- May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.

When will H1B Visa 2015 Season Begin ?
USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.
What would be the Cap count for H1B Visa 2015 quota ?
No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.

What would be the H1B Filing fee for Fiscal year 2015 ?
There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014. The H1B Visa 2015 filing fee can range anywhere from $1,575 to $4,325 based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet. But, lets say, if it gets passed, the below changes may happen.
- Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
- The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
- H1B Visa fees can up to USD $10,000.
- More stringent rules on H1B visa adjudication.
- Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

On April 10, 2014, USCIS completed a computer-generated random selection process, or lottery, to select enough petitions to meet the 65,000 general-category cap and 20,000 cap under the advanced degree exemption. For cap-subject petitions not randomly selected, USCIS will reject and return the petition with filing fees, unless it is found to be a duplicate filing.
The agency conducted the selection process for the advanced degree exemption first. All advanced degree petitions not selected then became part of the random selection process for the 65,000 limit.

USCIS will continue to accept and process petitions that are otherwise exempt from the cap. Petitions filed on behalf of current H-1B workers who have been counted previously against the cap will not be counted towards the congressionally mandated FY 2015 H-1B cap. Extend the amount of time a current H-1B worker may remain in the United States;
Change the terms of employment for current H-1B workers;
Allow current H-1B workers to change employers; and
Allow current H-1B workers to work concurrently in a second H-1B position.
U.S. businesses use the H-1B program to employ foreign workers in occupations that require highly specialized knowledge in fields such as science, engineering, and computer programming

I had some of my friends call their International Students Office at their Universities and ask them if there is any change in their SEVIS. If there is a change (something like waiting for review or something), it means they made it in the lottery. This happened even before the receipt number was received.

Uscis released the total number of application. Its 172500 and also completed the lottery process.

Yes. Regular Processing receipts will only be processed after all Premium Cases have been notified (end of April at the earliest).
Regular receipts will also be sent via regular mail, instead of email used for premium processing. Sometimes, that could take anywhere between 2-3 weeks to 2 or 3 months (some people from last year did not receive notification until June/July)…
If not just to show the value for $1225 paid for PP, what does it cost USCIS to just email the receipt number for regular as well as and when they decide?

In the Third World it takes days, maybe weeks, to count ballots – witness the Afghan elections – something advanced democracies can do in a matter of hours for nationwide contests.
This is not to put down Afghan election officials who, after all, have not had much practice.
But it does remind me that sometimes U.S. Citizenship and Immigration Services (USCIS) seems like a Third World institution.
The opening-and-closing day for the filing of H-1B petitions was on April 1, just as election days in most of the world are one-day-only affairs. A few hours after the polls close in the First World the voters know who won, and how many votes were cast for each candidate, with some minor variables usually worked out later.
But USCIS, according to Computerworld, a full week after the H-1B filing day was still “unable to give a final tally because it was still counting” the petitions. USCIS could only say that more than 85,000 applications had been received (that’s the statutory ceiling).
Now, counting ballots is a bit more complex than counting H-1B applications. With the ballots you have to figure out how many votes each candidate received. And usually there are several offices at stake.
With H-1B applications, all you have to do is to enumerate them. Further, there are only two precincts, if you will – the USCIS regional service centers in California and Vermont – not the thousands involved in national elections.
If USCIS is not capable of meeting the meager challenge of simply counting the number of documents it gets in a single day – in this case something on the order of 100,000 or so – how can it possibly manage decision-making for millions of illegal aliens, many with questionable documentation?
That would be its challenge were we to experience a massive amnesty, as proposed by the administration and passed by the Senate.
Maybe USCIS should seek technical assistance from those Afghan election officials.
We will conduct the lottery next Wednesday and will start notifications on Thursday.
We will also make sure to automatically reject any petition with “Article found on Web”

Its not the matter of their ability in counting the petitions. Its their style!! They clearly know that, no applicant/company can pick even a single hair for the planned delay that they are doing.
They put sharp 5 days timeline for intake of petitions and in the case of any postal delay, they expect explanation from candidates. But they don’t follow any timelines.
But one thing, if we do web analytics for USCIS site this month, the hit count will definitely cross the facebook n twitter hits 🙂 🙂

I have one question for you. My employer applied for H1B for me last year but unfortunately that was not picked up in lottery. This year also they applied for me. So my question is that if they can reuse LCA approved for me last year or do they need to file fresh LCA for me this year too. If yes, which site can give that data?

They would have most likely filed a new LCA for 3 years starting 1-Oct-2014 and got it approved from DoL and then attached the approved LCA in your H1B petition before sending it to USCIS.

If the employer has timely filed the H-1 petition, then they would have included the LCA as well. Unless you have reason to NOT trust your employer, why bother about all this?

There are instances in the past where USCIS gave more than one announcements in a day . BTW the update regarding District names is an alert and not a news release . There are distinction between alerts and news releases that USCIS makes . even in 2008 where 163000 petitions filed there was an announcement after 2 days regarding the interim count . so something should come up today .
I guess they will announce on Monday. These americans they do not work on Fridays ! so I guess we can chill out till Monday.

This is most likely an extension request (cap-exempt) which are being processed all the time.
I am not sure how the lottery method work. I am just wondering if is there a specific quota that each company must get from the lottery result.
Assume first company files 300 H1B and another files 2 H1B applications, and they run a random lottery and all the first company applications are picked up. If this is the case, this is really unfair. They should have a smart algorithm to guarantee fairness.

I’ve been here over 8 years, finished my master and worked my butt off to get a job, now im working for defense engineering comp with multi-billion dollars in rev, if I dont have a slot in the cap and didnt win the lottery, I will have nothing to say! this country needs a Immigration reform badly.
This 85,000 cap BS has been there since 2004 and no one bothers to change, and apparently those Ph.Ds and Masters made for nothing, so stupid!

I came here on F1 for bachelor, got scholarship for master (still F1) and just graduated not long ago, got a job and now applying for H1B. Agree that it sounds unusual because 8 years is a long time but what else can I do? I dont have money to invest, I dont want to get a fake marriage. H1b is the ONLY way! I guess the regulations are fine but when companies like Infosys are able to apply for 15k visas, this problem pops up ! it is not just the Indians! Chinese have their own stuff going on ! I guess there should be a limit for all the companies.
There should be a limit by country, it’s ridiculous how many Indians are applying and clogging up the all the petitions.

nah man, I dont think you are clear about the regulations (with respect!). It doesnt matter how many H1Bs those companies can apply for. If all of those PhDs/Masters apply for Infosys or IBM… thats their choice, but thats wont be the case. The problem is the Lottery in which a well qualified Ph.D/experienced worker may have the same chance of getting H1B as a less qualified Bachelor. And the problems getting serious when that number of well qualified candidates getting bigger when the cap stays the same
Companies like Inforsys, IBM, Microsoft… are actually very smart because they are taking advantage of cheap but high skilled labors

I am in the same boat bro! Been here for 8 year, finished studying in USA and have been working since past year and a half for a federal insurance company as a Lead. I applied last year and didn’t get picked in lottery! I hope this time atleast I go through since I have so much time and money invested in this country and it’s time to get some returns!

I had applied for regular category but I graduated with Computer Science so had 29 months of OPT. Hence was able to file this year too.

I think it is very weird that it is April 10th and they do not even announce the number of applications they received ! In a country like USA that everything is almost computerized and has lots of resources it is kinda astonishing !
NSA can track my cellphone and find me without any difficulties but the immigration office is even unable to announce that number from labor certificates that they issued !
That’s exactly the point Mike. The experience was better 15 years back when I was waiting for my Bachelors degree entrance exam results. We were given the date when the results would be announced and we used just wait for the newspaper on that particular day. With the advent of technology, situation has become worser. Or is it just us?

Do you think USCIS doesn’t give preference to Google, Facebook, MS who hire the brightest of bright candidates from premier Indian institutes unlike the Indian services companies who send applications in thousands?
If Google/Facebook/MS seek 200-300 H1-Bs, then in such case USCIS must be giving preferences to them, because they are not sending unprecedented numbers of applications like TCS, Infy, Wipro and CTS does.

Last time google reported 90 h1b rejections out of 300 :).
Can you share the link? As far as I know Google mostly hires Masters/PHd students from US and the expected probability for masters students was close to 90% last year. Not sure where u are getting this info.
Given the random nature of lottery 33% rejection looks highly unlikely.

Why wait for this year.. anyways you are getting work option right with H4. If the announcement was made atleast a month before, a lot H4 applicants would have dropped off.

If all the people who apply for H1b is like you — don’t care about their own interests, only want nothing but a single chance to serve this great nation. I think the US folks would totally want to increase the cap — what a great idea.
You’re afraid that a US company spends thousands of dollars to bring some idiots into the country? Imho they should think about making the selection process smarter first instead of randomly picking guys. If you have a PhD, 10+ years experience and the ideal job to leverage that knowledge happens to be in a US company you wonder why someone’s just rolling the dice to decide whether you get in or not. Other countries with even higher restrictions have already processes in place allowing such candidates to get through.
Everyone refers to some “thousands of dollars” but really it’s not that much, comparing to the salaries in question. I would probably make it more expensive even, to filter out some additional people.
I agree about the selection process, although I don’t see how it can be done neatly. These are the jobs where having a university paper and being present at the office is not enough. First thing they really need is talented and bright people. Experience and diplomas are secondary.
It doesn’t have to be perfect – anything is better than random. I applied for an Australian visa in the past where you get points for age, language, work xp, degree, etc. That of course won’t guarantee that the applicant will invent the next big thing. Hiring guys from overseas is risky: if it turns out you hired the wrong guy you wasted a couple of months time and money on visa/relocation etc.
Regarding the university paper: a technical PhD is (at least in my country) a little bit more than that 😉
All those who submit $1250 check for premium processing, Keep an eye on your account if you notice your check is chased. Its clear indication that you are selected in lottery. This is the canadian immigration services website. They give you lots of details to visit, work and also get PR in Canada. Getting settles in Canada is pretty easy compared to US. You can also go through any of the Canadian govt. approved consultants in India. There are atleast 50.

Extend the amount of time a current H-1B worker may remain in the United States;
Change the terms of employment for current H-1B workers;
Allow current H-1B workers to change employers; and
Allow current H-1B workers to work concurrently in a second H-1B position.

Concurrent H-1 is allowed. This means you can work part-time on another H-1 while working on one H-1 petition.

Master’s quota itself is not yet finalized, how come your room mate can receive the receipt # today. If at all he has received the receipt, then it should be cap exempt filing. Those who have applied for regular 2015 cap, will have to wait for another 3-4 weeks to get any updates.
USCIS will not do lottery for non masters so soon. They will do it once they have completed Master’s quota.

Guys, calm down and read the guy’s original post. His friend works for Cisco, so he may or may not be Cap Exempt. Most likely, his friend is cap exempt (probably he has already applied to H-1B sometime in the last 6 years and this is his second petition).
Also, keep in mind that USCIS still hasn’t made the official announcement on total number of applications, so it’s highly unlikely that they are already sending out receipt numbers.
The official announcement can be tracked on USCIS website under “News” section, which will probably come out sometime today (April 9) or tomorrow (April 10). Good luck to everyone 🙂

my sponsor sent me LCA (certified)… there is no employee name in that and also said that my petition filed on 1st April.
Last year, I missed in lottery (if my sponsor filed my petition, they didn’t sent my any filing document except calls over phone and my package returned in may’13).

There is no way to know this for sure unless you hear back your lottery result. At that point, you will either receive the receipt number (if selected) or a rejection letter (if not selected). Until then you will have to trust your employer.

I had the same doubt too as my LCA doesn’t have my name either….
LCA is not requested on any individual name, but for a specific specialized position in a company. It will only have the classification of job i.e. designation, employer’s details, location of work, prevailing wages, employer point of contact, attorney details etc.
While filing H1-B petition, an addendum is attached with the application to use the LCA in the beneficiary’s name.
Those who have concerns whether their application has been sent to USCIS or not, please ask your employer/attorney the FedEx/UPS tracking number. Also, the attorney can provide you the complete application’s copy because they have to send a duplicate of it along with the original as a requirement from USCIS in case the application goes into RFE.
As per my sponsor, many petitions filed whos LCA got certified. few LCAs denied as well.
I got one LCA… and I trust, it belongs to me only :)… as i don’t see any reason for my LCA denial ( 10+ yrs global IT exp.)…

Years of experience is not the criteria for LCA. It is labor condition application i.e. At the given time how is the labor market in the requested work location, mean the city. As I’ve already said, LCA is not issued on any persons name but for a specific job qualifying certain criteria.
Many companies use multi slot LCAs, i.e. they get LCA approved for specific numbers, when they want to use it, they send numbers of LCA again for certification back to DoL. But none will have any individual’s name.

Lottery wont be conducted immediately. it will take around couple of weeks for USCIS to conduct the lottery. First they will do it for the 20,000 masters applications, the applications which are not picked up in master category lottery will be included in the regular applications and 65000 will be picked up from these. Even if the lottery is done, you will not come to know if your application is been picked up or not on the same day. it might take anywhere between a day to a month

Do not hope for an instant lottery. It could take anything between 1 – 10 days, if past is taken into consideration. Below is the timeline for April 2007 lottery (where 150000 applications were received)

Yes, you can get Visa stamped anytime after your petition is approved, but the validity of the visa starts from the validity start date of your petition(will be oct 1st in most of the cases). You can enter the country at most 10 days before your visa start date.

In addition to what PC said, you can get your visa stamped at most 90 days prior to H-1 start date. So if your petition is approved w/ start date of Oct 1, then you can appear for stamping after July 1.

So there is no need to change the last name because its already same for her. DO we have to change the address and put my name in her passport ( right now its D/o so do have change it to W/o). It is not mandatory to change wife’s name/ address/ spouse name in passport for H4 stamping. You will require Marriage certificate in English.

I am on L1-B visa and have applied H1 B visa and didn’t received any receipt yet (I know it will take some time, if I get selected). My current project will be ended in July 2014 and I’ll be going to India July end.
If I go back to India, will my H1B visa get disapproved or only COS will get affected?
If my H1B visa get approved before July, so can I come back in October by getting my visa stamped from embassy?

If you leave US while H-1 is under process, then COS is abandoned. H-1 petition will continue to be processed and may get approved. You will have to get H-1 visa stamped and then return to work on H-1.

If someone’s L1 B is active until June 2015 and they have applied for to get it converted now to H1B… If selected in the Lottery and the processing is onway Since H1B gets active from October – 2014 , Can that person travel to India during Apr 14 – September 14 and be back in the States within October ?

H1B Visa 2015 lottery process. Duplicate filling is not allowed. Whereas in the H1B Visa 2014, this process was not implemented.

Also, they will keep 10K to 15K application in waiting list eventhough they are not picked in the lottory. If any applications are rejected in premium processing at the time of processing, waiting list people will get chance.

Duplicate filing has been prohibited since 2008. This is nothing new. Beside, only when same employer files multiple petitions for the same applicant, is it considered as duplicate. As this has been in effect for many years now, no employer does it.

Yes, every year they select few extra petitions to accomodate for the ones that will get withdrawn and denied. They deduce the number based on historical data and usually don’t publish the counts.

Whats the big deal about “currently being” in the US? Are they special in some way ?? “Being” in the US is not a factor in getting your application selected. Please keep your biases to yourself.
There is no big deal or special about “currently being” in the US, but yes, believe it or not it makes things more difficult for us more than it does for you! If you are already in US and lose your job because of this, it puts you in a very tight corner and doesn’t leave you with a lot of options. You lose your job, home, car and you go back to your home country where you have to start from scratch looking for a new job and everything. It’s like starting a new life. I have been in US for 5 years now and have never worked in India before, and I have well settled life here just like you have on other side of the world. Maybe it’s hard for you to understand what I am trying to explain here, it would only make sense to you if you were in my shoes.
Other thing – If you read carefully, I don’t think that the person you replied to has any kind of bias. All he/she was trying to say is that the people already in US may receive their receipts before people outside US do.

a. Nobody said anybody deserves more than other.
b. Even if they did mean to say that, what others say or think doesn’t affect your chances.
c. The person does have a point – while the upside is same for everyone (working a good job in the US), the downside is significantly higher (on average) for people who’re in the US because they’ll get displaced from their livelihood and home and will have to return to their home country to start searching for a job from scratch.
d. Also, consider the fact that a lot of people who are in the US and are applying for H1Bs probably are there because they went to US for higher education. Which means they’ve paid thousands of dollars to get an education, are already paying taxes to the US government and are decidedly more capable of contributing to the US economy (they’ve been operating in this economy already).
Bottom Line: Stay calm, stay positive! It’s an undesirable situation for all involved.

Guys… Be logical and try to understand that there were 124000 applications last year means approx 40k applications were rejected. I don’t see less than 80% of the applicants will give it another try so already 32k applicants going to be added with this year’s total. Hence it should be 32 k + last year application +/- 10%= 168000 – 144000
Oh yes please share more of your wisdom and correct calculations. Just shut up if you don’t know what you’re talking about.
