As many of you know, H1B Visa 2015 quota was over in the first week and a whopping 172,500 H1B petitions were received in first week by USCIS.  H1B Lottery / random selection was held by USCIS to select 85,000 H1B petitions to fulfil the work permit cap. Many of the unlucky ones are already wondering about next year H1B Visa quota. Also, some of you are planning for H1B visa for next year, you also would be wondering regarding the same. This article addresses many of the common questions, it will be updated constantly, whenever any changes to info.  Bookmark this page !  To start with, firstly the news updates on this season, followed by many commonly asked questions.

When will the H1B season for fiscal 2016 begin ?

USCIS will accept petitions for H1B Visa 2016 season starting from April 1st, 2015.  USCIS did a press release on March 12th outlining the details. Read summary of press release by USCIS on H1B 2016 .

Will there be lottery again for H1B Visa 2016 ? Predictions ?

We had lottery for FY 2015 and FY 2014. The total number of petitions filed for FY 14 were about 125,000 and for  FY 2015, there were about 172,500 petitions… As H1B Quota did not increase for FY 2016, and the demand does not seem to decrease, we would very likely have lottery for FY 2016.  Read H1B Visa 2016 Lottery Predictions, Dates, Results

What is the H1B Visa quota Cap Count ? Would there be any changes to H1B 2016 count ?

H1B Visa quota cap count is the total number of petitions that USCIS will accept for a fiscal year to provide temporary work permit for highly skilled workers.  For the 2016 fiscal year, the cap count is as below :

  • Regular H1B Quota : 65,000
  • H1B Masters Degree Quota ( only US Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

As per the press release in March 2015, the quota did not increase.  To give some background, as per the Obama executive action in Nov 2014, no changes were announced to the H1B Cap count. There was proposal in 2013 to increase H1B cap from 65,000 to 110,000 and Masters quota to increase from 20,000 to 25,000 did not go through as of March 2015. At least, for this FY 2016 season, the quota is fixed and it will be as above and no changes.

When should I start planning for H1B Visa 2016 ? What are the steps ?

It depends on your situation. Below are few scenarios and your plan.

  • If you are a student on F1 Visa in USA, you need to plan for your internship/ CPT or OPT employment  at a company that can sponsor your H1B Visa for FY 2016. In my view, you should start now to find something for the fall 2014 and continue that for next spring so that you can file for FY 2016
  • If you are in other country and planning for H1B, it is good to start your process around the end of this year 2014. It will give you enough time to find sponsors, search for job, etc.
  • If you are on H4, L1 or other visa in USA and planning for H1B for FY 2016, you also should consider looking around end of this year i.e. December 2014.

Most asked Question – How do I Find H1B Sponsors for FY 2016 ?

This is a million dollar question !  One of the biggest challenges is to find a good sponsor that can offer you a job and wait for you to start work after 6 months of filing your petition.  You should review the detail article on How to find H1B Sponsors for FY 2015. What about Comprehensive Immigration Reform ( CIR) – H1B Visa Changes ? What are they ?

There have been some proposed changes to the H1B Visa program to cater to the demand in the  US economy as part of the Comprehensive Immigration reform. Below are some of the proposed changes.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

These were proposed in 2013, but nothing has moved significantly and all the above are just proposed rules. We are not sure when they will be implemented. You can read  Summary of CIR – Immigration reform – H1B Visa and Green Card  to get an idea. The latest update is that Obama has taken executive action on Immigration in Nov  2014  and none of the below are included as part of that.  Stay tuned for updates.

H1B Visa 2016 Fees – Any changes ? How much does it cost ?

There are various components of the fee. The H1B Application filing fee could range anywhere from $1,600 USD to $4,400 depending on the size of the company. The attorney fee can range from $500 to $3000 depending on the attorney. If you apply for premium processing that is another $1,225. The fees has not changed in the past couple of years for FY 2014 and FY 2015. Unless USCIS revises fee based on immigration reform, it should be same. We will keep you all posted. H4 Visa EAD rule impact on H1B Visa 2016 Season ?

As you know, certain H4 visa holders are now eligible for EAD. The H4 Visa EAD Rule Passed earlier in 2015 and is effective from May 26, 2015.  USCIS will start accepting applications for EAD from those eligible H4 visa holders starting from May 26th. The question is that will that have an impact on number of H1B petitions for this fiscal year  ?  It very likely will have certain impact on the number of H1B applications that are filed for this year 2016 quota. Many of the H4 holders, who would now be eligible for EAD, may not apply for H1B visa, just because it gives them more flexibility to work and more choices to work as well. We would have to wait and see, how much of an impact that would have, but it is very straightforward and no brainer for eligible H4 visa holder to avoid the H1B processing.

H1B visa Premium Processing Changes to H1B Visa 2016 quota ? 

USCIS updated in their press release that the premium processing will be accepted for FY 2016 quota and they will only begin that “no later than May 11, 2015”. What it means for the petitioners is that the official 15 day premium processing clock starts from May 11th, 2015 and their petition could be adjudicated within 15 days from May 11th, which would be May 26th, 2015.  USCIS can process them earlier as well, but their new timeline is just indication for setting the right expectations to meet the stipulated time frame for premium processing.

    • SR,
      Term of 797 depends upon several factors like what employer requested, and what USCIS deemed appropriate based on submitted information and documents. In case of consulting companies, if the supporting project is for 1 year or if USCIS has concerns about employer’s financial stability 1 year from now, then they approve it for a shorter duration.

    I was waiting for this day.. Yesterday on Dec 3, 2015, case got approved. I was waiting from 8 months for this.. finally feeling i got it.

    13 / Apr – case revived
    20 / Aug – RFE
    10 / Nov – Responce recived for RFE
    3 / Dec – Approved.

    I don’t know its PP / RP. because my company was in process to upgrade it to PP in Nov last week. But i don’t know they have upgraded or not.

    Its WAC center.

    Best of luck for everyone, and suggestion for new applicants is never ever go for H1B, Its pain..

    I have been waiting since 4 months
    Ni update till now.
    Daily getting up 5 in the morning and checking for the status . I have been doing this since 4 months!
    Am fed up with it Now.
    RFE – Aug 18th
    Rfe submit – sep 18th
    Rfe received — Oct 7th.

    And still waiting for the update .
    Guys no idea what to do.
    Approval is very important for me !
    Can someone please help me .
    Do I have any chance ?
    Can I still expect something good ??
    should I still continue the above mentioned process 🙁 ??

    • Waiting too, California center RFE received Oct 22. The response timing from USCIS seems random. As per this forum, for some people it seems to be taking 2-3 months post RFE receipt and for some less than 10 days. Unpredictable. Endless wait!!

      I bet no body can answer your question. how long? It depends on our luck and immigration officer work load. But surely we will hear keep praying God. Share your rfe details and your rfe response so that ppl here can relate your case to their own and can give you some feedback. Without mentioning anything, just putting dates and expecting some replies for that is really waste of your time and others time, sorry to say like this but be in detail when you ask something. Because each case is different here in case of h1b,

    My Case was in RFE in sep 2015, and submitted the evidence in Nov, In Mid Nov my case status was changed to Approved.
    02.12.2015 Again i can see the status changed

    • There was issue with your Address .Contact to your Employer , If you move out you can change your adress on USCIS site.
      No need to worry.Your petition was already been approved.

From the description it looks like the approved documents sent by USCIS to TCS doesnot look no one picked and thats the reason Post office returned back documents to USCIS . Please explain the situation to TCS US Visa cell and followup with them

    .Every dog has it’s day.Today is my day, Received petition approval after long wait.
    I am regular visitor and regular commentator on this wonderful site. My daily work is opening this site in the morning and in the mid night to see new messages, good news, and commenting on others queries.
    Happy to share that i received approval.
    Applied through a small consultancy of workforce 7 ppl, i received RFE on 2nd September on Education Evaluation, Work experience Evaluation and project details, employer -employee relationship.This happened due to poor documentation by my attorney or employer. It’s a 9 page rfe and totally lost hope. Then i talked to my employer and did all my documentation, did not comprised on single thing. Got my education, work experience evaluation done from Trustforte, did my project documentation about 320 pages, and took care of every point asked for in the rfe.Finally submitted documents on 23rd november, 2 days before deadline. Received approval Today. Hardly 10 days.
    Guy thanks for everything and i know myself how much mental pressure i felt all these days. But God is great and firm believer of astrology and my astroloer told me in April itself that i will good nes about my visa before July 14 and i heard in june first week that i got selected in lottery. He told after october i will travel abroad at any point of time and sure that’s going to happen and he asked me to learn new courses. all the best guys

    As stated below…I attended my visa interview on 2nd December with my kids and spouse. After interview VO said that your visa is approved and I got an email to collect my kids passports. But when I am checking mine and my spouse, Its showing Administrative Processing.
    So should I have to wait 1-2 days. Is this a status before issuing visa…
    And how come my kids got visa on the same day but we did not?

    I have got an RFE on 25th Sept and my employer has filed for RFE response on 1st Dec but still the status is not updated on website regrading RFE documents receipt.
    My employer is saying that status is not updated on site even for those cases for whom they have filed 20 days ago. Can it really be a case??

    I want to understand that how long does USCIS take to update the status on website for RFE documents receipt??

      At times the online status is not up to date. If your employer has proof that RFE response was received by USCIS, you should be fine.

    1) Employer Name?
    2) Client Name?
    3) Job Title?
    4) Salary?
    5) Highest Qualification?
    6. Place of work?
    7. Job Duties?

    And VO asked marriage year to my wife and one question to my son that ‘what will u do there?’
    And he answerd smartly..’…he is 9 years old..he said that I will continue my education…. that’s it… and my Visa got approved…

  16. A Small suggestion for H1B applicants 2017, take it or leave it.

    Don’t run behind H1B / USA and don’t waste you time. Its been 8 months and still my case is in process. I could have moved on, but still waiting for results, if it gets denied my 8 months will be wasted.

    It will be all your luck and you will be wasting 3 months checking your luck. If you are lucky then you will be wasting another 2 months in waiting for status updated, some day will be RFE, later you will be wasting 3 months to response to RFE, finally you will wasting another 2 months to see if you are approved / denied.

    I would suggest, Canada express entry for IT guys will be a good option. because its fast and less rejection ratio and will not be wasting your time.

    Austria is also a good option, but work permit is expensive compared to Canada.

    Try Singapore, Better then USA.

    Time is money. After 9 months i realized i have wasted 2 appraisal, and to recover that I need to work for 1.5 years in USA(considering approximate saving in USA would be Rs 1 lakh per month) if i get approved.

  18. For my RFE the job duties listed in BRM letter are wording wise different than the Job Duties listed in a separate job Duties document, will this create any issue for RFE Approval…

    • As most of the job duties/responsibilities are generic, it should be a problem unless there is a drastic difference between two……..how is yours?
      Anyways it all depends onother documentation also and depends on officer who is verifying the documentation. We cannot really predict whether he really compares the job duties with other documents…Anyways all the best

    I see all the guys updating the status of their approval petitions. Good to see many approvals. One more thing i want to add is as most of the received approval after rfe response, it would be better if they can update the details of the rfe…merely updating rfe request/response will not help anyone here about the timeline….timeline all depends on the officer working and it depends on luck who acts on application fast. giving details about rfe will help people to analyse their own case and expectations to certain level……..thanks

    16 nov – got RFE from USCIS
    18 nov – RFE responded by Company
    19 Nov – status – RFE response received by USCIS

    still waiting for decision 🙁

    any idea why it is taking so long this time, any body got experience with RFE recently, please share experience
    should i expect decision in 15 days from 19th Nov as its premium

    • Hello, you should hear soon in next one week. Going for premium is not a good idea at this time unless you have some urgency……but anyways you should hear soon and result completely depends on your documentation applied and rfe requested and rfe responded …….all the best

        i learned that in premium case, it take 15 days from time your rfe response reception confirmed by USCIS, please correct me if I am wrong.

      • I submitted docs on 18th july. They asked for ECL, BRM letter, contract letter betwwn cmp and client,sow, appointment letter for current company. Only contract letter was missing from all my docs. I am not sure if they will raise SR.

  24. I’m in Case received status for more than a month. My friend has been in that status for more than 2 months and his employer raised an SR. USCIS responded saying, that due to H4 EAD, there are more than 75000 extra applications this year to process with the same staff, hence it will be delayed. So keep your hopes up. Its just delayed.

  25. My Visa approved on 23/11/2015. Planning to attend visa interview in January month 2016. My Passport is going to expire 02/2017, Is expire date will be impact on my stamping. Do i can renewal my passport now ? Please advice friends.

    • Hello,
      I would suggest, better go for new passport and then go for stamping. As long as the passport is valid for 6 months from date of visa start should be fine.when you get the new passport it is alwasy attached to the old one so no issues …..

    • This means there were small corrections made in your petition.For ex. Spelling of your name was incorrectly updated on petition file and now it is corrected. This is almost means in next few days your case will be approved 🙂 best of luck

    • You can Raise SR after 60 days past to your Date of RFE submission.
      In your case u can ask to your Employer to raise SR .

    I got an RFE notice after raising multiple SRs to USCIS and now the due date(8th Nov) to respond to that RFE is already crossed.

    Now my employer has responded to that RFE on 27th Nov. with all the SR details that they have raised to the USCIS.

    Is there still any hope for the approval of my case?

    • Hello MS.

      Its better your employer can attach those SR details and how you got delayed response. As you have Genuine and valid reason you don’t need to worry..If employer has already responded better to ask them to update USCIS somehow with SR details .

  35. Ny1 frm WAC has seen any updates in last few days? I only see comments from EAC center. I m bit worried now. USCIS not even responding to SR raised by my employer.

  36. My first post here…
    I had applied for the 2015 H1B lottery with 10+ exp in the IT industry. This was the first time I applied. I applied through a consultancy (acquainted through a mutual friend).
    My lottery got picked, and my case entered RFE status a couple of months back. My I-129 just got approved.

    Pending visa interview…hope it goes well.
