Flash News Update  : 

  • May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
  • April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?

USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.

What would be the Cap count for H1B Visa 2015 quota ?

No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.

  • Regular H1B Quota : 65,000
  • Masters H1B Quota : 20,000
  • It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

Would there be lottery for H1B Visa 2015 ?

How soon should I start planning for H1B Visa 2015 ?

[ Updated : H1B Sesaon is over for FY 15, plan for next year FY 2016 ] Well, there is nothing like too early… Getting a good H1B Sponsor can be a challenge these days. You need to find a job that fits your profile and find a sponsor that has a job for you.  Some employers want to test out the capabilities of the candidate before they plan to sponsor H1B Visa. Typically, they would like students with masters from US work for them on internship or co-op.  If they like the candidate then they will sponsor H1B visa.  If you are planning to land in US from overseas countries like India, it could be even challenging to find a good sponsor. Maybe you would need to work with global IT services companies and make your way up. It can involve lot of internal process to get the process initiated… You are never early…. How do I find Sponsors for H1B visa 2015 ?

This is probably the most asked question.  It can be a challenge to find a good sponsor. We have written quite a few articles on this topic. The fundamental concept of finding a good employer does not change.  You can use our H1B Visa Sponsors Database  and search for sponsors in a city or zip code. What would be the H1B Filing fee for Fiscal year 2015 ? 

There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014.  The  H1B Visa 2015 filing fee can range anywhere from  $1,575 to $4,325  based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet.  But, lets say, if it gets passed, the below changes may happen.

  • Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
  • The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
  • H1B Visa fees can up to USD $10,000.
  • More stringent rules on H1B visa adjudication.
  • Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

          • Guys, don’t worry about tracking , I was in the same state last Thursday , was not able to track till late Thu night , on Friday morning around 10 AM saw the case approved, also I don’ t think they are processing it sequentially as cases before and after me got approved a day before my case , so hang on .

            You are correct. I have been checking a case EAC1413453942 which was not able to track till couple of minutes back and all of sudden I can see the status now as post decision. It got changed from ‘case not found’ to ‘Post decision’ in a span of 2 minutes only.

            Waiting for mine to happen quick so that I can plan my travel….

    • About 51 percent of cap cases overall—approximately 87,500 H-1B petitions—were rejected for processing(Not selected in lottery)

      A non-advanced-degree case had about a 43 percent chance of being selected..

      • Non AD chances are close to 37% as don’t forger 6000-7000 visa are for Singapore chile applicants.

AD / RP folks… Just now I spoke to one of my friends here and he has received the call from the employer stating that he is through in the lottery… This is Probably CA as the employer is in Michigan….. He doesn’t have the receipt number yet as the employer has refused to Share I belv….Will post more info as I get it…

    Not a FAKE …but a genuine news..Coz we both applied from the same Consultancy But mine was a NON AD PP which dint go through the lottery…

  11. Same situation here. Although I got my case number, but still cannot track. The HR helped me apply for the application. She is already complaining about it and she does not want to do any more for me. How could I tell her to call USCIS to check my status?
    I cannot track it done on the website and when I called, they told me only the petition has the right to know the details by phone…

  16. Hi, I am on H4, still waiting to hear on H1 (Non AD/RP)…which I will get if some miracle happens..
    meanwhile i wanted to explore what could be my options…as H4. Anyone on same boat and have plan B? that will help

    • 1. Look for any non-profit organizations, they’ll offer you cap exempt H1 through out the year.

      • with CPT u can only work 20hrs per week is it? I am 7+ yrs IT person into testing and was told that I can try for online testing jobs…but i am not sure if thats legal.
        Anyway thanks for ur responses..i will think and figure out if I am ready for college again !
        Still praying that i get my H1! God is great..

        • Hi IBelieve ,

          Yes CPT is a good option . CPT is completely school specific and depends on your curriculum, and most importantly your advisor. If he or she approves your CPT, and your college permits CPT you can go for it. It is typical, most colleges approves CPT after 2nd semester because you will have enough academic knowledge before getting into market.

        • I did CPT 40 hours per week during summer. I think 20 hours rule only apply for regular college jobs without CPT/OPT. Please double check with DSO.

  19. On May 2nd USCIS has announced that they completed the data entry for all H-1b fy 2015 applications and now they will start returning petitions that were not selected in lottery.

    I still see people in this forum saying that they are still receiving receipt numbers.
    Can you guys confirm if receipts were generated on May 2nd ?

    Its kind a confusing… is there still a hope for people who have not received their receipt.

        • My employer doesn’t know about lottery. All they know it is they cut the check and sent to the attorney.
          They are American. The company only filed one h1b back to 2006. This year is only me.
          How am I gonna tell them about all this crazy h1b lottery?

  21. Hi All,

    Question: Does anyone know who will get H4/i-539 receipt?
    My employer filed H-1 & H-4 together, he told me he received receipts for both,
    but he sent me just a copy of i-129, when I asked for other receipt(i539) he said give me day or two
    its almost two weeks now. what should I do now?

    • As for as I know. H1b receipt should go to your employer and H4 receipt should directly come to your mailing address. As its the same case with me. I received H4 receipt while H1b receipt my employer informed me. You should better ask your employer again. And ask him why you did not receive H4 receipt.
