Flash News Update  : 

  • May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
  • April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?

USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.

What would be the Cap count for H1B Visa 2015 quota ?

No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.

  • Regular H1B Quota : 65,000
  • Masters H1B Quota : 20,000
  • It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

How soon should I start planning for H1B Visa 2015 ?

[ Updated : H1B Sesaon is over for FY 15, plan for next year FY 2016 ] Well, there is nothing like too early… Getting a good H1B Sponsor can be a challenge these days. You need to find a job that fits your profile and find a sponsor that has a job for you.  Some employers want to test out the capabilities of the candidate before they plan to sponsor H1B Visa. Typically, they would like students with masters from US work for them on internship or co-op.  If they like the candidate then they will sponsor H1B visa.  If you are planning to land in US from overseas countries like India, it could be even challenging to find a good sponsor. Maybe you would need to work with global IT services companies and make your way up. It can involve lot of internal process to get the process initiated… You are never early…. How do I find Sponsors for H1B visa 2015 ?

This is probably the most asked question.  It can be a challenge to find a good sponsor. We have written quite a few articles on this topic. What would be the H1B Filing fee for Fiscal year 2015 ? 

There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014.  The  H1B Visa 2015 filing fee can range anywhere from  $1,575 to $4,325  based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet.  But, lets say, if it gets passed, the below changes may happen.

  • Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
  • The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
  • H1B Visa fees can up to USD $10,000.
  • More stringent rules on H1B visa adjudication.
  • Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

Was planning for H1 application many days, my employer was keep saying go for H1. on 29th of March just 2 days before my H1 application my employer / company and attorney told me it will be a very tough/hard call to go for h1 application as I have no work experience in this field ( though i send all my documents ,certificates, CV, payment in January 2014 ) I just passed my graduation in Business Information Technology (3yrs) from University Of Greenwich ,England last year. Now my question to you all people will they reject my application coz of my Graduation which is 3 yrs instead of 4 years and no experience in I.T field ? is there any chance for me ?please reply me can’t sleep whole night !!

  8. I am from Accenture Mumbai..I have got an email stating awaiting lottery results while few have received intimation of they getting the visa. Does this mean I haven’t got the visa or as the intimations are sent out in batches we should be waiting?

    • Yes, you should be fine! Not sure of your background etc but if there’s nothing questionable then you should get your stamp.

  23. No update from cap in receipt. They know people who are not selected will resign as L1 rejection chance via cap is 99% .
    Seems receipt number will not be circulated sooner.

    I am badly in need of your guidance….. In my company receipts have come in batches, many have got many still waiting. I am am among the latter 🙁 … When I spoke to mobility team they said…wait till 2nd week of June.

    Just one simple question from all u guys who r already into it….

    Is it worth waiting??

    Any logical reply…..?

    • Just hope for the best. Until you did not receive your rejection package – there are still chances of getting the receipt number. Some people do not get the receipt number, However, they get approved for the H1B visa. Good luck … I am a Non AD, PP, and still waiting for my package.

  33. My employer Filed H1 PP for 2015 and was picked up as well. But it wasn’t showing on USCIS case status site. When we didn’t get any response my employer emailed USCIS.. and This is what I got in email ::’Hello,

    A review of our system shows that this receipt was voided on April 15, 2014. You should be getting a notice of explanation along with the package shortly.

    WAC- 14-138-53XXX
    Notice date : April 17th 2014
    RFE : May 12th 2014

    But i did not receive any details about RFE by mail, its been a week.
    My question is, how long does it take to receive, RFE details by mail and who will receive it?, is it my employer or my attorney?
    Please advise. Thanks in advance.

    • Your attorney gets the RFE, not you. If it’s something they can address on their own then they will. If it’s documentation they need from you then they will ask you for it. Hopefully it goes well. All the best!

        • That I am not sure of. Maybe one week or less. Try calling your attorney. Perhaps they’ve already received the mail and have addressed the request.

People here are fighting for their life to get a receipt -in order to take care of their families and grow from opportunities offered here, and you are informing us that you have misused the system by applying numerous times and waiting for the third receipt. I wish there were rules in regard to the number of applications per applicant. Its not fun – this is real life – and people take life seriously.

          I have an RFE and they asked for paystubs and all my W-2s. I did an unpaid internship for about 3 months for a faculty member and I do not have any W-2s for it. Will you please advise me over this issue ?

        • hehe..ur speaking too soon dude…what u are doing/done raises serious questions about ur authenticity and also would expose ur FAKE resume, etc.
          It would surely be fun (loads of fun actually) when u get rejected on your face at the consulate when u go in for a stamp 🙂 Getting selected in the lottery and approval from USCIS is just the first step.
          Lets see how much fun it would be when u mention the name of ur fraud consultant at the consulate. Fun times ahead you sadist !

            I need not to go for stamping..I am already here. I know its painful to wait for reciept and then getting your package returned.and I was v happy in my own country working there but as I am here so to work I need this visa and to remain with my family.

          • First of all – I was wondering if you have a real job, and necessary skills for that job. Just to let you know: If you got two receipt – it does not mean that you are smarter than any of us, but that you tried to have a higher probability of getting selected by applying numerous times and you were lucky. Therefore, thank God for the luck in your life and shut up. Sometimes I wonder why this world contains such selfish people… Lets assume that I will not get the H1B visa – I still have the ability to shine elsewhere.

            Thats why dont use such words which you used in your first post : “fighting for their life to get a receipt”. you are much more than that a visa.
            no comment about my skills and job…dont want to disappoint you that even top 100 univ grads also fight for H1…its just a lottery..it doesn’t see at my degree. worst part of lottery .otherwise their was no need for me to apply multiples 🙂

            Two receipts? Obviously people would get angry .Ask yourself if what you have done is ethically and morally right , .. me and my friends came here to do our Masters , studied hard and got a good job. Now we have a good job, a job that really wants us, a job that doesnt fetch us just money ..still a stupid lottery system is bound to collapse all our hardwork . And we are still yet to pay our student loans completely. These are the reasons why you are receiving a lot of frustrated comments.

            Remember one thing, this lottery system can’t collapse our dreams . Wherever we go, we will surely get paid for our hard work.

            I am not saying non-masters people dont have dreams at all . I am only happy for people who have genuinely “earned” it . ..and not for others.

            Btw, I am still waiting to get a receipt.

      –> Maybe depend on your situation, there is a still chance ( very very slim ) you will get receipt.

      But if I were you, I would start to work on plan B.

  44. I received an email today that my application is accepted in lottery though they have not shared the receipt number. But a great relief and I am thankful to god, I have been checking status on RMS day and night.
    But for my colleague it’s in waiting status. Thanks to guys out here who helped me to keep the hopes alive.

      • For RP , it can take up to 2 to 3 months.
        But USCIS randomly approving RP petitions as well.
        Mine is EAC141485#### and its already approved 6 days back.

    No where on the uscis website it is mentioned multiple cap gap h1b applications from different employer for same employee is allowed. I think such multiple cap gap h1b’s cannot be filed guys. May be its a misconception as it might be allowed for cap exempt cases….
