As many of you know, H1B Visa 2015 quota was over in the first week and a whopping 172,500 H1B petitions were received in first week by USCIS.  H1B Lottery / random selection was held by USCIS to select 85,000 H1B petitions to fulfil the work permit cap. Many of the unlucky ones are already wondering about next year H1B Visa quota. Also, some of you are planning for H1B visa for next year, you also would be wondering regarding the same. When will the H1B season for fiscal 2016 begin ?

USCIS will accept petitions for H1B Visa 2016 season starting from April 1st, 2015.  USCIS did a press release on March 12th outlining the details. Read summary of press release by USCIS on H1B 2016 .

Will there be lottery again for H1B Visa 2016 ? Predictions ?

We had lottery for FY 2015 and FY 2014. The total number of petitions filed for FY 14 were about 125,000 and for  FY 2015, there were about 172,500 petitions… As H1B Quota did not increase for FY 2016, and the demand does not seem to decrease, we would very likely have lottery for FY 2016.  Read H1B Visa 2016 Lottery Predictions, Dates, Results

What is the H1B Visa quota Cap Count ? Would there be any changes to H1B 2016 count ?

H1B Visa quota cap count is the total number of petitions that USCIS will accept for a fiscal year to provide temporary work permit for highly skilled workers.  For the 2016 fiscal year, the cap count is as below :

  • Regular H1B Quota : 65,000
  • H1B Masters Degree Quota ( only US Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

As per the press release in March 2015, the quota did not increase.  To give some background, as per the Obama executive action in Nov 2014, no changes were announced to the H1B Cap count. There was proposal in 2013 to increase H1B cap from 65,000 to 110,000 and Masters quota to increase from 20,000 to 25,000 did not go through as of March 2015. At least, for this FY 2016 season, the quota is fixed and it will be as above and no changes.

When should I start planning for H1B Visa 2016 ? What are the steps ?

It depends on your situation. Below are few scenarios and your plan.

  • If you are a student on F1 Visa in USA, you need to plan for your internship/ CPT or OPT employment  at a company that can sponsor your H1B Visa for FY 2016. In my view, you should start now to find something for the fall 2014 and continue that for next spring so that you can file for FY 2016
  • If you are in other country and planning for H1B, it is good to start your process around the end of this year 2014. It will give you enough time to find sponsors, search for job, etc.
  • If you are on H4, L1 or other visa in USA and planning for H1B for FY 2016, you also should consider looking around end of this year i.e. December 2014.

Most asked Question – How do I Find H1B Sponsors for FY 2016 ?

This is a million dollar question !  One of the biggest challenges is to find a good sponsor that can offer you a job and wait for you to start work after 6 months of filing your petition.  You should review the detail article on How to find H1B Sponsors for FY 2015. What about Comprehensive Immigration Reform ( CIR) – H1B Visa Changes ? What are they ?

There have been some proposed changes to the H1B Visa program to cater to the demand in the  US economy as part of the Comprehensive Immigration reform. Below are some of the proposed changes.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

These were proposed in 2013, but nothing has moved significantly and all the above are just proposed rules. We are not sure when they will be implemented. You can read  Summary of CIR – Immigration reform – H1B Visa and Green Card  to get an idea. The latest update is that Obama has taken executive action on Immigration in Nov  2014  and none of the below are included as part of that.  Stay tuned for updates.

H1B Visa 2016 Fees – Any changes ? How much does it cost ?

There are various components of the fee. The H1B Application filing fee could range anywhere from $1,600 USD to $4,400 depending on the size of the company. The attorney fee can range from $500 to $3000 depending on the attorney. If you apply for premium processing that is another $1,225. The fees has not changed in the past couple of years for FY 2014 and FY 2015. Unless USCIS revises fee based on immigration reform, it should be same. We will keep you all posted. H4 Visa EAD rule impact on H1B Visa 2016 Season ?

As you know, certain H4 visa holders are now eligible for EAD. The H4 Visa EAD Rule Passed earlier in 2015 and is effective from May 26, 2015.  USCIS will start accepting applications for EAD from those eligible H4 visa holders starting from May 26th. The question is that will that have an impact on number of H1B petitions for this fiscal year  ?  It very likely will have certain impact on the number of H1B applications that are filed for this year 2016 quota. Many of the H4 holders, who would now be eligible for EAD, may not apply for H1B visa, just because it gives them more flexibility to work and more choices to work as well. We would have to wait and see, how much of an impact that would have, but it is very straightforward and no brainer for eligible H4 visa holder to avoid the H1B processing.

H1B visa Premium Processing Changes to H1B Visa 2016 quota ? 

USCIS updated in their press release that the premium processing will be accepted for FY 2016 quota and they will only begin that “no later than May 11, 2015”. What it means for the petitioners is that the official 15 day premium processing clock starts from May 11th, 2015 and their petition could be adjudicated within 15 days from May 11th, which would be May 26th, 2015.  USCIS can process them earlier as well, but their new timeline is just indication for setting the right expectations to meet the stipulated time frame for premium processing.

    • Here I saw some people claimed selection mail without receipt number. I think they sent selection mail to those who selected. Look like they are hiding the rejection info from us and putting a narrow hope in their unclear selection status mail.They want to hold the money as long as possible.But they cannot hold this info after USCIS make an announcement of completion of rejected petitions. So we can wait for that day…

      • This info I got from Path2USA…
        The fastest way to know if your application/petition has been selected in the lottery if u applied for Normal/non-premium processing is the information whether your check has been cashed or not. If you check has been cashed, ask your employer/attorney to tell you the receipt number from the back of the image of the cashed check. Usually, it would take about 2 weeks(from the date your check is cashed) to get your receipt notice. This is because USCIS uses USPS(Normal mail) to mail out receipt notices.

  1. Got approved today. There was a mistake from lawyers end. My company thought he had filed in PP which was not the case. This week they converted by application to PP and got approved in 2 days.

    • I think they will hold the rejected petition status until USCIS make an announcement about completion of the returned packages ( uscis.gov/news/uscis-completes-data-entry-fiscal-year-2016-h-1b-cap-subject-petitions) . As per my understanding, they informed the guys those who got selection.We can see some guys claimed they got selection info from them.
      In the case of ours (unselected), they want to hold our money as long as possible. Thats why they sent an unclear mail.I think we can look on other plans and wait for the USCIS announcement. After the USCIS announcement they cannot fool us more.

  4. Hi,

    My H1B is filed for location A, but I had to travel to location B. So my company applied for new LCA. With the new LCA I travelled to US during last year. Now I came to India due to personal emergency and I am planning to travel back to US early next week.

    But now my company tentatively saying that I have to file H1B Amendment Petition before I travel due to April 9 H-1B Amendment rule. Even my company is not sure. I don’t have time to file my Amendment too since my flight is booked for early next week.

    If I travel, will I face any issues at Port of Entry?

    • Well H1b holders are returned back from port of entry because of other reasons. But I am not sure if they will do that in this case, since the H1b amendment rule is so now.

      In my personal opinion it would be better to reschedule if possible and get the amendment done.

  5. On my case status, they received my application on 30th Aprill 2015. but lottery was done on 13th april. I saw other case status as well. Most of case received on 13th april. Can I consider that its not receipt for new h1b 2016? Because new h1b 2016 application should be received on 13th april 2015. Right? My receipt num: EAC1514951XXX.

      • Hahaha … well said Slaughter … sometimes people think too much and end up no where. Thats because of so much of excitement that H1B is everything….even I was like that some time back 🙂 .

    • There are two things. 1) Case received : This is date when lottery has happened. This will be same for everyone including you unless there is a typo error.

      2) Receipt Notice received : This will be a different date. For me it is April 23rd. I think for you it is April 30th. May be you have mistake Receipt Notice received to Case received. You have your receipt number,…dont think much and just wait for the status to change to Approved.

        I guess here they are talking about case received status which should be same for all. Right?

  20. I thought at least by this friday GIMS would confirm the rest of the result. Waited daily for 40 days. As some previous experienced folks mentioned GIMS can not prolong to inform the result for months. So let us wait for another 2 more weeks.

        Do we have any hope? I don’t think so. Only we can expect rejection. Recently no one got. I m aware of only first batch. Afterward no news. I asked one GIMS person, he said almost no hopes. 🙁
        After waiting for long time, it’s really disappointing.

  21. My receipt no shows that they received my application on 30th April. Is it possible for new h1b 2016 case? because lottery done on 13th april 2015. Can we say this receipt number for renewal or some other case?

      So far we received 69 receipts out of 200 applications. We do not know about your case status yet.

      We are waiting for either the receipts or the application packages of all the candidates. Until the package comes back, there is a hope that we may receive your receipt. Because we got some receipts without the cheques cashed. Also some of the cheques cashed and no receipt came. So, until we receive the package we are not sure of your application selection.

      We will inform you as soon as we receive either the receipt for you or your application package back from USCIS.

      At the present time, we are looking for candidates who has either current H-1B or H-1B in the past to file for H-1B transfer if they are in USA or new H-1B in quota exempt if they are not in USA. Appreciate your help.

        Just read mail carefully. Its mentioned that they got some receipts without the cheques cashed.

      • Why do you want to report ? So people who are not selected in lottery, wouldn’t have any other option than getting into these universities. Do you want to even narrow these options for people who are already undergoing so much pain….. They already have tons of education loans and besides that going through lot of pain for not getting through lottery and are paying their salaries to maintain status in US….. you loser, go get some life……

        • Guys, u need not be rude to answer a simple question. If you dont wish to then better stay away. Dont jus behave as if you belong to top league college in US and Indian IT is stealing ur jobs. All of us know how a AD gets a job in US through some consultancy and if at all u belong to a top college , u have done nothing great there are thousands of them like u .. try to do something better with ur life rather than showing ur arrogance.

          • You are right. It is a simple question, that need not be asked. I don’t believe anyone here is from a top league college in the US, but I guess less than majority know how to read and know what the process of H1B is. There are thousands like an AD guy here, but millions of people like you who don’t know what the process is. You should be the last person telling AD guys what to do with their life. If people are acting intentionally dumb, rudeness is the best answer.

          • Then y bother answering and showing ur frustration rather than letting it be. True there are millions of Indians including u , struggling to get a better life and millions who could not afford quality MS education and depend on the India IT to give them a chance to experience something new and change their lives. Ur chasing an American dream and like u a lot of us are also chasing a dream of our own. If at all u can, then try to encourage, but never generalize and degrade your own kind. Knowing H1b process is not the top of the world thing and not knowing is the end. Yes i agree many doesn know the process and i believe this blog is for this very purpose and please don’t tell me that u knew the process since the day u were born. Even u would have asked someone or read somewhere and definitely would have asked a stupid question at some point. So relax, have a drink and before u look down upon someone, try to see the world from their side. My own brother is a AD and with in an year he will be in the simlar position like you guys are and i agree its a struggle for survival there also and i definitely dont expect him to be rude and arrogant but rather be helpful.

  24. I got a mail from consultancy yesterday that I was not selected in lottery, they have received my package back. How can I come to know of a proof that they really filed my petition. Any document I can ask them as a proof. Although its one of top consultancies and I was selected only after 3 rounds of rigorous interview. They do maintain online portal for visa tracking and all, they filed visa without any fees from me, but still I want to see some document as a proof.

    • Ask them a copy of the letter from USCIS that says you were not selected in the lottery. The letter is enclosed to the package they returned.

    • Ask for the covering letter which will be sent along with the returned package. that will be the only proof that you have applied and didnt selected in lottery. This letter will be sent by USCIS along with the every returned package.

    • Thanks guys, as per all your suggestion I have mailed them asking for copy of covering letter from uscis, which says I was not selected in lottery. Once I got a reply from them, I will update you all.

      Luck dint favored me this time, hopefully like others I should have applied multiple applications to increase chances. Many consultants were ready to file H1b for me but I selected only one of the best for being fair. A bit of mine background so that you don’t consider its a fake. I am a solution architect with over 13 yrs of IT experience, and lived for 3 yrs in London, 1 yr in Sweden and 2 yrs in Dubai. Although i have visited US 4 times and have valid B1/B2 visa for 10 yrs, but H1b is something I am missing. I will try next year for h1b, this year my L1 got rejected(hard to believe 🙁 ). May be few years in US but ultimately I will be settling in India only. 🙂

      • Nope. I talk to the paralegals every now and then. I always hear from them that they are still receiving receipts and have patience. At least until last week, they didn’t receive any not selected petitions yet. I will reach out to them tomorrow. The process is stupid. USCIS -> US -> Canada. This easily takes a month. I think if we don’t receive this week then we need to just make up our mind for the next.

  28. Don’t know what’s with these guys they are telling different version to different people. Is there any one who really received notification. Me and few of my friends called them and they claim they are yet to share the result with any one. But few comments here says they received

        • That doesn’t mean you’re not selected. I called them yesterday, they told they didn’t inform anybody about selection status . I think you can still hope. But I think we have to wait till July 1st week to get the Mail from them. By the time they may get all the receipts and return packages

    • I called them on tuesday, they told im not in the selected list. They are not expecting anymore. From next week onwards they r expecting rejection packages.

    • In the same situation, not return pack neither receipt. I just know that my check wasn’t in cashed. So, it being hard to keep the hope.
