As many of you know, H1B Visa 2015 quota was over in the first week and a whopping 172,500 H1B petitions were received in first week by USCIS.  H1B Lottery / random selection was held by USCIS to select 85,000 H1B petitions to fulfil the work permit cap. Many of the unlucky ones are already wondering about next year H1B Visa quota. Also, some of you are planning for H1B visa for next year, you also would be wondering regarding the same. When will the H1B season for fiscal 2016 begin ?

USCIS will accept petitions for H1B Visa 2016 season starting from April 1st, 2015.  USCIS did a press release on March 12th outlining the details. Read summary of press release by USCIS on H1B 2016 .

Will there be lottery again for H1B Visa 2016 ? Predictions ?

We had lottery for FY 2015 and FY 2014. The total number of petitions filed for FY 14 were about 125,000 and for  FY 2015, there were about 172,500 petitions… As H1B Quota did not increase for FY 2016, and the demand does not seem to decrease, we would very likely have lottery for FY 2016.  Read H1B Visa 2016 Lottery Predictions, Dates, Results

What is the H1B Visa quota Cap Count ? Would there be any changes to H1B 2016 count ?

H1B Visa quota cap count is the total number of petitions that USCIS will accept for a fiscal year to provide temporary work permit for highly skilled workers.  For the 2016 fiscal year, the cap count is as below :

  • Regular H1B Quota : 65,000
  • H1B Masters Degree Quota ( only US Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

As per the press release in March 2015, the quota did not increase.  To give some background, as per the Obama executive action in Nov 2014, no changes were announced to the H1B Cap count. There was proposal in 2013 to increase H1B cap from 65,000 to 110,000 and Masters quota to increase from 20,000 to 25,000 did not go through as of March 2015. At least, for this FY 2016 season, the quota is fixed and it will be as above and no changes.

When should I start planning for H1B Visa 2016 ? What are the steps ?

It depends on your situation. Below are few scenarios and your plan.

  • If you are a student on F1 Visa in USA, you need to plan for your internship/ CPT or OPT employment  at a company that can sponsor your H1B Visa for FY 2016. In my view, you should start now to find something for the fall 2014 and continue that for next spring so that you can file for FY 2016
  • If you are in other country and planning for H1B, it is good to start your process around the end of this year 2014. It will give you enough time to find sponsors, search for job, etc.
  • If you are on H4, L1 or other visa in USA and planning for H1B for FY 2016, you also should consider looking around end of this year i.e. December 2014.

Most asked Question – How do I Find H1B Sponsors for FY 2016 ?

This is a million dollar question !  One of the biggest challenges is to find a good sponsor that can offer you a job and wait for you to start work after 6 months of filing your petition.  You should review the detail article on How to find H1B Sponsors for FY 2015. What about Comprehensive Immigration Reform ( CIR) – H1B Visa Changes ? What are they ?

There have been some proposed changes to the H1B Visa program to cater to the demand in the  US economy as part of the Comprehensive Immigration reform. Below are some of the proposed changes.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

These were proposed in 2013, but nothing has moved significantly and all the above are just proposed rules. We are not sure when they will be implemented. You can read  Summary of CIR – Immigration reform – H1B Visa and Green Card  to get an idea. The latest update is that Obama has taken executive action on Immigration in Nov  2014  and none of the below are included as part of that.  Stay tuned for updates.

H1B Visa 2016 Fees – Any changes ? How much does it cost ?

There are various components of the fee. The H1B Application filing fee could range anywhere from $1,600 USD to $4,400 depending on the size of the company. The attorney fee can range from $500 to $3000 depending on the attorney. If you apply for premium processing that is another $1,225. The fees has not changed in the past couple of years for FY 2014 and FY 2015. Unless USCIS revises fee based on immigration reform, it should be same. We will keep you all posted. H4 Visa EAD rule impact on H1B Visa 2016 Season ?

As you know, certain H4 visa holders are now eligible for EAD. The H4 Visa EAD Rule Passed earlier in 2015 and is effective from May 26, 2015.  USCIS will start accepting applications for EAD from those eligible H4 visa holders starting from May 26th. The question is that will that have an impact on number of H1B petitions for this fiscal year  ?  It very likely will have certain impact on the number of H1B applications that are filed for this year 2016 quota. Many of the H4 holders, who would now be eligible for EAD, may not apply for H1B visa, just because it gives them more flexibility to work and more choices to work as well. We would have to wait and see, how much of an impact that would have, but it is very straightforward and no brainer for eligible H4 visa holder to avoid the H1B processing.

H1B visa Premium Processing Changes to H1B Visa 2016 quota ? 

USCIS updated in their press release that the premium processing will be accepted for FY 2016 quota and they will only begin that “no later than May 11, 2015”. What it means for the petitioners is that the official 15 day premium processing clock starts from May 11th, 2015 and their petition could be adjudicated within 15 days from May 11th, which would be May 26th, 2015.  USCIS can process them earlier as well, but their new timeline is just indication for setting the right expectations to meet the stipulated time frame for premium processing.

      • It could be AD. I checked few random receipt numbers from WAC and see that these are processed between 14th and 17th April time frame and no “premium” is mentioned in the description. Hence, not sure exactly it is non-AD or AD for RP

  2. I saw two comments from students who claimed to be on CPT, but whose employers have supposedly filed theirs under AD quota. My question is, can an employer file under AD even before the student has graduated?

    • I am assuming those guys are/were doing second Master’s in some shady Universities (which are’nt in the map), which offers CPT few weeks after joining, just to stay in status and work full time.

      It is not strictly speaking legal. Or let me put it this way. In the USCIS rule books, this is NOT illegal. But it is abusing of F-1 visa. People keep doing this and there is going to be lottery for F-1 visa soon. CPT or curriculum practical training is a program which allows international students to work in a company to complete their Master’s or Bachelor’s. Not the other way around.

        • Thats true. After 24th, we can see results flowing untill June. 95% of selected case will be notified to respective employers by mid of May at MAX. This is fact and true.

          Keep calm untill 24th April. This is my 4th attempt. Lets see.. I am the most unlucky person with lots of patience.

    • Ok good. Last 2 years I observed one thing in Wipro. Those filed their nomination in December & January are getting selected. Who nominated in February or later to that are not selected. Did anyone observed same.

  4. How you differentiate RP vs PP based on case number.
    e.g: EAC1513750848/WAC1513652224 etc.

    The case status as below:

    On April 20, 2015, we received your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number WAC15xxxxxxx / EAC15xxxxxxxx, and emailed you a receipt notice.

      They said they send the receipt (i.e) they mailed the receipts using post not emailed the receipt i.e for Regular processing ..

    • I just tried to do “check status” in USCIS with few receipt numbers EAC1513750848/EAC1513750851 and see that RP receipts are being sent.

        I also tried the same.
        What I did was I tried those Receipts and got the message as “Case Was Received and A Receipt Notice Was Emailed”.

        After that just randomly I changed the last digit and checked it gave “Fees Were Waived”. So does that mean this receipt was not picked in the lottery?

        As I am going through for the first time hence asking my query.

          • #EAC1513750850 is for a diff type of petition , excerpt from USCIS “we received your case and waived the filing fee for your Form I-192, Application for Permission to Enter as Nonimmigrant”.

        • ppl who gets receipt number means they are selected.

          I think “fees were waived” would be due to duplicate petitions, i am not sure. its just my guess….

        • I am not sure if any “fee waiver” exists for I-129 petitions. “Fee Waiver” could be for different petitions.

        • That is due to I-912 form, they would have requested for fee waiver, feeling good about USCIS ..
          they waive off fees for

          “To request a fee waiver for certain immigration benefits and services based on an inability to pay.”

        • For Premium it will be clearly mentioned in the case status. e.g; “On April 16, 2015, we received your request for premium-processing of your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number EAC1513753540, and mailed you a receipt notice. Your premium-processing receipt notice contains contact information …..”

          • You can’t identify from status that it’s a RP or PP..as status is changed later on. For me the day before it was saying that we recieved your request for premium processing. Next day it didn’t mention premium prcoeds ingredients anywhere and just mentioned that my case is recieved and receipt number is emailed. So by looking at status you can’t tell the type of processing.

        • You cannot identify the difference between RP and PP based on case number.
          Only difference is that for PP cases the receipt is sent by email whereas for regular cases it is sent by regular postal service.

      PP – Premium Processing ( it means faster response from USCIS )
      BD- Bachelor degree
      RP – Regular Processing ( it means normal processing time from USCIS)

      VT/VSC – Vermount Service Center
      CSC- California Service Center

      Below are types filing for h1b petition:
      1. AD/PP – means Advanced Degree quota filed as premium
      2. AD/RP – means advanced degree quota filed as regular
      3. BD/PP – means Bachelor Degree quota filed as premium
      4. BD/RP – means Bachelor degree quota filed as regular.

      • My Company filed my H-1B AD/PP/VSC through Fragomen and didn’t hear anything from them yet. I called to my DSO and she told me that there is “Change in Status Request”. Also, she told me that she will send my EAC number through e-mail as she can’t disclose it on phone. AD/PP/VSC and Fragomen Guys Lot of hope and stay calm. Update is at 4/22/2015 10:30 AM from my DSO.

  11. Guys, relax and don’t panic.

    My employer filed my petition last year and I was also curious just like all of you to get the results ASAP. However, my employer told that they start to receive the receipts only after 28th April every year.

    When I contacted them on 28th, they told me that they received the receipt that day itself and forwarded it to me. However, unfortunately my petition got rejected because USCIS wanted a client letter from my employer but my employer couldn’t arrange for it.

  12. My Employer filled 8 Non AD/PP.
    4 to California and 4 to Vermont
    He got responses back for 6 of these all 4 from Vermont and 2 from California. My petition is in the other 2.
    I called my employer today he said it’s 99% not selected. He would have known by now, if it was selected.

    Can I still Hope ?

    • Not sure who came up with that number and how this rumor got started! Is there something on the USCIS website or an official doc/source which talks about such sensitive matters? If so, please enlighten us. Or else stop spreading such figments of imagination…

          • I completely feel you…I have started to reluctantly and painfully think about my exit plan, have to sell/trash everything basically. Maybe in 10 years I can come back if my brother starts a sibling green card application now. Chin up brother where are you originally from?

          • h1bslaughteragain, you really need to grow up and face the facts! It is not over yet and even if you do not get selected, it is not the end of the world. Please start looking at plan B. Everyone knows that there are more people who will not be selected than the lucky ones! The system sucks, but we can’t do anything about it. Just grow up, stop feeling sorry for yourself and stop expecting people on an internet forum to make you feel better. Everyone already has enough to deal with, so please do not add your whining to the list!

    One of the Law firm data-

    ***UPDATE 4/21/15 – As of this morning, we have received receipts for:

    54% of California AD PP

    33% of California Bach PP

    No receipts for Regular Processing cases filed at the California Service Center

    71% of Vermont AD PP (major increase from yesterday)

    36% of Vermont Bach PP (also increased from yesterday)

    No receipts for Regular Processing cases filed in Vermont

  18. Guys its been 3 years i had been trying for H1b. I did 2 masters to be in status. I have seen people who had done 3 masters. The reason i am posting here is that my H1B got picked in the lottery. I can understand the pressure every one if going through. Spread the word saying not to apply more than 1. So that we all have more chances of winning the lo terry. Always have Plan B. All the best. Dont forget that someone loves you very much..

  19. No one confirmed if you sevis record states cap gap extended 9/30 pending uscis case status. Does that mean my friend is selected, He dint get the receipt number.

    Also anyone whose OPT is expiring before October 1st 2015, does the OPT automatically get extended till September 9/30 or only those who got selected

    • Hey I just got the email from the lawyer that i was selected for the lottery. The receipt was dated April 20th. When i called SEVIS service center last Friday, they told me that my status is pending. So I am pretty sure if you status has been either pending or updated, that means you got it.

      • Who told you CTS Infy TCS or any other IT company is fraudster? They file visa for less than 10% of their work force because they need to maintain rotation for running projects. One case of .001% visas misused once in years of H1b doesn’t mean all other 5-6% getting picked in lottery are fradsters. A hefty sum was paid for it, probably million times more than what was saved from that visa. They file only 1 visa per person and are given a fair chance. Most of them are atleast 4-5 years of experienced in IT industry and a thorough background check is done to be eligible for VISA within the company. They don’t crib about AD people getting a higher chance so why are you spitting vemon at them. When you file for LOTTERY, you should be mentally ready to accept the fact that it is YOUR luck which will decide whether YOU will get selected or not.

        For some saying they are AD and are more rightful people to stay in US, I guess there is a reason why you are put in lottery system. US doesn’t want all of you!

        So guys, keep your options open and hope for the best. This is not end of the world! Let your fate decide your future.

  22. Any hope left for AD/PP/VT?? I checked with my DSO and he confirmed that my SEVIS record hasn’t been changed…

    My mind is telling me that I should lose hope while my heart is telling me that I shouldn’t lose faith in God. Many of us came to this country to study and we have already invested a lot.. It is so hard and I don’t think I’ve ever been through something as nearly harsh as this process… All the hatd work to gradute, hard work to find a job, and hard work to do a great job at work is coming down to random lottery.

    • For us who have been investing a lot of money for school in the US and sacrifying our lives to get this far it’s not fair at all . I am trying not to think about it , I can go through this stress again . Let’s just hope God will do the best for us wether we got selected or not . I do not understand people in this website . They think getting selected in this freaking lottery is like going to heaven . This system is not fair and for that reason I won’t let this lottery kill me . At this point I am trying to get to plan B which is going back home with no worries

      I think waiting is what makes it worse.. if we get to know on day 1 if we are in or out it would have been great.

      But you know this lottery makes us realise that life is very random and everything is like a lottery, we only seem to have partial control over it.

      We can’t pick our looks, brains, parents etc..

      Luck plays a big factor..

    • Same feeling and it’s even more annoying when people around you are discussing about RFE’s
      and their multiple petitions!!!!
