Flash News Update  : 

  • May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
  • April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?

USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.

What would be the Cap count for H1B Visa 2015 quota ?

No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.

  • Regular H1B Quota : 65,000
  • Masters H1B Quota : 20,000
  • It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

Would there be lottery for H1B Visa 2015 ?

How soon should I start planning for H1B Visa 2015 ?

[ Updated : H1B Sesaon is over for FY 15, plan for next year FY 2016 ] Well, there is nothing like too early… Getting a good H1B Sponsor can be a challenge these days. You need to find a job that fits your profile and find a sponsor that has a job for you.  Some employers want to test out the capabilities of the candidate before they plan to sponsor H1B Visa. Typically, they would like students with masters from US work for them on internship or co-op.  If they like the candidate then they will sponsor H1B visa.  If you are planning to land in US from overseas countries like India, it could be even challenging to find a good sponsor. Maybe you would need to work with global IT services companies and make your way up. It can involve lot of internal process to get the process initiated… You are never early…. How do I find Sponsors for H1B visa 2015 ?

This is probably the most asked question.  It can be a challenge to find a good sponsor. We have written quite a few articles on this topic. What would be the H1B Filing fee for Fiscal year 2015 ? 

There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014.  The  H1B Visa 2015 filing fee can range anywhere from  $1,575 to $4,325  based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet.  But, lets say, if it gets passed, the below changes may happen.

  • Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
  • The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
  • H1B Visa fees can up to USD $10,000.
  • More stringent rules on H1B visa adjudication.
  • Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

    Could someone please clarify my query?

    In 2012 April my previous employer filed a H1B petition for the year 2013. There is no lottery then. I have got the file number (not petition number) which i don’t have now. Then i quit the company in June 2012. I do not know what happened to my petition, whether it is approved or not. Now, it has been almost 3 years i’m planning to go back to my previous employer. In this case, assuming that the previous petition is withdrawn/approved, please let me know if my previous employer can still use previous petition to apply for a H1B visa under quota-exemption category? [ I read somewehere that the validity of a H1B petition is 6 years]

    • Hi,

      Yes, your employer can use the petition if it was in “approved” state then. The validity for applying under CAP Exempt would be 6 years from 1 Oct 2012, which is till 30 Sep 2018. All the best !

    • Ok remember this. Never use any abbrivations in interview. Ex. B.Tech, B.Sc. etc. Always say their complete forms. VO may not be aware of these abbrivations.
      So comming to your question, better tell him complete figure as per your documents. Hope this helps. All the best.!

    It’s my turn now to write my Visa stamping experience with Hyderabad Consulate. It’s been so exciting to wait for the time and it’s really went good beyond my expectations.

    *** 2-Nov: Bio-Metrics ***
    Bio-Metrics is so simple and it won’t consume much of your time. My slot is at 4pm on Sunday and I reached the OFC at 2.45pm. Security people allowed us into the queue at 3.45pm only and they asked me to enter OFC at 4pm after checking the Appointment Letter. Once in, Greeters will come to you and check the DS-160 confirmation page and Appointment Letter against our Passport. If everything is fine, they ask us to proceed further. If they find anything wrong in DS160, there is one unofficial guy sitting beside to the building to correct the DS-160. So, don’t get panic if something went wrong with your DS-160.

    Later to this check point, we’ll be allowed to another security check where someone sitting with a tab to ensure our slot and details. Then, we’ll be entered into a physical security area and followed by another point where our Passport get attached with a barcode for the purpose of PAI interview along with a seal on the DS-160.

    Now we can collect a token from another security guard just next to the door. I entered into a medium space hall where around 10 counters are there with fingerprints machines and cameras. Once we get our turn (TV will show & announce the token numbers), we need to proceed to the respective counters. Officer at the counter asked the below questions:

    Who is your employer?
    For how long you are going to stay in US?

    Then, officer captured my photo along with fingerprints. He then asked me to read a notice of regulations on the wall. Then, he asked me to leave and requested to provide the feedback in a tab located at the exit door. That’s it!

    Please make sure to have the below documents for OFC:

    Passport
    DS-160 Confirmation Page
    Interview appointment letter
    One Photograph

    *** 3-Nov: PAI ***
    A Big Day! My slot is at 11am and I reached Consulate at 9.40am. Security people allowed me into the queue directly. Before entrance/gate, there is one guy sitting with a tab and checking our slot details. Then we’re allowed into a waiting area. Greeters will assist us to move further to collect the interview token. Token would be affixed backside of the Passport. Then we need to go through a physical security keeping all our belongings in a tray.

    Once done, we can collect our items back and we need to proceed to the central waiting lobby. It’s a nice location with a good ambiance. A greeter came to me and verified my token and asked me to sit at a place. She has given US rights pamphlet as well. TVs around us show & announce the running token numbers. It took around 35 minutes to get my turn. There are 16 counters in three segments and 2-3 applicants are there in a queue at every counter. I got my chance, here is the conversation:

    Officer: Good Morning, Can I have your Passport?
    Me: Good Morning. I passed my passport along with I797.
    Officer: Who is your petitioner?
    Me: Answered appropriately
    Officer: Who is your Client?
    Me: Answered appropriately
    Officer: What your client do?
    Me: Answered appropriately
    Officer: What you do?
    Me: Answered appropriately
    Officer: Why you?
    Me: Answered appropriately
    Officer: How much you earn there?
    Me: Answered appropriately
    Officer: In which city you’ll be staying?
    Me: Answered appropriately
    Officer: Are you married?
    Me: Answered appropriately
    Office: Highest Education?
    Me: Answered appropriately
    Officer: Place your right hand fingers on the scanner.
    Me: Did accordingly.
    Officer: Do you’ve US rights pamphlet.?
    Me: Yes, I hold it and shown.
    Officer: That’s Nice. Please Go through.
    Me: Sure!
    Officer: “Your Visa is approved… Thanks and have a good stay in US.”
    Me: Thank you! Good Day!!

    Officer is so friendly and she is with a smile on her face while asking questions. So, just respond with a cool smile and give the answers for the questions in a simple manner. They’re taking not more than 3-4 minutes for an applicant, especially for H1B, it’s so fast. So, it’s a matter of friendly chat!!

    Just have all the documents and below are the documents that I carried:

    DS-160 (Sealed on the OFC day)

    I797B (If applicable)
    One Photo (Just for safety)

    If you’ve any additional documents with you, please have them in a transparent folder for easy access. Have the checklist so that you won’t miss anything on last minute. Have a professional dressing so that nothing looks like odd. I don’t have any dependents; there would be few more documents required for dependents which I’m unaware of. Please have a check list if you’ve dependents.

    Plan to reach the consulate bit early to avoid any tensions due to traffic or in any other manner. Smile and Confidence are the only weapons to get success.

    I have a very unique situation here, I had my H1 Approved back in May and got it stamped last month. But I am still in India because my employer is now unwilling to call me up and losing interest in the project he hired me for.
    Can you suggest any options to handle this ridiculous situation.

    • You could look out for any other employer from US who can bring you there and get you a job. Even i know there are consultancies who would bring you up there and provide you interview. If you are confident on your skill set, go ahead. If you have valid visa, it is just required a new LCA & petition approved.

    Petition approved by USCIS recently. Unfortunately USCIS has not announced any definite period to dispatch the approved petition.

    Any idea how much time it would usually take to get hard copy in india.

    I and my wife are being in US on L1 and L2 that still valid until end of 2015. My employer filed H1B for me this year and it has been just approved but it is not Change Of Status (COS) so I need to go for stamping to activate my new H1B.

    My question: can I go outside for stamping first and my wife is still in US on L2?

  13. My application is in RFE RR since Aug 18. No updates yet. Anybody got approval from RFE RR after sitting in RFE RR more than 60 days?

    • I am also in RFE RR since 3rd September , still no update. For last two months waiting for update , not sure how much more time will be needed. Getting tense as days are passing. Is anything to worry ? Whats the deadline for the application to be processed?Receipt number EAC1414853xxx..vermont centre.

  14. I am sort of an “initial review applicant”, here is my case
    AD/PP/VT
    EAC14136XXXXX, notice date april 16
    Got paper receipt in 3 days, but did not get any email though it is a PP case.
    Could not track online, and when my employer enquired with USCIS, they said that my case is stuck in security check
    Aug 27 – was finally able to track it online, and my case was in Acceptance stage
    Called USCIS, and they said mine is a PP case, and the 15 day clock started on Aug 27
    Even after 15 days, my case was still in acceptance stage. Called USCIS and they said that my case is still stuck in security check.
    Finally on Oct 27, thank god, it went directly from Acceptance to approved. No RFE or anything.
    Still haven’t got the hard copy of the approved petition. Waiting for it.
    So, initial review applicants – there is a chance that your petition too might be stuck in security check, and thats why it is just stuck in that stage without any RFE or anything, and you too might get a direct approval. Keep you hopes high.

      I tried calling USCIS and the representative at USCIS are not willing to talk to me since I am a beneficiary and said that they will only talk to employer or attorney. When I call employer , he just shrugs off and say its nothing in our hands. Its upto USCIS to process the case.

      Can you tell what is this security check? what exactly do USCIS check in this case?

      • USCIS won’t talk to you. My employer/attorney called and enquired.
        They can call and make a “service request” , and USCIS will send your employer/attorney a letter stating the current situation of your application.

    • Hey Poonam & kinda initial review applicant. Even I want to know about security check. Poonam I’m stuck in similar situation as yours with similar first five serial number. Can anyone please let us know what is security check and how long it takes for USCIS to process those cases? Thanks

      • It is a series of name check and finger print check by FBI and border protection customs. You can google it to find more about it. Pretty much every applicant has to go through it. Some unfortunate applicants like me just get stuck in it for wotsoever reason.
        Unfortunately, there is no such time constraint for them to complete the security check. But from past years statistics (which is solely based on my knowledge from different forums), they should complete the processing of all application by december or january the worst.

    • My H1B was also denied on 27th October. Please advise on the chances of getting approval after reappealing and the duration of processing?

      • If your petition is denied, you can appeal. The success is based on the reason for denial and how well attorney handles. But overall general success rate is 20%. The processing time is usually 6 months, but few cases even take up to 1.5yrs.

          • I am not sitting idle to just blabber. When I needed this info..I didn’t get it easily. After checking with many consultancies and attorney I got this info. I have also mentioned each case is different.

            Don’t be rude on public forum…if you are sure the info is wrong then post the correct info which you know instead of blaming others.

    my h1b is approved the company A and currently im working for company B in india.
    now company A is telling me to submit ds 160 form with current company as company B and filing company as company A.

    will this work when i go for stamping? as im directly joining company A in US.(company A is having branch in india).

    • yes, that’s fine, because approved H1B petition means you have a new job offer from company A in USA. as to work in USA you need a work permit so company A has applied for work visa (H1B) for you.
      If you see most of the big MNCs have their subsidiaries in USA and when they send ppl to USA on H1B they give new offer letter from their subsidiary company. That subsidiary company has its independent entity in USA as a company. just the owner company of that subsidiary happens to be the big MNC. you are good to go if you have all documents and answers for visa officers questions;

    Im hearing lots of rumours about new LCA rule. Can someone explain what exactly has changed.

    Im planning to apply for LCA change(change in client) this week after I got my visa stamped last week. Can someone advice if the new rule will have any impact on my LCA change. The duration for LCA change communicated to me was 10 working days, will it change as per new rule.

    • If your company follow all rules then LCA change requires amendment to H1B petition which is more or less same thing applying for a H1B extension. company prepares a new petition , new job role for you, new client etc etc just you happen to be a cap exempt now.
      Till now most companies don’t bother to file amendments just to change LCA but in last few years big MNCs have started to follow this practice which is in fact required by USA law. I guess your H1B holder is a big MNC.

        • if they said only ten working days that means they are just getting new LCA. and not filing amendment. as I mentioned in my previous response most of the companies dont bother to file amendment and just file for revised LCA. main reason is the process to file amendment is long and takes time. and has same risk of approval/denial/RFE as any other H1B extension petition.

          as you are with top 5 mnc and most of the time they have good legal team to advice you are in good hands.
          New LCA just takes from 5-10 working days and no complications in the process. you already have your visa stamped.
          One more advice : your H1B petition and Visa records has client A name but your new LCA is going to have new client B name. as such by rules it is a case of H1B amendment so act smart if any immigration officer inquires you about at port of entry. I hope your client A and client B both are in same location ( City). better be prepared with your answer. The most frequent question asked by immigration officer at port of entry is “what is your client name and where you are going to work”. you are from top mnc so just stay confident and act smart…god luck with your travel

I am with one of Big 5.Will travelling with just a new lca be a problem at port of entry? … as that seems to be the norm so far in the history.but this year attorneys are pushing for many amendments but thats just random. they want to file some amendments to show up numbers.

          • then you are good to go with just the LCA change. no issue for sure. and I hope your salary is more than that of mentioned in both the LCA ( old and new LCA). rule is H1B has to be paid salary more than the prevailing wages. anyway top5 mnc then they takes care of all these technicalities

    Vermont Service Center – 4.9 Month Effective as of: August 31, 2014.

    1)LCA having PLACE OF BIRTH different from passport(but same district)…which one to fill PLACE OF BIRTH in DS-160? is it really concern?
    2)”Home address” in LCA is India address but presently staying outside India..is it correct to fill “Home address” of India and “Mailing address” as foreign country address where presently staying?
    3)Are SSC, Intermediate education details are really required in DS-160, if so
    Do I need to mention college names instead of Board Names like Board of secondary education, Board of intermediate education?
    4) Do I need to mention Client address anywhere in DS-160 form if working at client place..according to LCA..or Just employer address is enough?

  30. My petition is still in RFE RR since 15 Sep. Not sure how many more days to wait. Is there a deadline to have all the petition for 2015 completed?

      • Im waiting from Aug 11th. RFE RR. Califotnia center.
        As per my lawyer this center is bit slow when compared with vermount.
        And told me that by this month end we can expect all approvals.
        Hope for the best.

          •  You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use the processing time information on our website to estimate when this case will be done.

            That is what site says regd the time line for RFE RR.

          • Yes, it says 60 days which is their estimated time but they didnt promise it will be exactly 60 days. I have seen pple getting H1B approved in December and January last year. We never know how long they will take 🙁 If it goes to December well it will again get delayed due to Christmas, Newyear holidays. Pple take long holidays during those time. All I could wish is we all should get our visa’s approved by this month end. Praise the Lord!

        • Finally got my petition approval mail today.. feeling very happy. . It’s been indeed very long journey for me. Failing in lottery last year and finally everything is for this good.. wish all of the folks waiting to get their updates soon..

          Approved per uscis site 19th Aug.
          But i am notified only today, Oct 28. Not sure where it’s delayed.

          • I dropped a mail to chennai visa center . They replied saying that “we wil update once we get response from uscis ,no need to follow up from ur end ” …:(

          • Finally my petition also got approved . but I have not got the petition number , they said as per rules “untill they receive the petition in hand , cannot disclose the receipt number” .

            I need to check when petition is approved and for how many years.

            Need to wait for some more time 🙁 to know these things.

          • Hi,
            I think you have dates from second – third week of November. Since your visa was approved on Aug 19th, your docs would have already reached TCS well in advance, and you might be able to book the slots asap.

            My only advice – carry an umbrella + transparent file to carry all the docs + a bottle of water(in case you need..its gonna take hell lot of time to get in)

            Try to book a slot which is very early in the day like 8 or 8:30 so that you don’t have to wait much .

            Don’t carry mobile phones + bags as its a headache to manage it with locker, and also carry very less stuffs in your wallet.

          • I Submitted RFE docs on Sept 7th . Take your account manager’s help and check the status with visa team , then only you will get to know the status . Otherwise wait for official mail ( they will send once after hard copy reached to Chennai)

          • Even I am also in same boat. I called local FDFU hey told me that from HYD 28 people are like that so wait for some more time but this time is sucking. Dropped several emails to cheenai fdfu but no use same response very time “Decision is pending with USCIS. You will be notified if we receive RFE or Denial or Approval from USCIS. No action required at this stage. ” So only thing we can do is WAIT.

    My petition is approved and i am planning to attend visa interview for me and my wife.
    My worry is , my wife also currently employed on same company, if she attend with me as dependent, It wont be a problem? Employed spouse is eligible for dependent visa, Pls pls suggest.

      • Thank u very much RMM. So, not required to resign her job, while attending the visa interview? we can convey to VO as, currently she is working, she will resign while going to US, am i correct? sorry little bit worried 🙂

        • You can say that, your wife is working here and has some professional commitments. She will join with you once her assignments gets completed.

          H4 stamping is a cakewalk., can be done very smoother.
          Her employment will not be a problem

        • You can mention that she will either resign or will be on long leave but better stick to resigning the job. I actually gave my resignation letter but still the VO questioned me if I will be working in US or interested to in the future. I replied “No” and got my visa 😀

    1)is it required to have client letter since i work at my employer location ?
    2)if VO ask for client letter how can i manager ?

      my h1b visa fees = 190 $
      my wife h4 visa fees = 190 $
      ————————————————-
      Total = 380 $ for both.

      One more question , I am employed and going to work for a diffrent employer in USA ,
      Would i be asked for current company resignation letter ? and if i say Not yet resigned how would i deal with situation at the time of interview ?
      Would i be asked ‘when you are planing to fly ‘ , as i have not made any plans yet ?
      would i be asked my itinery as well for flying to USA ?

      Sorry to Bother all , just want to be double sure 🙂 …..

        you have already answered this question while completing DS160. stick to same answer. if in DS160 you have mentioned specific travel plan then arrange for some itinerary its better.otherwise you are good.
        Resignation letter : Again it depends on what travel plan you have mentioned in DS160. if you have mentioned that you are planing to travel after 1 week of visa stamping then it is assumed that you have resigned from company by now. generally no visa officer asks for resignation letter but when he inquires on this topic u should sound strong and clear on this topic.

            I am tracking the few tens of random numbers (all WAC** ) as mine is too in wait exactly same situation as many of you… during everyday status check, i am finding 50:50 approved and denials. It looks like USCIS found a new way of squeezing the lil more amount, buying more time as well as asking so called necessary papers by encouraging to file the MTR process.. This is an excellent excuse for another RFE if you already have one.. so the crux of the matter is don’t loose hopes even if you got negative news. This may be hard to digest for many but seems a reality…
