As many of you know, H1B Visa 2015 quota was over in the first week and a whopping 172,500 H1B petitions were received in first week by USCIS.  H1B Lottery / random selection was held by USCIS to select 85,000 H1B petitions to fulfil the work permit cap. Many of the unlucky ones are already wondering about next year H1B Visa quota. Also, some of you are planning for H1B visa for next year, you also would be wondering regarding the same. When will the H1B season for fiscal 2016 begin ?

USCIS will accept petitions for H1B Visa 2016 season starting from April 1st, 2015.  USCIS did a press release on March 12th outlining the details. Read summary of press release by USCIS on H1B 2016 .

Will there be lottery again for H1B Visa 2016 ? Predictions ?

We had lottery for FY 2015 and FY 2014. The total number of petitions filed for FY 14 were about 125,000 and for  FY 2015, there were about 172,500 petitions… As H1B Quota did not increase for FY 2016, and the demand does not seem to decrease, we would very likely have lottery for FY 2016.  Read H1B Visa 2016 Lottery Predictions, Dates, Results

What is the H1B Visa quota Cap Count ? Would there be any changes to H1B 2016 count ?

H1B Visa quota cap count is the total number of petitions that USCIS will accept for a fiscal year to provide temporary work permit for highly skilled workers.  For the 2016 fiscal year, the cap count is as below :

  • Regular H1B Quota : 65,000
  • H1B Masters Degree Quota ( only US Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

As per the press release in March 2015, the quota did not increase.  To give some background, as per the Obama executive action in Nov 2014, no changes were announced to the H1B Cap count. There was proposal in 2013 to increase H1B cap from 65,000 to 110,000 and Masters quota to increase from 20,000 to 25,000 did not go through as of March 2015. At least, for this FY 2016 season, the quota is fixed and it will be as above and no changes.

When should I start planning for H1B Visa 2016 ? What are the steps ?

It depends on your situation. Below are few scenarios and your plan.

  • If you are a student on F1 Visa in USA, you need to plan for your internship/ CPT or OPT employment  at a company that can sponsor your H1B Visa for FY 2016. In my view, you should start now to find something for the fall 2014 and continue that for next spring so that you can file for FY 2016
  • If you are in other country and planning for H1B, it is good to start your process around the end of this year 2014. It will give you enough time to find sponsors, search for job, etc.
  • If you are on H4, L1 or other visa in USA and planning for H1B for FY 2016, you also should consider looking around end of this year i.e. December 2014.

Most asked Question – How do I Find H1B Sponsors for FY 2016 ?

This is a million dollar question !  One of the biggest challenges is to find a good sponsor that can offer you a job and wait for you to start work after 6 months of filing your petition.  You should review the detail article on How to find H1B Sponsors for FY 2015. What about Comprehensive Immigration Reform ( CIR) – H1B Visa Changes ? What are they ?

There have been some proposed changes to the H1B Visa program to cater to the demand in the  US economy as part of the Comprehensive Immigration reform. Below are some of the proposed changes.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

These were proposed in 2013, but nothing has moved significantly and all the above are just proposed rules. We are not sure when they will be implemented. You can read  Summary of CIR – Immigration reform – H1B Visa and Green Card  to get an idea. The latest update is that Obama has taken executive action on Immigration in Nov  2014  and none of the below are included as part of that.  Stay tuned for updates.

H1B Visa 2016 Fees – Any changes ? How much does it cost ?

There are various components of the fee. The H1B Application filing fee could range anywhere from $1,600 USD to $4,400 depending on the size of the company. The attorney fee can range from $500 to $3000 depending on the attorney. If you apply for premium processing that is another $1,225. The fees has not changed in the past couple of years for FY 2014 and FY 2015. Unless USCIS revises fee based on immigration reform, it should be same. We will keep you all posted. H4 Visa EAD rule impact on H1B Visa 2016 Season ?

As you know, certain H4 visa holders are now eligible for EAD. The H4 Visa EAD Rule Passed earlier in 2015 and is effective from May 26, 2015.  USCIS will start accepting applications for EAD from those eligible H4 visa holders starting from May 26th. The question is that will that have an impact on number of H1B petitions for this fiscal year  ?  It very likely will have certain impact on the number of H1B applications that are filed for this year 2016 quota. Many of the H4 holders, who would now be eligible for EAD, may not apply for H1B visa, just because it gives them more flexibility to work and more choices to work as well. We would have to wait and see, how much of an impact that would have, but it is very straightforward and no brainer for eligible H4 visa holder to avoid the H1B processing.

H1B visa Premium Processing Changes to H1B Visa 2016 quota ? 

USCIS updated in their press release that the premium processing will be accepted for FY 2016 quota and they will only begin that “no later than May 11, 2015”. What it means for the petitioners is that the official 15 day premium processing clock starts from May 11th, 2015 and their petition could be adjudicated within 15 days from May 11th, which would be May 26th, 2015.  USCIS can process them earlier as well, but their new timeline is just indication for setting the right expectations to meet the stipulated time frame for premium processing.

      • It has NOTHING to do with the first character of name. I got Non AD RP VT receipt on 27th April, and my name starts with S. I know it is hard, and you are looking at things to pin hopes on. However, I am sorry to say it has nothing to do with names. You may still have chances for RP though.

  2. Hi, I got my receipt yesterday. Reg/NonAD/VSC. I actually thought I lost it and wept over it for a couple days last week and then accepted the fact. From then until yesterday I thought about realized how great my life is otherwise and actually thanked God for what he have given me. A good loving family and health are the most important things in anybodys life. So one small thing like a visa lottery should never bring you down. So hope for the best, expect for the worst and thank God for what you have right now. Take care of yourself and people around you who loves you.

  3. Although my OPT started in Dec 2014 and I still have 2 more attempts left my company applied for H-1B this time.
    I lost total hope when I did not have any update last week. Felt nervous when my friends got through lottery. But, received an email which made my day saying ‘Good news- we’ve gotten a receipt notice for the H1B we had filed on your behalf.’ I am very positive next year congress will increase the cap. Do not get disheartened if you have not got through lottery, good times are ahead.

    Info: check cashed on May 1st and lawyer received receipt yesterday.

    • If you are married apply for your spouse also. If you are unmarried apply for your to be spouse.

      If you have children apply for them from now itself. If you plan to have children apply for them from now itself.

      I dnt know whats happening but i find twice in the last few days that the Department link has been updated,the latest being updated with today’s timestamp.Before filing the visa only GIT team knows our dept.Why wud they update that again and again?2 probable reasons i can think of:
      1. They are updating receipt numbers in the backend and somehow this field also gets updated in the process.
      2.They have recieved my package back and hence the corresponding fields getting updated.
      I sincerely pray to God that option 1 is what they are doing.

    No one had forced or asked you to go and study at abroad.It was your greed to earn in dollars. No one had stopped you from chewing home food and earn in rupess. So STFU.

    Today one of my friend raised ahd asking for status And reply for his petition s selected in the lottery and will be updatedin aims soon. (just not lying… its true) . I also raised Ahd and got a reply , still for my apllication they didn’t received ananything .. feeling very depressed and stressed. Meanwhile this is my 2nd attempt. .

  12. GIMS has already updated the status for selected application in lottery for most of the candidate selected in lottery.
    Company has also started receiving returned application for unselected candidate.
    Now chances for receiving receipt is very less and that’s the hard FACT.
    I applied second time but didn’t get any positive result till now and lost all hope.

  13. Why don’t you also try for the different route? Better not to mention ivy name… I have a great respect to those institutions and you being a graduate from one of them and still do not have enough confidence on you and rely completely on H1B to decide your life??
    Coming to education, you entered into USA on F-1 visa and think about the answer that you will be giving to VO if he/she asks are you going to settle in USA? I bet you are not going to give an “YES” for that question…
    And about English, communication is just a part of career and there are several people who are technically strong and poor in communication…
    So stop crying about others and try to work on your other options…

    A receipt will only be send once cheque is encashed. Because receipt has a statement that says “received payment of $####”.

    So unless they receive the payment they will not send receipt.

Haven’t recieved anything yet.Yesterday I talked to my lawyer and we gonna figure out A visa Type and apply for greencard if I dont hear back end of this week.Just need to get my approval from CEO.Hopefully this will go through or I have to go to masters.This lottery put me into this situation where I had to deal with shit and dilemma years in U.S and still go through this lottery,Its a joke.However god has plan for everyone.those who are in U.S. be patient and think clearly.Those desperate people outside of U.S. hope you will pay for the cost of ruining other people’s future.

    • If your employer has canadian branch than look into applying for canadian temporary work permit visa.
      I applied for it last year as a part of my Plan B and successfully got in. Process took around 6months. Processing time depends on canadian region where you employer is located. I applied for Quebec region.

  16. Dude you came to US, completed degree and successfully got the job. It takes lot of guts to do this. You are a fighter so dont write this types of post and waste your time as this consultancies are not capable enough to process whatever you are saying.

    All those who are saying “why you went to US for study and all”. It takes balls to come to US for study and get a job after completing degree. It is not piece of cake unlike india. We all know how recruitment is done by indian consultancies who comes at the your campus placement events lol.

    And guess what? Once your consultancy lands you here on H1B, you still will be paid minimum wage and will be exploited by your masters in india. They will be enjoying home cooked indian food at your expense lol. I and others who got their jobs legitimately here in US will still earn more than you and also we dont have to worry about “contracts” unlike you guys. Have fun getting exploited for years!!

    • An advanced degree does not guarantee you a job for life. I have seen many USA AD guys come back to India and elsewhere and work under the so called Masters 🙂 If that is the case then why spend your time and money doing something after which you have to go back to your home country to work under the Masters and get exploited. I don’t understand what is legit. Buying a USA Masters Degree makes you legit. Then these people are much more smarter. They found the loophole and they are buying visas in dozens while you crib about your legit status. Please don’t get me wrong. In the whole process who is the dumb ass is very clear. They are getting better return on their investment. While you slog it out like a donkey and be satisfied with the tag “Legit”. They will give you a certificate of appreciation in being “Legit”. 🙂 🙂

      • “Buying US Masters”?? wow dude this is not india you are talking about. Getting job in indian consultancy is technically buying a job at an expense of getting exploited for years and you know it.

        —— No dude for a single position there are hundreds of people competing. Some save money and get funding and go to USA, EUROPE, SINGAPORE and do Masters because they understand that getting a good job in India means serious competition unlike USA. Here good candidates are far and few whereas people who apply most of them have no idea what the position requires. It is far more easier to get a job in USA as compared to India —

        ROI of people having direct jobs in US will always be higher than a person from consultancy. Dont believe me? Ask your manager or head of consultancy lol.

Some of these Master degree holders from USA work under them. 🙂 Unless you are from Ivy league. Ivy league schools do not have that many seats to complete 20000 quota. So lot of garbage schools are there where if you got the money you are given admission. The GMAT/TOEFL scores for admissions to the Non Ivy schools is cake walk ——-

      • Everybody knows how degree is bought in India. Somebody does project and everybody get marks. Have you heard of turnitin.com ? Every assignment in US school has to go through this and you need to have original work. If they catch you you will be back to India begging for work in sugarcane fields.

  17. Any hopes for AD/RP/VT? One of my friend got his receipt in the last week of May last year. It is my second time this year and my OPT ext expires in Feb 2016. I am planning for a Plan B which is CPT from the first semester itself. I don’t know if its legitimate.

    • Would love to see you work your ass off to get into a US college for a masters. Work the grind and hit the pavements with your CV to try and catch a break. Persuade employers to hire you instead of a US citizen. Intern for a free for months on end while still trying to make ends meet. Never see your family. You have no idea!

  18. Two weeks ago I started praying to the devil to get more lucky, it was a terrible idea but it worked. My employer just told me that my check got en cashed on Monday 5/4!!! Haven’t gotten a receipt in the mail but it should be coming soon. I’m Non-Ad/Rp/Vt and am really scared now, don’t know what the devil will want back or what I’m going to have to pay for it. I’m really scared.

I don’t understand why the hell you ppl go to US for study while i can comfortably sitting in home with your wife and kids and still can get H1b.. grow guys.. stop crying… u have money to go us and you dont worry abt leaving ur parents in home. but we have lot of commitments in india.. and still we are genuine as per USCIS standards. The world’s doesn’t stop because u guys didnt get H1b. go home and give us some respect

      I pity your ignorance ..I suggest you get out sometime visit a library and read something besides your sphere of work.. Here are some hints why we go to US and study ,most of the top Univs are based in the US , maybe to avail research work that suits our needs where we couldn’t find one in our home country , sadly enough . to work hard and prove something , to do research , to work as a RA to work as a TA , to work at the coffee shop , while still applying at 200+ companies just to get that one shot at an interview . and finally when our sweat tears and hard work are being awarded , that golden opportunity gets snatched away from our hands . Most of us belong to a middle class family .. You ignorant buffon

        • I don’t want to compare any advance degree in USA or elsewhere. There are many people who cannot afford a USA education due to cost factor. Many candidates have made it to USA for bachelors and advanced degree because they could fund it. Many times its because they are from well to do families and were born with silver spoon in their mouth. In India there is huge competition for good education and jobs. Its not even close to 10% of the competition that exists in USA. That’s why these fake consultancies and MNCs just bring people and treat them like cattle. Because they realize that even a cow or goat can also get a job in USA. Same is the situation with many USA colleges. Pay money and show proof of funding to secure your seat. Corruption is a worldwide disease. However, look at USA GDP and the number of companies and jobs and the number of people available. Since the competition is not intense that’s why everyone wants a piece of the cake. The problem lies with USA in not updating their policies and procedures to allow a better visa process. Better PR process. I don’t blame anyone. We all are victims of this process in some way or the other. And I do believe that deserving people are never left out. It may take some time and patience but it always works out in the best possible way for them. So chill and relax.

          There are Ivy league schools where getting admission is tough.

          There are lot of garbage Non Ivy league schools where if you can show funding and have an average GMAT/TOEFL score you get admission. Its just a cake walk. I know people who claim to go to schools 1 or 2 days a week and are doing bachelors and masters. I mean how is that possible. That means 104 days of study is enough to get a USA school degree 😀 huh

          USA AD for all schools are not the same. 🙂 Hope you understand.

        • Dude im not twisting whatever you said please re-read whatever you wrote.I quoted you for this reason.

          You have to show funding in IVY league too. And there are many occasions when people have got admissions in IVY based on there essay or community participation etc and not based on there grades. Please do research on all this things. Also getting into college is different than getting into program regardless of universities for e.g. nursing program.

          Anyways do you know how college schedule works in US? If not google it and than you will know why some students only have to go to college for 1 or 2 days. Also going to classes is not mandatory here in US but that doesnt mean that can simply pass the time and course. They still need to pass the exams assignment etc. College culture is totally different here. Please go and learn about it before making assumptions and judging people.

          Its same for Job also i usually have to go to office for 1 day out of 5 working days rest of days myself and my team does WFH so does that mean we are not doing our job? No because thats the office culture here. We still have to get our work reviewed and logged by the EOD everyday.

          Learn about all this before you come here it will help you a lot and prevent you from judging people lol meh

      • I believe in Survival of the fittest. if you get an H1b, your family will get good cloths and food. if i get my family will. that’s t. Don’t want to waste my energy spending time with you to argue which is good and bad. I will do masters once i reach US with my own money no matter what. Either you or me cant change the system.     • I have got my H1 but I want to make one comment over here. A lot of Indians that go to US are funded-mostly by GTA/GRA. Every one is committed to their family, it is not that only people who hate or don’t care for their family go to US. The thing you must understand is that there are lot of jobs in this world apart from working in IT MNC.

      Although lot of master’s aspirants see F-1 as most secure entry in US, a lot of people go to US for other reasons. I have done my master’s in electromagnetics, which has got arguably the one of the least jobs in US due to nature of work. I had published two research papers in that domain during my bachelor’s but ended up in Deloitte. It paid me good but kept me in a mental agony of not doing what I love.

      I got a fully funded admit in US and came here knowing the fact what I might not even get job even if I graduate from a top university. However, with hard work I defended my thesis, got a good job and currently i work on satellite antenna and Phased Array Design.

      I am assuming a lot of students can relate with my story. Indian MNC people should remember all jobs for H-1B are “Not IT” and not everyone is driven by work and being lackadaisical at work. At the same time, Indian students who have gained education in US should be calm and not bicker about Indian people stealing visa. They have been entitled to do so by US govt.

      • My employer already received the Receipt and they have told my case was picked up and given me receipt number as well. But I dont know how do I confirm this if receipt is on my name or someone else name?

        • You will get the form called i-797 (or something like that) from your employer most probably by email and it will have your name and receipt number.

  24. The way the H1B visa process is heading these cheap MNCs will go to engineering colleges and give Offer letter, and file H1B visa for the candidates. Because for them experience does not matter but the number of visas that they can get. Then they will manipulate the CVs and show that these freshers are experienced. All because of these cheap CEOs and Managers and their revenue targets.

    • Totally agree bro. Applying thousands of petitions using fake client letters and requirements. I think they pay money to have tie up with some clients to apply on their behalf. That is how they apply thousands of visas including for freshers. These MNCs should be banned for human trafficking. They should do strict enquiry into these kind of human trafficking by the MNCs.

      • You are completely wrong. There are minimum criteria followed by the MNCs to file H1B. No fresher gets filed for H1B. If that’s the case, you will see 30k applications from each company.
        In my project, there are onsite requirements – but no one in my 15 member offshore team has a visa. Some of them have 5+ years experience all in the same project (joined in the project as a fresher and are in the team for 5 years). They were unlucky last year and unlucky this year too!

        On the other hand, we had to look for direct onsite hires/contractors. Interviewed 20+ candidates in a span of one month. All 20 of them were from the same state. Some had proxy attending phone interview. When asked to appear on skype in middle of phone interview, their internet connection went down. Even if MNCs file for freshers, they are much better than these fake consultants from that state.

        • Simple solution is to take away the money for all the unselected applications so that anyone who files a petition if not selected will loose the money. Then neither can the MNCs nor will the fake people be able to file so many petitions or multiple petitions. Right now they realize that they will get the money back and so they are comfortable putting in as many applications as possible but once they loose money they will think twice before putting in so many applications. In turn the money can be used by USA for improving USCIS manpower and systems and making the system more robust. USCIS can also use the money for background check of candidates using agencies in that country and find out their qualifications and experience.

          • I agree with you. Most of the Indian MNC’s and the consultancies run by greedy Indians exploit H1b’s to the core. USCIS should not refund the money back the for the petitions that were not selected. This would atleast threaten these greedy pigs to stop abusing the system. Last year Infy filed more than 20k applications …

        • I get what you say about offshore team not having a VISA, and the consultants available in USA from consultancies being mostly fake. However, there is a question worth considering here. Why not hire a green card holder or a citizen for these positions? It does not HAVE to be an H1B. Ideally, that should be the first place you look at, if we are following the law.

        • The people who had their master are not always very rich…they wud have sacrificed a lot to enter in the country.I did my MS and came back to india in 2010. I haven’t make the money but I have seen the best. So I will always be aspired to go back. So if someone who has got a job is comfortable in India , will not loose much even if he/she won’t get the visa. But someone who has sacrificed a lot shud get the visa.

    • Agreed lot of useless and undeserving people are in USA job market and holding visas like H1B, L1B, L1A and GC. There is a lot of crappy people in USA whose knowledge can be questioned. But that does not mean that Freshers should be given visas. There should be simple common sense put into the system of selection. Greed should not encroach upon the process to get visas.

    • MNC need to send the degree certificate and educational details that gets verified once someone gets h1b. So how come one who passed in 2014 or 2015 will get a chance to apply for h1b or get selected or visa stamped?
