Flash News Update  : 

  • May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
  • April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?

USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.

What would be the Cap count for H1B Visa 2015 quota ?

No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.

  • Regular H1B Quota : 65,000
  • Masters H1B Quota : 20,000
  • It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

Would there be lottery for H1B Visa 2015 ?

How soon should I start planning for H1B Visa 2015 ?

[ Updated : H1B Sesaon is over for FY 15, plan for next year FY 2016 ] Well, there is nothing like too early… Getting a good H1B Sponsor can be a challenge these days. You need to find a job that fits your profile and find a sponsor that has a job for you.  Some employers want to test out the capabilities of the candidate before they plan to sponsor H1B Visa. Typically, they would like students with masters from US work for them on internship or co-op.  If they like the candidate then they will sponsor H1B visa.  If you are planning to land in US from overseas countries like India, it could be even challenging to find a good sponsor. Maybe you would need to work with global IT services companies and make your way up. It can involve lot of internal process to get the process initiated… You are never early…. How do I find Sponsors for H1B visa 2015 ?

This is probably the most asked question.  It can be a challenge to find a good sponsor. We have written quite a few articles on this topic. The fundamental concept of finding a good employer does not change.  You can use our H1B Visa Sponsors Database  and search for sponsors in a city or zip code. What would be the H1B Filing fee for Fiscal year 2015 ? 

There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014.  The  H1B Visa 2015 filing fee can range anywhere from  $1,575 to $4,325  based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet.  But, lets say, if it gets passed, the below changes may happen.

  • Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
  • The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
  • H1B Visa fees can up to USD $10,000.
  • More stringent rules on H1B visa adjudication.
  • Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

  2. Is there any-way to know the name of the candidate from by entering random receipt number on USCS sight? if so how to know the name.
    Seems my employer got the status (of few people) but not informing to us, as they seems waiting for more people status update.

    Pls let me know, if any way to know the name..so that I can run a automation script on USCS sight by entering Randomreciept numbers to get my name.

    My Employer in India processing H1b this time and I guess it should be regular. Can somebody tell me whether it will VT or CA. We are not given any info on that after processing.. I am working in India now and never been to US.

  9. Any body still getting receipts for Non AD and Regular from CA?
    Is there any hope still left even though cheques are not encashed till now?

    • If the petition validity is expired. You can apply under Non-Cap again for renewal through a new employer. You will not come again under Cap for lottery. Please check with lawyer or a firm who can do it for you.

      • That’s correct.

        I just checked with immigration law.

        Look at the approval notice (I-797). You will see an expiry (end) date there. H1B CAP is valid for 6 year, not the petition. Meaning, any employer can use the same CAP to file an H1B petition and keep extending it until you reach 6 years. You can also transfer to another employer using the same CAP. Only benefit here is that you don’t have to go through the quota again until you reach the 6 year limit.

      I am also in same boat, mine one is selected in lottery and USCIS sent RFE to my employer ,still my employer didn’t replied for RFE …its still pending.
      employer is no more in business and employer is closed his company.

      I dontwhat to do ?

        I advice please check with some attorney/immigration law firm as your case as lot many legal concerns.

        • In 2008, I applied for h1b through Company “X” and got selected in lottery, however, didn’t proceed further after that(didn’t attend visa stamping etc.)

          Now, I applied through company “Y” and waiting for lottery results.

          I’m in Non-AD/RP/Vermont.

          I haven’t mentioned company “Y” about my previous approval of previous h1b lottery in 2009.
          “Post Decision Activity
          On February 12, 2009, we mailed you a notice that we have approved this I129 PETITION FOR A NONIMMIGRANT WORKER.”

          Please suggest me, if I mention this to company “Y” helps me to Non-Cap Exempt.

          • As far as i know you can get cap-exempt for 6 years of your visa approval from USCIS.

            After that you have to go through cap/lottery.

            You should have to mention your employer/attorney regarding this.

            They might done something!!
            Just check with your attorney.

  14. I received a receipt on April 11 EAC series 14132xxxx. I can track online but the status says acceptance for 20 days now. I am AD/PP/VT.

    is anyone in the 14132xxx series or 14131xxx series able to see any change in their status. Been a while now…

    Can somebody tel me the next steps

    • Did you got receipt number?
      If yes, paste back here with out last 4 digits.
      If you have receipt number you can check the case status in uscis case status tracker.(search in google)

      Your petition should approved by USCIS, you can check the status.

      Once it is approved, then you are good to go for stamping and then fly to US.

      Please post back the receipt number.

  16. Non AD/ RP.. Got selected in lottery.. BTW can anyone change their employer when the lottery has been selected with a different employer? or do we need to be stamped first and within US to doa Hib transfer?

    • Not required to be IN US.

      Not sure about stamping, i guess you should go for stamping at least.

      After that you can transfer to new employer and they will H1b again with CAP-EXEMPT (no lottery)

    WAC(California) center is done with receipts updating/generating for H1B cap guys.

    Yesterday only 4 receipts generated(AD/NON-AD/RP) related to the cap, remaining all are cap exempt.

    Sit Tight, all are on the way if any one waiting(including me).

    May 2nd week on wards prepare for the worst.

  20. Guys, that make sense. Think that 175.000 have applied to 85.000 visas, that means they will be more people without it than with the visa. Good luck next time to all, I hope the americans will change such a crazy system.
