As many of you know, H1B Visa 2015 quota was over in the first week and a whopping 172,500 H1B petitions were received in first week by USCIS.  H1B Lottery / random selection was held by USCIS to select 85,000 H1B petitions to fulfil the work permit cap. Many of the unlucky ones are already wondering about next year H1B Visa quota. Also, some of you are planning for H1B visa for next year, you also would be wondering regarding the same. This article addresses many of the common questions, it will be updated constantly, whenever any changes to info.  Bookmark this page !  To start with, firstly the news updates on this season, followed by many commonly asked questions.

Official & Unofficial USCIS News Updates Regarding H1B 2016 Season 

When will the H1B season for fiscal 2016 begin ?

USCIS will accept petitions for H1B Visa 2016 season starting from April 1st, 2015.  USCIS did a press release on March 12th outlining the details. Read summary of press release by USCIS on H1B 2016 .

Will there be lottery again for H1B Visa 2016 ? Predictions ?

We had lottery for FY 2015 and FY 2014. The total number of petitions filed for FY 14 were about 125,000 and for  FY 2015, there were about 172,500 petitions… As H1B Quota did not increase for FY 2016, and the demand does not seem to decrease, we would very likely have lottery for FY 2016.  Read H1B Visa 2016 Lottery Predictions, Dates, Results

What is the H1B Visa quota Cap Count ? Would there be any changes to H1B 2016 count ?

H1B Visa quota cap count is the total number of petitions that USCIS will accept for a fiscal year to provide temporary work permit for highly skilled workers.  For the 2016 fiscal year, the cap count is as below :

  • Regular H1B Quota : 65,000
  • H1B Masters Degree Quota ( only US Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

As per the press release in March 2015, the quota did not increase.  To give some background, as per the Obama executive action in Nov 2014, no changes were announced to the H1B Cap count. There was proposal in 2013 to increase H1B cap from 65,000 to 110,000 and Masters quota to increase from 20,000 to 25,000 did not go through as of March 2015. At least, for this FY 2016 season, the quota is fixed and it will be as above and no changes.

When should I start planning for H1B Visa 2016 ? What are the steps ?

It depends on your situation. Below are few scenarios and your plan.

  • If you are a student on F1 Visa in USA, you need to plan for your internship/ CPT or OPT employment  at a company that can sponsor your H1B Visa for FY 2016. In my view, you should start now to find something for the fall 2014 and continue that for next spring so that you can file for FY 2016
  • If you are in other country and planning for H1B, it is good to start your process around the end of this year 2014. It will give you enough time to find sponsors, search for job, etc.
  • If you are on H4, L1 or other visa in USA and planning for H1B for FY 2016, you also should consider looking around end of this year i.e. December 2014.

Most asked Question – How do I Find H1B Sponsors for FY 2016 ?

This is a million dollar question !  One of the biggest challenges is to find a good sponsor that can offer you a job and wait for you to start work after 6 months of filing your petition.  You should review the detail article on How to find H1B Sponsors for FY 2015. What about Comprehensive Immigration Reform ( CIR) – H1B Visa Changes ? What are they ?

There have been some proposed changes to the H1B Visa program to cater to the demand in the  US economy as part of the Comprehensive Immigration reform. Below are some of the proposed changes.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

These were proposed in 2013, but nothing has moved significantly and all the above are just proposed rules. We are not sure when they will be implemented. You can read  Summary of CIR – Immigration reform – H1B Visa and Green Card  to get an idea. The latest update is that Obama has taken executive action on Immigration in Nov  2014  and none of the below are included as part of that.  Stay tuned for updates.

H1B Visa 2016 Fees – Any changes ? How much does it cost ?

There are various components of the fee. The H1B Application filing fee could range anywhere from $1,600 USD to $4,400 depending on the size of the company. The attorney fee can range from $500 to $3000 depending on the attorney. If you apply for premium processing that is another $1,225. The fees has not changed in the past couple of years for FY 2014 and FY 2015. Unless USCIS revises fee based on immigration reform, it should be same. We will keep you all posted. H4 Visa EAD rule impact on H1B Visa 2016 Season ?

As you know, certain H4 visa holders are now eligible for EAD. The H4 Visa EAD Rule Passed earlier in 2015 and is effective from May 26, 2015.  USCIS will start accepting applications for EAD from those eligible H4 visa holders starting from May 26th. The question is that will that have an impact on number of H1B petitions for this fiscal year  ?  It very likely will have certain impact on the number of H1B applications that are filed for this year 2016 quota. Many of the H4 holders, who would now be eligible for EAD, may not apply for H1B visa, just because it gives them more flexibility to work and more choices to work as well. We would have to wait and see, how much of an impact that would have, but it is very straightforward and no brainer for eligible H4 visa holder to avoid the H1B processing.

H1B visa Premium Processing Changes to H1B Visa 2016 quota ? 

USCIS updated in their press release that the premium processing will be accepted for FY 2016 quota and they will only begin that “no later than May 11, 2015”. What it means for the petitioners is that the official 15 day premium processing clock starts from May 11th, 2015 and their petition could be adjudicated within 15 days from May 11th, which would be May 26th, 2015.  USCIS can process them earlier as well, but their new timeline is just indication for setting the right expectations to meet the stipulated time frame for premium processing.

  1. Almost 3 month of wait and continuing for my H1B case Status to change. Knowing fully that cases are not processed in order, went ahead and checked 101 cases between EAC1514251700 to EAC1514251800. Only 12 (including mine) are in “Case Was Received” state, Hope they do get processed soon.

    Wondering why this post? Just to vent out the feeling 🙂

    • true brother, i checked mine eac series for +10 and -10 and almost everyone got approved or rfe apart from mine. 1 thing i noticed is that all approvals or rfes have date of either may or june. so ours is definitely delayed. i dont know whether uscics will stretch is past oct/nov.

    • As I posted before, my case is EAC series and got approved last week.
      Before get approved, I did the same thing on my series, and I also found a couple of “Green Card” and Citzenship process … that’s strange right ? Also 2 weeks before get approved, I see that some “Anonymous profile” was looking at my LinkedIn profile… never happen before… and I have my LinkedIn account for more than 7 years…

        I couldn’t see any unknown / anonymous one to visit my profile on LinkedIn. Although this morning when I went ahead to check my status, it showed status as “My Case was Approved. We will mail your approval notice.” Can you let me know some approximate timelines by when they will send the hard copy of approval notice. Since I am outside US I believe the flow of hardcopy will be from USCIS to my attorney in US and from attorney in US to my employer in my Home country and from them I will get the instructions.

  5. Got my petition approved on 7th August. Earlier it was “Case received on April 13th”, finally the long wait is over 🙂 Everytime I used to get an email notification on my registered email account over the phone I would desperately open it hoping it is from USCIS for some updates on my case lol. Anyways, Good Luck to All who are still waiting for any updates, do not worry – there might be delays but you WILL get your cases approved.

      Nice to see your posting. My cases is still showing the same status as “Case was Received” since beginning. Everyday checking the status just like anyone. Getting worried as days goes by. Did they forgot my case for some reason ?

    • I think the confirmation of returned package will be emailed after 1-2 months when the new cycle of H1B 2016 starts. With this strategy, not selected employees will apply for 2016 and wait for another year. This will help them to maintain the attrition. I think we need to keep bothering them to give the confirmation.

      • IBM has sent a bulk email that your case is not selected this year and do you wish to nominate for next year. When I checked with some one in travel department she told me that they have received lots of rejection and they will update zoom tool as and when time permits. She could not confirm me if my case/package has been rejected specifically due to huge volume.

    I’m a Master’s student here in USA. I have completed all my course work in 2013 May but was stuck with my Research Project since then. I have worked on CPT and OPT for 1 and half year. This year my employer filed for my H1-B under Master’s quota and got approved. But my problem is, I did not complete my master’s yet. I still need to complete 1 credit in order to get my Master’s degree.

    So can anyone let me know how does it effect in future? I still have my OPT Extension till next year October (2016). What should I do now? Should I cancel my H1 or do something else. Please advise me.

    I am in Canada on work Permit now. I am getting married in India and mostly I will bring my wife to Canada on Visitor visa as I dont have time to apply Canada dependent visa. I got my US h1b approved this year and I will go for h1b stamping in Canada in 2 months.

    My question, is my wife eligible to go for interview to get her US H4 dependent while she is in Canada visitor visa and if she gets it, can she travel to US from Canada. Please let me know.

    • My employer told my check was cashed in may 1st week…no update from uscis after that…anybody on same boat?waiting for receipt…as per employer,sometimes receipt nbr comes directly with rfe or approval to them…m not evn sure if vhek cashed actually means sure shot lottery selection Or can it be a mistake as it should not take so long in processing atleast a single further step 🙁

    • This is very intresting this year… there are many consultant and employes are waiting for their status.. Eventhough USCIS sent updates saying that they have returned all the rejected petitions.

      Last year when USCIS sent the same update everyone got either approved or rejected petition by this time. ( End July)

      But this year few people are still getting surprised emails …that.. they got selected and approved from USCIS and employer.

      Compney like TCS , Accenture communicate to employee very late but if someone still waiting for the status that means it is a delay from USCIS in your case.

      No hope .. Very less sleek chances but you may still get your petition approved..

      Otherwise get ready for next year..

  20. Awaiting status.. checked with many abt my status.. after so many investigation got update today 7th August that its actually not selected. As per Employee retention policy they will send us Awaiting lottery until December end. Next is the best part.. Jan we ll get email asking to initiate again..

    • That was pretty obvious, but many still have hope. All this bullshit “we haven’t received the rejection package yet – please, wait a bit longer”. Also, releasing results in shady batches, how hard can it be to send email to 1000 people?

I am very much frustrated here, Dont imagine about the people who are still waiting for receipt or lottery results. . Instead of US we should try for some other countries like Aus, Can , UK ……

    • People make their own choice. If this is too much for you so you’re better find another way. Take as a chance to learn how to take pressure. Life is not easy bro!

      Concentrate in your work buddy .. otherwise it will be more frustarted sitaution that you have visa but no project in US.

  22. Those who got RFE and it’s been more than 2 months since the RFE issue date, most probably your case status will turn from RFE issued to RFE response review by the end of next week. My case series is EAC1514855XXX and got RFE on 25th June. RFE deadline was 25th July, even today my case status shows as RFE issued. I’ve been searching the status of nearly 100 cases before and after my case number and I see most of them were issued rfe. The cases who got rfe on the date around June 1st to 10th turned to rfe response review on August 5th. So people with above series and with rfe issued after June 10th and been waiting for rfe update to change from rfe issued to rfe response review will see an update on their case status soon. This may not be the case with everyone. I see people saying their status turned to rfe response review within a week from the date they send the rfe answer, but this comment apply for who that is not the case.

    • The status usually changes in a week to RFE Response is being reviewed. If your employer/attorney sent the response a while back and it still doesn’t show as such online — ask them about it and confirm they sent it via priority mail. They may have used regular mail and your application may be on its way/just been received by USCIS.

    • Unnecessary you are wasting your time to check +100 or – 100 receipt to make yourself satisfaction.

      If your case is prepared by jenoun employer and attorney you will get the result without RFC. USCIS don’t compare case with +100 or -100 applicant .

      So funny dude …

  24. Anyone having any idea how long it can take for USCIS to process Regular/NAD case ? My case is still showing “Case was Received ” status. Is there any chance that i have to wait till Sep for an update!
    In my project few other people already received their approval & they have been asked by PM to go for stamping…so i am kind of stuck. So frustrating….

    • Well.. wait for sometime… once you get your petition approved you will have same chances to get your visa like others.

      US Visas are not issued based on first come first serve bacis..
      Also, once your case is filled with USCIS .. your case is 100% considered for evaluation regardless the time.

    I have BE degree in Computer Science(4 years degree) and am working in IT field for more than 9 years. My degree and my experience match the job I’m doing.
    But I got a RFE requesting below details –
    1) “With the evaluation, the official must include a letter from the dean or provost ofthe official’s affiliated educational institution, stating that the evaluating official has the authority to grant college level credit.
    2) The dean or provost must also state in the letter whether the affiliated educational institution has a program for granting credit.
    What kind of evaluation/approach would be needed for covering above two requirements.

    RFE also states that an acceptable evaluations should:
    1. Provide a detailed explanation of the material evaluated rather than a simple conclusory stalement
    Is this course-by-course evaluation? What kind of evaluation is this?
    2. Briefly state the qualifications and experience of the evaluator providing the opinion.
    Will the evaluation have this information?

    My attorney’s response is –
    This RFE is requesting for education evaluation from a college or university professor or official, such as an admission official.
    Ask your education evaluation service and they will get one of their college professor’s specialist to do it for you.
    Also, he asked me to send detailed experience letter showing I have at least 3 years of software development experience.

    But looks like I need to do more than what attorney suggested. Has anyone faced this RFE before and what is the best approach?

  29. I ‘m with cognizant and i havent received any updates on my petition (no receipt and no rejection). But what i was able to do was work with the internal immigration dept. I found out my check was not encashed and cognizant hasnt recevied my rejected package.

    This tells me two things –
    1. USCIS hasnt fully sent out the rejection packages.
    2. If you havent received a receipt there is a 99% chance its a rejection.

    My client is not willing to share client letter , so i have submitted the SOW .
    waiting for Approval, last year i didnt pick in lottery .

      I got an RFE on 6th Aug 2015. As i work in a non US account , i beleive neither i will get the Client letter and has to manage with the SOW.

  35. I think i owe this much to redbus2us forum that i should write about my experience! So, petition was filed by a small US based company after appearing for legitimate interviews consisting several rounds. I followed this forum and every other bit of resources till mid May. Employer said then check is not encashed. Lost hope, slogged few days and started working on plan B seriously. On August 3, dropped to mail the employer just to inquire what will be the status of my offer now since i dint get through the lottery. And, got a mail from them with the receipt number saying mine got selected and approved around mid June. They would have contacted me within two weeks for stamping procedures anyway! Though i dont know what will happen to the visa next, but that mail made by day. 🙂 awaiting soft copy of receive and approval now. NAD/RP

    I have a quick question and would very badly need to know. Wud appreciate if anyone can help me with the answer..
    I work for Indian MNC but am in Canada right now under same employer and got h1b picked and approved now.
    I plan to go to India for stamping and go to US from India, I have option to get stamped in Canada and go to US from Canada.
    1) Manager said that if i get stamping done in Canada and go to US, I may get more salary in comparison to, if I do stamping in India and move to US.
    2) Friends say the salary already wud have submitted during H1b application filing and cannot be changed by employer mostly(unless manager wishes), so getting stamped from Canada or India will be same in terms of salary..

    Can anyone tell me what wud most be probably true and what is the best option for me?

    • USCIS does not set different salaries for diff countries.. its entirely upto your employer and skillset.. I dont think merely getting stamped in Canada will boost up ur salaary… again, there are many strange people and companies in the world..

    • I dont know about the salary aspect but getting your H1B stamped in canada is a million times easier than getting it stamped in India.

      My advise – Don’t take the risk of rejection and get it stamped in canada before you travel to india

  40. I got a rfe asking for my post completion OPT status validity at the time of filing. The funny situation is that I was not on post completion OPT, I am on pre completion OPT, with full time enrollment in a program now and at the time of filing. I feel like they don’t really go through the documents, or else how did they miss my current valid I20… and my card which clearly says pre-completion OPT. Kudos USCIS. You guys cannot get better!

    • Am not sure, but pre-completion OPT is something you do before graduation. So you will not be eligible for masters exempt, unless this is your second masters in USA. If at all you have graduated and you have the EAD card then it should have Post completion OPT.

    • Many funny things happen with RFEs, in my case they want proofs that:
      1. Data Scientist is a specialty occupation
      2. A person with PhD in machine learning (and MS in applied math) is qualified to do it.

      That is ridiculous and annoying, but I hope that in such obvious cases everything ends well after a proper response.

      • Specialty Occupation RFE’s really are annoying.. In your case, they may not mean that you’re not qualified enough (which you clearly are) — USCIS may have issued it as they may have felt that your job wasn’t specialized enough to have someone as qualified as you doing it. The issue just could be with the way the job duties were described by your employer during the H1B filing. A solid response to such an RFE should be enough.

  45. I filed two H1b petitions. Both got selected in lottery. Still both are in process. is there any issues if i wait to get at least one petition approval and then drop the other petition?

    • I am in the same situation. I have one approved for my current employer and one pending status. I am going for stamping with current employer petition. All online forum says that there is not any problem on having multiple petitions approved, but Haven’t met anybody who had this experience in the past.

  48. I know many are waiting for approvals and some are stuck up in RFE’s, but I had a different story. Got my Visa approved today! Mine is a small product development company with less than 20 ppl applied from Vermont / Regular processing.

    For me the process this year was smooth(last 2 years didn’t get through lottery). Got approval notice by june 1st week. Scheduled Visa interview today 05-Aug and finger prints was on 4-Aug(this is a formality)

    VO asked few questions, like

    1. purpose of travel
    2. which place and salary
    3. who filed petition
    4. How many employees?
    5. Client – (for me its a in-house, showed him project documentation)

      • Well…I was on the same boat until Aug 3 when my status changed to RFE. And when I checked the numbers before and after me, all but one of them had changed to RFE as well…
        So three things :
        1> WAC15141522** has picked speed
        2> RFE may be their way of saying – I have given the requirement and it is for the Developers to code while I can relax,again .
        3> Series does matter else why on Aug 3 did 10 receipt number in same sequence change to RFE .
