As many of you know, H1B Visa 2015 quota was over in the first week and a whopping 172,500 H1B petitions were received in first week by USCIS.  H1B Lottery / random selection was held by USCIS to select 85,000 H1B petitions to fulfil the work permit cap. Many of the unlucky ones are already wondering about next year H1B Visa quota. Also, some of you are planning for H1B visa for next year, you also would be wondering regarding the same. This article addresses many of the common questions, it will be updated constantly, whenever any changes to info.  Bookmark this page !  To start with, firstly the news updates on this season, followed by many commonly asked questions.

When will the H1B season for fiscal 2016 begin ?

USCIS will accept petitions for H1B Visa 2016 season starting from April 1st, 2015.  USCIS did a press release on March 12th outlining the details. Read summary of press release by USCIS on H1B 2016 .

Will there be lottery again for H1B Visa 2016 ? Predictions ?

We had lottery for FY 2015 and FY 2014. The total number of petitions filed for FY 14 were about 125,000 and for  FY 2015, there were about 172,500 petitions… As H1B Quota did not increase for FY 2016, and the demand does not seem to decrease, we would very likely have lottery for FY 2016.  Read H1B Visa 2016 Lottery Predictions, Dates, Results

What is the H1B Visa quota Cap Count ? Would there be any changes to H1B 2016 count ?

H1B Visa quota cap count is the total number of petitions that USCIS will accept for a fiscal year to provide temporary work permit for highly skilled workers.  For the 2016 fiscal year, the cap count is as below :

  • Regular H1B Quota : 65,000
  • H1B Masters Degree Quota ( only US Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

As per the press release in March 2015, the quota did not increase.  To give some background, as per the Obama executive action in Nov 2014, no changes were announced to the H1B Cap count. There was proposal in 2013 to increase H1B cap from 65,000 to 110,000 and Masters quota to increase from 20,000 to 25,000 did not go through as of March 2015. At least, for this FY 2016 season, the quota is fixed and it will be as above and no changes.

When should I start planning for H1B Visa 2016 ? What are the steps ?

It depends on your situation. Below are few scenarios and your plan.

  • If you are a student on F1 Visa in USA, you need to plan for your internship/ CPT or OPT employment  at a company that can sponsor your H1B Visa for FY 2016. In my view, you should start now to find something for the fall 2014 and continue that for next spring so that you can file for FY 2016
  • If you are in other country and planning for H1B, it is good to start your process around the end of this year 2014. It will give you enough time to find sponsors, search for job, etc.
  • If you are on H4, L1 or other visa in USA and planning for H1B for FY 2016, you also should consider looking around end of this year i.e. December 2014.

Most asked Question – How do I Find H1B Sponsors for FY 2016 ?

This is a million dollar question !  One of the biggest challenges is to find a good sponsor that can offer you a job and wait for you to start work after 6 months of filing your petition.  You should review the detail article on How to find H1B Sponsors for FY 2015. Your first place of start is to find the H1B Sponsors in an area or by company. Use our H1B Visa Sponsors Database to search and filter. What about Comprehensive Immigration Reform ( CIR) – H1B Visa Changes ? What are they ?

There have been some proposed changes to the H1B Visa program to cater to the demand in the  US economy as part of the Comprehensive Immigration reform. Below are some of the proposed changes.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

These were proposed in 2013, but nothing has moved significantly and all the above are just proposed rules. We are not sure when they will be implemented. You can read  Summary of CIR – Immigration reform – H1B Visa and Green Card  to get an idea. The latest update is that Obama has taken executive action on Immigration in Nov  2014  and none of the below are included as part of that.  Stay tuned for updates.

H1B Visa 2016 Fees – Any changes ? How much does it cost ?

There are various components of the fee. The H1B Application filing fee could range anywhere from $1,600 USD to $4,400 depending on the size of the company. The attorney fee can range from $500 to $3000 depending on the attorney. If you apply for premium processing that is another $1,225. The fees has not changed in the past couple of years for FY 2014 and FY 2015. Unless USCIS revises fee based on immigration reform, it should be same. We will keep you all posted. H4 Visa EAD rule impact on H1B Visa 2016 Season ?

As you know, certain H4 visa holders are now eligible for EAD. The H4 Visa EAD Rule Passed earlier in 2015 and is effective from May 26, 2015.  USCIS will start accepting applications for EAD from those eligible H4 visa holders starting from May 26th. The question is that will that have an impact on number of H1B petitions for this fiscal year  ?  It very likely will have certain impact on the number of H1B applications that are filed for this year 2016 quota. Many of the H4 holders, who would now be eligible for EAD, may not apply for H1B visa, just because it gives them more flexibility to work and more choices to work as well. We would have to wait and see, how much of an impact that would have, but it is very straightforward and no brainer for eligible H4 visa holder to avoid the H1B processing.

H1B visa Premium Processing Changes to H1B Visa 2016 quota ? 

USCIS updated in their press release that the premium processing will be accepted for FY 2016 quota and they will only begin that “no later than May 11, 2015”. What it means for the petitioners is that the official 15 day premium processing clock starts from May 11th, 2015 and their petition could be adjudicated within 15 days from May 11th, which would be May 26th, 2015.  USCIS can process them earlier as well, but their new timeline is just indication for setting the right expectations to meet the stipulated time frame for premium processing.

  1. Hey guys..my employer told me they have filed my H1B. How do I verify as many of employee says that the employer always say so n does not actually apply H1..m worried ..is there any way where I can make sure that he isn’t lying

  2. You guys shouldn’t take the lottery bad luck so tragically. It may be for good. I don’t know if you realize that this puts on a road for more pain. The current wait times for EB3-India is more than 10y and if you get laid off on H1 you have 10 day to leave the country. I know few guys on H1s who got laid off and had to sell their houses, take the kids from schools and clear the country in no time. It may be for good if you don’t win the lottery.

    My Non-AD/RP, H1B application was filed, (not through a consultancy), and I am waiting for the results eagerly.

    However going through some posts here, I wonder why am I seeing such pretentious behavior from some of the AD candidates, as if the H1B program only belongs to them?

    There are Non-AD candidates who have achieved a lot more in life working hard enough and they deserve an equal chance.

      • Any application is deserving …but considering the fact that applicants from India continue with their life… but for applicants from the US, they might have to leave the country, find a new job basically a big change… apart from that i believe there is difference… and the frustration of this ambiguity for the applicants from US is making them take these statements.

      • I remember GIMS guys share results in batches only.
        It will be really good if they share the status immediately as soon as they receive receipts.

        • Mine is 3rd attempt……. So excited to see the result….. GIMS wont share any untill May 2nd week..Because if they share the results in batches, rest of the guys will shoot alot of emails, Tickets to GIMS…….. This is year Wipro files 10,000 applications.. Last year it was 5000, out of which 2,500 got selected…….

  6. I have finished 2 years on L1 visa and now applied for H1 NonAD/RP. I applied casually but I am getting nervous reading the comments. I hope I am as lucky as some of the folks here !!!

        • The time on L1 counts against the max allowed on H1 so you get no benefit from switching, you are just taking the chance away from somebody.

          • That is not true at all. There are many advantages. He can change employers on H1, which is not possible on L1. He can stay a year longer in H1, assuming he is on L1B (6 vs 5 years total). There is no prevailing wage req for L1, and Indian companies typically pay you the bottom rung amount like 60 K. Last but not least, even if he applies for a GC, and has labor pending, or has an approved 140, L1 can NOT be extended for more than 5 years based on that.

        Mine is non AD/RP/Vermont and yeah its my third attempt.. mostly if I don’t get selected this time I will hate US.

  8. Feeling lucky. Got email from my attorney with my receipt number. The e-mail was sent on Friday 8:09 pm and the Receipt date was 04/13/2015. My application was AD/PP/CSC.

    Can you share the receipt number from vermont with the date when you received it and if it was by mail or email?

    I received my h1 receipt under AD/PP/VT today afternoon.I work for a fortune 5 company based out of east coast and this was my second chance in lottery . I luckily made through this time before being put on edge. There are few things I noticed fro my experience last year and this year.
    – Most of the AD/PP receipts are issued before PP window starts but there are sometimes exceptions too.I know few friends who received their PP receipts in mid of may last year.
    – Someone mentioned a crude way to know if you are picked in lottery by checking your SEVIS status. Post said if it shows status as Pending Update or something of that kind then you selected , if active then not selected. This is incorrect information as I called SEVIS to know my status today after I got my receipt and my Status is Still Active. I have got this verified for another SEVIS number of friend of mine who received his receipt today – AD/PP/CALIFORNIA today.

    Guys do not loose hope! I know its painful but you will eventually sail through. Good luck to all! Best

  17. From 18 people in my team it seems only 6 of us got the AD/PP. Sad for all of us. Will try again next year. Hopefully will have some new reforms like increase in quota or no lottery for masters.

    Non AD/PP/VSC. We have been waiting for a H1 receipt number. Today we received a receipt notice and number for my son’s H4 petition. Does this mean my H1 petition has been selected in the lottery? I have not received any notice for my H1 petition so far.

    I would appreciate your input. I not sure whether i can be hopefull or not

    • Yes. You are also picked in the lottery. Without your H1, your son’s H4 would not go through. So the fact that you received your son’s H4 proves that your H1 got picked in the lottery.

It doesn’t matter how Gulti you are, how fake your resume is, or how many petitions you filed; if you don’t get the visa then whole point of being righteous and filing one petition with a fortune 100 company means squat.

  20. Hello guys. Hope you all are having a good day. I would like you to know that unfortunately one of our consultancy in Boston was closed and blacklisted by USCIS. We have appealed to remove the restriction but it seems like it will be a waiting game. Without wasting much I will get to the point. We are starting a new consultancy in Lincoln, Nebraska. Rathan Consultants. We will accept people from all engineering, computer and IT backgrounds. We will sponsor our employees.

    Thanks a lot redbus2us, it is an amazing blog and helped me through some real tough times. This was my last chance, I had to switch jobs (actually went from a high paying job to a lower one just to get a STEM extension) but at the end of the day really happy now.
    Guys like me (last chance) please don’t lose hopes, this year I was determined to remain positive throughout the process and it has really helped me in these days. I know it is easier said than done, but don’t lose hope.

    • Just heard back from Fragomen in NYC. AD/PP/VT (EAC1513652XXX). Missed the lottery last time, so was almost losing hopes this year but phew. Big relief. Abhi toh party banti hai…..Do not lost hope guys. There is still a chance. Its a terrible process and I feel much more for the AD applicants, who have invested so much money and time to set themselves in this country. Sucks that there is a system where a cancer pharma researcher can get beaten by a Java developer for work permit. But such is the system. Hopefully congress does something about it.

  22. My opt will be expired on June 18th. I called DSO on Friday. They told that my sevis is “change of status pending” but there is no receipt number yet. what does it mean? My case is in premium processing.

    • I have to say, the chance is low now, cause seems like uscis is inform H1b receipt by company, and many of my friend in oracle have already receive receipt last Tuesday. They are all PP AD

  27. non-PP, Adv, CSC. Give up, ask employer to check if their check is cashed, and they tell me as of 15th, check has not been cashed.
