Flash News Update  : 

  • May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
  • April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?

USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.

What would be the Cap count for H1B Visa 2015 quota ?

No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.

  • Regular H1B Quota : 65,000
  • Masters H1B Quota : 20,000
  • It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

How soon should I start planning for H1B Visa 2015 ?

[ Updated : H1B Sesaon is over for FY 15, plan for next year FY 2016 ] Well, there is nothing like too early… Getting a good H1B Sponsor can be a challenge these days. You need to find a job that fits your profile and find a sponsor that has a job for you.  Some employers want to test out the capabilities of the candidate before they plan to sponsor H1B Visa. Typically, they would like students with masters from US work for them on internship or co-op.  If they like the candidate then they will sponsor H1B visa.  If you are planning to land in US from overseas countries like India, it could be even challenging to find a good sponsor. Maybe you would need to work with global IT services companies and make your way up. It can involve lot of internal process to get the process initiated… You are never early…. How do I find Sponsors for H1B visa 2015 ?

This is probably the most asked question.  It can be a challenge to find a good sponsor. We have written quite a few articles on this topic. What would be the H1B Filing fee for Fiscal year 2015 ? 

There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014.  The  H1B Visa 2015 filing fee can range anywhere from  $1,575 to $4,325  based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet.  But, lets say, if it gets passed, the below changes may happen.

  • Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
  • The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
  • H1B Visa fees can up to USD $10,000.
  • More stringent rules on H1B visa adjudication.
  • Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

Found this on USCIS’s site. http://www.uscis.gov/working-united-states/temporary-workers/h-1b-specialty-occupations-and-fashion-models/extension-post-completion-optional-practical-training-opt-and-f-1-status-eligible-students-under-h-1b-cap-gap-regulations “Once a timely filing has been made, requesting a change of status to H-1B on October 1, the automatic cap-gap extension will begin and will continue until the H-1B petition adjudication process has been completed. If the student’s H-1B petition is selected and approved, the student’s extension will continue through September 30. If the student’s H-1B petition is denied, withdrawn, revoked, or is not selected, the student will have the standard 60-day grace period from the date of the rejection notice or their program end date, whichever is later, to prepare for and depart the United States. ”

    My OPT expired on May 6 and I have extended it to June 1. Per the paragraph above, does it mean that I can still work on my OPT until the day I receive the return package? Or I can only work till June 1?

  5. Atty. Emily Neumann (ImmigrationGirl website) in her interview to other site said the following when asked about RFE’s

    “Yes. And I would say, compared to previous years, the RFEs are much more aggressive, asking for a lot more documents even for cases where you would feel like it would just sail through. Sometimes, we’re getting requests about whether or not it’s actually a specialty occupation. That seems to be the new buzzword for this year. They’re asking more about the individual’s qualifications. We would normally submit an education evaluation if the person does not have a US Masters.

    And even those that do have a US Masters, for example, if you’re filing maybe a software engineer position, and you have a Master’s degree in Engineering but not computer science, they’re questioning, “Are you actually qualified for the position? Because your degree is not related to it,” which typically in the past, we haven’t had too much trouble with Engineering degrees qualifying for software-type positions.

    We’re also seeing a lot more questioning of the company, asking more for tax returns, lease agreements, photos of the business location. Even though they have the VIBE system—they should be able to check all of that out. There’s a lot of publicly available information, but still, they’re requesting a lot of documents in that line as well.”

      Is it true that the USCIS gives 90 days to respond back for the RFE ? If yes, then rejected RFE slots will be available for “wait-list” after 90 days. Does this mean that very few people (from the wait-list) can get receipt even in July and Aug ?

      • I am wondering if the wait list even exists or is it just something we are telling ourselves to feel better! I have had no word from USCIS and the packet has not been returned yet! Who knows what’s going on… Perhaps those visas are just wasted..

          Yes.. the wait list is there. if you see previous record of H1B.. the selected candidates was always more than the cap because there are rejections and they took people form wait list.

          • We all know that the USCIS will reject some percentage of selected petitions. We also know that they will select more than 85,000 to fill the rejected slots. The million dollar question: Will the wait-list applicants get a receipt later (around June and later) or along with the 85,000 applicants who got selected in the lottery in April and early-May ?

            According to ImmigrationGirl, “They do them all at once and send out the receipts all at once”

            If IG is right, then those who are waiting for a receipt have very little hope and the game is almost over for us. My attorney is a useless piece of sh*t. I asked him about this and he did not respond. IG is doing a great job. Keep it up IG !

          • once they reject the candidate.. they will pick from list and post the receipt… the rejection rate is around 6-8%.

          • I have read the USCIS article (2008) regarding the “wait-list” (see below). It says that the USCIS will send a letter to the attorney about these wait-listed petitions. I emailed the link to my attorney and asked him (a) about wait-list petitioners (b) is this policy valid for FY2015 ?(c) does an attorney get such a mail ? (d) Has he received one earlier ?. He replied back saying that he expects a small number only.

            I don’t know what to say regarding his reply. I think that (a) He does not seem to care or (b) He does not have a good reading comprehension or (c) The USCIS has done a great job in keeping it so vague that not many attorneys really know what is really happening. They are also just waiting to see either a receipt or returned application.

            “USCIS has “wait-listed” some H-1B petitions, meaning they may possibly replace petitions chosen to receive an FY-2009 cap number, but that subsequently are denied, withdrawn, or otherwise found ineligible. USCIS will retain these petitions until a decision is made whether they will replace a previously selected petition. USCIS will send a letter to the wait list petitioners to inform them of their status

            USCIS expects that for each of these wait-listed petitions, it will either issue a receipt notice or return the petition with fees within six to eight weeks.”

          • It is not true. A friend graduated one year before me had the lottery last year. He (nor his lawyer) was not informed of anything until late June. That’s when he received his receipt number. But overall, the percentage of wait list should be very small, let alone those who eventually get out. There is hope, but don’t count on it.

        • see this approved + denied cases are more than 85,000 that means the list is there.. so keep your hope until you get rejection packet..

          • The total number of cases approved includes both CAP as well as no CAP H1B. Plus there are H1B extensions as well that fall in the approved category.

  6. Is it true that only 50% or less of petitions filed by each company were selected? Does USCIS categorize based on Company?

        So what kind of documnets USCIS requires…Any Guess ?

        • There is nothing to guess.

          You will get a letter asking for documentation. Typical examples are:
          Education proof
          Experience proof
          Employee-Employer relation
          Immigration status (if you are in the US)
          Client letter
          Petitioning company information
          etc.,

          Typically, RFE is not an issue for genuine H1B applicants but for others, it could be an issue. Good luck !

    I have applied my h1b in 2008,which is lottery and mine one is selected . My employer shared the case # . wen i checking the status its showing as initial review ,status showing as ” On July 1, 2009, the post office returned the notice we last sent you on this case I129 PETITION FOR A NONIMMIGRANT WORKER as undeliverable. This may have serious effects on processing this case. Please call 1-800-375-5283 to update your mailing address for this notice to be re-sent.”

    But my employer is no more in active , he is shutdown the company .
    Please tel me can i transfer this to new employer or how can i get the H1B approved petition which is selected in lottery. I have only receipt # , even document is not also with me.

    Pls help me in this .

    • @H1B – 2007 : You should request for a copy of your receipt and/or approval notice through FOIA. They will send it to you in a CD. Preferable give them a US address. Subsequently, you can use that for your cap exempt H1B petition application. But i think time is running out for. A cap-exempt petition is only valid for 6 -years. Consult an attorney.

          • mine is still under initial review.. and yes i have found 3 cases where rfe was for not matching degree and h1b offered position.. i have found them in this blog and some other forum.

  10. Hi all
    I have applied for H1 2nd time and my H1b is selected in lottery(Lucky this time) and is showing in initial review. How long it take to get approved status.
    One more thing my L1B visa extension is also approved and yet to receive the letter, just on USCIS website I129 and I539 are showing as approved.

    What will be the best option for me:
    • L1B stamping now  go to onsite and then again come back to India for H1 B stamping after Oct this year or in next year
    OR
    • L1 stamping  go to onshore  once h1 gets approved L1 will be void & will be shifted to L1 to H1 automatically. Is it the case?
    OR
    • Better to wait for H1B approval  stamping of H1B in Oct 2014  Go to onsite after Oct 2014.

    • Your L1 will be voided only if your H1 petition is filled as COS . You can come to US on L1 and then amend petition to change CP(councellor processing) to COS(change of status) . And whenever you go back to India get H1 B stamped.

    • You will get for sure if your check got cleared.
      It takes 1 to 2 weeks, ask your employer, sometimes they don’t update on time.

I’m on F1 and on CPT my company applied for H1B for me but apparently no luck for me this year 🙁 it seems like I hate to do multiple application “since it’s legal” as what the people who got selected this year did : anyone can share any known consultancy companies that I can pay to apply for H1b through next year? thanks in advance!

      • last 2 yrs I have applied only one per yr from my company … but uscis isnt impressed with it.
        next year , I will file as much I can … through all f*** consult and see , that what they want I believe.

        • My case: non ad/ rp, fresh H1. Have received email from splendtek on 8may saying, my check was cleared. Waiting for Receipt number.

          I spoke to splendtek on 21may, they told me that they received 1 lot of receipt numbers and have communicated already them. They are expecting another lot this weekend. Hence asked me to wait.

            Did splendtek send separate email to those whose cheque got cleared?
            When i contacted them they told, they haven’t written names on the check and so would not be possible to relate whose cheque got cleared until receipt number is received.

            Pls update me what you know regarding this.
            I dont even know if my cheque got cleared or not?
            Why is splendtek updating me to wait until receipt numbers are received?

          • I connected with GI team and came to know that they are still expecting atleast 200-300 receipts..!!! Also, rumors are there about increase in H1B visas for this year… Keep your hopes high buddies…!!!

          • Out of so many thousands, only 200-300 are expected? then the chances are very competetive.

  13. No receipt and no rejection notice yet. Don’t know if I should have any hopes yet.

    On a related note, for people who have multiple applications through multiple employers, what happens to the unused H1bs that are picked in the lottery(For example person A has 3 applications through 3 companies and 2 get picked in the lottery. S/he will use just one. What happens to the other one)? Are they added back to the quota to be used by the wait listed people?

    • I have heard from one of the employers that there might be another lottery as USCIS is thinking of large number of visas and might give a relook to the ones who arent selected … probably AD might stand a chance… Am not here to spread anything just heard this so thought would post it here so that if anyone else has heard the same they can probably update the same on this post..

    Did not get any receipt, are there any chances now ?just curious to know what will happen to those who have applied through more than one consultant.. I heard that some people applied through 2-3 consultants and got picked up all times (2-3).
    I really need to know that because I think those are the people who reduced my chance of getting h1 b.

  16. My employer applied for H1B and not yet received any receipt/Return package and no response from attorney. I have decided not to worry abt the H1B better to plan for other options or go back to India. Now i am decided to go back and work from India, feeling so happy and relieved from pain.

    I applied for H1 this year through XXX and BAL is our Attorney. There was no update until today. But today status updated in BAL site as “RFE recieved. Coordinating with XXX for details”. Does anybody in same situation?

    Was a silent reader for this forum since long. Unfortunately, I dint receive any receipt or any confirmation from employer :(, lawyers are not responding only.
    Applied for non AD/PP/VT, i am not hopeful anymore. God please give some peace to my mind, So that at least i can focus with plan B in right spirit and attitude.
    Any suggestion for Plan B, i would like to go for masters.
    I am on H4 now (worked with big 4 mnc for 6 yrs) and any idea bout what window v can look positively for EAD.

    I am still waiting for H1B result … I was so hopeful while applying . But now I feel that I played some sort of gambling game ……

  20. NON AD RP VT- EAC1414853XXX (currently on L1..applied new H1)

    Applied thru 2 companies (2 major IT product companies with over 10billion market value traded on nasdaq…not langu mangu IT companies). I had called USCIS call center before going ahead with 2 applications. They confirmed it is legal to do so!

    i am very good at what i do and hence 2 companies were willing to apply for my H1. Only 1 of them came through lottery 2 weeks ago, and today the application is approved!

    Moral of the story:
    -USCIS DOES NOT send RFE just because you applied through 2 employers, like some idiots say here.
    -Applying via 2 employers does indeed increase your chances(nothing wrong with having exceptional ability and being able to get to job offers to work in the USA).

    Now all the sour grape foxes stop whining how it is unethical to apply through 2 companies just because you were not picked up in lottery….it is completely legal and USCIS is well aware of this…..there is nothing wrong in this.

      • No employer will su-su on him. H1 application means employer has a job for you in USA and want to apply a work permit. and you can always deny that any time. he is very good at what he do. so one will do su-su.

      • why would they sue me just because i don’t want to work for them? I did not sign any bond that i am going to work for them if i get selected in H1 lottery…..H1 is “at will” employment. Either parties(you are your employer) can terminate the agreement to work at anytime…

        good luck guys! My point is- If you find genuine employers willing to hire you, go ahead and apply from different employers. Nothing wrong.

        And as per math., even if you apply through 10 companies, all 10 of them may not get picked! You still need luck on your side anyways…..keep your options open and try to increase your probability % by doing things within the legal boundaries.

      I am in exact same scenario. Employer B, the employer I prefer to join did not receive any notification. Employer A received receipt. In your case, did the other employer receive rejection package? What did they tell u? It was my understanding that if there are 2 petitions for a candidate, either both get selected or both do not get selected.

      • I heard these words from others also and last year I saw it happening. More than 5-6 friends on mine applied multiple H1 applications and they got reciept numbers for all of their applications.
        but this year I have applied three applications and so far I have received only two reciept numbers. As now its already 22nd May and chances are very few to receive third reciept. This way I can say “either both get selected or both do not get selected.” rule is not correct.

    • What you did is totally legal. You are definitely the smartest person any employer could ever have. Happy for you that you got one of your petitions picked up in lottery.
      At the end of the day, you have more than one employer file petition for you. And you know this is purely to increase your chances. I don’t blame you. People should do what is best for them.

      I any case, when you go for H1-B stamping, I wish your visa gets rejected.
      By gods grace, if you get through the visa.
      You will definitely not get green card. That’s for sure.

  22. I am worried about not receving one more reciept number now as its too late now. I applied three H1B applications and just got 2 reciepts till now. I am really worried about why USCIS has not picked third application. I dont want to take any chance this year and want three reciepts from USCIS. Getting only 2 recipts I doubt if they reject one application and give RFE on second, thats why I want three reciepts so that third one can get approved. I spent almost 10K from my own pocket, really worried now.

      • I am really worried now. actually I was planning to work for two companies in weekdays and for third company on weekend so to earn more money. I am typical IT labour who want to earn more and more money. but my employer is saying now almost no chances for getting third reciept. means I am loosing 16 hours of money every week, I am sad now.any idea ?

      I think you are mentllay disabled . if you have provided correct doc and information to USCIS , they will approve your all application. or else, u will have all 3 application with RFE or rejection. so please refrain from putting dumb and not necessary quetions, and listen to other folks and try to understand the situation.
      I have gone through this process and now working in US. but let other folks allow to discuss some useful information.

      • Actually I have provided different different information in all three applications. so if they consider one as wrong then they can take second info as correct.
        Now you are in USA so is it really fun to work in USA ? Are americans hate black IT labours or they are ok with black IT labours ? I saw america only in movies and on TV.

  23. My friends 2 H1b applications got picked in the lottery and those two applications are in process( Initial Review). Will there be chance of getting RFE as he has applied 2 H1b applications and got selected. ANy one has faced this issue earlier and if anybody have any idea .Please respond.

    • just because your friend has filed two h1 petition he wont get RFE, unless something is missing in the petition and unless USCIS figure out some bad connection between the two companies. just because he filed 2 h1 he wont get RFE.

  24. I see the number of posts on this forum has reduced drastically this week. Does this means game is over. I have a good offer from another company in India, but I was waiting for H1b to get approved so that I can move to USA. How much time should I wait more before I accept the offer.

    • If your H1-B was approved and everything goes well during the interview at the US Consulate in India, you SHOULD enter the US in the first 10 days of October. (Can’t travel sooner than that date)

        Non-ad/pp/WAC
        14-apr – notice
        29-apr approved
        23-may – fragomen got a package with approval.
        I assume they got it early, but only today I got a notification.

  26. I just checked my status online uscis.gov and my case went from initial review to post decision activity.

    Stats:
    AD/RP; 141375****
    Receipt received: April 25th ‘initial review’
    Case approved: May 22nd ‘Post Decision Activity – Approval’

    So very relieved! Best of luck to all 🙂

    • What are the initial of your employer. I just want the first letter of the company name. I am thinking that the USCIS is sending/sorting the final approval/ based on the company name alphabetical order.

    Just now i had some email chatting with my HR..below are words he told to me
    “HR : we received about 50% receipt numbers only,its already 5/22 so likely chances that we may not get anyone further…..

    and last i asked that, “ME : oh okey, so it looks like game might be over for this year. :(”
    then he replied back “HR : you never know, lets see”…
