As many of you know, H1B Visa 2015 quota was over in the first week and a whopping 172,500 H1B petitions were received in first week by USCIS.  H1B Lottery / random selection was held by USCIS to select 85,000 H1B petitions to fulfil the work permit cap. Many of the unlucky ones are already wondering about next year H1B Visa quota. Also, some of you are planning for H1B visa for next year, you also would be wondering regarding the same. When will the H1B season for fiscal 2016 begin ?

USCIS will accept petitions for H1B Visa 2016 season starting from April 1st, 2015.  USCIS did a press release on March 12th outlining the details. Read summary of press release by USCIS on H1B 2016 .

Will there be lottery again for H1B Visa 2016 ? Predictions ?

We had lottery for FY 2015 and FY 2014. The total number of petitions filed for FY 14 were about 125,000 and for  FY 2015, there were about 172,500 petitions… As H1B Quota did not increase for FY 2016, and the demand does not seem to decrease, we would very likely have lottery for FY 2016.  Read H1B Visa 2016 Lottery Predictions, Dates, Results

What is the H1B Visa quota Cap Count ? Would there be any changes to H1B 2016 count ?

H1B Visa quota cap count is the total number of petitions that USCIS will accept for a fiscal year to provide temporary work permit for highly skilled workers.  For the 2016 fiscal year, the cap count is as below :

  • Regular H1B Quota : 65,000
  • H1B Masters Degree Quota ( only US Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

As per the press release in March 2015, the quota did not increase.  To give some background, as per the Obama executive action in Nov 2014, no changes were announced to the H1B Cap count. There was proposal in 2013 to increase H1B cap from 65,000 to 110,000 and Masters quota to increase from 20,000 to 25,000 did not go through as of March 2015. At least, for this FY 2016 season, the quota is fixed and it will be as above and no changes.

When should I start planning for H1B Visa 2016 ? What are the steps ?

It depends on your situation. Below are few scenarios and your plan.

  • If you are a student on F1 Visa in USA, you need to plan for your internship/ CPT or OPT employment  at a company that can sponsor your H1B Visa for FY 2016. In my view, you should start now to find something for the fall 2014 and continue that for next spring so that you can file for FY 2016
  • If you are in other country and planning for H1B, it is good to start your process around the end of this year 2014. It will give you enough time to find sponsors, search for job, etc.
  • If you are on H4, L1 or other visa in USA and planning for H1B for FY 2016, you also should consider looking around end of this year i.e. December 2014.

Most asked Question – How do I Find H1B Sponsors for FY 2016 ?

This is a million dollar question !  One of the biggest challenges is to find a good sponsor that can offer you a job and wait for you to start work after 6 months of filing your petition.  You should review the detail article on How to find H1B Sponsors for FY 2015. What about Comprehensive Immigration Reform ( CIR) – H1B Visa Changes ? What are they ?

There have been some proposed changes to the H1B Visa program to cater to the demand in the  US economy as part of the Comprehensive Immigration reform. Below are some of the proposed changes.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

These were proposed in 2013, but nothing has moved significantly and all the above are just proposed rules. We are not sure when they will be implemented. You can read  Summary of CIR – Immigration reform – H1B Visa and Green Card  to get an idea. The latest update is that Obama has taken executive action on Immigration in Nov  2014  and none of the below are included as part of that.  Stay tuned for updates.

H1B Visa 2016 Fees – Any changes ? How much does it cost ?

There are various components of the fee. The H1B Application filing fee could range anywhere from $1,600 USD to $4,400 depending on the size of the company. The attorney fee can range from $500 to $3000 depending on the attorney. If you apply for premium processing that is another $1,225. The fees has not changed in the past couple of years for FY 2014 and FY 2015. Unless USCIS revises fee based on immigration reform, it should be same. We will keep you all posted. H4 Visa EAD rule impact on H1B Visa 2016 Season ?

As you know, certain H4 visa holders are now eligible for EAD. The H4 Visa EAD Rule Passed earlier in 2015 and is effective from May 26, 2015.  USCIS will start accepting applications for EAD from those eligible H4 visa holders starting from May 26th. The question is that will that have an impact on number of H1B petitions for this fiscal year  ?  It very likely will have certain impact on the number of H1B applications that are filed for this year 2016 quota. Many of the H4 holders, who would now be eligible for EAD, may not apply for H1B visa, just because it gives them more flexibility to work and more choices to work as well. We would have to wait and see, how much of an impact that would have, but it is very straightforward and no brainer for eligible H4 visa holder to avoid the H1B processing.

H1B visa Premium Processing Changes to H1B Visa 2016 quota ? 

USCIS updated in their press release that the premium processing will be accepted for FY 2016 quota and they will only begin that “no later than May 11, 2015”. What it means for the petitioners is that the official 15 day premium processing clock starts from May 11th, 2015 and their petition could be adjudicated within 15 days from May 11th, which would be May 26th, 2015.  USCIS can process them earlier as well, but their new timeline is just indication for setting the right expectations to meet the stipulated time frame for premium processing.

    AD/PP -> Very few left (notices would not have reached or attorney would not have informed)
    non-AD/PP-> started sending receipts in Cali ..(You may know by Tuesday/Wed)
    RP ->Not started atleast in Cali…(should see fast movement by Wednesday)

    Correct me if i am wrong……

    • Buddy ..you are half right

      I think AD/PP/CA is done..so if somebody has not recieved a notice by now, then chances are slim now
      However, for AD/PP/VT, they have not even started sending the notices yet. In fact, Vermont has not sent out anything yet. There are ways to find out your receipt number like checks, SEVIS etc, but nothing has come out officially yet..if you are in this category, you need not worry

  3. Hi am waiting for non ad/rp . Does anyone got the lottery results for the same.
    Also can someone pls answer the attorney when will come to know if the lottery isn’t picked. Will it be the same day as people receive the receipts

    • If you are not get selected in lottery then they won’t notify anyone and attorney will come to know by when packet gets returned to attorney.

    • If you are picked you get a notification, otherwise no notification (the package will be quietly returned and you will know after a few months).

      If you do not get picked up, and notified by May 2nd week, the chances of of the application being returned are very very HIGH.

      To answer your question, no, there are no other 'lottery' like step after that, it's just standard approval formalities.

  11. My attorney said California center has issued all PP receipts on Friday and chances are very slim now. I am losing hopes. This was my third attempt.

  12. My Consultant didn’t charge me anything but he never shared any details of my H1B processing till date. Is something fishy here? Can anyone tell me the reason why a consultant would hide all details from his prospective future employee.

    • Fishy or not , cannot be commented — There is as such not much useful detail ( for you who has really not much idea about H1)
      SO, hold on, you can trust your consultant — just to be optimistic — Genuine people do exist

      anyways, first details of any use for you could be the result of H1B Lottery ( 1st week of may , that too by tracking cheque encashment) and or receipt number ( wait for this till mid may – the receipt may come by letter – mail) , you can track your H1b status using receipt number — if your employer share the number with you..

      then things move on for approval of H1b ( may , june or can go till september)

      So, google more about the process yourself.

  13. Since the h1b applications are dominated by Indians, I have a question for you guys. Why immigrate? There’s must be something pushing you guys if I have to leave all my friends and family just to come work to here on a middle class wage (70k-150k). Is India that bad and lack of opportunity? Sorry for the ignorance. I’m just curious. I’m on lottery too but its not that big of deal if I don’t win. Anyways I wish you all a good luck.

    • India is not that bad.Its a democratic country and if you have money you can live freely. To have money you have to sacrifice your entire life.A middle class family man/women earning 40,000 rupees per month in a city like Mumbai or Chennai have to suffer and live,because his three fourth of the salary goes for rent and other expenses. Pollution,corruption and not so safe for women adds a little more worry to that family man/women.
      Its hard but a bitter truth that life is a little tough for an average earning person in this dynamic and ever changing society driven by “MONEY”

      First cross the Ocean/continents and experience yourself \
      Remember advertisment ( Bachan ji on Gujrat) ??– Ab aayey ho toh kuch din toh Gujaro “Gujrat ” Ah Ah –> America mein .

      Now, here goes some good things about America
      1. – It’s free world , people donot care what you are upto — India mein : big problem is ” Log kya kahengey” or and people watch what you do , when you come to flat , what you do , why you do , why donot you do , wha you wear , what you eat , how you eat and how you excrete ..may be — hell lot of opinions about you by society
      2. Clear sky ( no pollution) , clean roads( obviously , we, you , me and many try to keep them clean in India too , but not all people , hence the difference)
      3. Food is awesome and infact ( sometimes I can say cheaper than india , if you compare the quality that we get in restraunts in India)
      4. Clothes, shoes and many more things — I think are cheaper
      5. You get good work culture to work in
      6. Probably more opportunities in hitech work — we get outsourced / mechanical work in India actually
      ( I worked for a big Korean Mobile company for software dev)
      7. Global exposure
      8. No Corruption ( I presuume at lowe level / common people level)
      9. Safety , people follow rules and it’s not easy to break rules / big punishments, so good to see rule following people and good traffic sense — so no stress on roads and life is simple if all follow rule.
      10. Cheaper fuel ( and clean fuel) – easy to buy car ( Bwm, audi) and to buy house here — India is really expensive for housing and cars

      P.s. there could be hell lot of bad things here , not counting those
      ( India is still superb, but do give a try here in USA and enjoy life / work , which is quite stressful in India at time )

      I am female engineer born in India. I did my masters from a good school and worked in a bay area startup for 2 and half years

      Now I am working in india again from home since Jan 2015 for my US employer.

      For me personally, it is not about the money at all, it is about the respect and quality of work.

      First, I find that US is far less racist and sexist. Also you are appreciated based on your hard work and productivity, unlike India where people are very judgemental.

      Second, I find US a lot safer, I can go out post mid-night to a pharmacy all by myself if needed. I cannot dare to do that in India.

      And most importantly, I get to stay away from all those relatives/”society” who think a woman’s primary role in life is to get married, produce babies and work/study only if her in-laws/husband allows. I just want to concentrate on my career as I love my work.

      And a note to those who think that going to US will make you quick money, you are in for a BIG surprise!

      • You last sentence stating “BIG SURPRISE”, can you throw some light? Keeping in mind in general Indians are good in money saving, then why can’t save more in US when we get more salary

        • If you are in Bay area (Silicon Vally) and you are married, then you saving per month would be less then 500 to 1000$.
          50% of your salary goes to rent, and with remaining 50% you have to take care of your taxes, health insurance, car, home, bills, trips & fun etc…

        • I stayed in bay area for 2 years and half (single) with a pretty decent salary and this is based on my experience.

          I dont think I was even lavishly spending, just on basic things like rent, car installment, insurance, utilities and home cooked food.

          And if you have any plans to buy a home in US (settle down there), it feels like a far-fetched dream

          Anyway no need to take my word. You will find out yourself when you move there. :-).

          If someone told me all this 4 years back, I wouldn’t have believed them too.

        • This not something that I read in papers or heard from friends.

          This is based on my personal experience, and I think I have spent a decent amount of time in India and in some more developed countries (US, Singapore etc)

          I am not sure where in US you worked, but maybe your experiences were different from mine.

          I have seen so much divide in india on the basis of caste, skin color, language, north indian/ south indian etc.

          It is amazing how we indians outside india never even think about all this and behave so differently.

          As a girl, not once did I face any discrimination in any city in US (I spent significant time in 4 cities there).

          Again this is based on my personal experience, you are free to have your own opinion but calling me a liar is not going to help.

      • The big picture is that around 70% of the “poorest” population of the world lives in India. All ills of this country are linked with this aspect – the filth, corruption, crime are merely under-statements. Society as a whole is affected. This makes some people struggle to get out this mess and attempt to live and work at the other end in environments thar are cleaner, even if it means earning less, paying more taxes, or saving less. Hence, more applicants for H1B.

    I see so many people here in the same situation as I am in. This year will be my last attempt. I am keeping my status intact by going to school for a second masters (thats about to complete this year by june).

    I applied AD-Regular in 2013(cap 2014), 2014 (cap 2015) — and both times I did not get lucky. (Single application from one employer both times).

    I hope I get picked this time. I applied regular again – one application. Wish you all the very best. To those who already got their receipts, congratulations 🙂

      • Technically Yes,
        But do not waste time for 60 days.. by may 2nd week, implement plan B, start the school admission process, otherwise it is a big headache.

        Also it will be easier to get stamping for student visa if you already took a 1 or 2 courses in the school and then go for stamping.

    • Hi Dear keep faith and hang in there, see I also lost all hope and even stopped checking my bank account to see if pp check is en cashed or not.. but I just checked today and found my check is en cashed. I dont know if its for sure that I am picked in lottery or not but I am 50% hopeful that I am picked.

  18. Hi All – I gave premium processing check from my side and I see in my account this as per last evening “Check # **** Converted to Electronic Transaction By Csc Field Office Payment **********” So does this means I am picked in Lottery? Please tell me guys.. please…

  19. USCIS should change the rules regarding multiple filings – it just doesn’t make sense. Whereas I believe the original intent of this system was to give all employers a fair chance of getting an employee of choice, this loophole is used by cheaters now!

  20. Does anyone know if USCIS actually selected 85000 (inc 5800 for resereved)?

    Think why is US having all this different immigration requirement? How would anyone know even if they picked say 150k-155k petitions and may be reject 20-25k with rfe’s, noids etc. Think this practicall, if someone if ready to pay appx $3000.00 per app and live in US, with say about $75000.00 annual salary. Considering taxes and other deduction appx 35%, living expenses $2000.00 per month all you will be left with is around $25-30k. My point is, you would US gov not like this? Just a thought. Feel free to comment !!!

    • Because those 70-80k salary could have gone to the American citizens and cutting unemployment rate. H1b cap is there to protect American labor market. Though the maximum number of quota is another story. And lottery allow a company of any size to have an equal chance of hiring a foreign national. The duplicate filing is such crap but I guess that’s how to raise their revenue.

  22. Guys, especially who already received receipt numbers, I have a question.

    I see a lot of you have checked your sevis status to figure out whether you are selected or not.

    is it also works for student who is still taking semester or OPT worker whose OPT expires after Oct 1ST 2015?

    I am desperately waiting for my receipt but want to go move on if I can check myself through this way.

  23. Both WAC and EAC started issuing RP receipts mid-day on Friday. So hope is practically gone for PP cases still without an email notice.

    My friend AD/PP/CA, received his receipt # today from his attorney processed on April 17 WAC151375XXXX I guess there are lot more receipts to be sent out yet. If you search with this you will also notice non/pp receipts in between processed on April 13 and after couple 1000 they again start with PP receipts. Just hand out tight and waiting for that email from USCIS !!!

  26. Guys, I just got an email this morning from my lawyer saying that my H1b application was chosen for the CAP. Also I have applied for premium process so there’s still hope for others that applied with premium process. Wish you the best!

    • I am also waiting for H1B result. Is anyone know what categories is Hawaii in? My employer applied the expedia and told me the lottery result will come out in the end of May but a lot of people already know the result. Its it different from each state? Thank you.

  28. Hey guys, AD/PP/CA and still waiting…I almost had a nervous breakdown at work on Friday after not hearing back. Anyhow, after some painstaking number plugging into the USCIS case status website, as of 4/18/15 0700 PST now, the latest receipt numbers issued are WACxxxxxx4047 and EACxxxxxx4016. These receipt numbers were issued yesterday afternoon, and nothing has moved forward for almost a full day. Maybe they are not processing any in the weekend.

    I can’t imagine there only being 8,000 or so PP cases that have made it through the lottery out of the 233,000 applications. And even out of those 8,000 so far, few of them are I-539 petitions which are not cap-subject. Have hope, I have the feeling a good bulk of PP receipts will be sent out next week! I am trying to prepare myself mentally for not making it through, which is excruciating (my OPT expires 5/31), but it is not over yet for sure.     If AD/PP are not selected in Masters Quota of 20000 but are selected in 65000 cap. How would they be notified? I heard the general rule to send the receipts is,
    1. AD/PP
    2. Non-AD/PP
    3. AD/Regular
    4. Non-AD/Regular.
    So if AD/PP is selected in 65000 cap will his sequence be “2” from above? Plz share your thoughts !!!

    I have one query in mind , if you know then please comment.
    I am working in a company X in india and same company has filed h1 for me from it’s US office. Do you think this company can apply L1 visa for me ? I meant actually people who join US office they need to resign here in india. It’s like same name & CEO but diff company.

    • Yes they can file for L1B if you have worked for their indian branch for 1 year.

      However they need to do some good paper work and prove that you have “specialized knowledge”.

    • Yes. Vermont started generating receipts today.. till now around 80 were generated for today among which there was no premium receipts. I guess premium from Vermont are done till yesterday.
      Latest EAC1513950001 to EAC1513950075 … all are regular cap and other applications.

It just shows u r a loser. @everybody, my attorney firm, which handles multiple big tech companies’ h1b accounts in Silicon Valley confirmed that till 16th they did not receive even a single reponse for Vermont filing. And though I did not check yestarday (17th), it is simple logic that even if Vermont started to send on 17th, all PP cant be done in a day. So, this guy is spreading a rumors sitting in a village, having no idea of h1b.

        • Check the receipts numbers which i posted. There was no single Premium case. Be optimistic but be logical at the same time. Post me the receipt number which shows its premium from which i posted. Stop behaving as if your a born citizen of US.

    I Got to know from my employer yesterday that mine application check got cashed, but no receipt number yet. AttoRney says, mine was picked in lottery & receipt will come later(?). This is my second attempt . Please do not loose hope.

    • No, it’s not over yet, despite that they started with small amount of reg processing it’s not over for premium processing. People with ad and non-ad premium processing still getting their receipt numbers. Wait till the end of the next week. Good luck and be patient.

    • how are you sure that its regular processing.I don’t think they inform any information regarding the same.Also no acknowledgement whether the file reached uscis and it was in the lottery process or so. Am i right?

      • when u open your case details in myvisa link you can find wt application is you are, whether rp or premium, mostly cog wont do pp for resources, they sent mailsaying that our application sent to uscis, thats is the only acknowledgement that we receive from cog

  49. uscis said they will start sending notifications for premium processing from 27th April but looks like they have already started.

    • USCIS said “On April 27, 2015, U.S. Citizenship and Immigration Services (USCIS) will begin premium processing for cap-subject H-1B petitions requesting premium processing, including petitions seeking an exemption for individuals with a U.S. master’s degree or higher”

      They are sending PP notifications from this week and looks like almost done…

        • What USCIS is doing just now isn’t premium processing of applications. They are merely sending out receipt numbers – and premium processing are dealt with first for this, therefore receiving their receipt number before those who have applied under regular processing.

          The actual processing of applications is where they review those selected in the lottery – which will begin NO LATER THAN April 27th. So this could begin some time before then
