As many of you know, H1B Visa 2015 quota was over in the first week and a whopping 172,500 H1B petitions were received in first week by USCIS.  H1B Lottery / random selection was held by USCIS to select 85,000 H1B petitions to fulfil the work permit cap. Many of the unlucky ones are already wondering about next year H1B Visa quota. Also, some of you are planning for H1B visa for next year, you also would be wondering regarding the same. When will the H1B season for fiscal 2016 begin ?

USCIS will accept petitions for H1B Visa 2016 season starting from April 1st, 2015.  USCIS did a press release on March 12th outlining the details. Read summary of press release by USCIS on H1B 2016 .

Will there be lottery again for H1B Visa 2016 ? Predictions ?

We had lottery for FY 2015 and FY 2014. The total number of petitions filed for FY 14 were about 125,000 and for  FY 2015, there were about 172,500 petitions… As H1B Quota did not increase for FY 2016, and the demand does not seem to decrease, we would very likely have lottery for FY 2016.  Read H1B Visa 2016 Lottery Predictions, Dates, Results

What is the H1B Visa quota Cap Count ? Would there be any changes to H1B 2016 count ?

H1B Visa quota cap count is the total number of petitions that USCIS will accept for a fiscal year to provide temporary work permit for highly skilled workers.  For the 2016 fiscal year, the cap count is as below :

  • Regular H1B Quota : 65,000
  • H1B Masters Degree Quota ( only US Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

As per the press release in March 2015, the quota did not increase.  To give some background, as per the Obama executive action in Nov 2014, no changes were announced to the H1B Cap count. There was proposal in 2013 to increase H1B cap from 65,000 to 110,000 and Masters quota to increase from 20,000 to 25,000 did not go through as of March 2015. At least, for this FY 2016 season, the quota is fixed and it will be as above and no changes.

When should I start planning for H1B Visa 2016 ? What are the steps ?

It depends on your situation. Below are few scenarios and your plan.

  • If you are a student on F1 Visa in USA, you need to plan for your internship/ CPT or OPT employment  at a company that can sponsor your H1B Visa for FY 2016. In my view, you should start now to find something for the fall 2014 and continue that for next spring so that you can file for FY 2016
  • If you are in other country and planning for H1B, it is good to start your process around the end of this year 2014. It will give you enough time to find sponsors, search for job, etc.
  • If you are on H4, L1 or other visa in USA and planning for H1B for FY 2016, you also should consider looking around end of this year i.e. December 2014.

Most asked Question – How do I Find H1B Sponsors for FY 2016 ?

This is a million dollar question !  One of the biggest challenges is to find a good sponsor that can offer you a job and wait for you to start work after 6 months of filing your petition.  You should review the detail article on How to find H1B Sponsors for FY 2015. What about Comprehensive Immigration Reform ( CIR) – H1B Visa Changes ? What are they ?

There have been some proposed changes to the H1B Visa program to cater to the demand in the  US economy as part of the Comprehensive Immigration reform. Below are some of the proposed changes.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

These were proposed in 2013, but nothing has moved significantly and all the above are just proposed rules. We are not sure when they will be implemented. You can read  Summary of CIR – Immigration reform – H1B Visa and Green Card  to get an idea. The latest update is that Obama has taken executive action on Immigration in Nov  2014  and none of the below are included as part of that.  Stay tuned for updates.

H1B Visa 2016 Fees – Any changes ? How much does it cost ?

There are various components of the fee. The H1B Application filing fee could range anywhere from $1,600 USD to $4,400 depending on the size of the company. The attorney fee can range from $500 to $3000 depending on the attorney. If you apply for premium processing that is another $1,225. The fees has not changed in the past couple of years for FY 2014 and FY 2015. Unless USCIS revises fee based on immigration reform, it should be same. We will keep you all posted. H4 Visa EAD rule impact on H1B Visa 2016 Season ?

As you know, certain H4 visa holders are now eligible for EAD. The H4 Visa EAD Rule Passed earlier in 2015 and is effective from May 26, 2015.  USCIS will start accepting applications for EAD from those eligible H4 visa holders starting from May 26th. The question is that will that have an impact on number of H1B petitions for this fiscal year  ?  It very likely will have certain impact on the number of H1B applications that are filed for this year 2016 quota. Many of the H4 holders, who would now be eligible for EAD, may not apply for H1B visa, just because it gives them more flexibility to work and more choices to work as well. We would have to wait and see, how much of an impact that would have, but it is very straightforward and no brainer for eligible H4 visa holder to avoid the H1B processing.

H1B visa Premium Processing Changes to H1B Visa 2016 quota ? 

USCIS updated in their press release that the premium processing will be accepted for FY 2016 quota and they will only begin that “no later than May 11, 2015”. What it means for the petitioners is that the official 15 day premium processing clock starts from May 11th, 2015 and their petition could be adjudicated within 15 days from May 11th, which would be May 26th, 2015.  USCIS can process them earlier as well, but their new timeline is just indication for setting the right expectations to meet the stipulated time frame for premium processing.

I did 9 applications from different employers this time, you know how much investment literally $27000 , all my savings from OPT i put on this time, because i have to go to India this time i weren’t been to India since 2011 it is so…so…so….so painful , last 3 times i wasn’t picked , i am 9 times more luckier than who filed 1 petition isn’t I?

    • I’m sorry, If i may ask, why so many applications?
      I heard a rumor, (hope for your sake it is a rumor) once the application is picked, they are scanning for duplicate applications, and once they find a duplicate filing, they are removing all the applications on that name.
      Did the other 8 employers know about this? Did you contact a lawyer before you took this step?
      I’m sorry if i’m scaring you, but these are just my questions.
      And out of curiosity, why are you so worried about h1b? if it didn’t get picked again, you can apply for a university right? in case, that 27k you’ve spent will be the fee for the tuition.
      Is that important staying in USA for you?
      Funny thing is, it was hard for me to get a second employer for filing and didn’t got one finally, so filed only once.
      I will remember you and come back here after 3 months to hear your results.

    Read this sentence from USCIS website posted ojn April 07:

    The agency will reject and return filing fees for all unselected cap-subject petitions that are not duplicate filings;

    It means USCIS is going to determine duplicate filings before lottery i.e. more than one filing for the same person
    and put only one filing into lottery to give equal opportunity to everyone.
    Among all unselcted petitions they are again going to retain the dulpicate ones if single petition is picked up against that person. So against multiple ones, single one gets for lottery. Yout thoughts?

    • And even this time they will take time due to it to filter out, that’s why they mention they are not sure when lotter will be conducted. I think so. May be end of next week they are going to conduct lotter, so just a guess

    • You misunderstood. The elimination of the duplicate filing is multiple applications from the same employer for the same person. It is done by USCIS always. But no elimination of duplicate filing from different employers which is valid as per USCIS regulation which will be included in the lottery.

  4. What will USCIS do with previous years vacant ones… I mean, there will be some petitions which would have got rejected previous year. So wont that count get added to the current 85,000 visas ?

Just a thought I feel USCIS should make a law that all companies who has applied for only 1 application should first get approved (people like me 😉 ), companies which have applied less then 50 apps should get 50% approval and all others goes in to lottery. Once lottery is done figure out person who is selected multiple time on basis of unique identification combination like Passport number, date of birth, place of birth, name then just pick them once and remove all other selected application and do one more time lottery to pick the remaining. Haassssshhh that looks like a lot of work and I am sure USCIS won’t do it 🙁 🙁 but that would be awesome if they can implement even half of above. Wishful thinking!!!!!

  6. Hi All – I have a question , people who are doing multiple application how does that even work? Do they tell the employers that if I will get H1 then only I will work with you OR who pay’s for their applications? And what if they are selected more than 1 time then what do they tell the other employer that I cant join you because…??? I just don’t get this whole mess.

      • Internal source.. cannot disclose.. trust or forget abt it.. does not matter.. truth will come out on either 10th or 13th when lottery takes place

    • As per calculation you have considered 58200 visa available ((85000-20000 AD)-Visa reserved for singapore etc.). You are taking 192000 candidates. So as per your calculation total number of applicant is 212000? Please check with your internal resource and post.

          • Even not considering 20000 AD Visa availability for calculating ratio. I think he is just trying to make waiting period more interesting and making others to scratch their heads. Hope we all are enjoying this waiting period. Keep it up Mr Gandhi.

  7. Friends

    As per my past experience with H1B Lottery. I have noticed that each company get some percentage of H1B in Lottery. In short if any small consultant is filling 8 H1B’s they also get minimum of 2 to 4 selected in every Lottery.

    It’s my assumption that the H1B Lottery software must consider that each employer should get some percentage of candidates selected otherwise one company may get more H1B’s and small companies may get nothing.

    It’s my assumption so thought to share with you all.

    • I hope your assumption is correct. Do you know where we can verify last year’s data? Mine is the only one petition my employer is filing this year.

      • My company filed for my H1b last year and I was the only one my company filed for. The company is market leaders in laser technology and I didn’t get picked in lottery. So I dont think all companies get a chance in lottery.

  8. Guys

    When USCIS say’s that to file with multiple employer is LEGAL than why they treat it as duplicate applications.

    I have not paid to any employer and gave the interviews with 2 different employers and because of my expertise in the technologies and having an experience of 14 years they are agreed to apply for me.

    I had accepted there offer and told them that I am applying for the fourth time in H1B Lottery and from any one I get selected than I am going to join them.

    What a issue in this and why USCIS is going to send an RFE when it’s LEGAL. If it’s not than they should has send the notification in advance.

    • Me to, I have applied from my current orginization which is a product development company, but by seeing most of applicients going with multiple employer, I started searching for a company who can sponsor me, I got 3 offer, in which i selected only one. i did not pay any money for filing or attoreny fee..
      So this year i filed 2 application both have different LCA, and both LCA are from different state.

      Y should it be a duplicate. ?

      • Relax guys. I don’t think your condition is counted as duplicate according to other comments. I think it is just really suspicious that your other potential employer would spend money and time on your H1B petition without knowing for sure that you will join them. It may even not pass through the company’s financial dept. For example, Google wouldn’t sponsor a position with my degree (a US advanced one, non STEM) in general due to the high risk of losing in lottery and cost of re-recruitment, so do IBM nor GE. And these are some of the biggest players in H1B petitions and tech industries. So either your new employers are somehow extremely confident about their chances, or they have no idea what they are getting into (and you didn’t clarify with them). Still, I’m glad you get such opportunities and wish you all the best!

        • Yes, both of them dont know about other offer. will it be a issue, if i reject offer after/if I get picked in lottery. I just signed the offer letter.

          • Legally, no. I don’t mean to judge but ethically it wouldn’t be considered as the best move. Even without the whole h1b thing, you are expected to disclose your job seeking status to your interviewer. Might be blacklisted by the HR/hiring manager if get picked and rejected.

      • I am not sure why but ever person has a different opinion about filling with different employers. As per USCIS, they had approved the petitions for same employee from different employers. I have an example that one of my friend has got 2 petition approved but he joined one company.

        There are many folks which are saying this is ILLEGAL.

        I am confuse who is correct and who is not ?

      • First of all, multiple applications from different sponsors is legal and it will not be considered duplicate.

        But is it fair if more than one application is selected for the same person, no. Why should a person have n options and other zero. We hear stories of people filing multiple applications and all the applications getting selected. Ultimately the person is going to use one H1 and other applications are unused. It would be to the best of everybody’s interest if USCIS doesnt select the same person again during lottery. But I guess, this will just remain as hope as USCIS will have to guard the sponsor’s interest as well. Eventually there is no solution to this problem.

        • This is a big hole in the whole H1B process. The USCIS is not clear on this point and it’s proved in past that many folks got many petition approved and others got nothing.

          I am not sure why USCIS should not raise a clear rule on it.

          Secondly, How USCIS determine which case is actually true and which are filled with ILLEGAL methods ? Is there any way USCIS can determine about it ?

          • Since theoretically you don’t need to be a full time employee to apply for a H1B, I guess USCIS is considering the case that company A and company B both file for one employee for part-time positions and the employee is going to work for both companies. Just realistically that’s never going to happen and people are just using multiple applications to increase the chance… Guess no way to check it, just hope USCIS don’t waste H1B offers that get rejected (if they keep track of them).

    This is an absurd the way all this process work and I feel sorry for all of us who see it as a chance to change our destiny.
    However I am prepared to whatever result that comes out, I will continue fighting to achieve my objective and mission!!

  10. The lottery selection software is probably quite straightforward. In fact, the USCIS note on damaged packages may have been a license for clever lawyers to re-submit petitions. I don’t think USCIS will care to pick these re-applications out and identify their duplicates etc. They would probably just shove the whole bunch into the total, and try and compensate by selecting more that 85k, like they compensate for multiple employer petitions and RFEs. And this makes sense for USCIS and America, gets them their 85k for the fiscal year, but it’s clearly unfair to the legitimate single petition applicants. It’s all quite disappointing and disgusting, to be honest. Takes the sheen out of all of the core attractions of building a life in America, “the American dream”, the idea of fairness, true capitalism. Screw is.

  12. For all those who has filed many applications –

    I think the USCIS don’t care anything for the multiple filling from different employers. It’s there source of income but whoever has filed from ILLEGAL way that’s not correct.

    I don’t know how the USCIS can differentiate all these cases who has filled from different employers. If they has the intention they must had declared this rule in advantage.

    • Dude… as per USISC duplicate means “same company can’t file multiple applications for the single candidate”. What if different companies file applications for the same candidate? Will that be treated as duplicate application?

  14. I believe that the American government just picks 65k randomly, I do not think that the American government cares enough to review each application for duplicates etc before picking,

    After spending decades in the US I see how Senior level Americans are being replaced by H1b Labour also the difficulty faced by American Computer science grads in finding jobs , this is nothing but the result of Extreme corporate greed by American Capitalists to gain immense profits,

    I only hope that some of the Indians who did their Masters and have learnt and spent their time working for american corporations but were rejected due to the lottery use their expertise in developing the IT infrastructure of India.

    • Not all people have done their masters degree in computer engineering for them to do IT work in India. There are lot of people from different engineering streams. 🙁

    April 10, 2014 USCIS Reaches FY 2015 H-1B Cap
    USCIS received about 172,500 H-1B petitions during the filing period which began April 1, including petitions filed for the advanced degree exemption. On April 10, 2014, USCIS completed a computer-generated random selection process, or lottery, to select enough petitions to meet the 65,000 general-category cap and 20,000 cap under the advanced degree exemption.

    April 07, 2014 USCIS Reaches FY 2015 H-1B Cap
    USCIS announced today that it has received a sufficient number of H-1B petitions to reach the statutory cap for fiscal year (FY) 2015. USCIS has also received more than the limit of 20,000 H-1B petitions filed under the U. S. advanced degree exemption.

    If 200k+ application, then no lottery.
    they will verify each and all application by hiring confidential private company.

          • That was Y2K era…. They needed ppl here…Its not like that anymore.. If no H1, they have H4 now.. 1,55 000 who are already eligible this May 26th.. Even if it takes 3 months to get the EAD , probably by Oct 1st they will start which is when any h1 would start.. So This option is ruled out.. Lotter is the only way out and 85K would eb the number this year.. But strongly hope your word comes true

      • I second h1blaughteragain… USCIS had already mentioned its going to do a lottery….if they were to process all 200K applications, they would not have mentioned about the lottery at all..

Last year I got my rejection notice after very long time.. when i enquired with my attorney for the reason, he replied saying For FY 2015 USCIS found lots of duplicate application and they started maintaining db by capturing all the company details and applicant details from 2015. this year i filed two different application, but looks like USCIS already aware that so many people will file more no of application. since its one of the main revenue for USCIS , they don’t allow multiple applications this year 🙁

    • You will end up loosing your attorney fees thats it.. USCIS would not benefit anything from you applying multiple petitions.. if not selected they send the full money back as Bob mentioned…

  19. This year 75k+ applications are duplicates till 3pm, Pst, 7th april.
    After shortout by passportnumber, DOB, First and last name.

      • Yes, thats required.
        USCIS need to be ignore all multiple application and only need to count 1 application per person.
        I understand too many peoples invest too much money by multiple application, as of me USCIS only consider one application from multiple application if 2 or 3 application picked up for same person , they can consider one and other slots can make empty for others!!

        • As per Uscis rule they only consider application as duplicate if filed by same employer more than once….applications for same person filled by different employers doesn’t counted as duplicate. .

  20. Based on comments on this page, it is clear that so many people have filed multiple H1B petitions (unfortunate for others like me). If they get more than one petition approved through lottery, anyway they have to revoke all but one. What happens in that case? Does all the revoked applications/H1B cap become available for other persons who didn’t get throgh lottery?

    • No, USCIS will pick up more than 85k petitions based on previous years’ rejection rates. So there is no waiting list anymore. Hopefully USCIS will enforce a stricter rules on filing multiple filings and revoke all unethical filings

  21. I applied last year and got selected in lottery. This time my wife is trying her luck. Just one application though. We had tough time getting one sponsor. How do people find multiple sponsors. Something is fishy!!!!

      • Why don’t you file for your green card too.. your wife can work after a year or so on H4 EAD.. Anyways you have a fall-back option for your wife so single filling is enough.. Till then enjoy 🙂

    • Last Year I got lucky. This year I know a friend who has told me that he has applied through five different companies after saving his OPT income. If you have money and time and people who are ready to sponsor then there is no problem.

  23. Guys, no matter about the number of applications. It is the matter whether you have the luck. Last year my friend applied only one and got through…So it is purely based on your luck..nothing else.

    • i also know of someone who had only one application, got picked, got a rfe but still cleared and now is happily working. So its pure luck.

  25. Come on everybody id coming up now , to be honest tell everybody how many applications did you file from different employers honestly i only did 3 , last time i did the same , this time for some reason i am pretty sure i am lucky guys…

      • We don’t care if you are from TCS, we studied here and we came to make our lives here and we don’t file 20K applications from one company. Just 20K from Infy last year and just 13K from TCS last.
        Just stay where you are or invest in education here and then you will understand our pain.

        • Yo are very correct bro. All these IT companies did some sort of setting and they get bunch of H1B visa. 90% of these daily soap companies like TCS, visa fraud company like infosys etc etc take our opportunity and materialize on that.

Noone asked you to go there and study, and if you din realize the h1b risk back then its probably your failure more than anyone else. Accept it and move on buddy!!

        • Now that is plain BS dude. Not all of us come through the Bigwigs or stupid consultancies. Some of us actually worked our ass off for years to be the very best in our fields so that US employers will sponsor us an h1B happily. I have a dream offer from an innovative startup and mine is the only one they are filing. Yet I am worried I might lose to people filing many petitions through consultancies of border line legitimacy.

      • Well even if you are from TCS, and even if you claim you are more genius to someone here; what will you do in US if your grammar isn’t good.. If your written has mistakes not sure how good your verbal would be..
        Don’t be a laughing stock for others and insult Indians.. humble request learn the language and culture before you go if you are one of the lucky ones.. and stop using abusing words.. it is legal to have multiple filings but again did anyone stop you from doing the same?

        • the difference is that some people here are paying for multiple filings which is illegal. People on this forum have accepted they have paid up to “x” amount of Dollars to file H-1b, which is completely illegal.

        • @NJ : I think you seem to be more concerned about the grammar and culture more than anything else!! unfortunately H1B stands for skilled worker instead of skilled english professor :)… As long as you have a particular skill set that can be used by an American firm for their business growth, his company has every right to apply for it..be it TCS/WIPRO/INFY… There is no difference between applying through an IT company/applying after completing MS as long as the applications are fair and square!!

          I dont quite get the idea as to how MS guys think that its unfair for the IT companies to file applications :S

          • no one is against companies like TCS, Infosys or whatever the other names were mentioned above. I think what people are cribbing about is when applicants pay for thr visa – which is against the essence of H-1B. I dont think anyone cares if you are from US or anywhere else in the world, as long as you can find legitimate employers with legitimate job openings that require skilled workers.

    • is this possible to file multiple petitions ? i think USCIS will consider duplicate filings and reject all of them? on the other note, if you have money, why do you need H1B.

  26. What you said is a big possibility..huge number of petitions…but I think of another scenario..what if they stopped receiving any more petitions mails and concluded that there might be no more coming in and then made the announcement?

I think they received too many applications this time cos its not even EOD on the 5th business day!!looks scary!! thanks to the endless duplicate filings that some morons did for the sake of getting a better marriage proposal. I guess u already realized which specific area in the country im referring cos most of the self paid duplicate filings originate there..

    I sincerely hope USCIS somehow rejects all those applications and conducts a lottery among all the genuine applications so that we atleast feel that we have been done in a fair manner!!

  29. Just imagine my boy friend applied 6 petitions from 6 employers, just imagine how people are crazy he spent his 7 months salary for filing the 6 petitions…. dont know where he will end like this….

    • Wow he spent 7 months salary in buying 6 H1B lottery tickets! If he would have spent same amount in buying State Lotto tickets which comes at 1$ each then he would have had 1000s of lotto tickets with high chance of winning millions of dollars which he would never earn in lifetime of H1 job. Think about it!

    • He May get selected in lottery but He will get RFE for multi applications asking for explanation. While it’s allowed by law to have multi application but USCIS knows by fy15 that just for the sake of lottery ppl apply multi therefore they may issue RFE to get evidence

  30. I don’t get it! Is everyone here form India?
    I am an architect form Switzerland and already in the US with a J1 visa. As I am highly skilled and from the best architecture school in the world my company wants me to work for them and is paying my H1B visa and attorney. But we only filed one petition though some other companies wanted me to work for them as well. So, I really hope fate will chose fairly. And I am shocked about how bad some peoples English skills are!
