As many of you know, H1B Visa 2015 quota was over in the first week and a whopping 172,500 H1B petitions were received in first week by USCIS.  H1B Lottery / random selection was held by USCIS to select 85,000 H1B petitions to fulfil the work permit cap. Many of the unlucky ones are already wondering about next year H1B Visa quota. Also, some of you are planning for H1B visa for next year, you also would be wondering regarding the same. When will the H1B season for fiscal 2016 begin ?

USCIS will accept petitions for H1B Visa 2016 season starting from April 1st, 2015.  USCIS did a press release on March 12th outlining the details. Read summary of press release by USCIS on H1B 2016 .

Will there be lottery again for H1B Visa 2016 ? Predictions ?

We had lottery for FY 2015 and FY 2014. The total number of petitions filed for FY 14 were about 125,000 and for  FY 2015, there were about 172,500 petitions… As H1B Quota did not increase for FY 2016, and the demand does not seem to decrease, we would very likely have lottery for FY 2016.  Read H1B Visa 2016 Lottery Predictions, Dates, Results

What is the H1B Visa quota Cap Count ? Would there be any changes to H1B 2016 count ?

H1B Visa quota cap count is the total number of petitions that USCIS will accept for a fiscal year to provide temporary work permit for highly skilled workers.  For the 2016 fiscal year, the cap count is as below :

  • Regular H1B Quota : 65,000
  • H1B Masters Degree Quota ( only US Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

As per the press release in March 2015, the quota did not increase.  To give some background, as per the Obama executive action in Nov 2014, no changes were announced to the H1B Cap count. There was proposal in 2013 to increase H1B cap from 65,000 to 110,000 and Masters quota to increase from 20,000 to 25,000 did not go through as of March 2015. At least, for this FY 2016 season, the quota is fixed and it will be as above and no changes.

When should I start planning for H1B Visa 2016 ? What are the steps ?

It depends on your situation. Below are few scenarios and your plan.

  • If you are a student on F1 Visa in USA, you need to plan for your internship/ CPT or OPT employment  at a company that can sponsor your H1B Visa for FY 2016. In my view, you should start now to find something for the fall 2014 and continue that for next spring so that you can file for FY 2016
  • If you are in other country and planning for H1B, it is good to start your process around the end of this year 2014. It will give you enough time to find sponsors, search for job, etc.
  • If you are on H4, L1 or other visa in USA and planning for H1B for FY 2016, you also should consider looking around end of this year i.e. December 2014.

Most asked Question – How do I Find H1B Sponsors for FY 2016 ?

This is a million dollar question !  One of the biggest challenges is to find a good sponsor that can offer you a job and wait for you to start work after 6 months of filing your petition.  You should review the detail article on How to find H1B Sponsors for FY 2015. Your first place of start is to find the H1B Sponsors in an area or by company. Use our H1B Visa Sponsors Database to search and filter. What about Comprehensive Immigration Reform ( CIR) – H1B Visa Changes ? What are they ?

There have been some proposed changes to the H1B Visa program to cater to the demand in the  US economy as part of the Comprehensive Immigration reform. Below are some of the proposed changes.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

These were proposed in 2013, but nothing has moved significantly and all the above are just proposed rules. We are not sure when they will be implemented. You can read  Summary of CIR – Immigration reform – H1B Visa and Green Card  to get an idea. The latest update is that Obama has taken executive action on Immigration in Nov  2014  and none of the below are included as part of that.  Stay tuned for updates.

H1B Visa 2016 Fees – Any changes ? How much does it cost ?

There are various components of the fee. The H1B Application filing fee could range anywhere from $1,600 USD to $4,400 depending on the size of the company. The attorney fee can range from $500 to $3000 depending on the attorney. If you apply for premium processing that is another $1,225. The fees has not changed in the past couple of years for FY 2014 and FY 2015. Unless USCIS revises fee based on immigration reform, it should be same. We will keep you all posted. H4 Visa EAD rule impact on H1B Visa 2016 Season ?

As you know, certain H4 visa holders are now eligible for EAD. The H4 Visa EAD Rule Passed earlier in 2015 and is effective from May 26, 2015.  USCIS will start accepting applications for EAD from those eligible H4 visa holders starting from May 26th. The question is that will that have an impact on number of H1B petitions for this fiscal year  ?  It very likely will have certain impact on the number of H1B applications that are filed for this year 2016 quota. Many of the H4 holders, who would now be eligible for EAD, may not apply for H1B visa, just because it gives them more flexibility to work and more choices to work as well. We would have to wait and see, how much of an impact that would have, but it is very straightforward and no brainer for eligible H4 visa holder to avoid the H1B processing.

H1B visa Premium Processing Changes to H1B Visa 2016 quota ? 

USCIS updated in their press release that the premium processing will be accepted for FY 2016 quota and they will only begin that “no later than May 11, 2015”. What it means for the petitioners is that the official 15 day premium processing clock starts from May 11th, 2015 and their petition could be adjudicated within 15 days from May 11th, which would be May 26th, 2015.  USCIS can process them earlier as well, but their new timeline is just indication for setting the right expectations to meet the stipulated time frame for premium processing.

  1. When will the 3rd list be out? Also how many were selected in 2nd list.
    In 1st list looks like only 88 people were selected.

    • I spoke to Visa cell teams, and they confirmed that the results were sent out to the IBG/IBU heads. The leaders have to disseminate the info. till the associates. I’m waiting for mine to come. A bit hopelessly! 🙂

      • No confirmed news but I heard that very few names came out in second list. From my IBU 0 names came out while in first list 48 people were selected from the same IBU

    • Thanks mate!! Patience and Perseverance sure did pay off. I wouldn’t say I know its importance more than all others who got it in the first attempt. It was more of a committment. I was just not lucky in the previous years and I had made up my mind that this would be my last try with H1B and this time I won.

  6. Like several others here, I was also a silent reader. This is my third consecutive attempt with H1B lottery and my petition is through this time. Got my receipt number yesterday. Non-AD/RP/EAC.

    Based on my experience with H1B in the past couple of years, the receipts are received till the end of June.

    I can understand how desparate others feel when someone says their petition is selected asks everyone else to keep the hopes. But I kept my hope, not just for a couple of months but for 3 years and it paid off.

    I just wish no one else to go through such long wait as me and wish everyone else waiting here ALL THE BEST.

    My H1b was selected in the lottery but RFE was issued.

    This is what my sponsoring company replied to me regarding RFE.

    The RFE focuses on the qualification standard set forth by the company for specified role and need for Bachelor’s degree specifically . Thus, company will provide further clarification of Job Description, qualification requirement and provide evidence requested.

    What are the chances of RFE getting approved?

    1. )My company is trying to get me to work in a research institute, I am aware that working in a research institute is H1B cap exempt? What does cap exempt mean?
    Also, can I bring my spouse on H4?
    2.)They are also looking for O1 visa as an option. How does that work? Can I get my spouse with me with a O1 visa?
    3.)Additionally, they are also focusing on L1. Like, sending me to Canada for a year to work.
    Please explain how all these options work.. I am getting married this year. I need to get my spouse here. Which option might work the best.. Please suggest.

    • Dude, you just asked several pages worth of information, be reasonable and use google first. The holders of all these visas can bring spouses.

    • Like non profit organization comes under exempt quota so there is no cap for H-1b. You can file any time and its quite easy only drawback is you won’t be able to transfer to the profit organization. You need to file H1B separate for that. (It’s non transferable from non profit to profit and other way around as well).

      O1 is out standing quota which has lots of benefits but its quite painful to get that visa. You need to have good peered reviewed publications and research work should be sky high. It needs to be good for the mankind and/or benefit humans . Your company needs to justify for that and its pain to do that but you never know until you try. I think your spouse can come but consult lawyer for that. Mainly post doc people get that. I won’t be able to comment as I don’t know much about your background. It must be outstanding.

      L1 is the best one among all (in my understanding.)

  10. Common folks, we Indians come here to save money as no one is sure on how long we are all going to stay on work permits. But once settled after getting GC, you’ll see drastic changes in their life style. Don’t cite stupid examples and blame certain community. It’s not fair to argue in these public forums and defame our nation. Grow up guys and don’t vent out your frustration in this manner.

    I am also waiting for the next batch result to release. It might vome in 1st week of june but igot to know that we have hope for it to come later also. Last year there were infact few cases who got acceptance mail in july as well. If i get something positive , will share soon.

  13. Guys need an advice,
    My case was received on April 13 and still the status is same, do we need to provide client letter and other docs to have the case approved or it gets approved based on the initial docs submitted during filing.

    • if applied through desi consultancies expect RFE for Client Letter.. Cases do approve w/o it as well.. Depends on your luck..
      For MNC’s it has a slightly higher approval rate even w/o client letter.. even if u get an RFE, chances are the company can arrange the client letters bcoz of the magnitude of projects with onsite oppty

    • I am also in same situation.. Received the application on 13th April and receipt date in the notice is 22nd April.. I guess it will take two more weeks to get get the same approved and we don’t need to act upon till that time..

      • Hi, The regular processing approval takes 90-150 days so you cn expect the approval by July or August. If lucky it will get before that as well..

      As of today no new notification has been received from USCIS regarding your H-1B Cap petition. Most likely your petition was not selected in the lottery. However, we cannot confirm this until we receive either a receipt notice, or the returned petition filing from USCIS. Once we receive either of these, we will notify you.

    Could anyone please help me with below situation.

    I got my H1B picked in the lottery and the receipt number I got was of WAC (got it on 04/29). My office and job is located in Connecticut and from what I read the receipt number should come from EAC. All the people from my company who got picked got WAC only. Is this something to be worried about? Is anyone else in the same boat?
    Please let me know, your help is much appreciated.

      • Are you sure the same region(Connecticut) is updated in your LCA also?

        The location which is mentioned in LCA only decides it is WAC or EAC

      • EAC or WAC depends on where your application was filed. It does not depend on your job location. If your law firm filed your case at California center then your receipt number will start from WAC.

    • Don’t worry too much on this, it is your attorney’s/ employer job to take care of that information. I am sure, they would have done what is right based on the address. You may speak to them and get clarified, if you are not clear.

      • I called up PMSD they informed me second set of result will be announced on or before Friday.

        The issue is mail will be sent to the ppl who are selected and the other will not get any kind of communication… so keen to know… is the result declared or not.

      I have applied from splendtek and got the below email on 5th May

      Sorry to inform you that, we haven’t heard anything yet regarding your H1B. We would like to wait till mid of June. We already informed to all the employees, whomever H1Bs picked up in lottery. If we hear anything regarding your case, we will let you know.

        • I just called them and they said they are consolidating the list of selected candidates today and have started communicating to the selected candidates via call. Has anyone received such a call from them so far?

            I went through the same wait phase during last year processing.
            Here are few timelines which might help your guys..

            Came to know my petition got selected in lottery on May 20th 2014. Update on my petition came in much earlier. Multiple updates continued coming in till almost end of June, few got lucky in every batch. So, please be patient till end of june.
            For any reason, if didn’t work out, don’t feel bad, nothing you can do apart from rearranging your plans.

  20. On the whole, my opinion is that hope is still left for infy guys. 2 of my friend got visa in June 28 previous year (Hopefully god doesn’t make me wait that much longer). Also all my friends saying that its after june 1st week, that we should start worrying of lottery rejection. Till then we shall have hope left.
    Every day after I get up, will think of this DAMN BULLS**T lottery. Will come to office with a mild hope that it might get updated. After coming to office with anxiety, will open the AIMS. For the past 20 days its been the same stage with ‘Work Permit In-progress’.
    At Last I have come to a condition of praying to God that even if i don’t get picked in lottery, Please give me the guts to overcome that painful time.

    • Getting Visa in June is a different thing , We all are talking about getting reciepts .Once you get receipt , could be in April also then one may get Visa petition by June also , no big deal. You are saying your friend got Visa in June that means they got receipt in April end or May 1st week only. Also last year I got “not selected” mail in July end . So hmmm..

  21. HCL guys, any updates, after removing the receipt number from iaura, did ISG shared receipt number with anyone else.
    I doubt they stopped sharing with the individuals and sharing it with DM’s as a whole. Please let me know if you have any updates

          • My case has been picked. Receipt number is removed from iAura now. Received the following mail from WPC SPOC.

            Hi,
            Receipt numbers are not being shared by ISG with employees nor with SPOCs and it will not be uploaded in iAura. It is confirmed that your nomination is selected.
            Approval notice will be shared with the employees only during stamping process.

    • You need 16 years of Education to be eligible for H1B. Yours is 15 years .If you do not have 16 years of education, you can compensate that by 3 years of work experience .3 years of work experience=1 year education. You have done B.sc and have 1 year experience. Not sure how your firm applied H1B For you.

      • I heard the rules are more stringent now.. they just dont see the number of educational years, but also are seeing the relevant education. for eg, if somebody does BE Mechanical, and applies for h1b thru IT experience, they must show additional work experience than their BE (Comp) counterparts.. somebody can throw more light on this, if aware of…

    • infy guys.. The process of update is considerably slow at Infy so don’t lose hope yet. I got selected this year and when I look at case history.. the status on USCIS portal was update on 30th April. I was informed only by 22nd May. And they are updating status only on Fridays and weekends. Ideally, this weekend is crucial

  26. Need help.

    I have valide I-797 form which I have got in 2008 and is expired on 15th Sept 2011. I went to Visa interview but got yellow form so not replied as I have not got proper documents from my employer. As per my knowledge I am eligible gor Cap Exemption now. When I appoached other employers recently few of them ready to sponsor me.

    But when I appoached my old employer who filed my H1 they have not accepted to do Cap Exemption they said I am not eligible. So they said they are interested to sponsor fresh H1. I said ok and did all formalities. Now My case got picked up in lottery.

    My Queries are :
    1. Having eligible for Cap – Exempt, is it fine to apply fresh H1?
    2. Why my old employer might not accepted to do the with Cap Exempt and did fresh?
    3. Wha kind if quetions I may get if I go to Visa interview with fresh H1?

      2) not sure why they rejected.. in fact i too had a similar exp.. God only knows the rules inside the cap-exempt visa
      3) its same as anyone… one additional question may be related to why you did not travel last time..
