Flash News Update  : 

  • May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
  • April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?

USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.

What would be the Cap count for H1B Visa 2015 quota ?

No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.

  • Regular H1B Quota : 65,000
  • Masters H1B Quota : 20,000
  • It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

Would there be lottery for H1B Visa 2015 ?

How soon should I start planning for H1B Visa 2015 ?

[ Updated : H1B Sesaon is over for FY 15, plan for next year FY 2016 ] Well, there is nothing like too early… Getting a good H1B Sponsor can be a challenge these days. You need to find a job that fits your profile and find a sponsor that has a job for you.  Some employers want to test out the capabilities of the candidate before they plan to sponsor H1B Visa. Typically, they would like students with masters from US work for them on internship or co-op.  If they like the candidate then they will sponsor H1B visa.  If you are planning to land in US from overseas countries like India, it could be even challenging to find a good sponsor. Maybe you would need to work with global IT services companies and make your way up. It can involve lot of internal process to get the process initiated… You are never early…. How do I find Sponsors for H1B visa 2015 ?

This is probably the most asked question.  It can be a challenge to find a good sponsor. We have written quite a few articles on this topic. What would be the H1B Filing fee for Fiscal year 2015 ? 

There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014.  The  H1B Visa 2015 filing fee can range anywhere from  $1,575 to $4,325  based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet.  But, lets say, if it gets passed, the below changes may happen.

  • Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
  • The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
  • H1B Visa fees can up to USD $10,000.
  • More stringent rules on H1B visa adjudication.
  • Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

  6. I don’t understand why people in India are feeling frustrated when they are not picked in lottery….their life job everything will be normal without H1.. we sacrificed many things by living in US and finally our fate is left to a lottery system….

    • @Kumar,,, there are lot many among us who has a strong desire to get a job in US be it for earning sake or something else. In my case itself I scored 1470 in GRE in 2003 (Specialization in Industrial & Production Engineering). I would have got placed in one of the best universities with that score considering the less demand for my B.Tech specialization. But as my family had gone through some financial crunches due to heavy loss in business, I had to stay back in India. But my dream to work in USA was still on. After gaining good amount of real time experience in India for all these years, my employer chosen me for H1b this year and luckily it got picked. It took 11 years for me to chase my dream. Had I moved to US then itself wayback in 2003, my life would have been even more better.

      ** I am not against AD guys as I am very well aware that you guys struggle much to complete education relying on Loan But wanted to convey that there are other aspirants as well like me still sitting around in India, day dreaming about a job in USA.

      • Bijju I like your comment and concerns about other AD people, at least you understand the frustration instead of blaming us. Some people are very rude and heart less they don’t have any concern on us and they are just saying that we don’t plan any other things other than H1 B. I hope you get through this lottery. Good luck…. I respect Indians like you but not like others who talk like hell about others with out knowing any thing about their tedious affords behind their degrees and careers..

        • Thanks buddy.. I understand your pain in getting through all this. If I am correct, I have been noticing one guy with name “AD/PP/CA” posting updates since apr 10th. I guess it was you.

          My Friend, Current stats looks like doors are almost closed for PP guys but we never know what happens until you get your package back. Yesterday, one guy posted a Vermont Receipt # which is very cornered case though. I don’t remember the # exactly but may be u can search through yesterday’s posts with message goes like this “I pity this guy EAC******”. When I verified the case, it showed as rejected due “Incorrect Amount filed towards petition and package sent back”.

          We may expect these kinds of specific rejections after lottery result and the count could be in few hundreds at least. So, to fill these gaps, I heard like USCIS retain some petitions as a backup to be replaced just in case needed. USCIS will notify on these backed up petitions at the very later stage irrespective of premium/regular I guess. So, if your’s is not picked yet, u still have a ray of hope.

          *** Last but not least…. If nothing goes in your way, India is still a hot place for techies like you… I am sure you can get placed in any big IT giants sooner…get L1 Visa stamped and come back…. Cheers****

    • just wanted to tell my story….i am already on H1 (US Masters and I140 approved, waiting for priority date to be current).

      My wife did her masters in CS from UK, moved here just for me, and she has received multiple offers….applied for H1 with a reputable employer and awaiting lottery results now, obviously my wife is tired of sitting at home on H4 visa!!

      Just wanted to share my story because not all NON AD folks are people in india from TCS INFY etc…we have decided to leave the country if we don’t get thru lottery this year….because there is no guarantee next year either!

  8. What do you mean by wait-list. I think it is all over for AD/PP. No more hopes, even for the next year. Next year also the situation will be the same. They won’t even give the preference to the applications that didn’t pick up in the lottery this year. This lottery thing even for AD candidates make me to hate this system forever. What is the point of bringing new people out of countries when many qualified candidates are waiting here. Those who applied under non AD out of countries don’t need to get frustration because your frustration count 0.00001 % when compared to AD (MS/MD/Ph.D from top universities from US) people whose fate and talent left to lottery after so much putting so much afford to obtain above degrees. I really hate people who applied fake applications with out having any job, you guys definitely will suffer for what you did at some time point in your life. I apologize if it hurts any one but I just want to express my feelings with tears

      • @AD/PP/CA, I agree with you totally, I have MS, PHD and this H1 lottery is not fair. I know one guy who is outside the country, he is so tensed that his did not get picked “yet”, he said that he paid money to company B for his H1B and he is working in another company A, really funny.

      • That’s because everybody’s life is important. Just because u chose to study in an American university did not mean others who didn’t study in US should forego our chances. Stop complaining. You knew that you are going to be in this scenario where lottery is going to decide your fate. At least, by seeing what happened during last year, you should have known. So stop whining and look what is to be done. I agree it is so much frustrating. But we are humans and we need to know how to survive in any situation. If you were not ready for this, I would blame you and not the system. By the time they applied H1B for you, you should have prepared a plan B.

        • FO, I am talking on behalf of all AD people not just about me. Coming to plan B I have already my own plans. If I didn’t get through the lottery it doesn’t mean that I have to go back to my home country. Just imagine the people situation who invest lot of time and money in obtain their degrees. I think people who likes and enjoy this lottery are those from out of countries with a bachelor degree, I don’t think these people are smarter enough to get through exams and to get admission in to prestigious universities and they are just paying $4000 to buy a visa just like getting engineering seat or medical seat in INDIA.

  9. So I guess it is 100% over for us with NON-AD/PP/VT??? Does my life have to turn completely upside because of this shit. I have a good job, front office at a bank in New York, life starts to settle down, lives in Midtown Manhattan and just moved to a new apartment 4 months ago… I am starting to enjoy life after years of hard work and now this… Is this even dair

    • @FHH – If you are working for a bulge bracket, they should be able to transfer you to London or HK office without too much trouble. My company (large bulge bracket) transferred 50 people to London last year because of this H1B fiasco. No one terminated.

  13. Somebody please tell if there is still hope for Non AD/PP. Has someone got receipts for Non AD/PP yesterday or today?
    If they have started processing PP does it mean they are done with sending receipts, or they might still be simultaneously sending out receipts for PP.
    Please anyone having experience with this situation, please help.

  15. Question for all the people from IBM,CTS, TCS/Infosys applying for H1b from India.

    If you don’t get selected in the lottery, what happens to you? Does your company fire you?

    Just curious. Most AD people like me who can’t extend their OPT and work in companies which have operations only in the US get terminated.

    • Let me provide you two point of view which you seem to have not noticed before asking this question:

      1. Like you, everybody has their reason to be in US. To be frank, We all need money which is why we are all here. Please do not deny this. This is the fact. I know people personally who are from poor family and waiting for H1B, so that they can give better lives to their loved ones. They made it till here with their effort and I don’t think it is bad for them to look for more.

      2. Leave the Indian companies. Even American company like Accenture want to send people from India through H1B. If they really wanted people who are already in US, they wouldn’t go through so much hassle in bringing people from here(considering the cost involved in making them travel). I’m not saying you guys are not as good as people they bring in. Point is “It’s all Business” for those companies. You can blame them but after all this is a competitive market.

      My sincere advice is to not blame others for your situation. This is all a matter of survival for you. I agree. But I do not think H1B is not the only option. Surely there must be some other way. Accept the reality. Shi*ting and bi*ching others is not going to help. Convert this frustration into positive energy which will definitely take you higher in life. All the best!

      P.S. I failed lottery for the second time consecutively. I am not losing hope. I am just looking for alternatives. Cos even I have mouths to feed. Cheer up!!!

I completely understand what you guys must be going through( esp if you have huge education debts back home) I want to assure you all that it is not as bad as you think. Things do start to turn for the better as time goes ahead. It might be scary now but trust me it gets better !!! I was not selected in the lottery last year and for a weird reason my OPT ext was not approved. I had to come back to India on a 3 day notice (denial of OPT ext came 2 days before my grace period ended) It was scary at first but then with over a year of US work exp and a Masters degree, finding a new job was not very hard. My old company in the US contacted me and told me it is ready to file my H1b this year and by God’s grace I got selected this time. This is definitely an option one must consider if your company has development locations outside of the US. I personally know many of my friends who relocated to Canada and India after not being selected last year. I wish and sincerely hope all of you get selected and get good news sooner rather than later. But, on the off chance you do not, please dont lose hope. This is just the beginning of a new journey !!!”

        I agree with you. It’s hardly the end. It may seem tough, harsh, unbearable and even cruel at the present moment.

  16. Good morning AD folks!

    Another day…..another 10 hours of grueling wait………no receipt yet……..28 horrible days of my life……….applied under AD/PP/VT category.

    We can retain some hope until May 12. But it is high time to begin working on plan B (applying other visa) and C (move to home country or other country). My mind says that it’s all over for those (w/o receipts) who applied under AD category but my heart (desire) says that we still have have some hope (may be we will get a receipt by postal mail or may be we are in wait-list). I also read somewhere that the mind could be smarter than the heart (desire).

    Let’s see how many AD/PP and AD/RP are still waiting here. Thanks.

    • At this point I have started doubting my lawyer. May be he never sent my package. There is one thing I want to ask that all Ad which are left, which field do they belong to? Mine is pharmacology.

      • there are people on the market they just collect money from 500 people and submit 100 applications and convey the other 400 nicely “you not picked in lottery”. they pretend more obidient and says we will refund your money but substract the attorney fee 500$.

      • Mueller, if you don’t mind me asking, are you applying for GC from F-1 status? I’m currently on my OPT, and was under the impression that you can’t apply for GC on F-1. Appreciate your response!

        • Right now I am on F-1 (OPT), so I am assuming that my attorney will be filing under F-1.

          However, keep in mind that the first 2 steps of GC process actually does not involve you or your visa status. It is exclusively filed by your employer as a petition for FUTURE employment:

          1. Employer needs to prove that they cannot find a similarly qualified U.S. worker to Labor Dept.
          2. Employer submits the form I-140 (Immigrant Petition for Alien Worker) to USCIS.

          You, as the FUTURE employee, don’t really come into the picture until Step 3: When your priority date becomes current, you apply to adjust your status to PR. You can do this while in the U.S., or living abroad, and you don’t even have to be working for the employer at the time.

          • Bangladeshi citizen born in the UAE. I have master’s degree, so that should place me in EB2, although my OPT expires in June so I don’t know if I have sufficient time.. Thanks again!

          • @fingerscrossed – does your company have any foreign office? If so, transfer abroad ASAP. At the same time, ask your manager/HR to initiate GC LCA process (3-6 months).

            I think you are in a good position, because your priority date should be current for EB2. Therefore, the whole process should not take more than 12-18 months.

            Also, you do not have be to working in the U.S. in order to process GC. You could work anywhere in the world, as long as your employer is willing to petition.

            My lawyer has not yet received my package and she was very irresponsible in sending me a reject email without an attachment on Friday. I literally had to call her several times and get the matter escalated to know whether she actually got the package. This is really frustrating ( She didn’t but she assumed tht she could send me that reject email. Waiting to sue her sometime soon ;))

            Anyways, as of now, I am trying to set up a meeting with her to know if I can get my GC filing done.

            Mueller, since you have got the process started already, would you know when can you start working if your GC is filed? Since I am from India and I don’t have a current processing date for EB2, I am wondering if I should even consider this path.

            Another plan is to ask the company to do intracompany transfer to Canada/London and then come back to US occasionally on B1 visa. So, next year I can apply for both L1 and H1B. I was kind of unhappy that after pursuing my degree in a non STEM category and getting a decent job (worked my a$$ off), I need to start from scratch again. But guess this is life – toss of a coin. Seriously wish, I should have resisted the urge to lease a new apartment for a year!! Thinking optimistically doesn’t always help 😉 Now to hoping that some magic happens and all this passes ASAP. I just want my peace that I got after working so hard. As of now, back to working on my plans.

            This forum has been really great and helpful in tracking what everyone else is doing. Take care everyone and all the best to those waiting! Oh and I really enjoyed reading the post that someone posted saying that they got like 2 visas and couldn’t get all the 5 that they applied for. Although cruel, I guess that guy’s post and the comments that followed made my day.

          • @S/AD/PP/VT – you can work in the U.S. at any point in your GC process as long as you have a valid work permit (H1, L1, TN, OPT, etc.). The GC process is not connected to your current or future work authorization status. However, just by filing the LCA or I-140 does not grant you the right to enter the U.S. You can only do so when your priority is current and ready to adjust status.

            I think your best bet would be to work for your company in a foreign office. After 1 or 2 years, you will have the option to reapply for the H1B or transfer back to the U.S. via L1 (with no cap/lottery). At the same time, your employer can start petitioning for your GC at anytime, whether or not you are working in the U.S.

            GC and H1B/Work Visa status are two separate issues. They can be done concurrently.

            Thanks for responding. That is what I was wondering. So, I cannot work even if I-140 is processed as I won’t have any other work visa. Ugh! Got it!

            What happens if I go to a different country and my company files for a EB1 to get me back? Will that work? Since that is in current processing, I should then be able to get back and work I assume?

          • Even if your company files for EB1, it may still take 12 months or more of processing LCA, and I-140, before going to the consular interview.

            Also, keep in mind that EB1 is reviewed under extreme scrutiny. You have to show significant achievements in your field and/or reach a high level of management experience within your company (usually backed by years of experience working as a executive-level director/vice president/president). Even if you do possess those titles and work experience, they have to be well-documented and recognized with international acclaim. You also need to have been employed, during the last 3 years, for at least one year outside of the US in a managerial position in the same company that is going to employ them in the US or in a related company.

            If you possess that background, EB1 may work. As you can see, the requirements are extensive for EB1, and that is why the priority date is current (very few applications).

            Like I said, the most realistic option is to work abroad for 1 year, come back as L1 (much easier and faster than H1B). At the same time, ask your company to file GC under EB2 or EB3.

            Thanks for responding. I am trying to see what my company can do in terms of filing an EB1. They definitely cannot do it this year. But next year may be a possibility as by then I would have worked outside US for a year. And if not, L1 and EB2 is much better than going through H1b process again.
            P.S – still waiting to hear back on my application status.

      • its epic when people ask ANY ONE FROM SO AND SO COMPANY? and then hundreds of people raise their hands. I mean seriously? How many H1 are each company filing? Its like whole other set of lottery is been carried in that companies… my employer is only filing for me. What is going on with these companies?????????????????????????????????????????????????????

    • AM waiting as well … my employer asked me to wait until next weekend … hopefully we all get our receipts … but yes we all should start working on PlanB,C,D whichever suits one for the best … This is ridiculous I see people commenting about that they have not received their receipts for Non-AD while sitting in India working for their current employer (what max could happen if they dont get the receipt this year, they will have to wait until next year) but in our cases we will lose our jobs which was very difficult to get one right out of the school …. BTW I am Indian so even I am suffering 🙁

  17. Praise the Lord. Finally all my family prayers worked out for me this year.

    Last year I missed the lottery and pushed the year very hard competing all my career challenges, now it all ended. Hurrah!!! I’m selected in lottery this year under regular and non advanced degree for California.

    I will pray for everyone in this forum to receive the same.

    I applied for a L to H conversion for myself and my wife. My HR send the receipt number for my wife’s conversion from L2 to H4 and her receipt # is EAC14143*****. Does that mean that i am selected in the lottery for the conversion from L1-Blanket to H1-b?

    I got my receipt number today. Mine is non ad/ regular & for vermont center.
