As many of you know, H1B Visa 2015 quota was over in the first week and a whopping 172,500 H1B petitions were received in first week by USCIS.  H1B Lottery / random selection was held by USCIS to select 85,000 H1B petitions to fulfil the work permit cap. Many of the unlucky ones are already wondering about next year H1B Visa quota. Also, some of you are planning for H1B visa for next year, you also would be wondering regarding the same. When will the H1B season for fiscal 2016 begin ?

USCIS will accept petitions for H1B Visa 2016 season starting from April 1st, 2015.  USCIS did a press release on March 12th outlining the details. Read summary of press release by USCIS on H1B 2016 .

Will there be lottery again for H1B Visa 2016 ? Predictions ?

We had lottery for FY 2015 and FY 2014. The total number of petitions filed for FY 14 were about 125,000 and for  FY 2015, there were about 172,500 petitions… As H1B Quota did not increase for FY 2016, and the demand does not seem to decrease, we would very likely have lottery for FY 2016.  Read H1B Visa 2016 Lottery Predictions, Dates, Results

What is the H1B Visa quota Cap Count ? Would there be any changes to H1B 2016 count ?

H1B Visa quota cap count is the total number of petitions that USCIS will accept for a fiscal year to provide temporary work permit for highly skilled workers.  For the 2016 fiscal year, the cap count is as below :

  • Regular H1B Quota : 65,000
  • H1B Masters Degree Quota ( only US Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

As per the press release in March 2015, the quota did not increase.  To give some background, as per the Obama executive action in Nov 2014, no changes were announced to the H1B Cap count. There was proposal in 2013 to increase H1B cap from 65,000 to 110,000 and Masters quota to increase from 20,000 to 25,000 did not go through as of March 2015. At least, for this FY 2016 season, the quota is fixed and it will be as above and no changes.

When should I start planning for H1B Visa 2016 ? What are the steps ?

It depends on your situation. Below are few scenarios and your plan.

  • If you are a student on F1 Visa in USA, you need to plan for your internship/ CPT or OPT employment  at a company that can sponsor your H1B Visa for FY 2016. In my view, you should start now to find something for the fall 2014 and continue that for next spring so that you can file for FY 2016
  • If you are in other country and planning for H1B, it is good to start your process around the end of this year 2014. It will give you enough time to find sponsors, search for job, etc.
  • If you are on H4, L1 or other visa in USA and planning for H1B for FY 2016, you also should consider looking around end of this year i.e. December 2014.

Most asked Question – How do I Find H1B Sponsors for FY 2016 ?

This is a million dollar question !  One of the biggest challenges is to find a good sponsor that can offer you a job and wait for you to start work after 6 months of filing your petition.  You should review the detail article on How to find H1B Sponsors for FY 2015. What about Comprehensive Immigration Reform ( CIR) – H1B Visa Changes ? What are they ?

There have been some proposed changes to the H1B Visa program to cater to the demand in the  US economy as part of the Comprehensive Immigration reform. Below are some of the proposed changes.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

These were proposed in 2013, but nothing has moved significantly and all the above are just proposed rules. We are not sure when they will be implemented. You can read  Summary of CIR – Immigration reform – H1B Visa and Green Card  to get an idea. The latest update is that Obama has taken executive action on Immigration in Nov  2014  and none of the below are included as part of that.  Stay tuned for updates.

H1B Visa 2016 Fees – Any changes ? How much does it cost ?

There are various components of the fee. The H1B Application filing fee could range anywhere from $1,600 USD to $4,400 depending on the size of the company. The attorney fee can range from $500 to $3000 depending on the attorney. If you apply for premium processing that is another $1,225. The fees has not changed in the past couple of years for FY 2014 and FY 2015. Unless USCIS revises fee based on immigration reform, it should be same. We will keep you all posted. H4 Visa EAD rule impact on H1B Visa 2016 Season ?

As you know, certain H4 visa holders are now eligible for EAD. The H4 Visa EAD Rule Passed earlier in 2015 and is effective from May 26, 2015.  USCIS will start accepting applications for EAD from those eligible H4 visa holders starting from May 26th. The question is that will that have an impact on number of H1B petitions for this fiscal year  ?  It very likely will have certain impact on the number of H1B applications that are filed for this year 2016 quota. Many of the H4 holders, who would now be eligible for EAD, may not apply for H1B visa, just because it gives them more flexibility to work and more choices to work as well. We would have to wait and see, how much of an impact that would have, but it is very straightforward and no brainer for eligible H4 visa holder to avoid the H1B processing.

H1B visa Premium Processing Changes to H1B Visa 2016 quota ? 

USCIS updated in their press release that the premium processing will be accepted for FY 2016 quota and they will only begin that “no later than May 11, 2015”. What it means for the petitioners is that the official 15 day premium processing clock starts from May 11th, 2015 and their petition could be adjudicated within 15 days from May 11th, which would be May 26th, 2015.  USCIS can process them earlier as well, but their new timeline is just indication for setting the right expectations to meet the stipulated time frame for premium processing.

  1. The problem with Indian IT Companies and the reason why they file unlimited H1B applications every year.

    1. Most of the IT Companies are based in cities like Chennai, Hyderabad, Bengaluru, Mumbai, Pune. So they give more preference to people from these states and nearby states in H1B visa filing.
    2. Most of the managers in these IT companies believe in regional politics. Hence giving preference to their states or to employees from nearby states is a must to do in their list.
    3. These are the same managers who have no leadership potential, no management skills and are basically excel sheet and word document workers who have benefited from IT boom and got GC in USA. So to manage their projects they promise false hopes and H1B visa dreams to the employees they are supervising.
    4. These Managers are the reason why you see more number of visa applications from people from Southern or Western part of India. They play their regional cards in even H1B visa nomination and want to breed an incompetent workforce similar to them.
    5. These managers have a derogatory attitude towards people from other parts of India and very limited people are given chance whereas incompetent people from their states are given H1B opportunity every year.
    6. If you compare the H1B filing status of people from Southern and Western part as compared to rest of India you will find that these managers have given nomination to the worst performers from their own state and also giving promotions and higher compensation.
    7. As a result of these incompetent Managers not only do good profiles and deserving employees suffer but the H1B visa count increases because they give nomination for incompetent people from their state. Rarely does an IT MNC in India select based on the knowledge. Because the incompetence starts from the Senior levels in the organization.
    8. Some of these Indian Managers are so pathetic that they try to give jobs to their family and friends and then nominate them for H1B visas.

    Its a sad story but the IT boom in India is stuck to a few states where large number of incompetent people are getting their H1B visa filled. Because their state managers are helping their cause.

    If these IT MNCs gave nomination for skilled workers then today the unusual numbers of H1B applications could have been reduced to a large extent.

  2. All who have got awaiting status in Accenture, when can we expect second batch of result for the Accepted Status.

    I heard Accenture will release result in 4 lots. 3 lots are still pending and result will be announced in a gap of 7 to 10 days… and finally the pending ones will turn into rejection at June End. Is this True ?

    Or Is the game over for Accenture and would awaiting status turn into rejection later ?

    • Connected to a PMSD associate and he has mentioned that still there are chances of lottery success mails for the ones who have received Awaiting results mail in Accenture recently.

    • Wipro received yesterday 40 receipts from USCIS. USCIS are sending the receipts in batches. So, unless and untill u get the rejected email. We can still have some hopes. According to the GIMS, they may get few more expecting another 100 receipts 5% . So Still we can have some hopes. Even they received in one bundle with only 10 receipts also. Lets see guys.

  4. I have observed that most of AP student or working professional are much serious to go US at any cost…and seems they got their passport ready before BORN even they are ready to clean shit in US rather having a normal life in INDIA. (not all AP people but at a large number).

        You know that’s why we will always be behind…..always trying to mingle with people from same culture no matter where ever we are in the world and throw mud to people from different culture.     I have received a confirmation from my employer that my petition has been accepted in the lottery, but they have not shared the receipt number.

    What could be the reason for not sharing receipt number with us, if the employer has received it?

    • Yes techmahindra shared the first list with respective IBU heads around 10 days back. I was fortunate to get selected in the first list. Plz check with your respective IBU.

    • Are you paying the money for ur H1B or the employer? Wh y are you bothering if the cheque is encashed or not. Chill dude. You will get the update in GIMS portal once they get the receipts. Hope is only till month end.

    • If cheque is not encashed means your case was not picked in the lottery, coz all 65000 cases were already selected and uploaded in USCIS. Sorry to say this, better luck next time!!!!

    • You will only know for sure when the packet gets returned. You may well have been waitlisted. Its a slim chance, yes, but still possible.

  12. i had received the same email from Cognizant Global Mobility as we received today.With last year comparision once Mobility team sent all the recipts to the associates they received , they will send a email like this “USCIS for the petitions selected in the lottery and the details are being updated in MyVisa within 2-3 business days. ” to avoid calls or gsd req to them.I guess receipts dispatch is completed for cts .

        We have been receiving the receipt notices from the USCIS for the petitions selected in the lottery and the details are being updated in MyVisa within 2-3 business days. Associates will receive an email notification once when the details are updated in MyVisa.

        We wouldn’t be able to confirm on the rejection status for cases where receipts have not been received yet, until we receive the packages returned by the USCIS.

          • IT companies will never share the receipt number. Employees will come to know only while going for Stamping. Only consultancies will know the Receipt numbers.

  15. I got a RFE for my application due to Specialty Occupation. This H1B process seems infinite, I don’t have strength to think about it anymore. There is no credible argument why they could dare about my position. I am a MBA and the position is Supply Chain Analyst with loads of analytics and project management, and a degree is a must. Let’s what comes next. Previous experiences testimonials are welcome.

    • I am also in similar situation. I called my employer and looks like they haven’t received any receipts for anyone as of now.
      Last year also , they have received the receipts in last week of May.
      So, I think we should wait till end of this month to get the receipts.

          • from previous comments it looks as if few associates (may be only offshore) received communication from GIT that within next 2-3 days they will receive the next batch but here you are saying GIT said “its over”…thats why I asked you not to spread wrong news.

          • What email you received – its “all over” or in the next 2-3 days GIT will receive and upload one more batch of receipts? Pls be specific otherwise the context gets lost…

        • But USCIS already confirmed in May4th sending the selected petition’s receipts completed.
          How our GIT team will still receiving selected receipts from USCIS. This looks like a false information from our GIT.

  17. I think everyone will be better served if they apply for VISAs when the need arises, and with strict validation from USCIS about the project need and dates. There should be validation that the employee joins the project within a certain number of days from h1 approval, and failure results in a revoked VISA. And let them start work as soon as approval is done, not October. If Infosys needs 10000 people in US, so be it, but let them apply for those as and when the need come, not in advance in April. If every company did that, the quota won’t get over in April, and people will find real employers who hire for real needs.

    • Correctly said bro. I have seen these sister state and Amma state managers give chance and preference to their state employees in my project. They are not working daily but at visa filing getting chance. Also ratings and promotions given based on state employees.

      • Many other sector companies, esp manufacturing, are run by gujjus and sardars, and in these companies only gujjus and sardars are rewarded (promotion, bonus, travels etc..). Ppl from southern states are considered outsiders. Look at the way Shahrukh Khan makes fun of south Indians. And you guys all laugh at us. One the other hand, IT companies are have by southern states guys and so you are not getting preferential treatment.. And you guys crib… Just because live in North India does mean life always has to be handed to you in silver platter…
        I work in mfg sector and I know how you North Indians, Gujjus & Sardars esp treat us bad…

        • I know couple of consultancies who helps through this process.
          Thy process first temp. visa(Canada/germany) valid for 6 months on which u can travel n search job or u can stay back in home country n search job once employment confirmed u can move on permanent Visa.
          No idea about their credibility though…

      • JEVS, I did not say that I was rejected in lottery the first time. The first time I missed the deadline for application, I was submitting my documents in jun 2012 and my consultant called me and informed that the cap was reached, 2013 and 2014 not selected…2015 today got the email…

    It is my second attempt and last one, I finally got through the lottery, but now get RFE ” Specialty Occupation”.

      • Yes. But mein is not CPT school and I got CPT 1 year after i enrolled in the school, and i did go to the classes and paid the tuition, and took the tests.

        The problem is that they are not asking about CPT thing.
        There are asking about “Written contract”, ” Current or previous the same position employee holding the degree”

        I don’t have written contract, and no previous employee having the same position.

    • RFE can be bothersome, but if your things are in order/genuine then it should not be of any problem. As I remember from your previous posts, USCIS is interested in employer/employee relationship verification. Since they are willing to accept even a verbal communication as the contract, it shows that they are not going to be very strict in this RFE.

      I am not sure how much guidance are you receiving from your attorney or your employer’s attorney. However, I had been in similar situation but far too complex to write about in this post (received RFEs and 221g several times for the same application). I took one hour consultation with an independent immigration lawyer and their suggestions made a lot of difference to my case, and my case eventually cleared.

      I don’t think that your RFE is that complex. If you are not sure what to do, I would suggest to consult with an independent immigration lawyer. I understand that this situation can really be challenging but you should be able to get past this.

      • Thank you for your kind advise. I contacted my attorney. It seems she is busy all the time , and I haven’t receive any response from her.

        I have prepared the detailed job description related to my courses on the transcripts and organizational chart. Now there are still 2 things: written contract and current or previous employee in the same position’s credential and w-2.
