Flash News Update  : 

  • May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
  • April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?

USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.

What would be the Cap count for H1B Visa 2015 quota ?

No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.

  • Regular H1B Quota : 65,000
  • Masters H1B Quota : 20,000
  • It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

How soon should I start planning for H1B Visa 2015 ?

[ Updated : H1B Sesaon is over for FY 15, plan for next year FY 2016 ] Well, there is nothing like too early… Getting a good H1B Sponsor can be a challenge these days. You need to find a job that fits your profile and find a sponsor that has a job for you.  Some employers want to test out the capabilities of the candidate before they plan to sponsor H1B Visa. Typically, they would like students with masters from US work for them on internship or co-op.  If they like the candidate then they will sponsor H1B visa.  If you are planning to land in US from overseas countries like India, it could be even challenging to find a good sponsor. Maybe you would need to work with global IT services companies and make your way up. It can involve lot of internal process to get the process initiated… You are never early…. How do I find Sponsors for H1B visa 2015 ?

This is probably the most asked question.  It can be a challenge to find a good sponsor. We have written quite a few articles on this topic. What would be the H1B Filing fee for Fiscal year 2015 ? 

There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014.  The  H1B Visa 2015 filing fee can range anywhere from  $1,575 to $4,325  based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet.  But, lets say, if it gets passed, the below changes may happen.

  • Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
  • The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
  • H1B Visa fees can up to USD $10,000.
  • More stringent rules on H1B visa adjudication.
  • Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

  3. I still could not find my case status in the USCIS website since received date was 04/10/2014. Does anyone has the same issue? It is 15 days since the received date and I could not find my case status with the receipt no provided in the email. I filed from VT.

    Should I be worried?

    • I can’t track mine either. I have EAC receipt number with a notice date of April 16. I am now getting a little worried.
      Saurabh, have you heard of this issue in the past? Why are some cases trackable whereas others are not?

  4. Do ogle tree deakins give receipt number and scanned copy promptly? Attorney just said u r in but no scanned copy or receipt number…. No update from DSO.. How to be sure?

    • Give them 24 hours. They told me I got the receipt yesterday morning. But I got the scanned copy today morning.

  5. neither my lawyer not HR have received anything yet from the USCIS.
    I talked to my DSO and they say I was picked because my OPT is extended untul ext fiscal year along with a receipt number.
    In the mean time I checked with my employer asking if the check is cashed and apparently it has not been cashed yet.
    Can the check be cashed after some certain time? What are your comments on my situation? Im really desperate because I should have received at least something from USCIS so far!

    • you said you got receipt number from your school. So you can go to uscis site and check status if thats there then you are selected. Congrats!!!!

      • yeah I’ve got receipt number from my school and it shows in ‘Acceptance’ level. But the thing is we haven’t received anything yet and the check is not cashed yet and Im a hacking AD/PP/CA!!!

          • you got receipt number means you are selected it might take time for them to cash your check thats it 🙂

          • My lawyer says if we do not hear back from USCIS until April 28, 2014 then you might consider you are not selected!
            I don’t understand what she is trying to do other than stressing my heart out of me!
            I double checked with school and they say we see an extension and a receipt number along with it, they even sent a screen shot of their screen!

    I looked into the USCIS website on H1B status WAC-14-138-XXXXX and the output was “Request for Evidence”. Does it mean that I got selected in the lottery? I’m waiting the results of the lottery on Non-AD/RP/CA

    • Congrats! You get selected in Lottery but they issued the RFE against your case. You lawyer has to reply based on RFE.

    • Yes, it means that you got selected in the lottery but USCIS requires additional documents or correction in documents(if any). You/your employer will get a notice via snail mail, requesting the list of documents or the necessary correction. Till then your case will be on hold.

      BTW, Are you AD/PP or RQ/PP? Which center?

    Have patience. I know that I have made though lottery by getting check encashed. But I haven’t received my receipt yet. Receipts are gonna take long time to arrive, atleast have patience till 9th may.

  9. I have been following this site for updates and every time an AD-PP got receipt number I felt even I will get mine.
    Unfortunately I didn’t get it and I lost whatever little hopes I had cos its end of week and I dont see much happening from now to Monday. Check hasn’t been en-cashed nor is my sevis updated. So its time to accept the hard truth.

    This forum was very helpful and I know there are a bunch of AD-PP folks who keep commenting here and who are still waiting, there were a few lucky ones who got it even till last week, I want to say thank you to all you guys for sharing your thoughts and keeping everyone updated with whatever little information you all had.

    I will be joining a university which gives CPT straight away, cant afford to do full time masters again due to financial constraints. Will apply for H1 again in 2015 and hopefully luck favors me, even otherwise I will be better prepared to deal with it and go back home, I am totally unprepared to go back this time.

    I feel very bad for myself and all the other AD folks who did not get it.
    GRE, TOEFL, numerous applications to Uni’s , finally get an admit, then get an F1 visa, maintain a decent GPA , 90 day wait for OPT and then get a job and finally D-Day is April 1st, it all boils down to H1B.

    No regrets though, guess this makes us all tougher from within and I’m sure like me everyone else has realized while chalking down Plans B,C & D that opportunities galore back home and at various places around the world.

    For the eternal optimist, retain hopes till the package is returned.

    I still hope and pray that all of us get the receipt number, If not see you guys on redbus2us in the spring of 2015.

    • Good luck next year. I am returning back to my home country. Worst part is that I had a promotion waiting for me here in the US. It is sad that all this effort was in vane. I hope the US government change this archaic emigration policy for future generations in terms of fairness and control those that crack the system to increase they changes.

    • Very inspiring. There is no change in my sevis status and the checks are not.cashed yet either. I am not ready to give up either. How to find a university that will offer me CPT? Are there many? Please share what you learned so it will help my research?

      • The Universities I found which offer CPT straight away are
        Goldy Beacom University
        Sullivan University
        ITU – San Jose.

        Apart from these some of the certification courses offer CPT too, the ones that I found out are UCSC extensions and UCLA extensions, I guess even UCSD also has some extension program, I found these certification courses in which we can maintain F1 status and get a CPT (20 hours) only in the west coast. Didnt do much research abt uni’s in the east coast that have these extension courses.

            You cant go to community college and maintain F1. I tried this last year as it felts like easy and financially affordable, but its not the option.

            You have to find another extension program or go for another Masters or PhD, otherwise immigration people think that you just want to stay here and going back to education as we are already highly qualified.

      Last year I didn’t get approve and till now I managed with CPT, spent almost 12k to manage CPT … If I don’t get my H1 approve this time then I decided to go back my country.

Now that I know, I think I missed out on all the stress and still have some time to figure this out. How to research for universities that give cpt right away? My boss is working with the lawyer about what else can be done

  10. I’m NAD/PP/CA for a Big-4 tech company.

    I just spoke with the people from Fragomen and they said that since they haven’t been notified so far, it looks like the petition will be rejected. They can’t say for sure until they get the rejected package next week though.

    I kind of activated plan B and spoke with HR of my company. Right now we’re working on relocating to an international office for a year and try again next year.

    Seriously guys it’s not the end of the world, just a small stepback in the way. In 10 years you’ll laugh at this. Stay positive and keep working hard this year.

    • or you to say since you can relocate. My company doesn’t have foreign engineering offices yet so I’m out of luck here. And it’s one of the big names in silicon valley. But I guess that counts for nothing. My HR keeps repeating that I should wait until the package is returned for them to finalizing the options.

    • I have also started to talk to my HR. My company has an office at almost everywhere…but I don’t know how the relocation usually works. Do I keep working for my team here even if I am located at a different office? Do I receive US pay or local pay?

  12. Can we start any petition to ban companies like TCS, Infosys, CSC etc for applying the visa of a person if that person is not in USA or something like that.

    • To be honest, you really can’t, there might be some immigrants other than ICC, say you need a good chef from Mexico or Japan.
      Besides, you even can’t limit them by industries as it’s a demand problem. USCIS has increased the application fees this year, which, unfortunately, helps little as people from ICC might pay by themselves if they really want to be here. However, I don’t know why USCIS allows the duplicated applications from different employers. Probably it could help to keep the talents a huge group (say GOOG) really want to keep.
      I don’t think the policy is your concern, the congress knows how serious the problem is. Besides, it’s more clear that out-sourcing is not always better than in-house development, and some resumes are exaggerated too much. Companies get what they could pay for.

      I am lucky enough that my extended opt allows me to apply it again next year. If it fails again next year, I believe in the faith — my motherland recalls me.

  15. Got update from HR, 2 out of 6 guys are picked up and received their receipts for RQ/RP. Asked to wait until 1 month before loosing full hope… 🙁

    Any idea, if USCIS is done with sending all RQ/RP receipts already ?

    • Both stations are actively entering Reg. Processing petitions into system. I think some time in next week data entry process will be completed and then everyone who do not receive receipt can start calling USCIS for update or believe they are not selected.

  17. NOTE 1: I am an engineering graduate student who applied under AD/PP category.

    Company A:
    This company “A” is located in the US. This company spends thousands of dollars (recruiter/HR expense, interview cost (several candidates), relocation cost (selected person), etc.,) to recruit one person with a US Masters degree. This company trains this person for several months and then applies for a H1B. This person does not get H1B and the company is screwed now. The company will have this position “vacant” again and they have to begin the whole process again. Will this company hire another foreign national again ? May be they will hire someone and deal with him.
    NOTE: I know about this process quite well.

    Company B:
    This is a big IT company outside the US. They have thousands of employees. Lets say that they have 2000 people specialized in skill “XYZ”. They have several projects in the US that needs 400 people with skill “XYZ”. This company could very well apply for 1000 people knowing that only about 40% will be selected. The good thing for them is that the company B will get all their money back for the remaining 60% of their cases. No loss situation ! May be they will need to do some additional training for the some of the selected ones who are not in the top level/category. Spending some time/resource to give additional training is better than not getting required number of H1B slots.

    Company C:
    This is an IT consultant based in the US. They could get a client letter from an Organization “ORG” that states that they have a project for 10 people, if they get H1B. The company “C” could have about 20 people with the skill that “ORG” needs and they file for H1B visas knowing that at least 10 people will get a H1B. The good thing for them is that the IT consultant company “C” will get all their money back for the remaining 60% of their cases. No loss situation ! May be they will need to do some additional training for the some of the selected ones who are not in the top level/category.

    Company D:
    This is an IT consulatant company. This company “D” has many other companies in different names like “D1”, “D2”, “D3” and so on. This company “D” files for a H1B for 1 person using each company name. This person now has a very high chance of getting selected. It appears that people are using these horrible tactics (Mr. Siavash here said that he applied under 5 such companies to get a H1B).

    Summary:
    Companies like “A” have a very slim chance of getting a H1B.

    NOTE 2:
    I applied for a H1B through a engineering company based in the US (just like company “A”). I am not an attorney. I also don’t know much about these companies like “B”, “C” and “D”. BTW: If in case, they got more H1B then required, can they just cancel few approved H1B petitions later without any issues ? Correct me, if I am wrong. I am just asking these questions regarding possible scenarios. I hope that these scenarios don’t happen. Can such things happen ? Are these legal ? Any corrective actions taken by the USCIS ?

    • unfortunately all the ab0ve scenarios you explained are valid and happening as we speak every year 🙁

      and until now USCIS has not really taken strong steps to fix the issues even though its not fair to honest companies like company A.

      Reasons:
      1) Large IT companies in Company pool B lobby to keep laws favorable to them.
      2) Scammers like Company C and D are too small and hard to go after. There is a very fine line between company B and C,D apart from scale of operations…so its hard to catch the fraud at source.
      3) USCIS is in turn working hard during H1b approval process to verify client letter etc which Company B handles very well….companies C and D may have denials here due to lack of documentation.

      Summary:
      System is not 100% fair! We have to play the game under existing rules i.e play dirty or lose out to others who play dirty….good luck!

      • In order to stop duplicate filing, all that USCIS needs to do is conduct the random lottery on employee basis and not application basis. Then each one has the same chance. It is only a change in the internal working of the USCIS (there is not any law required).

        That will reduce the actual case numbers and improve chances. But not stop mass filing like company B. A change in the visa condition should be made that it has to be used in a period X.

        Unused visas will be added to the next year Cap. (Cap visa stays the same and all of the 85K visas are used).

        Those are mine suggestions.

      Also work for a type “A” company here. We are a multinational (top 3 tech company in silicon valley) but we are only allowed to file one petition per employee. It’s very distressing to some of colleagues who did not get selected because all of them worked very hard to get to their current position, all of them with master degree or above from top-10 U.S. universities (Ivy League, MIT, Duke, Caltech, Stanford…). However, there is only one petition per person.

      Fortunately, our company has always tried to accommodate those not selected in the lottery. HR and managers here do their best to relocate employees to foreign offices in the UK, Hong Kong, or EU so that no one loses their jobs. It’s very stressful, expensive, and a waste of resources but that’s how we are dealing with the situation.

      but true 🙁 and nothing can be or will be done about it..

      If they cant pass the immigration reform at-least , have a different cap for people already in US, and reduce burden on local companies and let people keep their jobs and homes (this will benefit the US companies)

      Increasing the total number of H1B applications or costs will not help..
      Every year these companies will apply for the same person multiple times as D1, D2, D3

      I know 2 people who got through H1b last year and are in India due to lack of projects.. Those two people destroyed the lives of 2 people here last year ..

    • Dont you think ur company A is playing dirty tricks by relocating u to international location?they will apply for ur h1B again next year , is this not increasing no of applications each year? so how does it matter if u r only allowed to fule only one petirion per person? Also note company B,C,D hold high risk if they r caught by uscis.and also they spend attorney fees…

  18. I think everyone under AD should get the receipt and only very less number applications applied by TCS, Infosys, CSC should get selected in lottery. This is utter crap that these companies apply visa for people who are in India and they don’t even know when they gonna get the project. #retards.

    • Infoys got finded millions of dollars to get people here on B1’s and L1s illegally so now they are going through the ‘legal route’. But yes, thanks to those HUGE corporations small companies don’t even get a chance. My company only had 2 applicatons, no one got it. Infocys will probably get thousdands..

  20. Does anyone know when will USCIS start returning non selected PP packets back to employers? Or have they started sending returns already! At this point that’s the only thing I can expect.. It’s perhaps too late for any other news. Just very very sad.. All hard work gone to waste! AD/PP not sure where!

    • USCIS has never released any information on the timing. So it can come anytime in May or even June. They will finish sending all the receipts first before sending back rejected packages.

      I know… ridiculous, irrational, inefficient process that’s just a reflection of the inefficiencies and lack of progress in Washington today…

    I am a non Advance Degree/Premium Processing/Texas Company H1B applicant and I was wondering if there is still hope for Premium Processing.

    My SEVIS status has not changed as of yesterday, as confirmed by the University international Education office.

  23. Just an advice:

    Check your SEVIS with school. If there is an update with pending H1B, you have been picked in the lottery. I asked my school this Tuesday and got to know this right away.

    Then call your HR or attorney to ask if they receive the notice.

    Here is my case, my attorney received the notice on this Monday. My HR received the notice on Thursday. Both of them did not tell me anything. Today, I asked my HR about my petition, she said she just got it yesterday. Then my CFO emailed my attorney, and the attorney emailed back with the receipt notice.

    • Hey, my schooled checked my Sevis status on Thursday and shows pending petition, gap cap extension filed…am not sure if that’s what you mean ‘be selected’? Haven’t got anything from my attorney not employer…

      It doesn’t matter whether you have OPT or not, If you are selected in lottery then there will definitely be change in SEVIS status.

      If you want then check with your School adviser. They will be able to help you out.

    • Yes, there is hope!!! I received my email (AD) just this afternoon (maybe about one hour ago). To be honest, not entirely sure if I was PP/RP but since I’m with Fragomen and they did other ppl at my job with PP, I’m assuming I was also PP. So please keep some hope alive (while still looking at alternate plans).

        • probably in this 20 days… I would have logged into the gmail server not sure how many times… Logout… login back after a few minutes to see if you have that one mail that you have been waiting….and I am still waiting and logging in and logging out as I type this… Killing …..we need to either know if its an yes or a no.. I had lost hope.. But someone rekindled that by saying they got the receipt and hour back for NON AD PP…..just trying share here as didnt know what else to do…………………..this was really imp for me… anywaz need to move on….But this has been a wonderful forum

  24. I email my attorney to ask about general status on how many people filed by the law firm received the number. No reply. My attorney is not providing service. I have to think how to talk with the employer now. Apparently, my employer doesn’t know anything about Quota and lottery issue. I am the only person they filed h1b for me this year. I just don’t know how to talk with them.

      • I asked on Monday. The check was not cashed at that time. The person who checks whether the check is cashed is the owner of the company. Don’t have gut to bother to ask again.

    • Just call your employer as they are the ones dealing with the Attorney.. You calling Attorney and trying to get info might not work…

      Talk to your employer and ask them if they have filed the H1 for you or not..Ask for the tracking # or any application # ( not sure if they would give it to you )…if they have filed your H1 then it would be premium or regular.. If it is premium and if you are selected by the lottery , they should have had a response by now….If regular, you might need to wait for anther 10 days ( business) to get a proper reply…
