Flash News Update  : 

  • May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
  • April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?

USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.

What would be the Cap count for H1B Visa 2015 quota ?

No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.

  • Regular H1B Quota : 65,000
  • Masters H1B Quota : 20,000
  • It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

How soon should I start planning for H1B Visa 2015 ?

[ Updated : H1B Sesaon is over for FY 15, plan for next year FY 2016 ] Well, there is nothing like too early… Getting a good H1B Sponsor can be a challenge these days. You need to find a job that fits your profile and find a sponsor that has a job for you.  Some employers want to test out the capabilities of the candidate before they plan to sponsor H1B Visa. Typically, they would like students with masters from US work for them on internship or co-op.  If they like the candidate then they will sponsor H1B visa.  If you are planning to land in US from overseas countries like India, it could be even challenging to find a good sponsor. Maybe you would need to work with global IT services companies and make your way up. It can involve lot of internal process to get the process initiated… You are never early…. How do I find Sponsors for H1B visa 2015 ?

This is probably the most asked question.  It can be a challenge to find a good sponsor. We have written quite a few articles on this topic. What would be the H1B Filing fee for Fiscal year 2015 ? 

There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014.  The  H1B Visa 2015 filing fee can range anywhere from  $1,575 to $4,325  based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet.  But, lets say, if it gets passed, the below changes may happen.

  • Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
  • The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
  • H1B Visa fees can up to USD $10,000.
  • More stringent rules on H1B visa adjudication.
  • Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

  3. Is the mail vs e-mail for PP receipt a per-company decision ?

    I haven’t seen anywhere that USCIS must send the PP receipts by e-mail and the RP by mail though.

    This could bring some more hope for all the PP still waiting.

    On my side, I am trying to not keep the hope level too high, because it is killing me. Prefer spend time working on alternatives and plan B than waiting for randomness to knock at my door.

    • I don’t think this is per company. If you are PP then USCIS is prioritizing your case, i.e. you should find whether you got chosen in the lottery and whether your application got approved earlier than people in the regular batch. However, these decisions are usually communicated to your lawyers/company and they delay transmitting it to you.

    • I am not sure whether PP helps when you are not selected in the lottery. In that case you may wait for the rejection notice for as long as all the other applicants.

        • Thanks..mine is EAC 1413138 and me too not able to track.but M worried coz my number doesn’t match with statistic here on web.coz my receipt number looks like issued on 18th but got updated today on SEVIS web..so just confuse till i get something from employer or attorney.they told me before 20 min that even none of the cheque has been cashed till now…

    • I think non-AD applicants are not yet receiving their receipt numbers, so i believe you still have a chance…Keep your fingers crossed and hope for the best..Good luck 🙂

  7. Spoke to my university ISC and the SEVIS record showed a “Change Status Pending” and they gave me my receipt number.. Thanks to everybody in this forum and GOD.

    • Hi, how did you tell your university that you want to check you sevis status? I asked my university and they refused. They said they have policy against revealing SEVIS status.

      • Called them & gave my PID(Personal Identification number) and told them to see if they see any change in my SEVIS records, it would clearly show up as soon as they open it( “Change Status Pending” ) and they will be able to give you the receipt number…

        • Thanks! One question though, what is a PID? Is this a number every international student has? Or just your university’s ? Or just those who approved in H1B?
          I am trying to not sound like that I am probing my H1B status when I ask my university, since strange enough, they don’t allow us directly look up our SEVIS.

  8. Just spoke to my employer … As per them , they did receive the receipt in a mail not email for one of the guys yesterday … it was for PP- AD ( CA center)
    The cheque wasnt en-cashed but…. Later the next day the cheque got en-cashed… Lawyer has told them that until the packages are returned nothing can be said… Employer was like lets wait until weekend.. They are also about 2 AD PP folks along with me( NON AD PP ) for whom the reciepts are being awaited… Just thought will post this update, since there was not one for a long time …

    My application was not picked last year., This year Me and wife both applied to Vermont SC. My wife under AD/PP and myself AD/RP. My wife received the receipt, but I’m still waiting for my turn. Looks like people started receiving notices for AD/RP. Hope I will be lucky this week. Appreciate all for providing info., related your particular cases.

  13. My consultancy got 2 PP receipts today through mail (NOT EMAIL). So PP guys dont lose hopes…they are still coming…wait until 28th

    • So it is definitely that all PP receipts will be sent before 28th since they will start processing PPs on 28th. They won’t process along with sending receipts?

      I am AD/PP, no receipts so far….

      • Howard, you also might have a slight change after 28th. Many PP applications are coming in mail. So lets say you get selected on 25th (the last day) (26, 27 is a weekend), USPS will take few days to deliver the mail. Keep hopes!!!

      • USCIS never mentioned that they will start processing the PP on 28th April, they have mentioned “not later than April 28″….

        • The receipts should be send before the 28th for PP. Theres not any more picking going on. PP was first to be notified and the RP. All the people selected in lottery have been selected already. There is a slight chance USCIS will put some applicants on waiting list (not confirmed) in case other people get rejected or a duplicate filling is found at a later date. USCIS have been mailing receipts meaning, if the last day they send receipts is the 27th, then you could be notified in may sometime because of mailing times.

      PP -> Premium Processing
      RP -> Regular Processing
      VT -> Vermont Processing Center
      SEVIS -> Student and Exchange Visitor Program

        • No, you are wrong. What you are referring to is cap exempt category for advanced degree candidates. Cap-subject advanced degree candidates (that’s relevant here) need not be employed by public institutions.

    I applied as AD/RP/VT.

    I also talked to international office and they said my SEVIS was updated today. So I`ve got the receipt and the update on the same day.

      Look for above comment by PP.

      Some time it takes time to get notification, so just dont loose hope yet. I will suggest keep yourself positive until you receive application packet back from USCIS.

      Last year one of my friend got notification around April end for AD/PP.

    • @scared – I agree with the other posters. I also want recommend a strategy to help you cope with the wait: work on alternative plans. Trust me, at first I didn’t want to confront the situation, but it took a few days for me to realize that I should instead be devoting my energy to other plans. Now I am looking to transfer to my company’s international locations and/or get alternative visas (TN, L1, initiate PERM GC). And strangely, preparing for Plan B has helped me focus on something else other than the H-1B lottery non-sense. I feel even better and more focused now with a new purpose. The sooner you do this the sooner you’ll feel better.

      Btw, I am also AD/PP/VT still waiting. I know some others will not like my above comment, but I just want to share how I am dealing with this situation, and that there’s always a positive side to any bad situation.

      • Last year my lawyer made mistake in LCA and had to send the application again as first one was rejected, but by that time USCIS stopped accepting applications and gave over.

        I talked to my employer about this and we had details talk about what to do next. We looked for alternative option and now my employer is helping me with my education as well for couple of months of expenses, until I got my CPT.

        They have also suggested to go for Green card which I denied as I don’t wanted to go for that and also lawyer suggested it will be too early for me to apply for Green card.

        I will suggest who are waiting please concentrate your energy on alternate option instead of worring. And foremost don’t loose hope and stay positive until you receive your packet back.

  18. This wait is killing me.. RQ/RP/VT. How the lottery conducted by USCIS is a big question to me? Can someone clarify that.. Lets say California center received 132500 applications and Vermont received 40000 applications. Was that consolidated together and happened in the same place or it happened in California and Vermont separately with the received applications in each center…

    • i will give u simple example and you should be fine to understand this whole process:
      California center got 20 AD and 80 non AD application
      Vermont center got 30 AD and 70 non AD application.
      The day they stopped receiving applications they both sort out AD and Non AD.
      California center start putting numbers on application from AD
      They start as 1001,1002,1003…..1020(ex-if they have 20application)
      Vermont center start putting numbers from where California AD numbers finished 1021,1022,….1050(if they have 30 application)
      Now done for AD and one of them start putting numbers for non AD and where one center finished second starts.so if u assume after 1050 AD they started from vermont to put non AD they would have put numbers from 1051,1052….1120(if they have 70 for non AD)and than California 1121,1122….1200.
      So now they have numbers on all applications in this order AD–>Non AD
      1001 to 1200(total 200 applications )
      Draw for AD:-Now they generate draw for the numbers from 1001 to 1050 only and they selected random 20 numbers as (we assume 20 but they select 20000) and rest of the 30 numbers left as it is….
      Draw for Non AD:- now they generate draw from the numbers 1001 to 1200 except number who already got selected.
      So basically AD people get chance twice to get selected in lottery draw.
      And now they select 65 (65000)application from total 180 left(20 already they took for AD) and in this 65000 it is also possibility that all AD get selected or non of them get selected its just random lottery draw by a computer program.
      And now they have 20+65 application and they start processing in the order of Premium processing to regular processing application
      Hope this was a helpful to understand the process of lottery.

      • I was under an impression that h1B1 (for Chile, etc..) is also done in the count of 65000 and then RP receipts are sent. Happy to find myself wrong in this case :).

  19. Last year or this year? Bcoz I believe last year they were a little more random. This time they are faster and organized. I don’t think there are going to be any receipts after this week. Unless you lawyer is lousy in updating, it’s game over for AD-both pp and reg.

      What do you mean by denied? Did you get through the lottery but your application was not accepted for some reason? Did you figure out what was the cause of the denial?

  21. AD/RP or Non-Ad/RP should not panic! at least give a week and half time before you start thinking plan B. It took them week to finish all PP first in email and for RP it is in regular mail, plus sometime your attorney doesn’t update you asap. Also for SEVIS there is no straight forward way to tell, they are some cases which got selected and haven’t got it updated even though they have paper receipt.

    Best you can do is you can email your attorney and ask them !!!

    • assuming there were 26K AD applicants last year and 34k AD applicants this year, there should be 3000 who missed lottery last year..and out of that 3000 , only 1000 would have lost it this year too..and I guess we are in that 1000, out of the 60k..hard luck..( I applied last year through opt, this year with STEM, AD/PP/VT..i guess we are in that 1000)..and I am in Texas too, let me know what is plan B for you..

      • I did the exact same thing but we sure are an unlucky bunch. You know, for my Plan B, I am trying to wrap my head around this whole CPT idea. Being a drilling engineer and working in Permian Basin, the hottest oil play in the world right now, I think i am gonna go for broke. I am trying to find a school here in Texas to pull the trigger on this little deal once I hear the final word. Let me know brother if you know anything regarding this.

          • I have a Master’s in Petroleum Engineering which is a STEM degree. Drilling Engineering is a more specific role that you develop in the industry.

            I don’t know any particular colleges in TX. But I had to join a college last year for second masters and most of the schools I contacted (not sham universities) have a policy of giving CPT straight away as you already had a masters degree. I even contacted University of Chicago as I work in Chicago and they were ok with giving CPT too. I didn’t get into Uchicago with my credentials which is a different story but try contacting some local schools near you work. It is good to hear you are working in the same field that you did your masters. All the best.

      • @probability – same situation here. AD/PP/VT. Still waiting. My gut feeling is that it’s probably over for AD/PP for this year, but I will wait until April 28th just to confirm my suspicion.

        Right now, I am devoting all my energy to Plan B (transferring to an international office with my company and/or get TN or L1 visa). My manager and HR are very supportive so it’s not a very painful process, fortunately, and that I will get to keep my current job no matter where I go.

        If by some miracle I do get my receipt in the next few days, all the better 🙂

        • Pls do not worry!!!, there some dudes applied under AD where they had done masters in for-profit universities which will be outright rejected and the applications in waitlist (mostly AD) will be preferred, please do keep your hope alive!!!

    I have applied AD/PP/Vermont and haven’t heard anything back from my lawyers. My company also sponsored another person AD/PP/Vermont and he already got the receipt on April 14th.
    Does this mean I have already lost in the lottery? I saw many RP applicants have already received receipts. I am so worried.

    • I am in the exact situation. My friend from my company received her receipt last Monday (April 14) and I am still waiting. We are both AD/PP/VT. But I just read on the happyschools blog that 2 people (AD/PP) just received their receipts today so I’m gonna hold out some hope that I’ll get an email later today or tomorrow…

      • I am going to call my university to find out my SEVIS status, thought this indicator is not 100% reliable.

        I heard that for ones didn’t picked in lottery, the package will be send by flat mail. No email notice will be given. Is it true? If so, I think I can only know for sure until mid-May.

      • I am in the same boat too! My friend from my company has already received the receipt on the 16th! Can we still be hopeful of hearing back about the receipts?
        Does anyone have any idea how long it takes to receive the packet back if it doesn’t get picked? Assuming that’s the only way to know if the petition wasn’t been picked?

  24. Does anyone have any insight into Fragomen – do they apply PP or RP? I’m not sure if this is a company-specific choice or if in general Fragomen will put all their cases through as PP. I’m asking because I’m trying to get an idea of when I can still hold out hope. AD/VT….
    I asked them once for an update and they said they didn’t have any and to get back to them if I don’t hear back in 2 weeks so I don’t want to email again and ask if my case was PP/RP…

    • I’m with Fragomen and they applied with PP for my case but I honestly think it’s up to the employer.

      I emailed two reps last Friday and they didn’t even answer. I guess they don’t have any update.

        I’m also from a Big 4 so I was assuming that my case would be PP. So now I’m really a little more tense. Not sure why they are telling us to wait 2 more weeks tho…maybe to hear back if the case has been rejected or possibly waitlisted. Ah well, all I can do is wait and read this blog in the meanwhile:)

          • I’m not sure. At least for PwC they don’t as they are not ‘one firm’. I think you may have to apply independently…at least that was what I was told but yours could be different…

  25. Could anyone who received the receipt notice from the attorney or employer do us a favor? Could you check with your school to see if your SEVIS status has been updated with the receipt number? If the SEVIS status is tied to the result of lottery, we could call our schools to find out our results. Thanks.

    • Hi, If you see a receipt number in your SEVIS that means you are selected. I have not received anything from my employer or lawyer but my SEVIS is indicating a change of status application and the receipt number.

          • Yes ,H1B you are right 99%.because i have got same thing going on.my school informed me that my SEVIS updated today’s date on it and shows up with receipt number EAC 1413850***
            Even though i am not on OPT or CPT neither my I-20 is expiring soon.my I-20 is valid till november2014 and i am on F1 for second master on campus course.neither my employer nor my attorney received notice mail or neither cheque has been deposited till 4 pm today.but i think status change in SEVIS is a sign of picking up in lottery.
            I checked with my DSO and there was no change till friday and today it got changed to waiting change of status with receipt number .
            So hopefully it means i got picked up.

      Does your SEVIS reflect pending status? I have received mine yesterday (Receipt -AD/RP/CA) but my SEVIS is not updated. On Receipt do you see your Date of Birth? I don’t see my personal details except my name , employer name and attorney name.

  27. Here’s my situation:

    Out of 4 of us working at my employer, 3 people recieved their receipt notice on the exact same date and time. We have same positions, employer and lawyer. Since I haven’t got my receipt yet, does that mean its game over for me??
    I’m not optimistic at all.

    • I’m no expert but I think that you are fine. I say this because my friend (also at my company) told me that when she was in the lottery last year, they got their responses at different times (all from the same company). I think it just happened that they sent those three at a time but it doesn’t say anything about yours not being selected. Give it some more time.

    • sorry to say my fren…i was in the same senario last year. I was the only that didnt get it. All the other collegues got around the same time…maybe 1-2 days aparts….but mine never came. Rejection packet arrived on May 16th.
      Hope that wont be the case for you.

          • Last year or this year? Bcoz I believe last year they were a little more random. This time they are faster and organized. I don’t think there are going to be any receipts after this week. Unless you lawyer is lousy in updating, it’s game over for AD-both pp and reg.

  28. Congratulations to all that have been selected. Although I don’t see any comments from those that have not been selected. In other words, has anyone received the package with the checks back?

  30. Got my scanned receipt today.
    AD/RP/VERMONT, Notice date is April 17th.
    I do think the checking SEVIS status is effective!
