As many of you know, H1B Visa 2015 quota was over in the first week and a whopping 172,500 H1B petitions were received in first week by USCIS.  H1B Lottery / random selection was held by USCIS to select 85,000 H1B petitions to fulfil the work permit cap. Many of the unlucky ones are already wondering about next year H1B Visa quota. Also, some of you are planning for H1B visa for next year, you also would be wondering regarding the same. This article addresses many of the common questions, it will be updated constantly, whenever any changes to info.  Bookmark this page !  To start with, firstly the news updates on this season, followed by many commonly asked questions.

When will the H1B season for fiscal 2016 begin ?

USCIS will accept petitions for H1B Visa 2016 season starting from April 1st, 2015.  USCIS did a press release on March 12th outlining the details. Read summary of press release by USCIS on H1B 2016 .

Will there be lottery again for H1B Visa 2016 ? Predictions ?

We had lottery for FY 2015 and FY 2014. The total number of petitions filed for FY 14 were about 125,000 and for  FY 2015, there were about 172,500 petitions… As H1B Quota did not increase for FY 2016, and the demand does not seem to decrease, we would very likely have lottery for FY 2016.  Read H1B Visa 2016 Lottery Predictions, Dates, Results

What is the H1B Visa quota Cap Count ? Would there be any changes to H1B 2016 count ?

H1B Visa quota cap count is the total number of petitions that USCIS will accept for a fiscal year to provide temporary work permit for highly skilled workers.  For the 2016 fiscal year, the cap count is as below :

  • Regular H1B Quota : 65,000
  • H1B Masters Degree Quota ( only US Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

As per the press release in March 2015, the quota did not increase.  To give some background, as per the Obama executive action in Nov 2014, no changes were announced to the H1B Cap count. There was proposal in 2013 to increase H1B cap from 65,000 to 110,000 and Masters quota to increase from 20,000 to 25,000 did not go through as of March 2015. At least, for this FY 2016 season, the quota is fixed and it will be as above and no changes.

When should I start planning for H1B Visa 2016 ? What are the steps ?

It depends on your situation. Below are few scenarios and your plan.

  • If you are a student on F1 Visa in USA, you need to plan for your internship/ CPT or OPT employment  at a company that can sponsor your H1B Visa for FY 2016. In my view, you should start now to find something for the fall 2014 and continue that for next spring so that you can file for FY 2016
  • If you are in other country and planning for H1B, it is good to start your process around the end of this year 2014. It will give you enough time to find sponsors, search for job, etc.
  • If you are on H4, L1 or other visa in USA and planning for H1B for FY 2016, you also should consider looking around end of this year i.e. December 2014.

Most asked Question – How do I Find H1B Sponsors for FY 2016 ?

This is a million dollar question !  One of the biggest challenges is to find a good sponsor that can offer you a job and wait for you to start work after 6 months of filing your petition.  You should review the detail article on How to find H1B Sponsors for FY 2015. What about Comprehensive Immigration Reform ( CIR) – H1B Visa Changes ? What are they ?

There have been some proposed changes to the H1B Visa program to cater to the demand in the  US economy as part of the Comprehensive Immigration reform. Below are some of the proposed changes.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

These were proposed in 2013, but nothing has moved significantly and all the above are just proposed rules. We are not sure when they will be implemented. You can read  Summary of CIR – Immigration reform – H1B Visa and Green Card  to get an idea. The latest update is that Obama has taken executive action on Immigration in Nov  2014  and none of the below are included as part of that.  Stay tuned for updates.

H1B Visa 2016 Fees – Any changes ? How much does it cost ?

There are various components of the fee. The H1B Application filing fee could range anywhere from $1,600 USD to $4,400 depending on the size of the company. The attorney fee can range from $500 to $3000 depending on the attorney. If you apply for premium processing that is another $1,225. The fees has not changed in the past couple of years for FY 2014 and FY 2015. Unless USCIS revises fee based on immigration reform, it should be same. We will keep you all posted. H4 Visa EAD rule impact on H1B Visa 2016 Season ?

As you know, certain H4 visa holders are now eligible for EAD. The H4 Visa EAD Rule Passed earlier in 2015 and is effective from May 26, 2015.  USCIS will start accepting applications for EAD from those eligible H4 visa holders starting from May 26th. The question is that will that have an impact on number of H1B petitions for this fiscal year  ?  It very likely will have certain impact on the number of H1B applications that are filed for this year 2016 quota. Many of the H4 holders, who would now be eligible for EAD, may not apply for H1B visa, just because it gives them more flexibility to work and more choices to work as well. We would have to wait and see, how much of an impact that would have, but it is very straightforward and no brainer for eligible H4 visa holder to avoid the H1B processing.

H1B visa Premium Processing Changes to H1B Visa 2016 quota ? 

USCIS updated in their press release that the premium processing will be accepted for FY 2016 quota and they will only begin that “no later than May 11, 2015”. What it means for the petitioners is that the official 15 day premium processing clock starts from May 11th, 2015 and their petition could be adjudicated within 15 days from May 11th, which would be May 26th, 2015.  USCIS can process them earlier as well, but their new timeline is just indication for setting the right expectations to meet the stipulated time frame for premium processing.

    • No…i am still waiting.Hope none of them received updates on the petition from Accenture it seems.Hope by the August last week they will release the results for everybody as they did for the lottery accepted.

    • I raised a request directed to the People Mobility team from myrequests. I got a reply from the team stating that my H1 B is approved but they are waiting for the receipt of hard copy from USCIS and once this is received they would update. So, you can raise a request to check for your approval status.

      • Yeah..That worked for me.The people mobility stated ‘your petition is approved from USCIS and yet to receive the hard copy of the approval from our end’..
        Is it like USCIS will not send the hard copy of approval once they say that the petition is approved.just curious

  3. My application was approved on June 07th, I have applied through some desi consultancy. Still i haven’t go the papers and they are saying this is not the good time to go for interview and asking me to wait until October or November.

    I have one simple question. I received RFE for my h1b application. I won’t be able to submit documents before deadline given by USCIS. It’s nearly one month after issue of rfe and i just have last 3 days remaining to respond. Please tell me what to do if i miss thid deadline. Thanks in advance.

      • Thanks for your reply. Actually I received rfe notice after 10 days and since then I am following up with client for client letter, but legal team from my client side is raising new queries each time I sent draft for client letter. Thanks !

        • Dont worry friend. If you check your status there is one more thing has mentioned that if you did not got the letter by 30 days then you can request for e statement. So this one month is for receiving the document by your attorney. So try ur best to collect all those asked documents and send uscis for review. All the best ..have patience. 🙂

    • You get 90 days to respond to an RFE. The one month date is usually provided to let USCIS know if you haven’t received the hard copy of the RFE! Relax and just work with your attorney’s/employer to respond to the RFE.

    • Guys, don’t expect anything now.
      Lets accept the hard truth.
      Company don’t send the bad news till last point to avoid attrition. They will now tell you to submit application for next lottery.
      To be honest, most people who have picked up in lottery already received their approvals & now planning to travel.

    • There doesn’t seem to be any final list as such. My FDFU says that updates on the waiting status are being declared very slowly and most of them are rejected/cancelled.

      Can you provide who your source is? And any idea on why they were holding this list till this long?

    • Hey i got mail on july 15th as status changed to approved on USIC website..waiting for hardcopy.But still now no updates,they were telling my travel to USA starts from feb-march 2016 by considering all the procedures from them..

  9. i got my name changed in 2013 from karthikeyan to karthigeyan , while applying for H1B i have submitted all doucment and informed the attroney about this name change , old and new passport, by mistake my attorney used the old passport with old name to fill i-129 form, now LCA and i-797 contains my old name, iam tensed , informed my attorney , what is the way out , please let me know what should be done, Thanks in advance

    • File for H1b amendment. Your lawyer would do that. H1b amendment can also be done in premium processing so that would take 15 days.

  10. My employer filed my H1B Petition under Masters quota this year and I got picked in the lottery and got approved as well in July.

    Now my question is, if I’m denied visa when I go for stamping, will I be cap exempt when I file next year again ? or will I have to go through lottery again ?

    Please advice …thank you so much.

    • When a consular officer rejects a visa he can (and often does) send the petition for revocation back to USCIS. The USCIS then looks at the application and reasons cited by consular officer. If it deems that visa be revoked then it sends the Notice of intent to revoke to the petitioner. If the petitioner does not respond back satisfactorily then the visa is revoked and the original petition cannot be used again.

        Are we cap exempt in that case and do we have a chance to go for stamping again within few weeks ? or do we have to wait a year ?

        • Search for Notice intent to revoke and you will get several results that discuss this e.g. visarefusal.com/revocation/petition-revocation/

          If the petitioner responds satisfactorily or USCIS decides that there is no need to revoke the visa then the petitioner will be sent a notice saying that the petition has been confirmed after being readjudicated.

        • I had replied before, but it seems that since it had a link so it had been flagged for moderators approval.

          To answer your question, search for Notice of intent to revoke approved H1b and you will get several results that discuss this. If the person is lucky then the consulate officer will not send the petition back to USCIS for re-adjudication after denying the visa, but chances of that happening is less.

          If the petitioner responds satisfactorily or if USCIS thinks that there is no need to revoke the visa then it sends reaffirmation notice to the petitioner. In this case the petition is still valid and you don’t need to go for another lottery, but you would still need to go to embassy/consulate again to get the visa stamped.

    In my project, my employer nominated for 5 folks and out of that 3 of us got selected in lottery, and all of us got RFE in the same time. They asked us for 1) Manager Letter 2)SOW and client letter, we submitted all the required documents, but unfortunately one of my colleagues petition got denied last Friday and rest of our petition is showing RFE document received since July 2nd. My query is Manager letter sow and client letter is same for all the 3, do I need to worry about my petition now or is there any way to get it Approved.

    My application got approved in Jul 15 and my cinsultant is asking me to go visa stamping after Oct 1.

    My consultant is telling me that once you fly USA and you have to guve the interview one to one. he will not pay me any money until n unless İ get any job there.

    He has terms n condition for me like, i will work with him 36 months minimum.

    even İ dont know if my consultant will pay the flight ticket and immediate stay in USA.

    please help if some body has geniune answer.

    • I think your employer is fraud. Don’t know how us cis approved your case at the first place.
      Now, you have option to go to us cis & black list your employer by telling them the truth. But it may cost your H1b.
      My suggestion is, fly to usa & change your employer. In usa, no employer can officially say, they have bonded any employee.

    • Haven’t you discussed all these terms with your consultancy before applying through him (If not discused, there is no point discussing them here) ? Or has he changed the terms recently ?
      My guess is that you’ve paid money to your consultancy for processing H1B………..if yes, then you can’t even expect them to pay the flight charges.
      And yes, you mentioned that it is a consultancy………which will make money by deploying their people in client locations. So I guess they’ll certainly not pay you anything, unless you are placed somewehere…..!!
      P.S. I’m not a consultancy guy 🙂

        2) consultancy asked me to sign in agreement letter before the file.
        3) This is new for me also that I will be find the project in USA only once reached there.
        4) accomadation n flight ticket is neither discussed in agreement lettrr nor discussed till now. (i am just checking in this forum)

    Is it true that is you apply for H1B transfer after Oct 1, you can start working with new company even before it’s approved? I heard that you can start working with just the receipt notice; provided your H1B is already approved with company 1.

    • This is correct. You would need to fill I9 form with the new employer which needs the approved I797 number. You can use the Receipt notice number (and even the Fedex tracking info.) It will give you a couple of months before you have to provide the actual I797 number to I9 again.

      However, the only problem is if your transfer gets denied then you are in a difficult position since many employers revoke the petition once you leave them (which does not effect the H1 transfer.) So in case that happens then you would neither have old job and no new job. It is usually recommended to resign after the H1b transfer is through, and filing the H1b transfer in premium processing helps.

        • 7 days is inaccurate. Are you in Premium Processing? If so, it will take a maximum of 15 days. If you are in Regular Processing, it can take around 2-3 months. USCIS received the response to my RFE (I’m AD/RP) on June 16th, and I am still waiting for the final verdict.

          Mine is regular processing/Non-AD.

    • I got RFE on June 1st and my RFE response still not given by my consultant. i guess USCIS gives us 90 days grace period to respond.
      once RFE response given it may take max 60 days to give decision.

    I had applied H1B petition through consultancy and got approved.Now I am filling DS-160 form.While filling form there is an option where we need to specify the who is paying money for your trip,I selected as “U.S.Petitioner”.

    • I’m sorry I don’t understand… You are saying that you got approved, and when you go for Interview / visa Stamp you got a rejection ?
      What was the reason they told you ? It’s because you have only 2 eyars of experience ?

  26. People from TCS,INFY,WIPRO,HCL keep on jumping to Cognizant in masses to get filed for Green card. Cognizant files green card to everyone these days and luring the resources from other smaller companies as well. 5440 PERM for green card are approved in 2015 year alone which is totally shocking. Cognizant is making guiness record in USA in filing green cards. Simply unstoppable!!!..Now no H1B wants to leave USA becos cognizant is there to protect all!!!!

    • It may possible if the company that’s your sponsor have some problems with the law / government / fake company… or even yourself!
      If it’s a trusted company, and you have doing not bad in the past… you don’t need to worry!

    • Buddy, don’t worry! This “Fee refund was mailed” I think that your sponsor have payed more than the amount for your process… so this is why they change for that status… As I know they don’t refund if you get approved or rejected!

  30. LOL. Looks like half of the petitions got dumped towards RFE this year. I don’t buy that the paperwork of such large number of petitions could be weak. This has got to be a deliberate effort to fliter us out. I am wondering why didn’t I apply last year.

    • I got RFE in august ( wish I had got atleast earlier), nw I should wait fr 3 more months for the result . Its Employer-employee relation . I seriously don’t understand y I got RFE I am well qualified , gud experience from a good company . It sucks 🙁 🙁

      • This has happened with me last year. I had filed my visa from an Indian MNC, all my experience and education was genuine, still got Rfe with the same reason. There is something missing in the documents from Company.

    I see this message on USCIS Website,

    “On July 9, 2015, we approved your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number EAC***********. We will mail your approval notice. Please follow the instructions in the notice. If you move, go to uscis.gov/addresschange to give us your new mailing address.”

    What is the next step ????

    • Now the USCIS will send the approved package to your attorney / company, and they will forward to you to start schedule the visa interview, fingerprints etc… Contrats buddy!

  35. Actually one of my friend applied H1B this year and 2 peitions got filed(1 from his company,1 from outside consultancy).By luckily both got picked up and approved also.
    Now While filling DS-160,there is column to mention if he has filed any other petitions ,does he need to mention about the second petition information also in DS-160 or we can skip it.

    Now he want to go with his consultancy petition instead of company petition.

    • this is not SAMRT ass, this is a dirty pig, applied dropped multiple petitions and killed someone else’s chances…………counsular will know when they type your passport number during ur visa interview……and they will surely question u and reject ur visa……recently i have went for b1 visa and i ahve h1 and worked in usa for 1.5 year and came back…the first question she asked me is that i already have h1 and she asked me twice this question and with whom…..(which company)…. they will have your full biodata dude…..

    • How about keeping track of the same series after a week to see any change in RFE\Received percentage ?
      Probably this way we can confirm either USCIS is going to process the remaining “Received” cases ever………!!
