As many of you know, H1B Visa 2015 quota was over in the first week and a whopping 172,500 H1B petitions were received in first week by USCIS.  H1B Lottery / random selection was held by USCIS to select 85,000 H1B petitions to fulfil the work permit cap. Many of the unlucky ones are already wondering about next year H1B Visa quota. Also, some of you are planning for H1B visa for next year, you also would be wondering regarding the same. This article addresses many of the common questions, it will be updated constantly, whenever any changes to info.  Bookmark this page !  To start with, firstly the news updates on this season, followed by many commonly asked questions.

Official & Unofficial USCIS News Updates Regarding H1B 2016 Season 

When will the H1B season for fiscal 2016 begin ?

USCIS will accept petitions for H1B Visa 2016 season starting from April 1st, 2015.  USCIS did a press release on March 12th outlining the details. Read summary of press release by USCIS on H1B 2016 .

Will there be lottery again for H1B Visa 2016 ? Predictions ?

We had lottery for FY 2015 and FY 2014. The total number of petitions filed for FY 14 were about 125,000 and for  FY 2015, there were about 172,500 petitions… As H1B Quota did not increase for FY 2016, and the demand does not seem to decrease, we would very likely have lottery for FY 2016.  Read H1B Visa 2016 Lottery Predictions, Dates, Results

What is the H1B Visa quota Cap Count ? Would there be any changes to H1B 2016 count ?

H1B Visa quota cap count is the total number of petitions that USCIS will accept for a fiscal year to provide temporary work permit for highly skilled workers.  For the 2016 fiscal year, the cap count is as below :

  • Regular H1B Quota : 65,000
  • H1B Masters Degree Quota ( only US Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

As per the press release in March 2015, the quota did not increase.  To give some background, as per the Obama executive action in Nov 2014, no changes were announced to the H1B Cap count. There was proposal in 2013 to increase H1B cap from 65,000 to 110,000 and Masters quota to increase from 20,000 to 25,000 did not go through as of March 2015. At least, for this FY 2016 season, the quota is fixed and it will be as above and no changes.

When should I start planning for H1B Visa 2016 ? What are the steps ?

It depends on your situation. Below are few scenarios and your plan.

  • If you are a student on F1 Visa in USA, you need to plan for your internship/ CPT or OPT employment  at a company that can sponsor your H1B Visa for FY 2016. In my view, you should start now to find something for the fall 2014 and continue that for next spring so that you can file for FY 2016
  • If you are in other country and planning for H1B, it is good to start your process around the end of this year 2014. It will give you enough time to find sponsors, search for job, etc.
  • If you are on H4, L1 or other visa in USA and planning for H1B for FY 2016, you also should consider looking around end of this year i.e. December 2014.

Most asked Question – How do I Find H1B Sponsors for FY 2016 ?

This is a million dollar question !  One of the biggest challenges is to find a good sponsor that can offer you a job and wait for you to start work after 6 months of filing your petition.  You should review the detail article on How to find H1B Sponsors for FY 2015. What about Comprehensive Immigration Reform ( CIR) – H1B Visa Changes ? What are they ?

There have been some proposed changes to the H1B Visa program to cater to the demand in the  US economy as part of the Comprehensive Immigration reform. Below are some of the proposed changes.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

These were proposed in 2013, but nothing has moved significantly and all the above are just proposed rules. We are not sure when they will be implemented. You can read  Summary of CIR – Immigration reform – H1B Visa and Green Card  to get an idea. The latest update is that Obama has taken executive action on Immigration in Nov  2014  and none of the below are included as part of that.  Stay tuned for updates.

H1B Visa 2016 Fees – Any changes ? How much does it cost ?

There are various components of the fee. The H1B Application filing fee could range anywhere from $1,600 USD to $4,400 depending on the size of the company. The attorney fee can range from $500 to $3000 depending on the attorney. If you apply for premium processing that is another $1,225. The fees has not changed in the past couple of years for FY 2014 and FY 2015. Unless USCIS revises fee based on immigration reform, it should be same. We will keep you all posted. H4 Visa EAD rule impact on H1B Visa 2016 Season ?

As you know, certain H4 visa holders are now eligible for EAD. The H4 Visa EAD Rule Passed earlier in 2015 and is effective from May 26, 2015.  USCIS will start accepting applications for EAD from those eligible H4 visa holders starting from May 26th. The question is that will that have an impact on number of H1B petitions for this fiscal year  ?  It very likely will have certain impact on the number of H1B applications that are filed for this year 2016 quota. Many of the H4 holders, who would now be eligible for EAD, may not apply for H1B visa, just because it gives them more flexibility to work and more choices to work as well. We would have to wait and see, how much of an impact that would have, but it is very straightforward and no brainer for eligible H4 visa holder to avoid the H1B processing.

H1B visa Premium Processing Changes to H1B Visa 2016 quota ? 

USCIS updated in their press release that the premium processing will be accepted for FY 2016 quota and they will only begin that “no later than May 11, 2015”. What it means for the petitioners is that the official 15 day premium processing clock starts from May 11th, 2015 and their petition could be adjudicated within 15 days from May 11th, which would be May 26th, 2015.  USCIS can process them earlier as well, but their new timeline is just indication for setting the right expectations to meet the stipulated time frame for premium processing.

  7. I’ve got an RFE. Case number- EAC15148*******. Non AD/RP/Vermont.Could anyone enlighten me on this please.Is RFE something to be intimidated? What sort of information they will be looking for? Why would a case get a RFE? Please share your experience.My position is Business Systems Analyst

    • There would be many reasons for RFE. Mostly the client letter must be required more explanation from employer side OR your education is not relevant to the job/field you applied for OR you might have only 3 year (Indian UG) degree substituted with the experience (lack of 1 year as per US degree equivalent) for applying h1 which would rise the question why the employer chose you when there are lot of candidates available with the US equilant degree with adequate experience.

      Tell me you fall under in which category and I will let you know the complete details. Your employer might have received the detail letter from USCIS with the proper reason.

        • Saj – That could be one of the reasons. Your field of Education should match with your experience and the job you are applying for H1B. Unless your Attorney has given a Evaluation Report explaining your Education is Equal to a US Bachelors Degree…

      • Fellows – There are 150k people who were not picked and need to go back to india or wait for next year’s H1B pick. That is a bad situation.

        You are picked and by all statistics so far, there hasnt been a lot of denials. I dont know why you are so worried about the case not being approved yet when you know it will normally take 3-4 months for this to happen. Relax…just know you are in a much much better position that the others.

    • Be sure to ask your employer for the reject notice. It should have your name in the letter. Make sure your employer really applied for you.

  12. I contacted Chennai visa cell about my visa status. And this was their reply :
    “USCIS announced May 4, 2015, that it has completed data entry of all fiscal year 2016 H-1B cap-subject petitions selected in our computer-generated random process. USCIS will now begin returning all H-1B cap-subject petitions that were not selected. Due to the high volume of filings, the time frame for returning these petitions is uncertain. USCIS asks petitioners to not inquire about the status of submitted cap-subject petitions until they receive a receipt notice or an unselected petition is returned. USCIS will issue an announcement once all the petitions have been returned.”

    Till when can it take for USCIS to return all packages ? Also, any news from TCS Mumbai ?

    I need some help.

    Below are the updates I am seeing in USCIS portal ever since I get the receipt number from my employer. My case is submitted as premium category.

    I am not seeing any RFE nor NOID.
    My employer is not giving me any updates on this. So frustrated.

    Can some one help me with some clarifications….
    what would be the message in USCIS portal if the case has RFE/NOID?
    Attorneys are the only source of information in case of RFE or NOID?
    is there any other source to check what is going on?

    I am seeing many cases which is in later series are approved. even regular…

      • My company is trying to send me to Canada for a year and get me back on L1 visa.. Don’t know how complicate or easy that may be.. 🙁 Whats yours?

        • Hey there. My H1B didn’t get picked last yr and my company also took the same route. Fortunately my H1 got picked in the lottery this yr else they would have applied for L1 after completion of 1 yr here in Canada. FYI, if you come back next yr on L1 visa then you would have a better chance of getting EB-1 GC (processed within 6-8 months). The primary requirements for EB-1 GC and L1 are exactly same. Rather than going back to your home country you are better off going to Canada.

          • But, the problem is I am gonna get married by the end of this year.. It will be too much of moving for me and my family.. 🙁 Anyways, I really hope they apply for a L1 for me next year rather than applying for H1B. I don’t wanna get into this hassle again.. 🙁

          • That is partially true Eric. Most technical people, who form the majority of H1B applicants, will only qualify for an L1B visa (specialized knowledge), and not an L1A (manager / executive). An L1B offers no advantage for green card processing. Even for an L1A, while it may be possible to get it for a small time first line manager (chances of rejection are small for real executives, and higher for “namesake” managers), the green card evaluation for Eb1 takes a much sterner stance. EB1 was abused a lot by companies earlier, which has now resulted in a very high percentage of audits.

          • Yes. You are correct. Even though very remote chances but I still believe you have an outside chance of Eb-1 category with L1B visa. Also this guy should apply for H1B as it can be applied earlier and visa approval at the time of interview chances are higher than L1 visa. Also down the road it would be better for him and his family if his H1b is approved.

      everytime they say ….rejection list will be out next week

    I got a question here: I am asked to travel by the client on B1 Visa for couple of month, It is adviceable when H1B is still under process.

    • As far I know, B1 & H1 have completely different objectives, so it should not be an issue. But u can expect some questions from embassy since they may also get an impression that u may be planning to work on B1 for these 3 months till October which is not allowed as per B1. So it all depends how u r going to convince Embassy during stamping. This analysis is purely based on my knowledge,…u can contact an expert in these matters.

    • Final results may take August end even September….Yeah TCS had released 4th list across India..not sure about Mumbai…no idea about next list.

    My employer said that my cheque was encashed on May 1st, but till date I did not get the receipt number and its RP. Does it take too long n RP to get the receipt number. Is anyone else on the same boat.

    • Hi..

      I believe you still hope because I didn’t receive any notification from USCIS, but my approval notice. Neither my employer nor attorney received any notification that my petition is selected in lottery. It was a big surprise when my employer received a notification saying my case is approved, where the receipt date was April 21 in the approval notification. So I believe you still can hope.

Hello Infosys guys, i heard that on friday 3rd july AIMS was updated for Selection/Rejection and most of my frnds were Rejected..did anyone received update as “Selected” on AIMS on 3rd july..just wanted to know if any hope is still available or not 🙁 ..mine status is still same as “filed with USCIS”..might be mine rejection will come by this week… 🙁

    • My frnd got “Selected” on june 30th. So there is a chance, but its very very less. We will be getting next update this month end.

        • Yeah, out of 30 in my team, one got selected (in the last batch that have come) and others rejected. So you need to be lucky 😛

          • I have also no update yet. But GI team confirmed me that till 15th July all results will going to be updated.

            My one friend, from IBM told me that selection update from USCIS is over

          • Yes, confirmed with Infy GI team, last list was released on June 30th and they received both positive and negative cases. They did not confirm the no.s of both but yes they did receive. They said they are expecting more in the current and following weeks.

    • If they open doors completely, entire India will fill up their country. Then, USA will look like India. At least, USA is still allowing Indians to come. If it were India, they would have completely banned entry to people invading their country like pests.

        • BUddy. Do you really think the guys wrking for crap Indian companies like TCS, Infy, wipro etc are doing US favors. They are just cheap cyber coolies here to earn a quick buck and try their best to find a green card sponsor. Maybe Only about 5% are real innovators like pople work wrk in product based companies. I have been for 7 years and worked for the same desi companies . So I would definitely say US is doing a favour to all the 3rd world countries by providing H1B.

          • Indeed sad to see such kind of derogatory remarks. But if you find it right to think that way, your choice. I personally generalize people. And there is something called respect which we owe to others. A shrewd country like US will not do a favor to its own citizens, leave aside people from India. If things fall in line of their Business interest, then only they will favor someone. I have worked in IT Industry for more than 8 years and have seen many great minds in Service based companies as well. Only thing is, they don’t have the bandwidth and scope to showcase their potential because they are expected to work on specs which are controlled by client.

            Let’s be a little bit considerate before passing such kind of harsh views on someone.

  20. My case got RFE on 26th June, stating Requesting for Additional Evidence, EAC1514****** I don’t know what it means exactly, my employer said they didn’t receive any mail yet, How much time USCIS will take to send mail..? Can anyone share there experience or anyone in same boat.

            Consulate people never interact with employee during USCIS adjudication process unless your case is issued 221g during stamping

            Chennai Visa Cell mean our internal visa team.

  28. Guys,
    Mine is regular case. My employer told me on 18th may that my check was en-cashed. But they didn’t provide me neither written confirmation nor receipt number till date. I called them many times but they said they are waiting for approval.
    My question is….Is that possible that my check encashed and they didnt get any email form USCIS?? Is there anyone with same case??

    • I am exactly the same like you . My company told me that my cheque encashed around 5/1, but they didn’t receive any receipt notice by now as well as approval.

    • If they say, they are waiting for approval, definitely they have your case Id with them.. Without that, how can they check approval/rfe status.. But, you can’t do anything than requesting them…

    My application was not selected in the lottery. Today only the status was updated in GI portal. Actually it was rejectd status was received on 18June, but it is updated today in system.
