- May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
- April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?
USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.
What would be the Cap count for H1B Visa 2015 quota ?
No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.
- Regular H1B Quota : 65,000
- Masters H1B Quota : 20,000
- It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

What would be the H1B Filing fee for Fiscal year 2015 ?
There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014. The H1B Visa 2015 filing fee can range anywhere from $1,575 to $4,325 based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet. But, lets say, if it gets passed, the below changes may happen.
- Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
- The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
- H1B Visa fees can up to USD $10,000.
- More stringent rules on H1B visa adjudication.
- Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

I got my receipt number on 21st April and I was not able to track it till today.
I was PP/VT/Non- AD. I just checked my case status and it shows RFE. My employer said that cases do get RFE’s and it should not a problem, we can always send whatever document is needed.
But I am worried… Any comment would be great help!

Last year one of my friend got RFE, USCIS needed some documents from employer. But yeah its all got sorted out when they got required docs.
There is nothing much to worry just USCIS want more information to complete your application.

All ADs that have job and currently working should be given H1B first. This h1b abuse from companies that are filing in bulk for people who are not even in the country should stop.

Guys on AD would have already be on a project and an AD person not getting their h1 would be a loss for the person AND the company too !. due to someone leaving the project in between !
This law of allowing multiple applications/person was done with an honest intent and people abusing it should be ASHAMED of themselves and i strongly wish a ban would be placed on multiple applications.
You would not agree to your statement when you file application for the first time. There are many people who work offshore for many years and they understand clients business more than you AD guys. I am not favouring any body but you should consider all situation before you put your comments

I am still waiting too. I have not given up yet. I am non-ad/rp/vt. Stay positive. If nothing comes up we can apply for grad school. I have decided not to stress over it. Life is not easy, sometimes we might have to walk different road to reach our destination. Be happy and enjoy what life has to offer.

Is the wait list also applicable for Non AD/ PP Preminum processing? My employer and attorney did not receive any update from USCIS which clearly means my case was not picked up in lottery. But my emplyer says I can still have some hope as I can be in wait list and get lucky if other’s get rejected, is that true?
Bro… Not being Harsh , but do not keep any hopes / high hopes on this waiting list… As the chances are very very very slim…But yes, there is a chance to get on to the waiting list……But again very slim chances….

Your assumption maybe wrong. If you were not selected in the lottery, your employer / lawyer would have sent you an email with the bad news. Don’t listen to the bashers here, they are negative people. Stay POSITIVE.
We need to think and be a little practical here.. they have started to process PP applications and we are still waiting on Lottery results ? No one is trying to project negativity here , instead of thinking about the lottery all the while and why i didnt make it , we would need to move on…Accept the fact that lottery results of PP are done…been close to a month now…
Employer and Attorney would not send a mail saying you are not selected until the package is returned back – I do understand there is a process of waiting list, but trust me there wouldn’t be high rejections if you are expecting it…So keep very less hopes on the waiting list and by Gods grace if one gets through that ….Well and Good… and I will be really happy for him…

That is the main issue, I did not receive any email from employer or attorney, they say they don’t have any information yet but cheque was also not encashed.

I am not in that. He says the game could be over for me since last year they applied for 12 and got only 2 on the same day similar to this year.

It’s not about AD or Non-AD. I have friends working for Amazon in Seattle who do not have a degree from US. However, they proved their worth to their employer and were transferred to US to work on making the cake, not just the icing (metaphorically speaking). They worked hard to get themselves in the right place. Similarly, there are people with advanced degree from US who worked hard to get a full time job with a US employer (Non-consulting companies). I just got my H1-B approval notice (AD, Premium Processing). My company has almost 400 employees in total and filed only 2 H1-B visas this year. Companies like mine need the 2 of us but companies like Infosys just need as many H-1B approvals as they can. They are misusing the system. They hire so many people with the promise of filing H1-B as if they are sending them for some sort of site-seeing expedition. Infosys has filed more than 15000 petitions this year. The motive is not to send the worthy candidates to work in US on a need basis but to file as many applications as possible so that they can send as many employees to work in US as possible. It is good to make good use of opportunities. Misuse leads to depletion of resources.

I agree with you. I work at Infy. So far, companies like Infy were only worried about manpower quantity not the quality. Even a person who does not have a good tech knowledge gets an H1B. This is my second time of facing lottery and believe me, about 80% of the people for whom they initiate H1B is totally unworthy. Don’t think I am talking all these because I lost it the last time. I am talking because I know what I am seeing and my view is from inside and not from outside.
But things seem to change a little bit in Infy(Not sure about other companies). They have brought in rules to filter out the non performers from getting visa. Again performers/non-performers are decided based on the rating(which is considered as biased by most ppl). But everyone should agree that out of those unworthy 80% ppl, at least 50% will get filtered out. Infy is getting more careful in picking ppl since things are backfiring at them.

So, 99% receipt generation is pretty much done as of yesterday.

To be frank, nobody knows for sure if there is even a wait-list. This is the fact: You either get receipt if you are picked or get your package if you don’t. Everything else is just speculation.(Comments are based on experience from last year)
AD/RP/VT here. Don’t want to discourage you guys. I am still holding on the little hope. Just emailed my lawyer to see if they received any receipts. They told me it is possible to assume that I am not selected in the lottery according to the experience of the last a few years. So sad.. have to start all over again. It’s my birthday today, not the birthday presents I was hoping to get.
Don’t lose hope until your package is returned. You can choose to work on backup plans but it is good to keep your hopes.

I am AD too. It is so sad. I can’t sleep well, woke up several times in the nights. I don’t understand why white house will give EAD for h4 who don’t have a job, but turn blind eyes for the people who have job and are waiting for h1b.

Hi ,There is nothing to worry about your case and the decision from USCIS is almost all out for you,some times USCIS will not update any status till it reaches to the last stage that is ‘Post decision activity’ unless there are no hurdles in the applicants petition,and in your case it happened in same way,so get ready for the mail/email from Attorney or Employer and cheers.
I have read in so-many other blogs that applicants receipt status was not found till yesterday and suddenly went to ‘Post decision activity’,this clearly says that though USCIS doesn’t update the status on regular basis,still it process the petition in the back ground and posts the results finally.

All the Hard Working AD guys , your comments here are really demeaning to others . You are accusing somebody that if they didn’t know what to do with H1B visa why did they applied for it , somebody legitly applied with two employers then you are accusing them of stealing some AD Guys chances . All said and done guys , somebody who’s H1B is applied by an employer and is Non Ad faces a far more stiff competition than so called you Hard Working AD Guys . The other guys are hard working that’s why their employees choose them to be sent to work at client locations.
You guys came here by your own choice , studied here (your own choice) and should have known about consequences 2-3 years down the line incase your visa doesn’t come thru .
This is a systemic fault where in big companies are hogging most of the visas , for the guys who you see here in such forums , it’s as important to them as to anybody else whether AD or NON AD . There are many who don’t post but read and there are many who do post .

I have a Masters in Architecture, Ive had my plan B set up since February this year. I got my receipt on the 20th. Ive never said anything against
non- AD. And I WORK HARD every day of my life. So before you start venting out to others, take a second and realize what you are saying. You are generalizing. I open up this forum every 2 hours just to see updates and comment every now and then under different names.
When i first came to the US i had no idea of H1B, i did do my research on F-1 and OPT. In October of last year i started my research on H1B. As far as i can see there are people still posting about what are the process of H1B a month after applying for it.
Tell me something, do you think that its fair for someone that has no interest in their future or hasn’t even bothered typing into Google “H1B VISA” get a proper response. That is where the majority of comments come from, from my point of view.
So if you dont like working hard, get the hell out and allow people that do read the updates in peace.

You already have proved that toy can get interviewed and appointed in US and tout get unlucky and some stupid person in India gets lucky, and without requirement is Sent here, too enjoy the perks, it really hurts. You have an approval so be happy. Don’t peach others. Lets see how many of these H1 holders fromv India can get appointed in an US company.

Is it game over for AD and NON AD RP people? From the last 3-4 days may be a handful of people mentioned they received receipt # and even those are with receipt # with EAC 14 – 142- or EAC 14-144 (max) i have seen. Did USCIS send out all the selected candidates receipts already?? Why isn’t there any updates of any new receipt numbers??!!!

1 option to all people out there AD/NonAD/Etc. I think Most of you are overlooking 1 more option you have with/without H1B.
You can always work remotely for the company and get same salary you desire, i have been working from home in my home country for startup.

Everyone who cant track or check their status should creat an account and set up a notification ..it really hepled me..I was checking it every 10-15 min like a maniac but this alert notified me immidately..even before my attorney got confirmation email..(I checked the timing)..So instead of wasting time in checking every 10-15 min just set up a notification…

I just tried that and pop up the following error. I think until USCIS update something on our case, we can’t track our case online.

Dude, if your case no. itself is not available in USICS, how can you track.
Once you see your case, you can register and based on status change you will get alerts..
In my case status there is an option to make an account..you have to put your receipt number there…I was able to track the case number when I created an account..so may be you can’t add your case number when you can’t track it…

No way, WAC they are already done day before yesterday only.
You just have to wait for the one already mailed. Don’t expect any new receipts generation in WAC.
It’s perhaps foolish to even ask but any hope left for AD/PP? I mean how soon do we find out if we are on WL? Have they started sending return packets? Any AD/PP candidates received receipts in last two days?

Don’t know if we are having any hope of getting when everyone in PP started getting approvals. My employer said to wait till the 2nd week of May…only thing i can see is wait for the return packet for confirmation…
Same here … AD / PP / CA still waiting. There are about 10 people from my company who are still waiting …. I don’t think it is coming …..
@ KK: How many AD applicants applied through your firm ?
Its not foolish to be hopeful. Lets wait till we get our packets back. Realistically speaking we’re done but we never know. I’m AD/PP as well.

Not sure how they will encase the check. As per i think first they will generated the receipts for all selected in lottery. Later they will start encash after they verify everything about the petition whether they filed it correct fee .

Just be positive bro. The receipts are random they cant send every receipt on the same day. AD guys should be more positive has you have gud chance of getting selected in lottery. So hope for the best . best of luck 🙂

I am losing hopes now, last time I spoke to my employer he said the check has not been cashed, nor there is any change in my SEVIS record per my school DSO.
Very stressed with all this, I recently got promoted to new position, for which I worked real hard and finally last month it paid back with the promotion. I was so happy but it was short lived as not getting through the lottery this year being my last chance would be devastating as my OPT expires in July. I am back to square one will have to start everything from scratch again.
Somewhere down the line I am still trying to keep my hopes high until the package is returned but later at the end of everyday with no good news I lose it all again. Cannot concentrate at work don’t feel like doing anything.
I know a lot of AD guys are here just like me waiting and waiting and wake up in the morning everyday with a hope.
Anyway … I will keep praying for myself and all other AD guys out there who are still waiting.

I wish a miracle happens and every AD applicants starts getting receipts one after other…. I would never question gods existence ever again. It’s silky to write it on this place but I wish to express my feeling that whole stories of karma seems to be nothing. Genuine people have to suffer the most .
This is the thing that matters: your success. You have been successful in your current position and you will be the same everywhere else ! now think about those people coming from outside for job that we all know why they have hired someone from outside in the first place ! what do you think awaits them ? success ? a good life ? heh … we have been here forever, and we know … let them come and see … we step out and they will buy us like crazy everywhere else cuz we are the best and we’v got the best education.
I am in the same boat buddy, AD/RP. As of today i haven’t received anything and my hopes are diminishing as well. Although it will be such a shame to see all these years hard work lost in a single gamble. Even i had to work hard to get from a contract to direct hire position and this is my only chance and i doubt that i made it through the “lottery”.
Well we tried, but if luck turns down on people who only count on working hard, there is little we can do here.
while keeping that litte hope until my packet is returned,I might just go back to my country or, join an other degree which is see not very likely…
I wish all the “luck” you can get…at least we are prepared now not to count only on hardwork.

My two cents:
1. This is not a “lottery” because we have already won our right to work and add value to this country through hard work. In addition, We have invested part of our life and money building this new journey.
2. The US loses if we, highly educated people, leave the country just because a flip of a coin. Sometimes I think about this “lottery” process as an emigration guy tossing a coin just when we go trough emigration: heads – welcome to the US, tails – sorry, please go back to your country.
I believe in fairness so we will soon hear about or H1B visas. keep the good thoughts guys!
we are in the same condition. I just got a promotion last month and I love my job and my team so much…. my OPT will expire in June. This waiting thing is so stressful and painful. Can’t fall asleep every night

I agree with one of above AD who said those coming from India don’t know what’s awaiting here. I assume them to be in their 30s. If they step here and are paid around 40k, which is a lot in India but here they will realize it’s nothing if they have kids n family . And then to learn to order taco n subwAy , Driving, accent, manners in that age is pretty insulting. Feeling sad for them too

I am exactly in the same position as yours dude. I recently got promoted and I worked so hard to get there. My OPT expires in May :(((((((((( and I have been waiting since day 1 to hear some positive news on H1B. I am still hoping for the best keeping my fingers crossed….not sure if the game is over or not but I hope some miracles happen and we all get through it!!!

AD guys who didn’t went thru in first 20K and who went through in second lottery along with regular guys -still have chance and their receipts will come late. So don’t give up until regular guys are done. Hope you guys got my point.

The only thing which is frustrating to me is, USCIS merging the category of people coming from outside with the category of people who has done advanced degrees here.
Why not create another visa type like H1-AD(Advanced Degree) for AD folks and let people coming from outside compete for regular H1. Fair chances to both categories and win-win situation.

Exactly the same here (AD/RP/VT). MBA, got promoted two weeks ago, OPT expiring end of June.
I hope the US government fix this madness for future generations. This emigration policy needs to be changed.
From 8 people that I know applied with me (AD/RP/VT), 5 have already got their receipt number. I hope we hear soon about this.

I have to clear one thing here: SEVIS record doesn’t always reflect your H1 case status. One of my friend already receive the approved notice but his SEVIS record still unchanged.

Guys, even if you are from the same company, you may get the results in different times. Asking about outcomes based on your company will not get you anywhere. Selection is randomly, your case number is randomly as well.
