Flash News Update  : 

  • May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
  • April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?

USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.

What would be the Cap count for H1B Visa 2015 quota ?

No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.

  • Regular H1B Quota : 65,000
  • Masters H1B Quota : 20,000
  • It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

How soon should I start planning for H1B Visa 2015 ?

[ Updated : H1B Sesaon is over for FY 15, plan for next year FY 2016 ] Well, there is nothing like too early… Getting a good H1B Sponsor can be a challenge these days. You need to find a job that fits your profile and find a sponsor that has a job for you.  Some employers want to test out the capabilities of the candidate before they plan to sponsor H1B Visa. Typically, they would like students with masters from US work for them on internship or co-op.  If they like the candidate then they will sponsor H1B visa.  If you are planning to land in US from overseas countries like India, it could be even challenging to find a good sponsor. Maybe you would need to work with global IT services companies and make your way up. It can involve lot of internal process to get the process initiated… You are never early…. How do I find Sponsors for H1B visa 2015 ?

This is probably the most asked question.  It can be a challenge to find a good sponsor. We have written quite a few articles on this topic. What would be the H1B Filing fee for Fiscal year 2015 ? 

There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014.  The  H1B Visa 2015 filing fee can range anywhere from  $1,575 to $4,325  based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet.  But, lets say, if it gets passed, the below changes may happen.

  • Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
  • The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
  • H1B Visa fees can up to USD $10,000.
  • More stringent rules on H1B visa adjudication.
  • Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

  3. May not be the right place to ask but will give it a try..

    I am on L1 and my I-94 expired last week and extension has been filed.. I got picked up on H1 from same company and I am hoping it will be approved soon.. I want to go India on vacation in July and I am guessing that my H1 will be approved by then and L1 extension will be in RFE state.. Can I still get be in US payroll and come back in October after H1 stamping? Is it legal..? Sounds like its not since I do not have a valid visa or I-94 during that period and extension will be withdrawn since I am going back to India.. But just curious…

    • Simple rule.. no valid visa.. no payroll.. but you will get RFE in H1B coz your i94 expired and L1 extension is filed.

      PHd is a great achievement. Congratulations on that. Having said that, its unfortunate if u missed the lottery this year. Dont worry too much about it.
      All these infosys, TCS, etc etc will get what they deserve.
      Pray that the immigration reforms pass. That will put a full stop to these service based companies. (im waiting for that day).
      Something tells me that was one of the reasons for the application explosion this year. Fear that the law will pass.

    • I did. According to my attorney, “It is a standard RFE asking for confirmation that the proffered position is a specialty occupation”. AFAIK, I don’t have to submit any documents and the attorney will send a letter explaining my job.

    • Me too on the same boat. Still there are chances bcoz USCIS received lot of duplicate and errored applications itseems. They are filling these void so still there might be a minute chance. Lets leave it to the almighty instead of worrying. All the best!

    • I am also AD/RP/VT and received my receipt number on April 25th. My receipt is also 14137*****. It still says ‘Initial Review’ but hopefully it will turn to Approval soon. Not too worried and you probably shouldn’t be either.

          I am EAC141365 also and still case not found.. the receipt date is also Apr 16th., I called USCIS today, they said it will take time and even it didn’t show the case but its in processing and will show up when the process is done.

  11. Hi My roommate said, his employer told him that he got selected on the basis of “they have received application number for the file.” My employer said me that he got my application number but didn’t said about approval and told me to wait.

    am I selected in lottery on the basis of I got application number? Should I keep hopes…?

    • yes, if your employer has said, he has recvd the Application # , I think he meant the receipt # – You are selected int eh Lottery.

  12. We lost hope , my wife got selected in lottery and employer sent mail on April 14th . PP/NON AD

    till now there is not response from USCIS . Employer just sent mail saying NO UPDATES YET !!!

        • your case will be under PP but they missed the 15 days timeline so they will refund PP fee and will process it under PP for free.

            Let me tell u what struggle is. Having a loan in upwards of 50k to study in the top universities in US, secure a 4.0 GPA, get into RnD in one of the fortune 50 and then losing out to folks applying via consultancies from india. and u are talking about struggle. how in god’s name would someone clear out that loan dude !. u got rejected last year because the USCIS might have deemed the application unFIT for H1b. unless anything has changed with respect to skill set or anything else, i see it as another lottery h1b wasted.
            I really hope there is a wait list from USCIS. Its a pity to see the AD students struggling due to this.

            Just because someone is talented , they should not explore outside opportunities ?. sorry im not that altruistic .
            Given that, YES, in my opinion, PHds must be given the highest preference of H1bs followed by masters students in the US(non consultancies) and then the remaining can be used by the H4s or these outsourcing companies.
            Its an obvious choice dude.. there is no debating that.

  14. I received the case number for my wife’ application (H4 visa) which was filed along with my H1B visa 2014 Petition (NonAD/RP/CA). but i haven’t received my case number yet?. Is my application picked up in the lottery or not? Any idea?

    Just want to share news which is kinda weird.

    I am AD/RP/CA, selected in lottery and yesterday my attorney send me the notification that I my H1-B has been approved and my case status changed to “Post Decision Activity”.

    Last time I checked was on Monday and it was on “Initial Review”.

    I am saying weird because I think PP processing is in progress and I am RP and my application has been through.

    Anyhow just wanted to share with you guys.

  19. This was posted by YourFather on May 10, 2014 at 7:30 pm. It was interesting to learn about the situation in TCS from an insider.

    Note: Not written with any frustration, but just a thought to see if anyone agrees to my point.

    Folks am from TCS, awaiting lottery results for the past two years. Internally the visa portal said ‘awaiting response from immigration office’ since March 2013 till Jan 2014. I was asked to cancel that application and redo this Feb 2014, it went to same state this year too, I guess I have to wait till next Jan.

    On top of this we have a freaking policy in TCS that every IT employee should be at level 1 (system engg) to get their visas applied, if you are promoted to level 2 or 3 (ITA, AST) then BANG, you can’t get your visa applied at any cost. So Ppl investing their career here in TCS for years have to just see new joinees travel onsite, coz TCS have to pay more to L2 candidates per LCA norms, in turn they paid even for L1 and L2 by their client.

    I myself worked several companies like CTS, WIPRO, IBM etc have abt 8yrs of experience in my core technology, joined TCS with this ‘visa promise’. I train new joinees within my project in TCS. Among which good looking chicks whom I train get their visas processed, they go onsite and control me as onsite leads. From my point of view candidates who are to be given visa are being given visa, there are no deviations, this lottery concept to me is just an eye wash. IT giants already settle the available visas within themselves in an auction or something and process applications for only to whom the project points.

    I was recruited in L1 in an error and I was to be given L2 on the next month of my onboarding, but my project management pointed out that I am super skilled and have to be board a rocket and leave onsite asap, so they wanted me to choose between visa or L2 promotion, I waited in same level for 1 year for being able to apply for a visa. Then for the past two years I was virtually tied with this visa chord whenever I went to ask for promotion, my salary would easily crossed over the six digit mark each month, if I opted for my promotions atleast, blame me. All my home, marriage plans got drilled on a rotatory axis in a linear motion (screwed) due to this visa gamble.

    We have an internal visa work flow in tcs that shows my petition is filled, no register number will be given to employees whatsoever. When I went to check my status with the visa team in tcs, I was told about 40k petitions are filled with USCIS from TCS, That was the best joke that my common sense ever witnessed, 40K X 325 USD = 13million USD (80 crore rupees approx) non-refundable out of which hardly 6k petitions will go through for TCS. So is TCS so very generous to apply petitions for all 40k applicants? They cant merely pay the L2 guys a few more dollars and reject their applications, inturn choose freshers to pay less.

    Well I would take this lottery gamble sh*t at the least if it was genuine and wait for my luck. But in reality this lottery process helps IT giants to say “Hey, we have done all that we cud do, your petition was not selected in the lottery sweet heart, our a*s is clean, smell it yourself”

    So folks don’t go by the internal visa work flow, it’s just a manipulated tool to apply toothpaste and brush your hope. Believe in what preference or weightage that was given internally to your visa application instead of having a wide open mouth, awaiting honey rain.

    • Couldnt agree more.. Best option is always to go for your masters and not stay with these MNCs.. Industry experience doesnt mean much. AD is the way .. take a bold choice by doing your masters or else resort to praying/hoping.

    • This is your 4th job in ~8 years of experice; most likely anyone would do it for a hike in salary. We would have n reasons to justify our act, to save a few more bucks. And you are blaming TCS for doing the same. Hilarious you are blaming the lottery system.. Out here at US we have 100s of ADs who are more impacted by the lottery.

      Get out if it Dude..By the way TCS is not the only IT services company in India and US is not the only ONSITE position. Try your luck for other Visas and other companies.

    • Looks like USCIS is processing the petitions randomly. Both petitions near my receipt number got the acceptance last week. Also, few petitions dated one day before mine are also under Initial review.

    Day before yesterday my application’s (WAC141405xxxxx) status was “Initial Review” with text – “On April 10, 2014, we received this I129 PETITION FOR A NONIMMIGRANT WORKER, and mailed you a notice …….”

    Today status is still “Initial Review” but text changed to – “On May 14, 2014, your Alien Registration Number was changed relating to your I129, PETITION FOR A NONIMMIGRANT WORKER. ……..”

    What does that mean ??

    Today i received the good news from the employer about my petition number. It was a long wait. Though he has not disclosed the notice date, but i can see that its in Initial Review. Thanks to everyone for the support here. It looks like the petition notice date was April 24. It took 20 days to reach my employer.

      • I talked to my employed today and he said he is getting 1or 2 receipts still here and there and the ones successfull are not the ones whose checks are encashed before. Enchashment of check and receipt generation has been parralel for the,. Still some hope i guess. Keeping fingers crossed. Please pray for me guys.

    • Lol……”mobility team is still waiting to hear updates from USCIS on the lottery results. For your information, we have sent one of our resource to US to check the status , unfortunately his H1 got picked through some f***ng consultancy and from since then he has switched off his mobile. Please do not panic . If not this year, we will inform you next year. Please keep working and never forget to book 9.5 hrs in time sheet. Thanks for your kind support.

    Not sure if RFEs are more common these days, but it really makes me PANIC… cannot believe even after the crazy lottery madness, now I still need to pray for RFE response , another timeless waiting with uncertainty…

        • I got RFE as well. It was about my pay stubs, W-2s and etc.

          I did an unpaid Internship for about 3 months. I’m worried too although my attorney said it is something real simple and I do not need to panic that much but I heard lots different stories for this type of RFE !

          • Indeed there are lots of different stories regarding RFEs… yours seems much simpler as long as you can provide legit documentation. Wish mine can be as simple as yours…

    • Hey Guys, I got my RFE on May1st, asking me to submit my I20, which I did on May 2nd and the status went from RFE to Initial review on May 5th. Got my Approval on May 9th and got my Form i797A on May 14th.

      So if you guys submit what they ask and your lawyer should know how to handle this, in terms of cover letter etc, they will take care of it. I would say not to bother too much as long as all your paper works are in place.

        • I am PP/AD. The I797A form is sent to the Lawyer from USCIS and the Lawyer sends the copy to the employer and you will get the approved petition and the I797A to your address. But the Lawyer gets it first, no matter what…..

      • I had received a notification from splendtek on 9may, saying my chq got cleared and requested to wait for 4-5 days. Assuming it is 4-5 working days, the worst case ECD should be 19may. Hence we will have to wait.

        I called splendtek on 16may and i was told that, they are expecting the receipt numbers anytime.

        Yet to hear anything.

    I got a receipt number yesterday so got lucky. Good luck to all guys waiting. I have heard the foreign deputation cells of companies need to fill long forms with info before saving a receipt, which might be causing all the delays in getting that ecstatic email. I guess hopes should still be real till 30 May and alive till packet gets back. Thanks to the forum members and admin for bringing us all together and share thoughts.
    I have a question though. My L1 extension last year had got rejected and so was my new L1 B application 6 months after coming back to India. Will this have any impact on the H1B processing which will now follow? Thanks for any help.

    • Which office? Location? I am from Capgemini Mumbai and came to know from mobility that they haven’t yet released any results.

      @ GSM – how did you contacted FRAGOMEN, could you please let me know some details around it. What information we should have to get status from FRAGOMEN.

  47. My attorney is BALGLOBAL….I spoken with them and they said that the game is now over so I am hopeless now……congrats whoever selected and all the best whoever still have hopes…..

    • We received mail from BalGlobal on may 9th as This is to confirm that our office has started receiving receipt notices for those H-1B petitions selected in the H-1B cap lottery process. It is expected that USCIS will continue sending out receipt notices for the next several weeks. As we receive receipt notices, we are updating our system.

      your statement contradicts their mail.

    • Hope some good sense prevails next year and they increase the quota of the H1’s or somehow find the duplicate applications and just do not give them the visa even if they are selected in the lottery.. The moment they find the person has another appln which has also been selected, just disqualify that and select a legitimate candidate.. I might be harsh , but better to be Harsh than being disappointed as have seen lot many ppl just on this form who were just waiting for this one opportunity esp the AD Folks… Anywaz am also one among them here… but on a NON AD ….All the Best Folks… Do well !!

  48. Folks,

    Yesterday My employer called the USCIS to check the status of Petitions filed by them. USCIS officer replied as, see if the fee amount got debited from your account, if so, you will get the receipt, if not, then probably your employees not selected this time.

    But my employer gives me hope that, last year they received one receipt in June. So unless the packet is returned we can not be sure. So I am hoping something would turn up.

    Also my employer is planning to call USCIS again on Friday, so I have requested them to check 2 things,

    1. Do they have a Waiting list concept.
    2. If not selected, probably when can we expect the packet back.

    I will keep you all updated as soon as I get to know something.

    Note: If anybody has any questions, please post. I will try to ask my employer to ask that to USCIS, as they are so kind enough to listen to me.
