As many of you know, H1B Visa 2015 quota was over in the first week and a whopping 172,500 H1B petitions were received in first week by USCIS.  H1B Lottery / random selection was held by USCIS to select 85,000 H1B petitions to fulfil the work permit cap. Many of the unlucky ones are already wondering about next year H1B Visa quota. Also, some of you are planning for H1B visa for next year, you also would be wondering regarding the same. When will the H1B season for fiscal 2016 begin ?

USCIS will accept petitions for H1B Visa 2016 season starting from April 1st, 2015.  USCIS did a press release on March 12th outlining the details. Read summary of press release by USCIS on H1B 2016 .

Will there be lottery again for H1B Visa 2016 ? Predictions ?

We had lottery for FY 2015 and FY 2014. The total number of petitions filed for FY 14 were about 125,000 and for  FY 2015, there were about 172,500 petitions… As H1B Quota did not increase for FY 2016, and the demand does not seem to decrease, we would very likely have lottery for FY 2016.  Read H1B Visa 2016 Lottery Predictions, Dates, Results

What is the H1B Visa quota Cap Count ? Would there be any changes to H1B 2016 count ?

H1B Visa quota cap count is the total number of petitions that USCIS will accept for a fiscal year to provide temporary work permit for highly skilled workers.  For the 2016 fiscal year, the cap count is as below :

  • Regular H1B Quota : 65,000
  • H1B Masters Degree Quota ( only US Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

As per the press release in March 2015, the quota did not increase.  To give some background, as per the Obama executive action in Nov 2014, no changes were announced to the H1B Cap count. There was proposal in 2013 to increase H1B cap from 65,000 to 110,000 and Masters quota to increase from 20,000 to 25,000 did not go through as of March 2015. At least, for this FY 2016 season, the quota is fixed and it will be as above and no changes.

When should I start planning for H1B Visa 2016 ? What are the steps ?

It depends on your situation. Below are few scenarios and your plan.

  • If you are a student on F1 Visa in USA, you need to plan for your internship/ CPT or OPT employment  at a company that can sponsor your H1B Visa for FY 2016. In my view, you should start now to find something for the fall 2014 and continue that for next spring so that you can file for FY 2016
  • If you are in other country and planning for H1B, it is good to start your process around the end of this year 2014. It will give you enough time to find sponsors, search for job, etc.
  • If you are on H4, L1 or other visa in USA and planning for H1B for FY 2016, you also should consider looking around end of this year i.e. December 2014.

Most asked Question – How do I Find H1B Sponsors for FY 2016 ?

This is a million dollar question !  One of the biggest challenges is to find a good sponsor that can offer you a job and wait for you to start work after 6 months of filing your petition.  You should review the detail article on How to find H1B Sponsors for FY 2015. What about Comprehensive Immigration Reform ( CIR) – H1B Visa Changes ? What are they ?

There have been some proposed changes to the H1B Visa program to cater to the demand in the  US economy as part of the Comprehensive Immigration reform. Below are some of the proposed changes.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

These were proposed in 2013, but nothing has moved significantly and all the above are just proposed rules. We are not sure when they will be implemented. You can read  Summary of CIR – Immigration reform – H1B Visa and Green Card  to get an idea. The latest update is that Obama has taken executive action on Immigration in Nov  2014  and none of the below are included as part of that.  Stay tuned for updates.

H1B Visa 2016 Fees – Any changes ? How much does it cost ?

There are various components of the fee. The H1B Application filing fee could range anywhere from $1,600 USD to $4,400 depending on the size of the company. The attorney fee can range from $500 to $3000 depending on the attorney. If you apply for premium processing that is another $1,225. The fees has not changed in the past couple of years for FY 2014 and FY 2015. Unless USCIS revises fee based on immigration reform, it should be same. We will keep you all posted. H4 Visa EAD rule impact on H1B Visa 2016 Season ?

As you know, certain H4 visa holders are now eligible for EAD. The H4 Visa EAD Rule Passed earlier in 2015 and is effective from May 26, 2015.  USCIS will start accepting applications for EAD from those eligible H4 visa holders starting from May 26th. The question is that will that have an impact on number of H1B petitions for this fiscal year  ?  It very likely will have certain impact on the number of H1B applications that are filed for this year 2016 quota. Many of the H4 holders, who would now be eligible for EAD, may not apply for H1B visa, just because it gives them more flexibility to work and more choices to work as well. We would have to wait and see, how much of an impact that would have, but it is very straightforward and no brainer for eligible H4 visa holder to avoid the H1B processing.

H1B visa Premium Processing Changes to H1B Visa 2016 quota ? 

USCIS updated in their press release that the premium processing will be accepted for FY 2016 quota and they will only begin that “no later than May 11, 2015”. What it means for the petitioners is that the official 15 day premium processing clock starts from May 11th, 2015 and their petition could be adjudicated within 15 days from May 11th, which would be May 26th, 2015.  USCIS can process them earlier as well, but their new timeline is just indication for setting the right expectations to meet the stipulated time frame for premium processing.

  6. My Company filed my H-1B AD/PP/VSC through Fragomen and didn’t hear anything from them yet. I called to my DSO and she told me that there is “Change in Status Request”. Also, she told me that she will send my EAC number through e-mail as she can’t disclose it on phone. AD/PP/VSC and Fragomen Guys Lot of hope and stay calm. Update is at 4/22/2015 10:30 AM from my DSO.

  8. Called up Sevis to check my status and they said its active. My CPT is ending on December 2015 and I had applied in Regular process/ non AD degree/ VT.

    Should I give up or should I wait until they start processsing NON AD/ Regular process applications?

    • Call on this number and ask can you please tell me my Sevis Status. They will ask you couple of ?s and will let you know. All the best.

      I called and my status is pending but I have applied in regular process, so I am not sure if I should call them back after they start regular process or should I take that as a final answer?

    • I just emailed to my international office about my status. They emailed me back with receipt number shown on my I-20. My expiration date is December. I don’t know if this means I was selected in the lottery or not. Hope this helps.

    I just emailed to my international office for my I-20 update a couple of minutes ago. They replied me back with receipt number, which I used to check online:

    On April 13, 2015, we received your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number WAC151375xxxx, and sent you the receipt notice that describes how we will process your case. Please follow the instructions in the notice. If you do not receive your receipt notice by May 13, 2015, please call Customer Service at 1-800-375-5283. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

    I don’t know if it means I was selected in the lottery. If so, guys, go to ask your international office no matter your expiration date is before or after October.

    My status: AD/RP, and OPT will expire in December this year.

  11. I got the receipt number from my SEVIS number, it states status pending,EAC…., and i checked the number on USCIS, it states on April 20, we received ……
    but i haven’t heard anything from my attorney. It is kind of wired.

    • You are SCREWED! Why would you file 2. You would work for only 1 employer and screwed other person’s chance of working here. You should get screwed! Amen!

    • Wait till which one gets approved, because just because the number got picked does not mean they are approved. If both get approved you can choose the company you want to work with

    • You have nothing to worry until these applications weren’t files for same position or by same employer. Do not withdraw any of the petition and let both process parallel. Once both get approved, you can decide which one to go with.

    • Hey Even I have applied from two different employers, both are legit offers I havent paid anything. Just wanted to know will the sevis record show both the receipt numbers, if both the petitions are picked up??

  12. Friends, Non-AD/PP i have seen only few people getting through. can we still hope till 27th or is it all over? My attorney told to wait till 27th. Mine is second attempt and its very hard to digest the fact that chances are slim now…

    Because your employer has filed for H-1B you were granted a cap-gap extension while the USCIS makes there decision. Your cap-gap extends you to 09/30/15″

    I was not provided a receipt number. Does this mean I was granted a cap gap because my h1 was filed, while USCIS decides if I am picked in the lottery and then processed.

    Sorry really confused as I haven’t heard anything from my attorney.

    I’m currently on my CPT and have exceeded a year, so I don’t have OPT anymore. I’m suppose to graduate in May, but potentially I can fail a class and extend it to Aug. I finally get selected under PP this year after 3 years.

    My questions is. Is there a way I can work between Aug to Oct 1st? If not, Do I have to leave the country and come back?

    I very much appreciate all opinions, advice and encouraging posts on this forum; they provide insight that you cannot find easily anywhere else.
    I need to know you all opinion: I applied for PP/AD in VT and haven’t heard back from USCIS. I sent an email to my school asking about the status of my SEVIS record and here is what they said:

    “Your SEVIS Record has been given the cap gap extension, which means that your F1 status has been extended until September 30, 2015. I have a new I-20 with the cap gap extension on the third page to send you. What address should I sent it?”

    Does this mean that I was picked in the lottery? Or could this status change be simply a result of H1B filing.

    My message to all of you waiting: stay positive and be prepared for any outcome of the lottery. When one door closes, God opens thousands more.

  21. According to immigration girl blog,as of 21st morning only 33% of non -ad/PP receipts from CA center were sent…. So still there is some hope 🙂

        • I dont mean to discourage , I just wanted to give my opinion on that… for non AD the pick probability is 28% and the blog claims to receive 33% applications reply (close to the pick probability) so if you are PP (irrespective of AD or non AD) and did not get receipt by today I would suggest to prepare for plan B

          It is good to be hopeful but not at cost of being unrealistic… Again I dont mean to be rude.. I dint get through last year aswell I kn the pain

    • Guys, guys !! Immigration girl posted the percentage based on the total number of application they have sent NOT the total number of applications received by USCIS. Lets say immigration girl filed 100 AD/PP applications to California, they received 33 receipts. That is what they meant, and not the total number. At least that is what i construed.

    ***UPDATE 4/21/15 – As of this morning, we have received receipts for:
    54% of California AD PP
    33% of California Bach PP
    No receipts for Regular Processing cases filed at the California Service Center
    71% of Vermont AD PP (major increase from yesterday)
    36% of Vermont Bach PP (also increased from yesterday)
    No receipts for Regular Processing cases filed in Vermont

    • From same blog: on 4/20/15
      For Masters cap cases filed in Premium Processing in California, we have receipts for only 50%. And for the Bachelors cap we have receipts for only 30%.
      It shows from 20th to 21st number of receipts has slowed down from California. But, still receiving.

  25. People, this morning I called my school and they told me because my employer has filed my h1b, I have been granted a cap gap extension upto 9/30 while USCIS makes a decision. What does that mean? Really confused 🙁

    My current opt expires late June… Did this happen to everyone whose opt expires before October 1st?

    • If there is a change in your SEVIS, it means USCIS started processing your application.
      I’m pretty sure your applications is picked.

    I checked with SEVIS and they said there is a ‘change of status’ showing on my account. After that, I checked with my school, but advisor said there is no ‘change of status’. I’m really confusing about this. Does anybody know why?

  27. PP receipts are processed completely. If anyone who has not received any receipt by the end of this week should focus on plan b. Some people have also started getting RP receipts.

  28. There is a way to find out if it’s PP or RP. If it says ’emailed receipt’ in case status page, it’s PP and if it says ‘sent receipt’ it will mean RP.
    Keep hope amigos.
    Remember we are all in mid 20’s and there is lot of life ahead.

    • That has absolutely nothing to do with whether the case was filed with RP or PP. If the receipt was sent via email, it probably just means the attorney / petitioner submitted a Form G-1145 (which requests that USCIS communicates any updates via email) along with other documents. If a case were filed under PP, USCIS would make it explicit in the very first sentence of the case status.

  31. every one talking about they are getting PP receipt numbers. but we would get them after 27th april right since PP processing starts on this day?

    • Processing for PP applicants will begin from April 27 and it will be completed in 15 calendar days as per USCIS. Now only receipt numbers are delivered through email whoever selected in the lottery process.

  32. Guys,
    Don’t get mislead by a few people on the forum. There is no way to tell from the receipt number if its a RP or PP case. PP receipts are still being generated. Unless people who have applied in RP comment on this forum that they have received their notice please please don’t get mislead.

      Looks like the PP is completed for the CSC. Lets keep some hope till 25th April otherwise the PP chances are very slim.

    • Yes.. and even if they have stoped generating pp receipts they haven’t sent all pp receipts for VT yet… so still all pp has chance for VT center…
