As many of you know, H1B Visa 2015 quota was over in the first week and a whopping 172,500 H1B petitions were received in first week by USCIS.  H1B Lottery / random selection was held by USCIS to select 85,000 H1B petitions to fulfil the work permit cap. Many of the unlucky ones are already wondering about next year H1B Visa quota. Also, some of you are planning for H1B visa for next year, you also would be wondering regarding the same. When will the H1B season for fiscal 2016 begin ?

USCIS will accept petitions for H1B Visa 2016 season starting from April 1st, 2015.  USCIS did a press release on March 12th outlining the details. Read summary of press release by USCIS on H1B 2016 .

Will there be lottery again for H1B Visa 2016 ? Predictions ?

We had lottery for FY 2015 and FY 2014. The total number of petitions filed for FY 14 were about 125,000 and for  FY 2015, there were about 172,500 petitions… As H1B Quota did not increase for FY 2016, and the demand does not seem to decrease, we would very likely have lottery for FY 2016.  Read H1B Visa 2016 Lottery Predictions, Dates, Results

What is the H1B Visa quota Cap Count ? Would there be any changes to H1B 2016 count ?

H1B Visa quota cap count is the total number of petitions that USCIS will accept for a fiscal year to provide temporary work permit for highly skilled workers.  For the 2016 fiscal year, the cap count is as below :

  • Regular H1B Quota : 65,000
  • H1B Masters Degree Quota ( only US Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

As per the press release in March 2015, the quota did not increase.  To give some background, as per the Obama executive action in Nov 2014, no changes were announced to the H1B Cap count. There was proposal in 2013 to increase H1B cap from 65,000 to 110,000 and Masters quota to increase from 20,000 to 25,000 did not go through as of March 2015. At least, for this FY 2016 season, the quota is fixed and it will be as above and no changes.

When should I start planning for H1B Visa 2016 ? What are the steps ?

It depends on your situation. Below are few scenarios and your plan.

  • If you are a student on F1 Visa in USA, you need to plan for your internship/ CPT or OPT employment  at a company that can sponsor your H1B Visa for FY 2016. In my view, you should start now to find something for the fall 2014 and continue that for next spring so that you can file for FY 2016
  • If you are in other country and planning for H1B, it is good to start your process around the end of this year 2014. It will give you enough time to find sponsors, search for job, etc.
  • If you are on H4, L1 or other visa in USA and planning for H1B for FY 2016, you also should consider looking around end of this year i.e. December 2014.

Most asked Question – How do I Find H1B Sponsors for FY 2016 ?

This is a million dollar question !  One of the biggest challenges is to find a good sponsor that can offer you a job and wait for you to start work after 6 months of filing your petition.  You should review the detail article on How to find H1B Sponsors for FY 2015. What about Comprehensive Immigration Reform ( CIR) – H1B Visa Changes ? What are they ?

There have been some proposed changes to the H1B Visa program to cater to the demand in the  US economy as part of the Comprehensive Immigration reform. Below are some of the proposed changes.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

These were proposed in 2013, but nothing has moved significantly and all the above are just proposed rules. We are not sure when they will be implemented. You can read  Summary of CIR – Immigration reform – H1B Visa and Green Card  to get an idea. The latest update is that Obama has taken executive action on Immigration in Nov  2014  and none of the below are included as part of that.  Stay tuned for updates.

H1B Visa 2016 Fees – Any changes ? How much does it cost ?

There are various components of the fee. The H1B Application filing fee could range anywhere from $1,600 USD to $4,400 depending on the size of the company. The attorney fee can range from $500 to $3000 depending on the attorney. If you apply for premium processing that is another $1,225. The fees has not changed in the past couple of years for FY 2014 and FY 2015. Unless USCIS revises fee based on immigration reform, it should be same. We will keep you all posted. H4 Visa EAD rule impact on H1B Visa 2016 Season ?

As you know, certain H4 visa holders are now eligible for EAD. The H4 Visa EAD Rule Passed earlier in 2015 and is effective from May 26, 2015.  USCIS will start accepting applications for EAD from those eligible H4 visa holders starting from May 26th. The question is that will that have an impact on number of H1B petitions for this fiscal year  ?  It very likely will have certain impact on the number of H1B applications that are filed for this year 2016 quota. Many of the H4 holders, who would now be eligible for EAD, may not apply for H1B visa, just because it gives them more flexibility to work and more choices to work as well. We would have to wait and see, how much of an impact that would have, but it is very straightforward and no brainer for eligible H4 visa holder to avoid the H1B processing.

H1B visa Premium Processing Changes to H1B Visa 2016 quota ? 

USCIS updated in their press release that the premium processing will be accepted for FY 2016 quota and they will only begin that “no later than May 11, 2015”. What it means for the petitioners is that the official 15 day premium processing clock starts from May 11th, 2015 and their petition could be adjudicated within 15 days from May 11th, which would be May 26th, 2015.  USCIS can process them earlier as well, but their new timeline is just indication for setting the right expectations to meet the stipulated time frame for premium processing.

  3. If you are concerned about if we can reach 100k or not. Don’t worry, it’s not necessary to get 100k or more to get attention from the White House. As long as the petition is among top popular topics, I’m sure WH will give us some response back. Remember that the H4 EAD petition only received about 6k signature but it’s going to become a rule now. Let’s make the lottery free of frauds. Thanks

      I wrote an email to Center for Investigative Reporting, a non-profit organization that works on immigration issues. I have given this web page as reference to see how people openly tell about their multiple petitions and I have also given the link for our H1B petition to whitehouse. Hopefully we might expect some news on this in coming days. We might not be successful this in stopping these cheaters but I’m very much confident there’s going to be a huge reform on this issue in the future. Lets just cross our fingers and hope for the best now.. Jai Hind.. and God bless America..

    • If everyone file multiple petitions I doubt the chance would change even if you file multiple. Plus there is risk of breaking the law and get deported.
      If I don’t get selected I wouldn’t try H visa in US again. There are big holes in this system that it is never going to be fair unless reform takes place.

    • As per my employer, the count is expected higher than last time and the attorney is expecting USCIS to take a little longer to announce the final number this time. So, we should hear something by the end of the week.

    • Canadian work visa is even worse. You easily spend years to get it. If you are in yr late 30s or 40s, do not even bother… That is it,our luck brought us to be a citizen of undeveloped countries.

    • Sure, that’s why we raise our concern to make something happen. If your multiple filings are legit and ethical, you can sleep well and wait for your visa. If not, wait for the consequences.

    • Multiple petition is fine. As lone as you have multiple offer of which the companies are not parents and affiliates or act under a “deal” to issue a offer you should be fine. Otherwise you have the risk to be rejected.

    • Dear, Calm down. If someone suggesting you to work on something it not always he/she is jealous of you. It could they are really giving you genuine feedback, specially when you have time to fix it. Also be humble, according to a recent study technical skills only contribute nearly 15% of one’s financial success, rest 85% is because of his personality, communication and ability to take initiatives and lead.

  7. Just curious, people from this forum really considering acceptance of multiple offers that contradict each other is ethical? I understand it doesn’t against the law, but you really think it is fair for the companies who truly want to hire you and they would understand you? And you think the reason other applicants don’t file so-called genuine multiple petitions is because they cannot find as many sponsors as you? I’m shocked.

    • I’m not including the cases where your offers don’t contradict each other, or your employers are aware of the multiple acceptances and use H1B as compensation to bid (I doubt this is the common case though). Also not including the case where your future employers are just shipping cheap labours but unnecessarily have work for you hence they wouldn’t care.

        These multi petition cases are related to Desi one who pays for their petition fee.

        • If you have read some of the old posts you’ll find someone indicate they or their friends lying to their employees that they are willing to work under them. They plan to make a choice if more than petitions get picked. And they called this “genuine multiple petitions” because their employers truly paid for them.

      • Would happen if company hire a part-time employee and then another company hire the same person as a part-time employee. This happens not very often.

        And under your circumstance, yes it rarely happens as well.

    Answer. The rule does not prevent related employers (such as a parent company and its subsidiary) from filing petitions on behalf of the same alien for different positions, based on legitimate business need.”

    Sorry man i can’t tell you the name of companies but out of 3 one company comes in top 5 IT company in world, and second is not that big but salary they offered is very good than the first one and third one is consultancy with 80-20 salary ratio, i hope you know this if you are staying in US from last 5 year, and one question Man don’t take it personally no other company sponsor you H1 from last 5 year even you have lot of patents on your name, i understand lottery is only from last 2 years before that there was no lottery so if you were not happy with work or salary then why you didn’t applied for H1 through other company or you got all your patents last year only ???

    If you really have lot of patents by your name then you should not worry about visa why companies is not hiring you on L1 then, don’t lie the truth is that the guys like you just jealous from another people who is getting success, If you think you are super skilled person then why you didn’t find multiple sponsors, according to you i am not skilled nut still 3 employers filled my H1 visa this year, and i didn’t gave them a single penny even i never visited to US, and about the kick you will get kick on your ass, But don’t worry kick is also important in life without kick there is no fun in life so just wait for your turn you morron

    • I am on L1B in US(about to exhaust 5 year) and not many companies can pay me the salary I am getting so do not have much choice unless I want to join at lesser salary and less exciting work.
      Forget about me…..I was talking in general and there are many more super talented people in this forum than you and me.
      Can you tell which 3 companies sponsored you for your special skills?

    You can’t change anything by signing this petition it was good if you could spend equal time before to find second sponsor or invested rest time to improve your technical skills, by this you are just showing your frustration and proving that you guys somehow managed to find only one sponsor who was ready to sponsor your visa, and now you are getting afraid from the people like us who filled 2-3 application, But still I wish that you people will get well soon, some people are reacting like H1 visa is their only hope otherwise they will die hahahaha shame on you guys what you will do to come in us, people like you only create a bad image about indians, and you will see soon that no one from these frustrated people will get visa, then I will read their comments, for now do whatever you want signing this petition can’t change our rules, I mean uscis rules and the people who called to uscis offc I am sure they will not find their name in coming lottery,

    • 1. The petition is not against multiple petitions. It is against the potentially unlawful multi-filling conducted by some consultancies.

      2. If what you are saying is true then you are very qualified for high-skilled worker’s visa. H-1B is not your only choice. You could consider O visa as a backup.

      So no need to bash that petition, friend. Unless you are conducting the unethical behavior. Good luck.

  17. What is this petition all about. Was going through comments, its like people filing multiple petition with different companies, wasn’t aware of this. I think its absolutely wrong. Equal chance should be there for all. This would have been the reason I wasn’t selected last year 🙁
    I voted for that petition and completely agree. USCIS should take action on such people filing multiple petition, reject and ban them forever. The system should be fair. I dont understand why even companies willing to file for candidate when they know that candidate might not join them as he has opportunity from other employer too. I was optimistic this year.. but as people filed multiple, I feel my chances are very much reduced this year too… Hoping for best..

    • This is against frauds who pay money to file multiple h1bs against non existing jobs. Multiple petition by legal companies for real jobs is fine.

      • I still not don’t understand how it can be fine. Logically you can work for only one employer once you have the visa stamping. Imagine if a person has 3 petition and all his petition are selected in lottery, so will this count to 1 cap or 3 cap out of 65k limit. [I assume its not per person but per cap]. So this way he has wasted 2 extra seats, as he can only work for only 1 employer at a time. So 2 seats got wasted which otherwise would have got to other deserving candidate. Do you think its right..

      • Even if we talk about genuine big companies filing for very skilled worker, why would they file for candidate if they know he might or might join him as he has offer from other employer. This case still can be justified. But people filing with multiple consultants just to enter US without any genuine job offers are the real culprits and I read in comments people are even paying for the visa which is illegal. This is simply unethical.

If you have complaints, you should fight the companies that is ready to hire Non-US people. Stop the universities that provide admissions for foreigners. This will automatically stop.

      First , we ( employee ) never apply for H1B. It will be by employer who files petition.

      About chances, no one knows even the number of petitions received. Its all probability since its through random selection process. Even who applied 3 petitions last year they did not got it. But many single petitions selected.

      Here there are people who are signing even 100 times. Do you think the government take care of it.

      I had tweet to USCIS about this web page and ask them to read this page before taking any decision.

        Nobody is signing multiple times. Nobody can spend so much time and create so many email ids. I just signed once. This initiative is by genuine people who follow the rules.
        If this petition was started by multiple petition cheaters then I would have agreed to what you are saying.

  21. Just want to tell you that regardless of the number of signatures, we should not be discouraged to continue supporting for the petition as we fight against fraud and unethical activities. Even the H4 EAD card petition only got over 6K signatures, it still received a very respective response from the U.S government. So, don’t care about the number, just spread it out and ask people to sign for it. I’m sure regardless of the final number, White House will give us a satisfied answer to this issue. Stand up and spread!!!! Now!!!!

  22. I think this petition is going to create extra burden for all h1b petitioners.. Uscis might tighten the rules for h1b similar to L1b visas.. Uscis is not going to design any rule specific to any one type of employer.. Instead in a way everyone is going to get impacted.. It would have been better if petition was raised git increase in cap count.. Everyone might have got a chance atleast..,

    • Isn’t that good. let them raise the bar. let them be extra sure about applicants. We cannot ask for more application or cap count, we dont have the right to do so. But we have the right to fight for fraud. Also CEO’s of big tech companies are fighting for increasing cap count. You can see the group “fwd.us”

      • Not all people are working for face book or Google .. Most of the People working under tier 2 or lesser tier companies are the ones would be impacted more if the rules are tightened.. Because the employer bothers not much to spend anything extra for those employees.. In a way this is going to have negative impact..

    • Do not spread false rumor about the petition. Increasing the visa cap is already supported by CEO’s of big companies as well as by the govt.

      If your company is filing your h1b legally you will benefit from this petition. This is a fight against fraud not number of application.

  23. Too late, its already among top 40 popular petitions in the white house website. Petition does not affect current year unless the President takes an executive action, which he cannot.
    As far as multiple employer petions or duplicate petitions from a single employer or just a single petition., There has been cases where a candidate has been issued rfe asking the employer to show the revenue stream to sustain the employees during the “internal project”. In most cases the employer knowingly avoids responding to the rfe to avoid further scrutiny. This particularly happens when the employer in question is not well known. Example Facebook might not be issued a rfe but something like XYZ teckcorp can.
    Irrespective of a signature petition there is going to be a heightened level of scrutiny of all applications this year. That was the main reason why they charged fraud detection fees as part of h1b application fees this year.

  24. I see the petition is to stop multiple filing. I nowhere see its for fake companies or for candidates who paid for h1b. As per my assumptions this is just to stop filing from multiple companies. Mr so and so do not spread wrong message here.

    H1B is visa for foreign workers with theoretical and practical application of a body of highly specialized knowledge in a field of human endeavor. Recent years a lot of cheaters without such kind of specialized knowledge applied it and submitted multiple petitions to increase their chance to get H1B visa. This kind of action significantly reduce legal worker who has specialized knowledge and only submitted one petition to get the visa.     If we sign for good cause they may treat regular cases also fake ,see here I applied only 1,but my employer applied for other employees,those employees are applied multiple,so in this case they will reject all,why do we take risk,if we have luck will get in lottery,why do we need to worry about others. please don’t vote

  28. Can some one shed some lights on how such a huge number of employee can apply through multiple consultancies.
    point1- as an employer i wont take risk of sponsering a candidate from outside my company who have other job offers,rather than wasting time and money i can hire directly from US or sponser someone in my company.most of the H1b is popular among software service industry and am 100percent sure top service companies wont offer H1b for someone from outside
    point2- if the person is so highly skilled i can apply for L1.even though rejection rate is so high, if the skill set is valid i have seen people getting approved L1.

    considering the above facts what i feel is genuine multiple employer applications will be less and fakes are getting more if the allegations made in the below discussions are true.

    • But how to determine which is true case and which is a fake case ?

      Every small employer generate the employment. It shows client letter, SOW etc.

      If suppose any has paid also no fake employers take in his account there are many other source. How a person is caught ?

      • I have applied from 2 companies but not paid not even a single penny. Every thing is legal.

        How these guys are saying that this is not legal ? As USCIS law says we can file from different employers. Its my choice whether to join anyone of them.

        It has happened in past and going to be remain in future if there is a lottery and if there is no lottery.

        Please explain how come this process is illegal. If this is a case than USCIS should have to change the law and than take decision.

        Whatever you guys are doing its fine but this should implement next year and I am sure this should not impact anything in this year of H1B selection.

        Experts please comment …..

        • You must be highly skilled to get the offer from two.if you are from software, two offers is rare or you must be having rare skills other than usual java dot net c cpp oracle sap etc. Anyways unless and until you do not fake alll the best to you

        • Multiple filing becomes illegal only when you pay for it from your own pockets. If 2 companies are willing to sponsor your petition, then there is nothing wrong with it. Though such happens only rarely and only to candidates with a very rare skill set.

          However, if you are paying the visa fee/attorney fee and/or a commission to the so called desi consultancies, then it is clearly scamming the system. If an inquiry ever comes into such, the proprietor of the consultancy in question goes to federal prison and you will be banned for life from petitioning for H1B (OR) deported if you are already in the US in some other visa category.

          If you paid a single penny to the petitioner (the employer), then it IS an immigration fraud.

      • Yup u r right its pretty difficult to figure out. One more point we missed is how can any employee risk this much amount of money for fake small consultancies.at the max he will deposit for one or two not more than that.and the consultancies who get the money mostly wont give any proof to the employee and for sure they wont return the money.either employees are been cheated or uscis is been. The former is pretty easy to do than the latter.
        so the conclusion would be many employees who file multiple would be cheated than the uscis itself

      It works like this,
      I have a small consulting company which implements projects in insurance industry. Now i see a huge potential in a guy from india who is working in a big software company which starts with a ‘C’. My technical team says that this guy can bring more dollars to the company if he joins. In normal conditions this guy wouldnt join my small consulting company. so i make an offer to sponsor him an H1b so that there would be chances of him to take the offer.
      I would like to say one thing, People are the real assets for consulting companies, Its a gamble we need to take if we have to survive in the business.

      • Yup you are right “”huge potential” it would be less/rare and hence,what i feel, is even if say more than 10000 to 15000 files multiple, it would be too much.
        For small consultancies business matters and time matters, even if you do premium it would take time in getting the person abroad and you might never know whether he would join or not as this “huge potential” employee would already been sponsered by the so called huge “C” employer. So still what i feel is small genuine consultancies would prefer a person from US directly or hiring a person already having h1b or even a candidate who is doing single petition rather than this “huge potential” employee as there is a 70 to 80% chance of him switching the company.

    • Please stop spamming.. If you have to raise the sign petition then do some other stuff. Do not play with emotions of other applicant. For me it looks like person who are supporting petition are posting these comments. So please do not manipulate others emotions.

      FYI I also support and have already signed and asked my 2 friends to sign same.

  30. I ’m visiting USCIS site every hour but no updates. I tried to clear browse history, cleared cache and even rebooted computer but still no updates. Do guys have any suggestions what else I can do? Plz suggest. I really need h1. Thanks in advance..

  31. Folks in India – It is our turn now.
    If you are filing h1b legally from a genuine company go ahead and sign below petition – This will increase your chances in getting selected in the lottery this year.

    This is against frauds and not against people who follow legal course and are filing through genuine company like TCS, Infosys, Cognizant, Wipro and other reputed companies. Spread the word for your better future and ask all your friends and family to sign it.

  32. Though I filled only one petition with genuine “USA Company” and support single filing per person. I support banning fraud consultants.

    I still feel here someone playing mind game. Someone intentionally asking chance for filing multiple petition. So people see their comments and sign the petition.. Let people should decide themselves and do not create false circumstances.
