- May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
- April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?
USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.
What would be the Cap count for H1B Visa 2015 quota ?
No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.
- Regular H1B Quota : 65,000
- Masters H1B Quota : 20,000
- It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

How soon should I start planning for H1B Visa 2015 ?

What would be the H1B Filing fee for Fiscal year 2015 ?
There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014. The H1B Visa 2015 filing fee can range anywhere from $1,575 to $4,325 based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet. But, lets say, if it gets passed, the below changes may happen.
- Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
- The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
- H1B Visa fees can up to USD $10,000.
- More stringent rules on H1B visa adjudication.
- Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

All the Wipro / TCS / Infy dont know how much hard work / money is spent by each and every AD guys.. You guys just abuse this H1B system. Come here on a H1B provided by a bull shit company and spoil the consultants market over here.. Work day long and even nites and spoil the american work culture here.. Bcoz of u guys pay scale is going down for even niche skills.. I think USCIS shud ban these indian firms from applying H1B.. I dont find any point bringing in these guys who work for less and take our jobs when we are not selected in lottery and left without job/ join a school again work hard to get H1B.. RIP Indian consulting firms.. 🙁

They don’t apply L1 because all L1B are getting rejected during stamping with the simple reason: if he nature of job is technical, go apply a H1.
Pretty sure that F1B is for advanced studies only. That visa category does not guarantee about post work employment. H1B is a seperate visa. Dont see why a candidate with AD (most of them with no intrest in pursuing academia and do Masters for H1B only) candidates are more entitled to H1B.
I do concede that from companies hiring individual AD candidates, it sucks but from individual perspective, I think all skilled (AD or work Ex) candidates deserve equal oppurtunities.
Better solutions are needed (more quota/better screening for bogus candidates, etc) but dont make a mistake of questioning individual candidates and what they “deserve” for all the IT companies you have highlighted. Lot of them really do good work and are really liked by their clients.

AD guys dont do master’s only for H1B. Please correct your statement.
I am a AD guy who work for a American firm ( Full time) and internally there is a Indian Firm where its outsourced.. You dont know the politics these guys do here and even work after office hours and force a consultant like me to support and destroy the work culture. Yes Indian firms are liked by clients bcoz they work for less.. I too have many client appreciations and a MVP of my client.. They like them only bcoz they work for less.
PS: AD guys contribute to US economy and in turn take their share. and we are not here only for master’s ( except u)

In IBM I have asked almost 30+ people. Only 2 people have got it. I wonder how come it possible. I am hearing that it keeps coming till May and in June too as it happened last year. So really in confusion what is going on.

I applied for H1 last year but was not lucky. However this year I made through the lottery…
I just checked my attorney’s website account and it shows one reciept number for me WAC1414451xxx. I checked the case status on USCIS and it says following:
“On April 10, 2014, we received this I129 PETITION FOR A NONIMMIGRANT WORKER, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. ……”

Just got email from my lawyer. Email says I should consider looking for alternatives but she also mentioned there is hope until end of this month. I am calling my HR today to see if my company offers any relocation for the ones not selected in this process.
My plan B is to go to grad school and plan C is to go back to home country. Remember this is not the end for us. One day we shall all be successful.

So my employer has informed me that the checks cleared on April 24, but we still haven’t received an official receipt yet. Do you think mine was selected in the lottery since the checks cleared? Yes, it means you have been selected in the lottery.
There are two formal ways to check if you are selected from the lottery without receiving the official receipt.
1.) to see if the checks have been cached
2.) to see if the SERVIS ( if you are student ) record has been updated
just want to know if they are notifying about the lottery and generating receipt together ? if that is the case i still have hope…but if they notified everyone who got selected last week and generating receipt now then i think i am out..
I am really not understanding why there are very few receipts for RP and Non AD @ CA till now. This number is very very low when compared to all categories.

As far as my around people go, only one people have received. Today I called my employer, they said today only 2 received receipt number. I doubt whether they have shared the receipts for all. At the end of day it’s 43%, approx 1 from 2 to be there. when I see around in 5-6 only 1 received. Something is seriously wrong either due to multiple filings. Many people may be have more than 1 filing which is sheer waste of dreams for many and selected or still receipts are waiting to be dispatched.

I am in the same situation, I am also AD/RP/VT. I guess it is normal and as long as you have received the receipt notice you are good. It just means they haven’t started processing our file but we are selected in the lottery since we did get the receipt numbers. I am sure majority of RP will having the same issue.

Same here with PP-NonAd-VT, received email from attorney couple of weeks ago now but no update on the website, just says Case cannot be found. Its been a glitch for a couple of years now apparently.
Just have to wait ‘patiently’ for it to update once there is activity on your case, or your employer/attorney to contact you with the good news.
Do not worry, it is going to take a time. If you have received your case number, then USCIS will process your application. Just because you can not track down the case number on-line would not change anything.

yes you can but before returning u have to go for stamping in India..btw can you share 1st 8 digits of your receipt number…and when did you come to know about it?
You can travel only 10 days before the October 1 once your H1 B is approved.
Don’t travel when it is pending. Travel only after it got approved.
Yes you can..but make sure to have employment letter or offer letter, EAD card, and your H1B is approved by the USCIS and not under pending status. Take the client letter, employer letter and you should be able to come back.
I am still waiting for any news on my receipt for AD/RP …. My employer just called me saying all checks for the applications he received receipts for has been cashed except for mine and asked me to start working on PlanB ..

I’m totally new to this forum. Just one quick question. I received a case number from my attorney on 4/12 with the “acceptance” status. However, It has not been changed to initial review (as of today 5/5). I contacted my attorney and he said it’s not certain whether my case is selected for the lottery (I’m not sure if this is true) and advised me to wait. Thanks AD-RP, that’s what I think too. Since a lot of cases have been approved and I applied under a premium process, I feel unsafe about the situation. It’s been more than 3 weeks with no update.
Hi PhH1B, I am in same boat. AD/PP/ Vermont and haven’t moved from acceptance since 4/11. If it was not selected then why would they give us a receipt/case number? Don’t think that can be true.

I’m in the same boat. But hear my story and ask your lawyer to call the PP unit ASAP to verify the case number with them.
I got the receipt number and it shows its accepted online but there has been NO updates on the case status check after that so far so I asked my lawyer to call the PP unit to verify the receipt number.
Guess what happened! They said my case was selected first and it got voided for some reason and that’s why it doesn’t get updated online. They also said the most common issue for the denial cases is duplicate entry which is impossible for my case because I’m the only person with a single application from my employer.
My lawyer is pretty sure there was a human error done by USCIS and insisted them to request an investigation and they finally accepted our investigation request.
My advise to you is never give up on this and fight till the end because they have been processing tens of thousands of applications and its not uncommon at all that they might have done some mistake on some unlucky guy like me.
But if it was voided/denied, shouldn’t your lawyer/employer get an email that instant
well she has not received anything yet. I got my receipt number from my school DSO. It’s really weird that my case was voided because there is no apparent reason for that!

Could be any h1b does not have to be a lottery once. If its selected in lottery than its must say April 10 as lottery done on that date. Anything says after April 10 means its a cap exempt h1 application.
if its selected in lottery, the wordings will be same as ” On April 10, 2014, we received this I129 PETITION FOR A NONIMMIGRANT WORKER, and mailed you a notice describing how we will process your case”.
