Flash News Update  : 

  • May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
  • April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?

USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.

What would be the Cap count for H1B Visa 2015 quota ?

No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.

  • Regular H1B Quota : 65,000
  • Masters H1B Quota : 20,000
  • It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

How soon should I start planning for H1B Visa 2015 ?

[ Updated : H1B Sesaon is over for FY 15, plan for next year FY 2016 ] Well, there is nothing like too early… Getting a good H1B Sponsor can be a challenge these days. You need to find a job that fits your profile and find a sponsor that has a job for you.  Some employers want to test out the capabilities of the candidate before they plan to sponsor H1B Visa. Typically, they would like students with masters from US work for them on internship or co-op.  If they like the candidate then they will sponsor H1B visa.  If you are planning to land in US from overseas countries like India, it could be even challenging to find a good sponsor. Maybe you would need to work with global IT services companies and make your way up. It can involve lot of internal process to get the process initiated… You are never early…. How do I find Sponsors for H1B visa 2015 ?

This is probably the most asked question.  It can be a challenge to find a good sponsor. We have written quite a few articles on this topic. What would be the H1B Filing fee for Fiscal year 2015 ? 

There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014.  The  H1B Visa 2015 filing fee can range anywhere from  $1,575 to $4,325  based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet.  But, lets say, if it gets passed, the below changes may happen.

  • Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
  • The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
  • H1B Visa fees can up to USD $10,000.
  • More stringent rules on H1B visa adjudication.
  • Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

    • I have read some people receiving receipts already from Vermont for non AD/ Regular. I am in the same boat and still waiting. Even checked with my employer today and the checks haven’t even cleared yet. Not sure how much longer I can keep my hopes up. Initially, I thought everyone would at least have a receipt notice by April 28th, but maybe not……

      • well , according to my employer need to wait for 2 more weeks to know the status. Last year my friend got the receipt for regular on May 15. Cheques will be en-cashed few days before we get receipt number.

  3. I applied for a H1b under the Master’s quota and my wife as a dependent(H4). She got her receipt number (EAC-14138*****) yesterday via regular mail and I am yet to get mine. Does that mean my case was selected? My gut feeling is yes because my wife got her receipt and she is my dependent. I asked the same question to our lawyer, still waiting to hear back from him. Any help would be appreciated.

    I’m extremely emotional as I write this. After being hopeful for a long time I received my receipt email 20 minutes ago!!!!!!!!!!!!!!!!!!! My receipt number is EAC 141375****…I’m AD and believed that I was PP but not sure to be honest. Soooo my PP friends you CAN keep hope alive. and thanks to EVERYONE on this blog for your support, information and hope!!!

      • Agreed. It’s so annoying to read people freaking out and saying how SAD they are their receipts doesn’t show. Since days people have said that USCIS hasn’t started doing that yet, If I would have my receipt I would be out partying and being more than happy rather than whining over this forum where thousands are waiting and have not received one.

I am suspecting that the receipts issues for all PP applications selected under lottery did not have status update in USCIS site. so it means they will directly will process from 28th will get the final results like approval or RFE. If anyone disagrees, please show me a Vermont PP case numbers, who can track their status.

    All PP guys will get an final approval update at the max by May 20th.

  7. In my company 3-4 people out 50-55 people got receipt number from solicitor yesterday from CA center – Non AD/RQ/RP. Does anyone know if USCIS send the receipt number to lawyer at once or over the period of time given the same solicitor has filled all petitions on the same day. I want to know of if there are any chances left or i can safely assume that my petition is not selected. Thanks!

    • My company had filed for about 12 people, five of them got their receipt numbers yesterday and 3 of them got it today. So I guess you can wait and there is lot of time left for non-AD-RP.

  8. I started wondering how many applicants we would have if everybody just submitted one application!
    What’s wrong with you and your company and similar ones?
    I wonder what you really think coming here and asking this question while people with degrees such as PhD from MIT are still waiting!?!

      • problem is not just people applying under multiple employers….these run in a few thousands…

        the real problem is desi mega outsourcing companies like Infosys, TCS, Wipro, Syntel, CTS iGate etc…

        even if the H1 cap is at 200k/year these companies will find way to sneak in 25k applications every year….

        i wish there was a limit on H1 application per company

        What happens when one employee gets all 3 selected in lottery… He would finally pick and work only in one…

  9. Guys, I got my case number on Monday but it’s still not trackable – EAC-14-135-**** Non-AD/PP. I have seen other guys saying that they also have problems with tracking their numbers. Is there any update on that? is anyone still in the same boat?

    • Yes!thats true…in my case it happened so it looks like that.i got my Receipt number from DSO on monday but til wednesday i was not able to track it and i got call from Employer saying check was encased on wednesday and it started showing my status on wednesday afternoon.but till today we havent received my receipt.

    I’m under AD/RP….basically all my friends got their receipts. I checked with my school and they said no updates to my SEVIS status. I’m starting to lose hope. Anybody has suggestions for finding a school that issues CPT asap?

  12. Any one received with number EAC14137/6/5/4/3/2/1…..can track case now?
    Or find updates in SEVIS? Looks like all issued case from VT in last week cannot track in system until now
    I am guessing if they will wait until approved to update the failure in tracking information….
    Cause my OPT is going to expire in half a m0nth, I really wanna make sure it will be extended to Sep 30 after H1B….

  13. neither my lawyer nor the employer have received anything from the USCIS yet. I talked to my school DSO and they see a pending change of status on my SEVIS record with a receipt number.
    Then I decided to ask to my employer if the check has been cashed and it has not been cashed as of yesterday.
    So whats wrong? I’m feeling so depressed and down that I’m literally like a living zombie!

    • Same here. I got my receipt number from school DSO on SEVIS first. Don’t worry, I think your employer or lawyer will get the mailed copy soon.

    • Dont worry i was in same situation on Monday and my employer confirmed on wednesday that check was encased.but till today employer or lawyer hasnt received my receipt.
      But you are in so relax and plan for further and collect possible RFE what they can ask and you haven’t submitted in petition.

  14. Alright this is it. No more wait. What’s gonna happen is gonna happen. Waiting is not gonna change anything. I’ve lost my happiness for the past 2 weeks due to this and now am gonna take a break from this and start worrying if I get the petition back. AD/Regular/Vermont.

    I don’t want to raise false hopes, but I see most of the receipts received by my friends yesterday are dated on April 18th. It took 4-5 business days for them to receive. The latest numbers shows receipts are generated couple of days back too. so Regular folks, please wait till May 1st week.

    I’ve asked my attorney when can we expect rejection notice, he said by May mid week they’ll start sending rejections.

    • This is not todays. Today EAC1414452119. The date APRIL 10TH is the date when they did lottey and picked up the application .They are generating receipts for that application .

    • 10 April is the date when they conducted lottery so for all applications date will be 10th April …. 143 in the receipt number is the day when the receipt was generated ..

  18. This is horrible. 100% of my friends have received good news or have been advised by lawyers to move ahead with plan b. I think J-1 is my move.

    • If you want to go with J1, then how are you planning on what to do after the J1..All J1’s are subject to Two-year home residency law which states that upon completion of the J1, then the person should leave back to the home country for atleast two years and then can re-enter USA…Have you already thought about this?

    • I am waiting. It made me not be able to concentrate on anything. I will start to work in May using CPT. My employer asked me to move to the city to be convenient. They can’t wait for me to start to work. I am the only person in the company that they file h1b for me.

      Yes … You still have hope and dont lose it…. There is still time for you and probably , would suggest to wait for another week to 10 days ( Business Days)

      Even if there are about 40000 reg applications picked by lottery out of the complete lot, it needs to be sent by MAIL and not EMAIL… So its not an easy process… So dnt lose hope and enjoy your weekend.. You will get one next week…

      I don’t think (personal opinion that there is much hope left). Unless we are wait-listed (if such thing truly exists).

      • AD/PP here. Not really much chance. There may be a slim chance left but it’s best not to wait for it.

        I just called my school for a SEVIS update. They did not see any recent updates, and I take that as an indication that PP receipt is mostly completed.

        Time to move on 🙂

        • I agree with you. I am also under AD/PP/VT.

          We need to work on our backup plans from this weekend. It may take about a month or two to finalize and choose a different option. If we get H1B in the mean time, it is not going to hurt having 2 choices.

          I am going to relax this weekend. I have faced sufficient stress for the past 25 days. I did not file my taxes yet. I requested extension earlier. I will finish my taxes and then on Monday, I will work on my backup plan actively.

            1. Yes, get some rest. Much better use of your time than getting stressed over some stupid computer lottery. Both you and I know that our lives and our success are not and will not be defined by some random lottery. We define our own lives, through hard work, perseverance, our friends and family, our education, and our real effort. These are the things that truly matter.

            2. Do your taxes. Your will get a good refund 🙂 I did mine, and it felt good.

            3. Go out with friends, relax, and get a drink. Depending on your mood, I recommend Stella, Blue Moon, Franziskaner, Paulaner, or some Scotch Whiskey/Hennessy Cognac 🙂 Just don’t drink too much to hurt yourself.

            4. Plan to have immediate conversations with your HR and direct managers about next steps and what options are on the table. Usually there are more options that you realize. I just had my conversation with my manager and my attorney yesterday – they were both very supportive and asked if I wanted to do internal transfer or apply for another visa type.

          • Yes, that sounds good to me too. I’ve been so stressed everyday. Strained relationships with family and friends because I’ve been so tense. I’ve been negative for weeks now. Even before April 1 I knew there was such a small chance.

            I guess you are right and our life’s success doesn’t depend on a stupid visa. I’m just sad because it was my last option (I am non AD) and I have to go back home and will lose my job prospects. My friends are all here so I’m just upset that all this is decided by a lottery. Life isn’t fair, I learned that the hardest way through the visa process I must say.

    • Look at those people here who are waiting for their receipts. Because of you, many of others lost their opportunities and have to go home. You break the rule and fairness of the lottery. Shame on you!

      • There must be a process to disqualify people who have multiple applications based on their passport details, which will stay same in all their applications.

    • @Siavash – I very much agree with everyone’s opinion on here. You say it is legal to apply for more than one employer to submit different petitions for you. That is correct. However, it is NOT legal for an employer to KNOWINGLY submit petitions for the same applicant simply under the disguise of different subsidiaries. Read the Immigration and Nationality Act fine print carefully.

      At any point in the future, should the USCIS conduct an audit on your future immigration/H-1B extension/Green Card case, both you and your employer will get implicated.

      However, in the mean time, enjoy your time in America before USCIS’s future audit. Karma will bite.

      You have just ruined the lives of 4 other highly qualified applicants who have worked so hard to get their advanced degrees and real jobs here in America.

      You are the most stupid and idiot person i guess. think about other people, who have worked hard to get admission in any University at USA. He/She has to go through GRE, TOEFL and so many things, then worked hard to get a degree and finally finding a job in USA is the hardest one and then convince your employer to file for H1B . People like me who does not fall under STEM even don’t have OPT extension. This was the only chance for me. My Family back in my country wait every month for me to send money. I am sure there are lot of people here are like me . You just ruin their life. SHAME ON YOU!

    • I am writing an email to USCIS to address this issue. Friends on this site, if you want to stop the 1 guy 5 petitions situation, please send an email to USCIS and ask them to audit same name applications. If they receive many emails about the same issue, they can’t ignore.

    AD/RP/( I am in Chicago, so I do not know which location it is)

    WAC14138XXXXX.

    Notice date: April 17,2014

    I actually checked my SEVIS on this Tuesday from school. My adviser said my SEVIS got updated with pending H1B, then she mailed my extended I-20 on that day. I received my new I-20 yesterday. Then today, my HR told me my receipt notice also arrived yesterday.

    My receipt # from my adviser is the same with the official receipt notice.

  22. H1B Premium-Processing Cases

    The USCIS began issuing receipt notifications of H1B cases via eMail on April 11, 2014 for premium-processing cases. The electronic notices will be followed by physical notices, sent through the U.S. mail. The Murthy Law Firm received the first of these hard-copy receipt notices for premium-processing cases on April 14th. These undoubtedly will continue to arrive. The USCIS has indicated that processing under the premium-processing timelines of fifteen (15) calendar days will resume by April 28, 2014.

    Standard Processing H1B Cases

    The USCIS does not send electronic receipt notifications for cases filed using the standard filing option (as opposed to premium processing). For these cases, only hard copy notices are sent. The Murthy Law Firm began receiving such notices on April 21st from both the California Service Center (CSC) and the Vermont Service Center (VSC). These notices inevitably will continue to filter in through the end of April and, likely, into the month of May.

    Expect H1B Packages Not Selected in Lottery by May

    Once the receipting process is complete, the USCIS will begin to return the cases that were not selected in the lottery. As of this writing, the Murthy Law Firm has not received any returned H1B cases.

  24. I checked with my employer he says checks have not been encashed yet. Does that mean game over for me? Is there anyone who recieved a reciept but checks have not been encahsed yet?

    I just emailed my sponsor and attorney and asked them if they have got anything from USCIS. Then I got the answer in 10 minutes. No more guessing, no more anxiety. I am IN! So if you haven’t talked to your boss or attorney, I strongly recommended you to do so instead of refreshing this page every 2 minutes like I did since April 10th.

    For those who haven’t got receipts, remember, the GAME IS NOT OVER yet before you get reject notice. Be positive and have faith! For those who have got their receipts, the GAME JUST BEGINS. We still have long, long and long way to go before getting officially approved.

    I believe ALL of us are winners here, no matter you are luckily selected this time or not. After what we have accomplished to get to this H1B madness, we should be proud of ourselves. We are the best of the best!

  26. Hi Guys,

    I have not received receipt number till now I..e .. 24th April. when can be the last date for receiving email for the CAPs that are selected?

    And i heard about premium processing from 28th of April will there be any chance for those CAPs which are not selected will get receipt number this time.

    Please let me know your inputs will be helpful
