As many of you know, H1B Visa 2015 quota was over in the first week and a whopping 172,500 H1B petitions were received in first week by USCIS.  H1B Lottery / random selection was held by USCIS to select 85,000 H1B petitions to fulfil the work permit cap. Many of the unlucky ones are already wondering about next year H1B Visa quota. Also, some of you are planning for H1B visa for next year, you also would be wondering regarding the same. When will the H1B season for fiscal 2016 begin ?

USCIS will accept petitions for H1B Visa 2016 season starting from April 1st, 2015.  USCIS did a press release on March 12th outlining the details. Read summary of press release by USCIS on H1B 2016 .

Will there be lottery again for H1B Visa 2016 ? Predictions ?

We had lottery for FY 2015 and FY 2014. The total number of petitions filed for FY 14 were about 125,000 and for  FY 2015, there were about 172,500 petitions… As H1B Quota did not increase for FY 2016, and the demand does not seem to decrease, we would very likely have lottery for FY 2016.  Read H1B Visa 2016 Lottery Predictions, Dates, Results

What is the H1B Visa quota Cap Count ? Would there be any changes to H1B 2016 count ?

H1B Visa quota cap count is the total number of petitions that USCIS will accept for a fiscal year to provide temporary work permit for highly skilled workers.  For the 2016 fiscal year, the cap count is as below :

  • Regular H1B Quota : 65,000
  • H1B Masters Degree Quota ( only US Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

As per the press release in March 2015, the quota did not increase.  To give some background, as per the Obama executive action in Nov 2014, no changes were announced to the H1B Cap count. There was proposal in 2013 to increase H1B cap from 65,000 to 110,000 and Masters quota to increase from 20,000 to 25,000 did not go through as of March 2015. At least, for this FY 2016 season, the quota is fixed and it will be as above and no changes.

When should I start planning for H1B Visa 2016 ? What are the steps ?

It depends on your situation. Below are few scenarios and your plan.

  • If you are a student on F1 Visa in USA, you need to plan for your internship/ CPT or OPT employment  at a company that can sponsor your H1B Visa for FY 2016. In my view, you should start now to find something for the fall 2014 and continue that for next spring so that you can file for FY 2016
  • If you are in other country and planning for H1B, it is good to start your process around the end of this year 2014. It will give you enough time to find sponsors, search for job, etc.
  • If you are on H4, L1 or other visa in USA and planning for H1B for FY 2016, you also should consider looking around end of this year i.e. December 2014.

Most asked Question – How do I Find H1B Sponsors for FY 2016 ?

This is a million dollar question !  One of the biggest challenges is to find a good sponsor that can offer you a job and wait for you to start work after 6 months of filing your petition.  You should review the detail article on How to find H1B Sponsors for FY 2015. What about Comprehensive Immigration Reform ( CIR) – H1B Visa Changes ? What are they ?

There have been some proposed changes to the H1B Visa program to cater to the demand in the  US economy as part of the Comprehensive Immigration reform. Below are some of the proposed changes.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

These were proposed in 2013, but nothing has moved significantly and all the above are just proposed rules. We are not sure when they will be implemented. You can read  Summary of CIR – Immigration reform – H1B Visa and Green Card  to get an idea. The latest update is that Obama has taken executive action on Immigration in Nov  2014  and none of the below are included as part of that.  Stay tuned for updates.

H1B Visa 2016 Fees – Any changes ? How much does it cost ?

There are various components of the fee. The H1B Application filing fee could range anywhere from $1,600 USD to $4,400 depending on the size of the company. The attorney fee can range from $500 to $3000 depending on the attorney. If you apply for premium processing that is another $1,225. The fees has not changed in the past couple of years for FY 2014 and FY 2015. Unless USCIS revises fee based on immigration reform, it should be same. We will keep you all posted. H4 Visa EAD rule impact on H1B Visa 2016 Season ?

As you know, certain H4 visa holders are now eligible for EAD. The H4 Visa EAD Rule Passed earlier in 2015 and is effective from May 26, 2015.  USCIS will start accepting applications for EAD from those eligible H4 visa holders starting from May 26th. The question is that will that have an impact on number of H1B petitions for this fiscal year  ?  It very likely will have certain impact on the number of H1B applications that are filed for this year 2016 quota. Many of the H4 holders, who would now be eligible for EAD, may not apply for H1B visa, just because it gives them more flexibility to work and more choices to work as well. We would have to wait and see, how much of an impact that would have, but it is very straightforward and no brainer for eligible H4 visa holder to avoid the H1B processing.

H1B visa Premium Processing Changes to H1B Visa 2016 quota ? 

USCIS updated in their press release that the premium processing will be accepted for FY 2016 quota and they will only begin that “no later than May 11, 2015”. What it means for the petitioners is that the official 15 day premium processing clock starts from May 11th, 2015 and their petition could be adjudicated within 15 days from May 11th, which would be May 26th, 2015.  USCIS can process them earlier as well, but their new timeline is just indication for setting the right expectations to meet the stipulated time frame for premium processing.

    • Focus on the whole sentence instead of the number only:
      It clearly states “nearly 233,000”
      USCIS received about nearly 233,000 H-1B petitions during the filing period

    • 233000 is for 85000. So 233000 – 20000 will be considered for normal lottery ..which is 213000 for 65000 vacancies. Now out if these, 6400 for sing & Chile … So finally 2,06,600 applications will compete for 58,600 vacancies … So the probability is : 35 : 100

  2. USCIS received about nearly 233,000 H-1B petitions during the filing period, which began April 1, including petitions filed for the advanced degree exemption. On April 13, USCIS used a computer-generated random selection process, or lottery, to select enough petitions to meet the 65,000 general-category cap and the 20,000 cap under the advanced degree exemption. USCIS will reject and return all unselected petitions with their filing fees, unless the petition is found to be a duplicate filing.

    Sessions, Durbin Lead Bipartisan Group Of Senators Demanding Federal Investigation of SoCal Edison

    WASHINGTON—U.S. Sen. Jeff Sessions (R-AL), Chairman of the Subcommittee on Immigration and the National Interest, issued the following statement today after he and Senate Minority Whip Richard Durbin led a bipartisan coalition of Senators in sending a letter to Attorney General Eric Holder, Homeland Security Secretary Jeh Johnson, and Labor Secretary Thomas Perez, asking them to investigate Southern California Edison’s use of the H-1B guest worker program to replace American workers:

    “Southern California Edison ought to be the tipping point that finally compels Washington to take needed actions to protect American workers. As Professor Ron Hira testified, the H-1B visa has become ‘a highly lucrative business model of bringing in cheaper H-1B workers to substitute for Americans… Most of the H-1B program is now being used to import cheaper foreign guestworkers, replacing American workers, and undercutting their wages.’ The U.S. is graduating twice as many STEM students each year as find jobs in those fields, yet the H-1B program continues to provide IT companies with a large annual supply of lower-wage guest workers to hire in place of more qualified Americans. There is no ‘shortage’ of talented Americans, only a shortage of officials willing to protect them.”

    Text of the Senators’ letter follows:

    “Dear Attorney General Holder and Secretaries Johnson and Perez:

    We are concerned about recent information that has come to light regarding the abuse of the H-1B visa program by Southern California Edison (SCE) and other employers to replace large numbers of American workers. We urge you to investigate this matter.

    A number of U.S. employers, including some large, well-known, publicly-traded corporations, have reportedly laid off thousands of American workers and replaced them with H-1B visa holders. To add insult to injury, many of the replaced American employees report that they have been forced to train the foreign workers who are taking their jobs. This troubling practice seems to be particularly concentrated in the information technology (IT) sector, which is not surprising given that sixty five percent of H-1B petitions approved in FY 2014 were for workers in computer-related occupations. Though such reports of H-1B-driven layoffs have been circulating for years, their frequency seems to have increased dramatically in the past year alone.

    In many cases it appears that the H-1B workers are not employees of the U.S. company laying off American workers, but instead are contractors employed by foreign-owned IT consulting companies. This increasingly popular business practice by U.S. companies and foreign-owned IT outsourcing firms raises several questions. For example, have the U.S. companies that have laid off American workers and replaced them with H-1B workers and/or the IT consulting contractors the companies retained engaged in prohibited citizenship status discrimination against U.S. citizens? Did the Labor Condition Applications certified by the Department of Labor’s Employment and Training Administration and the petitions approved by U.S. Citizenship and Immigration Services for each H-1B visa holder who replaced a U.S. worker at these companies accurately reflect the scope and location of their work? Did such labor condition applications or visa petitions show any evidence of misrepresentation or fraud by the employer-petitioners? Did the employer-petitioners maintain a true employer-employee relationship with the H-1B workers after they were placed at the U.S. client company? While media reports indicate that the H-1B visa program is the principal visa program at issue in the layoffs, were other visa programs, such as the L-1B or the B-1, also used to displace American workers at U.S. companies?

    We respectfully request that you investigate the unacceptable replacement of American workers by H-1B workers to ascertain whether SCE or any other U.S. companies that have engaged in this practice, or the IT consulting companies supplying those companies with H-1B workers, have violated the law. Additionally, please notify us of any obstacles in existing law to conducting such an investigation.

    • Ya and may I ask you when you were reading the news did you saw the word Last Year???

      Last year, there were a total of 515,605 Labor Condition Applications (LCAs) submitted. Only if those are approved can a person be entered into the visa lottery.

    Another week went by with me suffering through it. I have to put on a brave face at work and around to not worry people around me. As i for so many years have been a pillar for those around me. Yet on the inside i am scared and terrified with the outcome. My last year in the lottery and nothing I can do to make it right, except may be pray. I am hoping i get through and others who genuinely are on last chances, and everyone else who should get them. Please do offer a prayer for me as hope is all i have at this point.

        • I agree with you my friend, its not that easy to not to worry. I am as worried as you and this is my last chance too. I have to start fresh if I dont make it. My marriage was fixed last year and I couldnt go since my authorization ended and I had to go on CPT and do MBA after my previous MS. Just got an email saying final number is 233,000. Chances look slim…:(

      • It’s most probably going to be announced towards the end of this week and the petition count is going to be significantly higher than last time.

          • It is actually the other way round. “Count is high” is my fact and “delay in announcement” is the inference from that fact.

            I am certain that the count is going to be high. I have discussed this with my employer and attorney (both are reputed). Also, if you read a bit more online, you would find almost every reputed attorney is expecting >=200K filings.

  11. How to verify only person applying with multiple companies has paid for this and not with single filling? Also I see lot of comments are fake. How you know people saying they filled multiple petition and paid for those are genuine and they are not posted by supporter of petition?

    • Because I know that some of my friends have filed 2 applications this year and last year as well.. And I hate to admit that they are my friends.. If I get chance, I will definitely reveal their names to USCIS..

      • If this is the case then they should be punished. This is my first application but USCIS must be aware of these thing. If so why they do not take strict action against those fake consultants which file paid h1b.. I hope we have good response in may be they act from this year only and blacklist those companies.

    • What world are you living in? There are a thousand desi consultancies in US who would sponsor you an H1B for $5K-$6K. This has been a normal practice for years now. Thousands in F1 and H4 status files petitions for non-existent jobs every year through these consultancies.

    My employer has one Not for Profit client. I will be placed to this Not for Profit Ogr on H1B. Please let me know if I will be cap exempt as I will be employed on this origination or not as my direct employer is a s/w development company?

  15. Hello, I applied for my H1B this year. I have been working for my employer for last 2 years. They work for one Non Profit Organization. Now they need me in US and I will be placed to this Non Profit Organization. I have heard there is no Quota for Non Profit Education Institution. Please let me know if all “not for profit org” qualify for this? Can I apply again with quota cap if I am not picked in lottery? Thanks in advance for your reply.

    • Yes.. all non profit organizations are cap exempted and they need not face the lottery. And in fact they can apply at any time of the year unlike the for profit organizations.. So Dont worry abt this lottery…

    • No this does not qualify for “Profit Org.”. You are not working for that non-profit org but the employer provide its services to them.

  16. Ok , I controlled my stress for so 13 days, kept telling everyone to calm down and wait, relax, be positive now I can’t do it anymore. I am actually freaking out this wait is killing me. I also checked my bank account n number of times to see if my premium processing check is en cashed but nope nothing (yes I gave money for premium processing from my side so it will show up in my bank acct if its processed) 🙁

      If it’s to happen, it will happen. Stay calm and you can will be fine. Last year I was in same position and this year as well. This time it’s for my husband who didn’t get h1 picked last year. Not sure what’s gonna happen if it’s not picked this year.

      • I understand all this but this is very stressful now. A lot of things depends on this dear and I am so worried 🙁 we both me and my husband have applied for H1 and this is a crucial year. Last year it was me only but didn’t got picked up in lottery. Best part is my employer on Friday told me not to worry as I deserve this and will get it and if I wont they will keep on trying for me 🙂 which was so much relief and gave me assurance that I really deserve it not just one of the body shopped employee.

          I know it’s the same situation here. My husband applied last year and he wasn’t lucky. He went to school all these days. Seeing him working on assignments all the week, it’s pain. Doing second masters is painful, and I think we deserve h1. Seeing all these fake petitions would reduce our chances.

    • That could be a good thing. Regardless selected or not selected the Premium processing check will always be checked. If premium processing Check is not cashed means they have not processed anything yet, not lottery not filtering fake ones not rejecting anyone’s. Which means yours is still there. Which means we still have hope.

But for some reason my employer backed out and now I am stuck in India with no future with the employer that sponsored me and no consultant willing to help (since they all keep saying that you need to be in the US only then can we hook u up with a job)

      • No employer can ask for the money. I didn’t paid not even single penny.

        Legally no employer can ask money from any one. If anyone ask the money they are going to given the imprisonment.

        In case some one has paid, how you prove that they had taken the money ? But I doubt no one has paid any money to any of the empoyer’s as it’s totally ILLEGAL.

            It’s good that you guys are signing that page but how you prove that the employers asked money ? because H1B is a employer based VISA.

            Multiple H1b from different employers is absolutely fine. As the filing fees of H1b is 100% employers’ responsibility, the beneficiary won’t be liable for this fees in any case.
            No question of ethics too, as far as things are legal, you are good to go. In the same way employers have all the rights to terminate your job even after one day of service. Again, no ethics, no emotions, just legality matters. It’s employer’s decision to invest the money on the future employee. They are free to hire a USC or GC holders.

      • Because of this petition one thing is for sure. This time uscis is going to send lot of rfes and noids. Most of the shady consultancies run away as soon as they see rfe or noid. 🙂

        • Every consultant has to prove the client letter, SOW, LCA certified, future employment etc.

          Whatever you are saying, you are correct and this has happen in the past as well.

          But any one who has correct way of filling and prove for every legal document. There is no issues at all.

          You will see this trade of business (small consultants) never stopped till USCIS create a RULE.

          Please try to explain how you or any one can prove that a empoyer has asked for the money ?

    Guys whoever has submitted multiple petition with correct way. There is no need to worry. I checked with them and they said if it’s ILLEGAL than the government is going to take the steps else they will not. There is no rule that a person can’t file multiple petition.

    Do not worry ! The lottery system works like this – every company some percentage of the seats. If the lottery is high still there are more chances to get selected in the lottery.

      Two boys were arguing when the teacher entered the room.

      The teacher says, “Why are you arguing?”

      One boy answers, “We found a ten dollor bill and decided to give it to whoever tells the biggest lie.”

      “You should be ashamed of yourselves,” said the teacher, “When I was your age I didn’t even know what a lie was.”

      The boys gave the ten dollars to the teacher.
