manner. The consultancy takes up only a fraction of the quota, which actually makes it slightly better

    This is my second time. Last year I was not picked..I put in two applications this time. I got selected in one, but not on the one I wanted. I guess it’s over now

    • People like you should be actually barred from applying for such visas. You go to some low ranked college, scrape through, get a job through some fraudulent consultancy and apply for multiple visas and whine even after getting it. There are people here who have gone to the best schools in this country and work for reputable organizations and are being screwed over because of you assoles. Seriously get a life and stop whining like a bitch!
