As many of you know, H1B Visa 2015 quota was over in the first week and a whopping 172,500 H1B petitions were received in first week by USCIS.  H1B Lottery / random selection was held by USCIS to select 85,000 H1B petitions to fulfil the work permit cap. Many of the unlucky ones are already wondering about next year H1B Visa quota. Also, some of you are planning for H1B visa for next year, you also would be wondering regarding the same. When will the H1B season for fiscal 2016 begin ?

USCIS will accept petitions for H1B Visa 2016 season starting from April 1st, 2015.  USCIS did a press release on March 12th outlining the details. Read summary of press release by USCIS on H1B 2016 .

Will there be lottery again for H1B Visa 2016 ? Predictions ?

We had lottery for FY 2015 and FY 2014. The total number of petitions filed for FY 14 were about 125,000 and for  FY 2015, there were about 172,500 petitions… As H1B Quota did not increase for FY 2016, and the demand does not seem to decrease, we would very likely have lottery for FY 2016.  Read H1B Visa 2016 Lottery Predictions, Dates, Results

What is the H1B Visa quota Cap Count ? Would there be any changes to H1B 2016 count ?

H1B Visa quota cap count is the total number of petitions that USCIS will accept for a fiscal year to provide temporary work permit for highly skilled workers.  For the 2016 fiscal year, the cap count is as below :

  • Regular H1B Quota : 65,000
  • H1B Masters Degree Quota ( only US Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

As per the press release in March 2015, the quota did not increase.  To give some background, as per the Obama executive action in Nov 2014, no changes were announced to the H1B Cap count. There was proposal in 2013 to increase H1B cap from 65,000 to 110,000 and Masters quota to increase from 20,000 to 25,000 did not go through as of March 2015. At least, for this FY 2016 season, the quota is fixed and it will be as above and no changes.

When should I start planning for H1B Visa 2016 ? What are the steps ?

It depends on your situation. Below are few scenarios and your plan.

  • If you are a student on F1 Visa in USA, you need to plan for your internship/ CPT or OPT employment  at a company that can sponsor your H1B Visa for FY 2016. In my view, you should start now to find something for the fall 2014 and continue that for next spring so that you can file for FY 2016
  • If you are in other country and planning for H1B, it is good to start your process around the end of this year 2014. It will give you enough time to find sponsors, search for job, etc.
  • If you are on H4, L1 or other visa in USA and planning for H1B for FY 2016, you also should consider looking around end of this year i.e. December 2014.

Most asked Question – How do I Find H1B Sponsors for FY 2016 ?

This is a million dollar question !  One of the biggest challenges is to find a good sponsor that can offer you a job and wait for you to start work after 6 months of filing your petition.  You should review the detail article on How to find H1B Sponsors for FY 2015. What about Comprehensive Immigration Reform ( CIR) – H1B Visa Changes ? What are they ?

There have been some proposed changes to the H1B Visa program to cater to the demand in the  US economy as part of the Comprehensive Immigration reform. Below are some of the proposed changes.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

These were proposed in 2013, but nothing has moved significantly and all the above are just proposed rules. We are not sure when they will be implemented. You can read  Summary of CIR – Immigration reform – H1B Visa and Green Card  to get an idea. The latest update is that Obama has taken executive action on Immigration in Nov  2014  and none of the below are included as part of that.  Stay tuned for updates.

H1B Visa 2016 Fees – Any changes ? How much does it cost ?

There are various components of the fee. The H1B Application filing fee could range anywhere from $1,600 USD to $4,400 depending on the size of the company. The attorney fee can range from $500 to $3000 depending on the attorney. If you apply for premium processing that is another $1,225. The fees has not changed in the past couple of years for FY 2014 and FY 2015. Unless USCIS revises fee based on immigration reform, it should be same. We will keep you all posted. H4 Visa EAD rule impact on H1B Visa 2016 Season ?

As you know, certain H4 visa holders are now eligible for EAD. The H4 Visa EAD Rule Passed earlier in 2015 and is effective from May 26, 2015.  USCIS will start accepting applications for EAD from those eligible H4 visa holders starting from May 26th. The question is that will that have an impact on number of H1B petitions for this fiscal year  ?  It very likely will have certain impact on the number of H1B applications that are filed for this year 2016 quota. Many of the H4 holders, who would now be eligible for EAD, may not apply for H1B visa, just because it gives them more flexibility to work and more choices to work as well. We would have to wait and see, how much of an impact that would have, but it is very straightforward and no brainer for eligible H4 visa holder to avoid the H1B processing.

H1B visa Premium Processing Changes to H1B Visa 2016 quota ? 

USCIS updated in their press release that the premium processing will be accepted for FY 2016 quota and they will only begin that “no later than May 11, 2015”. What it means for the petitioners is that the official 15 day premium processing clock starts from May 11th, 2015 and their petition could be adjudicated within 15 days from May 11th, which would be May 26th, 2015.  USCIS can process them earlier as well, but their new timeline is just indication for setting the right expectations to meet the stipulated time frame for premium processing.

  1. Hi Friends,
    Could you please clarify me the below queries?
    First of all i got my H1 stamped and my husband got H4.
    1) I am currently working for a company in cybergateway hyd and my h1 b filed by a usa consultancy where i paid some money.
    2)Now, I got a offer from TCS and they are asking me to transfer my current visa to them and they are ready to send me onsite and also they gonna sponsor my flight tickets (h4 ticket as well) and accommodation for a month.
    3) Can i transfer my visa without informing to my petitioner in this case? what are the complexities involved if i wanted to join TCS and go through them?
    4) My petitioner said that i need to learn JAVA as well before i goto usa and start working for him , he will then take some % in my every month sal. i think its bit harder for me to manage my expenses since my husband is not going to work in USA. He’s asking me to travel in FEB2016 as well where TCS sends me in NOV!
    PLEASE GIVE GOOD INPUTS AS I AM IN A SITUATION WHETHER I SHOULD GO TO USA OR NOT???

      Looks like your current H-1 employer is a desi consulting company, who will market your resume once you land in US. This often leads to few months of benching. I assume this employer will not pay you while you are bench, which in turn will hamper your legal status in US.

      A better option is to come to US on H-1B through TCS (they can file a cap-exempt petition for you on the basis of your already approved H-1B petition). You can then continue to work for them or move to a better employer.

      In either scenario your husband will remain on H-4 and will have to sit at home.

          1. You are not required to get H-1B visa stamped again as long as previous visa stamp is still valid. However, several employers prefer to have visa stamp in their own name. So in this case TCS may ask you to appear for stamping again. You will have to check with TCS’ immigration team about this.
          2. Yes. Denial of TCS’ petition will not impact already approved petition and visa stamp.

      I also applied through desi consultancy, got my visa also. Now I am looking for an MNC who can transfer my H1B and send to US. May I know how did u got ur job in TCS with H1B. Whenever I tell, I am having H1B and looking for onsite in interview, they are rejecting me stating that the requirement is for offshore only.

      Your employer needs to be ensure that you are legally allowed to work in US. If they can suffice that on the basis of online status, then ok. If they want to see the physical copy, then you have to wait a little longer.

    • I’m in AD/RP/EAC…Series 15141…Submitted RFE in the month of July. Till now no reply. USCIS attitude reveal its money making ability. Hence in the sophisticated manner it ask us to convert all RP to PP.

    • My petition was filed on 10th June under Cap exempt. EAC1518152XXX. It is still in “Case was received” state. USCIS has started processing May third and fourth week cases. Hoping that ours will be adjudicated in next 3-4 weeks.

    I got RFE asking for job description (SOW) from the past company from which I resigned 5 years ago. Now, my the then manager also left the company. Can anyone suggest if the job description should be submitted on the letter head or else just a letter from my ex-manager will suffice ?

      It is best to get it from someone who is still with the ex-employer. Maybe manager’s manager or a peer. If not, your ex-manager can give it on personal stationery and mention his latest contact information so that USCIS can follow-up to verify. Also, include his linked-in profile which shows that he did work at the employer during that time period.

    How long does it take for USCIS to send the I797 Approval notice papers to the attorney after the case is approved? My current status says “Case Was Approved And My Decision Was Emailed”.

    • I actually received the paper notice within one week. But my I-129 was denied and they requested me to change my status outside of U.S. I’m not sure if I receive it faster because of my special situation

      • 6 weeks I think is little long…what I heard from my colleagues was max 1 month some in Aug even received in 10 days …. all are RP (I was told RP & PP do not have any difference when it comes to receiving of approval notice.)

  6. The two year wait finally ends now.
    Year:2014 – Didn’t get through lottery
    Year:2015 –
    April 28th : Notice Date . Sign of relief
    June 17th: RFE – Processing Suspended
    August 12th: RFE response received
    Oct 1st: Approved
    A long wait from RFE received to approved status. 🙂 Thanks redbus and the people out here. Follow up on your case and help others. cheers ATB.

    • Hi denial employers, I have experience in past , if you don’t hV good relationship with your manager, you can not get B1, L1 or H1b. In my last company my B1 and L1 rejected.Now I HV good manager,Let see.correct me if I m wrong. Thanks.

  7. I have my L1B interview scheduled for 6th Oct through Company A.

    But Company B had notified me that my H1B had been picked up in lottery & they are yet to share the next steps.

    H1B is my first priority, but i cant stop the L1B process until i hear it from Company B.

    I have two questions,

    1. What will happen if my L1B Visa is approved & then i go for H1B stamping? Will it affect the H1B stamping result?

    2. Does my L1B(if got approved) will be closed once i get H1B stamping or is there any process that the Company A can block?

    • Hi,

      1) You can go ahead with your L1B interview process and it won’t impact your H1B process
      2) Once you get your H1B stamped, your L1B visa is automatically cancelled (since both are employment based visas you can’t have both active)

    Application Sent: 1st April 2015.
    Application Acknowledged: 13th April 2015 (Status: Case Was Received).
    RFE issued: 27th May 2015.
    *RFE was about the company’s address confirmation. RFE never reached me, but according to my HR it was regarding some address conflict while the petition was applied.*
    RFE Response submitted: 14th July 2015. (Status: Response to RFE was received)
    Upgraded to Premium: 26th Sept 2015. (Status: Case was Received and Notice was Emailed).
    Approved: 1st Oct 2015. (Status: Case Was approved and Decision was emailed.

    Expecting a hard copy of the approval notice by early next week.

    • PP helps only till approval. Once it is approved, time taken to receive approval notice is same for PP & Normal…is what I have been told by my immigration team. And right now it is taking about 2 – 3 weeks time.Please let me know next week if you receive the approval notice.

    • That is of no use for you, I did it two year back for my L1 processing, they will ask all your details and tell finally that you are the employer or beneficiary… and at last. we will share the details to ur employer only.

  14. Hi, got selected last year.. but valid till sep 30,2015…i filed my case on July 2nd for Amendment+cap Exemption for case #EAC15198******. Now my status is CASE RECEIVED. ANy one has same situation ?
    What is the last date to process H1B amend+cap Exemption cases by USCIS. When can i expect my case approved status. ? i am in regular processing ?

    IM still waiting for any update after selection in lottery. My employer is a consultant. He is telling me the cases are processed according to the “Notice Date” in my selection notice. My notice date is April 29th. Is there anybody who filed under regular with notice date before that and have got at least some progress?

    • I think thats wrong …. My notice date is April 23rd and mine got approved on Sep 25th (Direct approval from ‘Case Received’). My friend’s notice date is April 28th and he got it approved on Aug 14th (Direct approval from ‘case received’)

        • First thing is there is consultancy, company which USCIS is bothered about. That’s irrelevant to them.

          To your question, nope … mine is top 5 IT company in the world. My friend which I referred in the comment is from consultancy.

          • To be clear,…for USCIS it is irrelevant whether its a company or consultancy. TCS is also a consultancy…infact most top IT companies are consultancies. So first we should understand the meaning of consultancy.

    RFE Received: 10th July
    RFE response sent: 12th Aug
    Case approved on 30th Sep

      • That’s too long..!!!! Is this wait time same for change of status people also who are already in US?

        My case is approved and now my new employer wants me to join asap (if possible tomorrow). Just waiting for the approval notice because I don’t want to take risk by just looking at online status. This process really sucks… After approval also, it takes so much time to be normal for the candidate 🙂

    Another unlucky guys posting that “My Visa Got Denied” today.
    Center : WAC
    RFE Responded Date : 2nd july
    Rfe rejected Date : 30 Sep
    Submitted : SOW, Client letter and manager letter.

    Is there any way to reopen my case, I know it is almost done, but still feeling hard to digest this pain. In the denial notice they have mentioned we mailed you our decision and your “Options”. Just want to know what options we have to proceed further..

    Friends please let me know, if there is any option. INitially I thought not to share this and make you guys panic, but still I wanted to know the options, thats why I posted this.

    • Balaji, Really sorry to hear that. I am also waiting for approval from past 75 days . RFE received 5th June 2015 , RFE submitted status 17th July 2015. I am worrying like after waiting this much long period there are chances of getting rejections … 🙁

        • Leading MNC send all the RFE cdocuments and got denied. I have checked online yet to receive the reason. I am not sure whether I will get know the reason for denied.

    • I am also from Leading MNC and case was denied on 22 Sep 2015, Immegration team got the reason but they never share that with us and I heard from senior folks that no one cares about denied cases… That in our organization… but you would never get to know the reason….its better to go for next year cycle.

    • Balaji, Sorry to hear. You can file Motion to Reopen or Recosnider for unfavorable decision. Check more info at USCIS Manual , Speak to your attorney and see the best way to proceed. There have been many instances, where people have successfully use this option to get a favorable decision.

  19. Its officially OCT now, my case moved to “RFE response received” on July 21st. Till now same status crossed more than 70 days. I see people are getting updates with 15-20 days. Not sure, when will I get update, already raised SR to USCIS, even for that need to wait 45days to get an update. Really frustrating!!!

    I want to share my happiness and want to thank red bus for keeping me posted on latest updates on h1b
    Its been a very long tired journey here in united states. I want to post my experience just to help some people who are waiting for H1b.
    Here is my story. I have applied my h1b by ( Advance cap, non-pp) initially.
    I have received H1b rfe on june 15th, replied in sept 9th and upgraded to premium on 17th
    today i got approval from Vermont center.
    Thank you lord for helping me and wish all gets approval as soon as possible.

    Can anyone please tell what is the different between below two status and when one should see either of them with respect to approval notice?

    “Case approved and decision EMAILED”
    (AND)
    “Case was approved. We will MAIL your approval notice.”

    My case was approved under PP but the status says we will MAIL your approval notice. Shouldn’t it be EMAIL? Not attorney have not received email yet. I need to get the approval notice asap as I have to resign from my current L1B employer. Any alternatives?

    • “Case approved and decision EMAILED” — This status you see only for premium applications where your attorney will get a copy of 797 in email prior to USPS mail…

      “Case was approved. We will MAIL your approval notice.” — This status you see only for regular processing applications where USCIS generally send it through USPS postal mail to your attorney.

    • Valid point…you should have seen ’emailed’ word since yours is PP. Thats what I saw in many blogs on what the status means. What does your attorney say….

      • OK, here is what I have received just now from attorney and I had to edit my reply (this is scary).

        The attorney says – “I just called USCIS and they confirmed that the H1B has been approved. These appears to have been a fluke with them not sending out an e-mail. We will let you know as soon as we receive the original approval notice.”

        Now, not sure what to do. Should I go ahead with this and resign from current company.! 🙁

        • So for you, is the case just showing “Case Was Approved” or ‘Case was approved and decision has been e-mailed’ ?

          Because, even for me though my employer said that request for PP was sent on Sep 10th they did not get any email confirmation from USCIS. But my case got approved on Sep 25th and the status was just ‘Case was approved’ …. I am till now under assumption that my case got approved normally…but looking at your reply now, seems like mine also could be PP and may be USCIS missed an email acknowledgement in my case as well.

          But see, I was told that even if it is PP or normal approval, to get the hard copy it will take same time (right now it is about 3 weeks)

          Now coming to your point,…it takes about 3 weeks to get the documents as per my immigration department. So in another 1 week you should have th docs with you hopefully.

    How much time it will take to receive the approval notice?
    Mine got approved on 8th Sep.
    Still employer is saying that they didn’t receive it.
    Is there any other way to get it?

    • Hello Shark, Congrats for Approval so in your case uscis has taken 24 days after response receive status, right ? Mine was in Response receive status on 22 Sept so its 8 days till now. Some time they approved in 5 to 6 days and some time take month. I hope my will approve in Oct last. Its depends actually!!, God knows 🙂

    RFE status update on USCIS Website: 22nd July (Specialty Occupation and Company location mismatch on VIBE)
    RFE(hard copy) received by the Attorney: 31st July
    RFE mailed to USCIS via USPS Priority(Overnight): 11 Sep(Friday)
    Upgraded to PREMIUM: 17 Sep
    Premium processing confirmation update on USCIS website: 18 Sep
    **Request for RFE status on website: 22 Sep (Confused! Attorney called USCIS on 23 Sep about the RFE: is it new? USCIS: can’t say. They said they will fax the 2nd RFE next day!)
    RFE FAX received by attorney: 24 Sep (it was the OLD RFE)
    RFE Response received status on USCIS website: 24 Sep
    “Case approved and decision emailed” status on USCIS website: 29 Sep

    Still in ‘Case Received’ status. And my employer is not ready for upgrading to premium. It is so demotivating to wait for 1 decision for 6-9 months.

    Is it true that these days RFEs are very common because USCIS is buying out time to process the petitions?

    • I don’t see any reason for that. For regular processing uscis does not have any obligation, so they can just as well keep the case. Also, writing down RFE probably takes more time, if you ever saw it – it’s a multi-page document, while approval is just approval.

      I think uscis has more scrutiny this year.

  33. Is there anyone here form CapGemini who got RFE and waiting for Petition status change to RFE Response Received?

    I am wondering, My RFE response was due in beginning of September but status is still “Request for Additional Evidence Was Mailed”

    As usual no one from H1B HR departments care to respond the emails about the RFE status.

    • I am also on the same path, but from different company. RFE documents were submitted last month, but still showing the status as “Request for Additional Evidence Was Mailed”. There is no change in status.

      • 1st week June moved to RFE – RFE documents submitted on 1st week SEPT :). Approved last or this week and it is RP.
        I don’t know exact dates because Wipro not sharing case number.

  35. Hi, I have few questions on H1 and L2 visa.
    My Employer filed H1B for the 2016 Quota. Got selected in lottery but received RFE for educational evaluation and Specialty Occupation by Sep 12th . My Employer may reply to RFE on December first week. But in between, my husband’s employer processing L1 visa for him, and I need to travel along with my husband. I have the below questions
    1. Can I apply for L2 visa and travel along with my family when H1 visa is in progress (RFE)
    2. As per my current employment, there is no onsite opportunity for my current employer, at least for the next 1 year. Given this situation is it worth to wait for H1 visa approval? Or I can go for L2 visa.
    3. If that is case what will happen to my current H1 processing? Whether that will be denied or rejected
    4. Consider I travelled in L2 visa and getting my H1 visa approval sometime later may be Q1 of 2016. Am I eligible for Change Of Status from L2 to H1.
