As many of you know, H1B Visa 2015 quota was over in the first week and a whopping 172,500 H1B petitions were received in first week by USCIS.  H1B Lottery / random selection was held by USCIS to select 85,000 H1B petitions to fulfil the work permit cap. Many of the unlucky ones are already wondering about next year H1B Visa quota. Also, some of you are planning for H1B visa for next year, you also would be wondering regarding the same. When will the H1B season for fiscal 2016 begin ?

USCIS will accept petitions for H1B Visa 2016 season starting from April 1st, 2015.  USCIS did a press release on March 12th outlining the details. Read summary of press release by USCIS on H1B 2016 .

Will there be lottery again for H1B Visa 2016 ? Predictions ?

We had lottery for FY 2015 and FY 2014. The total number of petitions filed for FY 14 were about 125,000 and for  FY 2015, there were about 172,500 petitions… As H1B Quota did not increase for FY 2016, and the demand does not seem to decrease, we would very likely have lottery for FY 2016.  Read H1B Visa 2016 Lottery Predictions, Dates, Results

What is the H1B Visa quota Cap Count ? Would there be any changes to H1B 2016 count ?

H1B Visa quota cap count is the total number of petitions that USCIS will accept for a fiscal year to provide temporary work permit for highly skilled workers.  For the 2016 fiscal year, the cap count is as below :

  • Regular H1B Quota : 65,000
  • H1B Masters Degree Quota ( only US Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

As per the press release in March 2015, the quota did not increase.  To give some background, as per the Obama executive action in Nov 2014, no changes were announced to the H1B Cap count. There was proposal in 2013 to increase H1B cap from 65,000 to 110,000 and Masters quota to increase from 20,000 to 25,000 did not go through as of March 2015. At least, for this FY 2016 season, the quota is fixed and it will be as above and no changes.

When should I start planning for H1B Visa 2016 ? What are the steps ?

It depends on your situation. Below are few scenarios and your plan.

  • If you are a student on F1 Visa in USA, you need to plan for your internship/ CPT or OPT employment  at a company that can sponsor your H1B Visa for FY 2016. In my view, you should start now to find something for the fall 2014 and continue that for next spring so that you can file for FY 2016
  • If you are in other country and planning for H1B, it is good to start your process around the end of this year 2014. It will give you enough time to find sponsors, search for job, etc.
  • If you are on H4, L1 or other visa in USA and planning for H1B for FY 2016, you also should consider looking around end of this year i.e. December 2014.

Most asked Question – How do I Find H1B Sponsors for FY 2016 ?

This is a million dollar question !  One of the biggest challenges is to find a good sponsor that can offer you a job and wait for you to start work after 6 months of filing your petition.  You should review the detail article on How to find H1B Sponsors for FY 2015. What about Comprehensive Immigration Reform ( CIR) – H1B Visa Changes ? What are they ?

There have been some proposed changes to the H1B Visa program to cater to the demand in the  US economy as part of the Comprehensive Immigration reform. Below are some of the proposed changes.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

These were proposed in 2013, but nothing has moved significantly and all the above are just proposed rules. We are not sure when they will be implemented. You can read  Summary of CIR – Immigration reform – H1B Visa and Green Card  to get an idea. The latest update is that Obama has taken executive action on Immigration in Nov  2014  and none of the below are included as part of that.  Stay tuned for updates.

H1B Visa 2016 Fees – Any changes ? How much does it cost ?

There are various components of the fee. The H1B Application filing fee could range anywhere from $1,600 USD to $4,400 depending on the size of the company. The attorney fee can range from $500 to $3000 depending on the attorney. If you apply for premium processing that is another $1,225. The fees has not changed in the past couple of years for FY 2014 and FY 2015. Unless USCIS revises fee based on immigration reform, it should be same. We will keep you all posted. H4 Visa EAD rule impact on H1B Visa 2016 Season ?

As you know, certain H4 visa holders are now eligible for EAD. The H4 Visa EAD Rule Passed earlier in 2015 and is effective from May 26, 2015.  USCIS will start accepting applications for EAD from those eligible H4 visa holders starting from May 26th. The question is that will that have an impact on number of H1B petitions for this fiscal year  ?  It very likely will have certain impact on the number of H1B applications that are filed for this year 2016 quota. Many of the H4 holders, who would now be eligible for EAD, may not apply for H1B visa, just because it gives them more flexibility to work and more choices to work as well. We would have to wait and see, how much of an impact that would have, but it is very straightforward and no brainer for eligible H4 visa holder to avoid the H1B processing.

H1B visa Premium Processing Changes to H1B Visa 2016 quota ? 

USCIS updated in their press release that the premium processing will be accepted for FY 2016 quota and they will only begin that “no later than May 11, 2015”. What it means for the petitioners is that the official 15 day premium processing clock starts from May 11th, 2015 and their petition could be adjudicated within 15 days from May 11th, which would be May 26th, 2015.  USCIS can process them earlier as well, but their new timeline is just indication for setting the right expectations to meet the stipulated time frame for premium processing.

    Can someone please answer a quick question-

    When we say that it is over for AD/RP applicants (just an example), what does it mean? Does it mean that the AD/RP candidates should lose hope OR that they should hope to get picked up in the 65000 quota if not 20000.

    I have read multiple comments stating that USCIS will share the results for NON-AD/RP in the coming weeks, which makes me feel that the AD/RP results are done with.

    Any help is greatly appreciated. Thanks!

    • Yes, you are right, you can lose hope, you don’t have any more place in 65000 quota, now it’s time for non-ad!!…you can make other plans…

      • Not true. Please keep your hopes alive till you receive your application/packet back. Back in 2013 I have received the approval notice in mid of June.

        • Thank you! I can see why USCIS declares the results for Premium processing candidates first. No one has given any priviledge for the getting the results first to the Master degree candidates. If anything, it has to be random.

  4. There is a lot of animosity here between different groups. I don’t agree with people filing multiple petitions, unless they are real job offers from employers. However, there are reasons people go with consultancies. The attitude that only people with AD deserves to work in USA is wrong. The problem for others is that while they are legally here, and eminently qualified to work, it is so difficult to get a non consultant employer to file for H1. Suppose I am on H4, with 10 years of experience, and can add real value to any organization I join. While it is possible to really impress many direct employers, all back out when they hear “I will need H1 sponsorship”. It is not the expense. It is the wait. Which company would hire you in Feb, file for you in April, and wait until October when you can join and start work for them? That is when people are forced to go to consultancies and first get an H1, and THEN find a direct employer and transfer it

    • Agree. We interview lots of people but it is just not realistic to expect that we’ll wait for 6 months for them to start plus there is also possibility that they do not get H1.

    • I have been told by my lawyer to wait till may… I am sure I was PP Non AD… Please keep up your hopes at least for another week or so… As you know Vermont is processing at a slower pace…. Stay positive my friend

    I know there are applicants who filed multiple H1B application. What happens next when they start withdrawing or USCIS starts denying ?

    Suppose someone file 3 application and he got all select in lottery. At end, he selects 1 only for stamping. What happens to the unused or vacant application ? Do AD gets priority, I am not sure how does it work. Can anybody answer please?

    • Early next week. My check was cashed out on Tuesday and my employer got the I-797 with receipt number on Thursday morning. Big Cong!!

  10. Yea Lalu Ji , you are so right. It is a game for survival and every wants to survive by hook or crook. We all apply for multiple colleges , multiple jobs etc. only concern is , things are in our control when we give multiple interviews but here in lottery we can not do anything about it except depending on damn luck. I think , this luck thing makes us crazy and angry with multiple filers. If it were depending on interview , no body would have blamed any body for giving multiple interviews for getting selected in h1b

She is planning to come to US after a month or maybe couple but if in between my h1 got approved does that mean her F2 is not valid anymore as my status have changed or she can still enter US before October on F2 visa?

  12. I dont understand how people can be so hypocritic about multiple applications. Everyone has sometime or the other in their lifetime has crushed someone else dream and got ahead of them.
    1. When you apply for BS/MS do you just apply for one university ?
    2. When you apply for jobs do you just apply for one company ?
    answer your own questions and stop being hypocrites.
    Suck it up as the world is not going to play fair everytime. Its the game for survival.

    • How about a guy who files selfishly with 2 or more fake petitions, and just wait for some of them get picked up, while there is a PhD guy spending his whole life doing research in the university, then gets a full-time job with 6 figure salary and wait for the company he is working for to file a H-1B for him, then desperately figures out his slot is occupied by a wasted fake petition from the first guy. He ends up going home with the awareness that his skills are no use in his country. Yes, It’s a fair shot isn’t it?

      • My Simple question over here is why didn’t you get two or more offers from different organizations if you are a Phd and talented guy. I gave interview to 3 companies out of which have selected in 2 .whats wrong in it.

        • I think what is wrong is that most of these people who had multiple petitions filed on their behalf are someone who is sitting on his/her ass on the other side of the world. They are not even currently working in the U.S. On the other hand people who complain about this stupid practice of legally filing multiple petitions are who have been working and paying taxes on their OPT. Because normally people weigh their options and accept one of the offers they received and start employment before the filing date the following year, they can only have one petition filed for their sake. That is why your point making fun of the original commentor not being able to get multiple offers was recklessly stupid. That person might have received five different offers but might have had to pick one.

          I just think that it is not a fair game for everyone. If you got 10 offers, good for you. But you should be required to pick one that will sponsor you and file your petition. You need to have some integrity. When you say we are living in a competitive world and we need to compete with each other in order to be successful, you will only get so far in life. That thinking does not work so hot in a developed country like America. It is all about how you develop networks and how you utilize them and chances are people don’t like to be associated with someone arrogant lacking integrity. You can only be successful without the help of others. Good luck getting far in your life.

            Ultimately one person should pick up only one h1b application even though if he applied for 3 applications and picked up all those 3 in lottery. he should withdraw rest of the picked applications which will be allocated to people again. Hence, if you are in that luckiest bucket then you will get an opportunity.

            I understand your frustration friend and even my application didn’t pick up yet .Think positive and Good luck.

        • This is another misconception around. Check USCIS website..u need to be exceptional in u r field…10+ journal publications, review experience etc….

          Not all PhD’s have all this. And data is telling that people who work in research labs for 5 years after PhD qualify for this.

What will you say when someone from different country come to your country and start dictating how the laws should be reformed? That’s not how it works. Right?

      • One of friend got H1B while his start date is October 12th. He will graduate next month. H has also not interned with this employer before

        • Big Employers will wait if you are not graduate yet. They care for talent. It’s not that they are counting on you. Even smaller companies will wait if it’s not an urgent requirement. Some will ask you to join on cpt/opt if h1 lottery doesn’t work for that year.

          If you are already working somewhere, then it’s a whole another story. They will want you to switch and then they will apply for h1. No one is gonna invest if they know you are only gambling.

          However, Consulting companies don’t think like that.

  13. I am Non-AD/PP (applied a single petition from US based IT company in India). This is my 2nd attempt in lottery and it hurts like anything knowing that luck has failed me once again. I was positive and had that slight hope until 24th April, checking my emails every 1 hour, checking the immigration portal every 2nd hour. But today, I realized that’s it now.

    One more thing, my company had applied for L1B after first debacle even that was denied.

    I do not know, how can I take all these, but the fact is that I am very unlucky guy who have very supported company at the same time without GOD help.

  14. I am Non-AD/PP (applied a single petition from an IT company in India). This is my 2nd attempt in lottery and it hurts like anything knowing that luck has failed me once again. I was positive and had that slight hope until 24th April, checking my emails every 1 hour, checking the immigration portal every 2nd hour. But today, I realized that’s it now.
    I am trying to make my understand the fact that someone had to be in that unlucky list of (233000-85000) 148000 people. Someone had to fail, someone had to get up and try again. Not everyone would have got the visa anyways. I am one of those.
    So be it.
    Somewhere I also feel that maybe someone else, who is in US, in a situation more worse than mine, where he/she would have to leave the country where he/she has already settled, needed this H1B visa more than me. I console myself saying probably someone else who needed this visa more than me must have got it.
    Congrats to all who got it, and good luck to those who didn’t. Life goes on!

    • If you don’t know how anything works stop commenting here pk. It’s not over for ad rp guys.. People started receipts from Thursday. Most of the people who got to know they were selected was through check being en cashed or sevis update. Stop spreading panic

    My case was selected in last year 2014-15, H1b lottery. I was soo happy that i got thru in 1,73000 applications and was hoping for all good news through out. But to my surprise, my case was put into RFE. After almost 7 months waiting and agony, in Dec14, my case was Denied. Reason for denial was not shared to me. I was soo depressed and low with that. Finally i had to accept the facts and continued the process for Second time. Now this time application are too high and im really worried.
    Mine is a NonAD/RP and ONE application only (both years). Just wanted to know when we will come to know about the regular processing applications got selected or not. When i checked with company they said we need to wait for 2-3 weeks more to know any updates. Is this true that after 27thApr, the NonAD/RP cases will speedup? Really worried and tensed.

    • Sounds like your H-1B was filed by a body shopping company, since they are the only ones who will not disclose RFE details and keep things in secrecy. All employment related details has to be shared with the employee since the H-1B application is for that employee to work for that employer. So it looks like you got the right decision and if you have applied with the same or similar employer, don’t expect the decision to change even if you get picked in the lottery.

  18. Does anyone know of CPT colleges from day 1 in Illinois or near? Also, how strict are such colleges with regards to attendance and grades and how are the courses? Is it tough to manage both coursework and full time job?

    • It is amazing how people are asking about illegal things to do in a public forum! No wonder there is no improvement year after year. Even if you get in to a university which does offer “CPT from day 1”, (which does not follow the F-1 immigration rules), you might be able to work, but it will come back to bite you in the backside at a later time – during H-1B processing, H-1B interview, GC processing, etc. So once you do this, you will be tense and under pressure every step of the way going forward.

  20. Hi Fellow H1B applicants,

    I am applying for 2016 H1B as well this year. My employer also applied H4 for my wife. Now my wife received a Receipt Notice with a receipt Number today from USCIS VT (dated on April 21, 2015, amount received: $290.00 US). Does that mean I got selected on the lottery? I am AD/VT but not sure if it is RP/PP. My lawyer didn’t contact yet.

    • Congratulations man, your case got picked. Now relax. There are a few cases where the spouses’ h4 application check is cashed first like in your case.

    I was just doing a simple hypothesis and number crunching. This is only for AD. Please dont get offended, nothing personal.

    I applied only one application and I am also in the same league like others genius candidates. Nothing personal, I do not have any issues with people who applied with multiple, I just say, there are smart enough to make better choices to compensate today over future risk until they get stamping. I know it is legal to apply from multiple employer but I just need this frustration to go away and bring out to all applicant what are the impacts that some candidate have to go thru.

    Here is simple hypothesis categorized- Purely based on my assumption.

    Full time (AD 1 App only) — possible count not more than 5000
    Consultancy (AD 1 App only) possible count not more than 12,000
    Full Time & ( AD Multiple, avg 3 App) 5000*3 = 15000- 5000 = 10,000
    Consultancy (AD Multiple, avg 3 App) 12000*3 = 36000 – 12000 = 24000

    Total count: 5000 + 12000 + 10000 + 24000 = 51000 –> Total AD H1 Application.
    Original Count that should look like –> 5000+12000 = 17000
    Extra applications filed towards AD — > 34000
    This means still 3000 more could have become H1B potential applicant.

    I understand everyone has plans, so may this 3000 potential applicants.
    I appreciate all those who made only one, you guyz believed in faith or at least you guyz challenged and claimed your faith. May be not this time, but I am sure..time will repay you back for jeopardizing what you were destined to.

    • That was very painful to read. It is as if there is no place for honesty in this world. I felt hopeless for three years now. Single application, single employer everytime. The h1b system has been abused badly, people take competition so seriosly that they will use every possible means to get ahead. Just because something is legal does not mean it is ethical.

    • My understanding of uscis lottery system is, all 85000 visas will be filled every year and I don’t think they are going to waste a visa if someone gets both of their applications get picked… That might be the reason why people got receipts even in June last year… But multiple applications will reduce your initial probability of getting selected in lottery…

  22. I think they should put a quota on the number of Indian being selected . Every year there is at least 80 per cent of Indian applicants . I am not trying to be racist but I am sure if there were less Indian who are starving to death for this H1b , I would have been selected . For ya who have been here paying for school fees and taxes , it’s so unfair that someone from another country got selected . I think we deserve it more than anybody else . Why can’t we live our dream but other live their dream without even going through the sane hardships we have been going to . I don’t care if Indian feel mad about wat I am saying but that’s the clear truth

  24. I think Non AD users are still about to get status so far I head whatever got recipt from VT all are AD/PP and AD/RP only, this week surly from monday we will start getting Non AD/PP first also same time Non AD/RP as well. I wish all the best friends don’t lose hope until July 🙂 haha

    • As of now no updates. We can expect from May 1st onwards. Earliest can also be from 27th April.

    I have question regarding H1B, when I applied for H1B i have Indian Passport. But now i am having German passport. So how will be my H1b will be process????

    • Even green card is based on country of birth not citizenship. Enjoy your German passport but I don’t think it will help you in U.S. Immigration

        Thanks a lot…. I kn it won’t help but wethere i get H1b or not I have to do my German passport. I was just worried if in June i get my German passport plus H1b then what??? As while applying i was not German.

  27. hello, I am in AD/RP not sure if VSC or CSC . I heard most people who were picked under AD/RP got their receipts last week. Any idea about how long should I keep my hopes up on being picked up? stressed out I am.

  28. Guys.. I am on H4 right now and i m in usa. IS that game over for Non-ad/PP/VT?
    some ppl say we can wait for few more days, some say its over.
    can anybody say genuine answers, is still there any chance or need to got for option B.
    If its over, then suggest for option B.

    • I am also a non ad/pp/vt but I think it’s over . Rp receipts have been sent out so I think that’s over for us . I called my lawyer but he say to keep hope cuz pp is starting in 27 th but I think he is lying to me or don’t know how the system work . I think we should look at plan B and not remain hopeful . That’s sad but everything is in God’ a hands .

  30. I’m waiting the result from Sayfarth in Boston. They keep saying that I need to wait until middle of May. Anybody already received the receipt from them? I’m AD/PP/CA.
