Flash News Update  : 

  • May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
  • April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?

USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.

What would be the Cap count for H1B Visa 2015 quota ?

No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.

  • Regular H1B Quota : 65,000
  • Masters H1B Quota : 20,000
  • It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

How soon should I start planning for H1B Visa 2015 ?

[ Updated : H1B Sesaon is over for FY 15, plan for next year FY 2016 ] Well, there is nothing like too early… Getting a good H1B Sponsor can be a challenge these days. You need to find a job that fits your profile and find a sponsor that has a job for you.  Some employers want to test out the capabilities of the candidate before they plan to sponsor H1B Visa. Typically, they would like students with masters from US work for them on internship or co-op.  If they like the candidate then they will sponsor H1B visa.  If you are planning to land in US from overseas countries like India, it could be even challenging to find a good sponsor. Maybe you would need to work with global IT services companies and make your way up. It can involve lot of internal process to get the process initiated… You are never early…. How do I find Sponsors for H1B visa 2015 ?

This is probably the most asked question.  It can be a challenge to find a good sponsor. We have written quite a few articles on this topic. What would be the H1B Filing fee for Fiscal year 2015 ? 

There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014.  The  H1B Visa 2015 filing fee can range anywhere from  $1,575 to $4,325  based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet.  But, lets say, if it gets passed, the below changes may happen.

  • Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
  • The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
  • H1B Visa fees can up to USD $10,000.
  • More stringent rules on H1B visa adjudication.
  • Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

  3. My employer (in US) informed me today that they are still receiving receipts for non-AD/PP…So we can still keep our hopes alive…They told another few days left before they stop sending it…So just wait and pray guys….

    I just received mail from my employer that they have received the receipt notice which was generated on April 22, 2014 by USCIS. It is for non-AD/RP/VT. I am now relieved. Thanks a lot for all important info in this site.

    • I just got a call from my employer saying they recieved the approval notice yesterday evening. Mine was not trackable till May 1 and it went to decision.

    • No, my check was not cleared yesterday, but this morning I received notice from attorney this morning at 6 am, with receipt date 4/10, notice date 4/30, so they issued EAC XXXXXX166 before they cashed the check. I was upset yesterday because the check was not cached, but it was not an indication of the lottery status. Don’t lose hope. Last weeks notices are being received by attorneys just now. I am RQ/RQ/VT not even a fortune company. Not an Indian or Chinese, though. I don’t suppose they give Indians lesser chances, right?

    as the count shows 1439, is there any chance other cap will reach that much count?

I have seen many scumbags with MS Degrees from US Universities in NY / NJ area living in concentration camps of the roadside IT body shops getting trained in basic IT skills and expertise in faking resumes. These guys are worse than genuine IT developers from Infy, TCS and Wipro who worked their a$$ off to get a job in India.

    80% of MS douchebags in USA are applying through desi Consultancies and all those ‘0’ skilled dudes should be kicked their backs to home.

So AD guys dont have right to come here.. you dont know how hard we guys work here to get to this situation. At any point I can say AD guys can do better than a NON-AD in job market ( be it communication / skillset anything).. U guys suck..!!

      • Housewives on H4 are doing MS in 10 months. Only 20% of Indian cream go to top US universities and everybody respects them. These days, due to all the black money daddies are earning back home, every douchebag and scumbag is joining a US University by producing fake financial documents. Look at the GRE scores of our dudes, pathetic, they cant crack a freshers test of Infy.

      • Ppl with low scores (gmat gre) also get into ms n land up an equal oppportunity…y because u paid for a usa degree.. Thats no excuse for ad to be more eligible for h1b ( it should always be skills). Just because you dint.have the patience to work n gain experience n skills by working in.india you choose the easy way out by spending on an.ms degree ( and hopefully getting the skills)

        I dont like the attitude of such AD guys. Come back to india if h1b was not the criteria for your ms. You are there because you want a us salery

        If you deserve the h1b you should get it, one chance for everyone

        I gave up my mis in 2 months to avoid wasting money for an h1b…got the required experience… Now have an equal chance for a h1b

      • Im a BE grad with 10+ years of experience in IT. I worked in various IT divisions in India, acquired variety of technical skills , worked as an infrastructure architect in Australia and Im here in US now as a lead architect. Do not stero type all NON AD folks. There are scumbugs in both NON-AD and AD groups. Ive also worked with AD folks who has no idea about technology but join a consultant with fake experience.. 8+ is what they state when they are straight out of college.

      • I am non ad/rp and can proudly say that my 8 years experience in telecommunication industry in Bangladesh has provided me the opportunity for h1b sponsorship(picked up in lottery and now in initial review). I do have respect for those ad guys having high cgpa , had TA/RA during graduate study and working for big giants like Msoft , google . But most of them spend a fortune to buy their MS in US and think that US is their mother land just because of that 😕

      • AD is for US based advanced degrees only.
        There are numerous people out there with better degrees than US-based Masters, but they don’t quality.

        The AD classification is a means for the US to keep people around, in which they have already invested. It doesn’t say anything about their specific abilities to get a job or be a good performer.

        Anyone selected should feel privileged, not entitled.

    This part of the message is for those shit heads who look down on IT Service Providers ( Ones with so called American Advanced Degree ) I have an american bachelors degree from a major school in the midwest working for an Indian service provider and I have been very impressed by their approach and there is no “Gaming the system” so speak/write after u give some thought. Also i have seen first hand all you losers in Grad school who make zero effort to assimilate in american culture and stare at white chicks like they are piece of meat. Look at yourself first and think what name you bring to India before u shit on Indian companies trying to make an effort to put India on the global map.

    • I cannot believe what this lottery system has done to people! Everyone has put a lot of effort and have undergone a lot of pressure to get where we are today. Before Masters degree people are ridiculed , I would like to point out that a vast majority of people in the IT industry did not study computer science and glorify resumes to get into the s/w industry. Honestly some of the AD people criticized here do the exact same thing. They somehow get a masters degree and get a job that gives them H1B. I do understand that sending multiple application has hindered people’s chances but the legislation passed by the Govt is to be criticized not the people. Who knows what these people are going through? loans, family problems etc. Congratulations! on getting selected in the lottery, but, do understand that such arrogance is a mere reflection of your immaturity. Do understand that H1B is not the end of it. Good Luck!

    BTW… to all the consultancy bashers !! Wake up… The guys who come through consultancies too are qualified to apply and are eligible and all my friends who have got in have gotten in through consultancies.. BTW.. all of them have a job before even they travel to US !

  22. I am a Ad/RP/VT with my undergrad from IIT and graduate degree from UT Austin. I have never paid for my education (always been on scholarships/fellowships). I have not yet heard about my visa status (which possibly indicates a rejection).
    I am thinking about starting a petition addressed to President Obama to allow people with advanced degrees to stay in the US beyond the expiry of their OPT on the following grounds:
    Professional: As advanced degrees indicate, the people who were not selected in the lottery are highly qualified whom their employers cherish having and who contribute to the US economy in a great way. So, it is beneficial for the US to retain people with such qualifications.
    Humanitarian: (1) Most people with PhDs get married during their Phds and some of them even have kids, who if born in the US are American citizens. Now if the parents are from country X and country Y, and one or both of them has to go, then it is a family calamity. (2) Many advanced degree holders have paid a fortune or taken huge loans to study here. If their staying and working in the US represents a win-win situation, wherein they manage to pay back their debts and the US benefits from their high level of skill, then there should be no reason as to why they should not be allowed to stay and continue till suitable/appropriate immigration laws are passed.

    If I receive overwhelming response from you guys, I will start this petition and circulate on FB and Twitter.

    Please be serious and respond. I would not appreciate any silly comments.

    • Also tell the fact that those consulting companies file multiple application for 1 person decrease the odd of honest people. Deny those fraudulent application and give those quota to honest AD people with a real jobs.

    • Dude , what lawyer can do if you don’t have luck in lottery to pickup . Better to apply 2 petitions with 2 different employers or apply with 2 applications if your boss have 2 different companies so your chances to increase to 4 instead of 2 chances .

    Can anybody please share with me what are the feasible plan Bs for staying in this country?
    Which are the colleges providing CPT/OPT(whichever is required, sorry I am not much aware) from the earliest possible day?

Some of my friends received their acknowledgement receipt, when i checked with my HR they asked me to wait till another 8 days and they have not received any update for my case, so i wanted to know like, do i have to keep my hopes alive or is it all done. How MNCs will be receiving receipts they will receive all at once or individual, if at once means then my case is definately gone.

    Worked really hard for this H1 🙁

  32. I finally received my receipt notice from my employer. I am non-AD / PP / VT. The representative from immigration team & HR informed me only yesterday. It is EAC14-141. I am very much relieved now.
