- May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
- April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?
USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.
What would be the Cap count for H1B Visa 2015 quota ?
No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.
- Regular H1B Quota : 65,000
- Masters H1B Quota : 20,000
- It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

How soon should I start planning for H1B Visa 2015 ?

What would be the H1B Filing fee for Fiscal year 2015 ?
There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014. The H1B Visa 2015 filing fee can range anywhere from $1,575 to $4,325 based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet. But, lets say, if it gets passed, the below changes may happen.
- Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
- The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
- H1B Visa fees can up to USD $10,000.
- More stringent rules on H1B visa adjudication.
- Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

But I had a question in mind….these consultancies take huge processing fees to apply for H1b….but because of the lottery system what is the guarantee that they have genuinely sent the application…..there is a possibility that they take money , do not apply and later tell us simply tht our application did not get picked in the lottery….
If so….It’s an easy way to make money!!!

One should avoid paying employers to file H1Bs in the first place. Lots of people are getting it filed at no cost through their employers, why would anyone in their right mind want to pay for something that is available for free to others?
@ TZ : The blatant stupidity, arrogance & ignorance of your comment is embarrassing. People who do not get employed by a recognized company, have their visas running down but need/want to stay in the US need to pay a consultancy to do this for them. Its not out of option but a necessity for some.
There is neither stupidity nor arrogance in what he’s said. Paying money upfront to employers is unethical. The cost is supposed to be borne by the employer. To use the H1B to enter the US through a shady consultancy is nothing but misuse of the visa.
@ Commodore: To be honest, you’re doing something illegal and should be ready to face the consequences in case something goes wrong. I would hedge against that risk by either saving communication where the employer demands money to file on your behalf, recording an audio conversation where the employer makes the demand, or better still, recording it on a hidden camera. You should also avoid paying in cash and use a check or money order so that there is proof that money changed hands. If you ever run into problems with the employer, you can hold it over their heads and they will most likely treat you well. In the worst case scenario, you can hire a lawyer who will take them to court over the issue and I’m sure they will agree to an out of court settlement to avoid being shutdown.
There is a I-765 C form I believe. This is the form that is signed by the labor department for each applicant and sent back to the employer before sending out the package to USCIS. This could just show they did start the process — Sadly I guess there is no real proof whether someone actually sent out the package because USCIS returns the package unopened if not selected in the lottery. Maybe someone can demand the postal details showing delivery from UCSIS.

You may ask for slip for courier which they sent to courier

Ask them to return the money if it is not selected in lottery. USCIS returns the package when it is not selected.

My OPT expires in May 16, 2014, and I have not heard anything about the receipt yet. My university won’t file cap-gap for me without the receipt. So I will be leaving my job next week!
The biggest problem is, COMICON is in July 25th, and I really want to go to the conference. I don’t mind going home, but Comicon is crazy important to me. My 60 days grace period will not cover it if I leave my job on May 16. Does anyone know how can I remain in status until I go to the Comicon and fly home?

Show proof to your school that your H-1B is filed.
Ask your attorney or employer to write a letter stating the same.
Take that letter to your school and get your OPT extended until June 30th at least.
From then you have 60 days, so you should be good to go to COMICON.
Submit the letter to school ASAP before receiving your rejected petition back!!
You just need to show your school the prove of your H1B petition filing and you can extend your OPT to June 1st. My OPT was ended on May 5th originally.

Can I be on unpaid leave for a month or use my vacation after OPT expires?
My OPT expires in August 8th, but I got a huge vesting bonus that won’t mature until August 28th!! If I leave company before, I will forfeit that money.

You should ask your school DSO about the situation.
It is bit tricky situation. Once your OPT expires, you are not allowed to work legally anymore. But if I am correct unpaid leave or vacation ( also unpaid ), that should not be considered as working status ( paid ). I am thinking you should be ok as long as you took unpaid leave after August 8th. You might have to explain to the immigration in the future that your bonus was not result of being employee after August 8th.

If your employer applied for H1 visa, it means your check is not with him. It’s with USCIS.

My employer en-cashed my check on 6th May, not sure why he waited all these days.
Generally it takes 7 – 10 days to receive the receipt once the check is cleared. So nothing to worry 🙂

For that you need copy of notice from USCIS, ask your employer to send scanned copy of notice. Receipt number,Beneficiary name(your name) ,Notice date,Application receive date,Petitioner name (your employer) everything will be there on notice.
My check was deducted but i have a problem with it…Another person to whom my employer filed H1B got 2 receipts,the EAC number on the back of my check matches with the other applican’ts receipt No(the other applicant has 2 Uniue receipt no’s printed on his name).Don’t know whether in those two receipts one was mine?

I have Plan B since last week.
Right now I am using full time CPT to work for summer semester, but in fall semester CPT is part-time limited to 20 hours. I don’t know my employer’s idea.
I am a silent reader, at last I have given up, I have lost all my hopes – non-AD/RP/VT . I inquired with my employer, my check has not got en-cashed yet. This is the second time I applied for H1 with lot of hopes, but seems have no luck. I feel so unfortunate.
I does not wanna waste one more year to try my luck in lottery, I am planning to move back to my home country and try my luck there, at least we does not have to fight for a Work Permit.

I understand your frustration. Im on the same boat! Ive given up all hopes for this. Its unfair that we must go through this if we have been hired by a U.S. employer. Hard enough finding someone to take us in and they have been waiting since last year for me and now this. I have a friend in Australia that is telling me that its soo much better in terms of applying. You can obtain your permanent residency if your career is considered as highly needed. He is an industrial engineer and got his permament residency showing proof of his studies and work experience.

Last year, I had 2 sponsors, i quite one and went thru the other but the petition didn’t went thru… Thanks to USCIS :), I moved to one of the richest country on the earth, the day I got my packet back :)…

My check also got en cashed last friday. But my employer got the receipt mail on Monday itself.It take 3 to 4 business days.
But i read some post from others that it took more than a week for receipt mail after their cheque got en cashed. Call your employer may be he has not informed you.

Writing this because I am sick and tired of the state I am in.. Each one of us here who is still waiting has gone through perhaps the most painful wait of their lives.. this is the 38th day of our continued hope and patience, 38th sleepless night, 38th day of no appetite and 38th day of misery we will never forget… However, whatever happens I am going to come out stronger because I know that in the end neither of us deserve this.. We do not deserve this torture after all the hard work we all have put in. It is just sickening to see how flawed and outdated this infrastructure is and perhaps will be for many many years. Because in the end NO ONE CARES!
It’s a promise I make to myself that whatever happens I will not let this get to me. There is a better life and a better job somewhere and eventually I will get there.. I am done waiting! So no more hopes for H1.. time to relax and move on. Good luck!

if you belongs to AD then call school guys for receipt # or send email for COS . Otherwise you have to wait until attorney gets email or std mail .
It depends on which company you are in. if they track check is deducted … like my friends case (he got to know April 3rd week or so) , you will come to know early… but for me they dont do such things … so I have to wait for receipts or rejected packet …lawyers are saying…. still anticipating ….

I mean if you are working for a company say around 2 years in the same project .They think you are skill are specail the chance are more. There are more people getting RFE in L1b
If it is product based company and you are working with the same company for more than 2 years then 75% you will get visa. If it is service based company then 95% rejection in visa interview.
There are more RFE these days. They also wanted in details what type of work you going to do there by day to day basis
Last year someone requested the same information from USCIS using Freedom of information right.
Based on that the approval rate was 63%, Denial is – 35% and 2% withdrawn.
I have a copy of that PDF that was issued by USCIS but it is not allowed to paste it here. That pdf shows other details as well.
These numbers are for L1B Visa…. for L1A the approval rate is around 90%

my supervisor originally targeted at L1A, after several times failure, he switched to L1B and made it after the fourth trial.
This is my first time petitioning for the H1B. I have the opportunity to get transferred from my job in Singapore to my US interco. My co did the L1a for me but got RFE and NOID and subsequently Denied. Then they resorted to try H1B. I didn’t get any updates from the attorney to date. I just wonder if my plan H would be to try again for L1 from my home country. Is it possible? I’m not Singaporean so I’m not entitled to apply for H1B1.
So much for my agony, it seems like getting L visa is not easy either. The NOID was not easy and certain information requested were too P&C. All I know is that, you will need to tailor your answers exactly to what was questioned. And then when they petition for H1B, I stumbled upon this website and read so much about the voices of agony from the students in the States itself and India. I think maybe my plan ‘I’ would be to just stay in Singapore and continue working here.
Why plan H and plan I you might ask. Cos I’ve tried L1 blanket which is Plan A, L1-a individual as plan B, followed by some obstacles from my previous co, bla bla bla and til the appeal stage. It’s a horrible time and utterly waste of time.
I know Singapore is always looking for talents as well. Not as grand as the States but taxes is definitely lower about the range of 11%-17%. 🙂 I’m hoping that God will choose the best path for me, either to beautify my resume by sending me over there or to get me a better job in Sg soon. Sorry, I need to vent my frustration here and I’m really touched by reading and knowing that all of us are truly happy for those who got the lottery and still hopeful for those who are still waiting. I believe God is fair and always guide you to the path that He has planned for you. Just do not give up hope and stay positive. You’ll get it in no time. Life goes on and next year hopefully there is a ‘finally’ a change in the quota after being stucked at 65k all these years. My parent company just pushed me to get a working visa, but the HR in my parent company has too limited understanding about US H/L application, not to mention the ridiculous lottery.
I have an international Bachelor degree and US CPA license, but neither the degree nor the license helped me in the lottery, for sure…
I served in this company no more than 1 year, I can not apply for L at this moment, that’s why my supervisor suggest me try H
TWO AD, one is PP, the other is RP, already got their receipt within 04/25, I seen their checks already be encashed. But my check is still pending,
the attorney said most of regular/RP cases he handled obtained receipt within last Friday, and suggest me consider Plan B

Does anyone know the attorney or the employer hear from USCIS first or at the same time? So if your attorney has any news, then your employer should have the news at the same?

I noticed that all of you paid the USCIS fees with cheque. How come our company lawyer asked for Money Order instead of Cheque? Do I smell something fishy going on?
No one should pay for lawyer. Its illegal if u really paid ur lawyer. At-least i have not heard any such cases in My country.
I mean our lawyer submitted my H1B on behalf of my company. And instead of requesting company cheque to pay for USCIS fees, he asked for money order..
Then it is something u need to be worry about. Usually Employer prepares cheque on behalf of USCIS and submits it to lawyer for cross verification. But, i see no point in money ordering. looks strange
Some desi consultancies do that. When they submit the documents to attorney in last minute(March 15th or so) they’ll ask people to send the check directly to attorney to avoid the delays. I’m not sure about your employer/attorney though.
But I never heard about money orders.
Its totally Illegal asking us to send checks here and there for the benefit of getting h1b. If they perform audit and get to know that cheque came from candidate – literally employer and candidate will be shortlisted and then blacklisted.

I just got the receipt number from my attorney and my case is in the initial review stage! What a relief this is! The past month has been tough, but the wait was worth it. Words can’t describe how I feel right now. I definitely am lucky and blessed. God does answer your prayers I know for sure now 🙂
It took about 11 days to get the receipt notice from the day my checks cleared. Mine is non-AD/RP/VT.
