Flash News Update  : 

  • May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
  • April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?

USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.

What would be the Cap count for H1B Visa 2015 quota ?

No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.

  • Regular H1B Quota : 65,000
  • Masters H1B Quota : 20,000
  • It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

Would there be lottery for H1B Visa 2015 ?

How soon should I start planning for H1B Visa 2015 ?

[ Updated : H1B Sesaon is over for FY 15, plan for next year FY 2016 ] Well, there is nothing like too early… Getting a good H1B Sponsor can be a challenge these days. You need to find a job that fits your profile and find a sponsor that has a job for you.  Some employers want to test out the capabilities of the candidate before they plan to sponsor H1B Visa. Typically, they would like students with masters from US work for them on internship or co-op.  If they like the candidate then they will sponsor H1B visa.  If you are planning to land in US from overseas countries like India, it could be even challenging to find a good sponsor. Maybe you would need to work with global IT services companies and make your way up. It can involve lot of internal process to get the process initiated… You are never early…. How do I find Sponsors for H1B visa 2015 ?

This is probably the most asked question.  It can be a challenge to find a good sponsor. We have written quite a few articles on this topic. What would be the H1B Filing fee for Fiscal year 2015 ? 

There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014.  The  H1B Visa 2015 filing fee can range anywhere from  $1,575 to $4,325  based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet.  But, lets say, if it gets passed, the below changes may happen.

  • Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
  • The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
  • H1B Visa fees can up to USD $10,000.
  • More stringent rules on H1B visa adjudication.
  • Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

  1. I got 221G by VO asking client letter. My Employer sent required docs after week time but if I ask them to forward those docs, they are not doing it. Is there anyway to ensure that employer really responded and sent docs to Embassy ?

    • Try to trust on your employer.. if they can file for you H1 then they would have submitted client letter as well..

      Confidentiality might be an issue for your employer.. and they never give you or tell you about that…so dont worry..

  6. After my lot status on may 15,TCS just sent my approval request today.Its a nice journey in this comments section.Thank you all for all your valuable info.
    Today i just checked the petition number they gave in approval request.
    I was shocked.
    It was approved on JULY 10.But TCS sent just today.
    TCS sucks.

      TCS send s the approval mail only wen it receives the documents for US. U shud be thankful to the company who has filed for h1b and u havent paid anything from ur pocket. Needless to say company will benefit from u but then again u will experience something which laks of associates are still dreaming about.

    My H1b application is at Initial Review since 10th April. I am on H4 visa now. Do I need to apply separately for h4 to h1b conversion once H1b petition is approved ? or it would automatically convert H4 visa to h1b? Guyz please reply!!!!

    • There is an additional document you need to file called Change of status. My guess would be your company filed that with your H1B docs. Once you get approved for H1B, read carefully if the Change of Status (COS) was approved as well. Otherwise you will need to go out of the country to get the COS approved.

    • Hi Poonam, I have applied for H4 to H1 and yes, the employer would have filed a seperate COS from h4 to h1 which needs to be approved with your H1. I am waiting too from Aug 18th with RFERR status.

    Those who got 221g don’t worry, you will get your VISA for sure.
    I attended Visa interview at Chennai consulate on 19th Sep and got 221g for client letter.
    I applied through small consultancy having 20+ employees in US, VO asked specifically for client letter with my name where there is a opportunity for me.
    I only have client contract copy between employer and client, then VO issued 221g saying my employer to submit PDF copies of all petition documents,employer and employee agreement, offer letter,client contract letter and client letter with my name through email, much worried at this point and I thought my petition is going to be denied.
    Discussed with my employer and they responded to Chennai consulate on 26th Sep with required documents and explanation saying that they can’t produce client letter with individual names, because that client is not provide such kind of documents, I had tough time and sleep less nights during my wait period, later received mail from US travel docs on 1st Oct saying to collect envelope from OFC,
    2nd to 5th were holidays, I went to OFC on 6th Oct and collected envelope having another 221g indicating to submit passports to nearest Visa application center (OFC). I submitted all passports(mine and dependents) immediately on the same day.
    Received mail from US travel docs on 8th Oct to collect passports from OFC,collected all stamped passports on 9th Oct, big relief.

    Thank god for giving me the opportunity,I know this wait period is really annoying but you will get it for sure.

    Can anyone advise on this?

    I got my H1 approved submitted through a consultancy at US. Im on H4 right now. I have an offer with a company for which I would like to transfer my current Visa which is approved. Are there any challenges transferring the VISA? The H4 to H1 conversion is yet to be done.

  16. Finally H1B petition approved after more than 6 months. heres the timeline :
    Selected in Lottery : April 10
    CPT related RFE : May 9
    RFE documents sent : June 10
    Status changed to RFE Response Review : June 11
    No change in status after June 11. Upgraded to Premium Processing on October 3, after waiting ~4months.
    Status changed to Initial review : October 4
    Status changed to Acceptance : October 4 evening
    Status changed to Initial review : October 14. Online status message said that address changed :-\ No idea why. My lawyer’s office address has not changed.
    October 15 : Lawyer received approval email. Online status has not changed and is still on Initial Review.

    Today I have done with H1B stamping PIA. I am silent viewer of this blog from a long time. This blog helps me a lot to get overview of interview. I just wanted to share my experience so it may help others too.

    Visa Priority: BEP

    Questions:
    1. How long you are working with XYZ Company?
    2. What they d0?
    3. Are you single or married?
    4. What will be your role in USA?
    5. Who is your client?
    6. What they do?

    And finally I heard golden words “Your Visa is approved!”

        They didnt ask me to show tax return. But I would suggest you to keep below documents.

        1. LCA, DS160 confirmation , Appointment letter, salary slips, revision letter if any
        2. I797 original
        3. Client letter or sow copy if you have
        4. Education and experience certificates
        5. And off course passport

    • Your new passport carries the same info as your old so nothing to do with visa . Ony thing is you passport should be valid while you go for stamping.

    • I didnt see the surname change :O Where did you make changes? Actually all the profile info should be same as the info give for Visa. I got married and I still carry my dad’s name as my last name in order to avoid confusions and also to dignify my dad. I will not have any issues right from visa to further studies.

  22. Hi..I got RFE on July 4th
    -Changed to RFE Response Review on July18th
    -Sep 30th, the status is same (RFE Response Review) but the received date got updated to Sep30th.
    – Oct 1st, status changed back to Initial Review.
    and now still in same status(Initial Review). If anybody have similar situation or aware of something like this, please help me with the info

  25. I did not make through lottery for FY-2015 regular H1b Cap.
    I was holding a earlier H1b petition from FY-2008 which was filed by some US based Desi consultancy. Due to recession and Job hops within Indian companies, I never got H1b stamped from my FY-2008 H1b petition.

    After getting rejected in FY-2015 lottery, I made my employer to file a Cap-exempt petition. Since I was already counted in lottery in 2008, my employed filed a new petition (Premium Processing) referencing the CAP number from my 2008 petition.

    On 10th Sep, I attended Visa Interview along with my Wife at Hyderabad consulate. Since mine is a BEp company, getting through interview was like a piece of cake. Below is my interview experience.

    Me & my Wife – Good Morning Officer
    VO : Can I have your passports please.
    Me : handed both the passports to VO. he looked at my Id card (I was wearing my company’s Id card)
    VO : started doing something on his computer
    VO : Which client you will be working for xxxxxx (my current company)
    Me : YYYY (told the client name)
    VO : What will be your salary in US
    Me : ZZ-K annually
    VO : Directed me to a finger printing machine. Please put your right hand four fingers on the machine Sir.
    Me : I placed the finger and he captured the prints on his computer.
    VO : To my wife – Mam, please place your left hand four fingers on the machine. She did that and VO captured her fingerprints also.
    VO : Thanks. Its approved. Have a great day.
    Me & my Wife : Thanks officer.

    This forum is of great help and I am happy that I reused my old unused petition and can stay in US for 6 years.

    I am traveling to US in November end.

      • Hi unique,
        Actually its a FY-2009 applied in Apr-2008.
        There is a misconception on 6 years duration. It does not matter if your H1 petition was approved 6 yrs back or 10 yrs back or 20 years back. A petition is mostly allocated for 3 years duration. But If you have a petition you are CAP counted aka CAP-EXEMPT (relaxed from applying H1 petition again). You can use your earlier CAP number to file a new petition with new employer.
        You are CAP exempt if there is still time onyour H1 duration i.e unused time in US. Eg. If I have stayed in US for 2 years, I can file a new petition to stay for 4 more years.
        Since I stayed 0years on my old petition, I get full ^ years stay with my new petition against the CAP-EXEMPT.
        I hope I am able to eliminate your confusion above.

        • Hi,
          Please do not mis-guide this forum.
          The Cap Exempt (ot of cap) rule says that – “you have to be on H1 status in last 6 years”. Which means –
          1. either your petition start date should be within last 6 years (if you never traveled to US)
          2. your date of exit from US (on H1 visa) should be within last 6 years.

          and of course, you should not have completed your 6 years stay in the US on H1/ L1

      In 2008 your petition is approved did you have visa stamped from that peition.
      I want to comfirm if petition is approved with out visa stamped can it be counted cap-exmpt for next 6 years.

    I received 221g in chennai consulate and they asked me to send requested docs to one mail id.

    But I didt send mail but my employer sent mail to the mentioned email id in 221g by stating my case id and everything.

    Is this a problem?

    • No, it’s not a problem. Same happened with us. Employer replied to the 221g and within a week we were asked to submit the passport and next working day our visa was approved.

          • Mine is In house project. I didt carry project documentation. VO was asking where are you going , why are you going like that.. and asked me to explain the project. then he asked me do you have project document with you.

            Then I said I dont have. Then gave me 221g stating to send mail with petition submitted to USCIS,contract letter between me and employer and tax return of company and salary and wage report.

          • Hi, mine too is an in house project. I think VO is giving 221g for most of the in house projects. I hope this doesn’t happen with Mike.

    My petition got selected in the lottery, and went to

    REF: 9 JULY
    REF RR: 2 SEP
    OCT 4 it went to Post decision Activity and on OCT 9th it again went to REF.

    I don’t know what is the reason for REF, my attorney replied to that.

    I am confused, what would be the reason, please let me know. If anyone in the same situation?

    Now, Is it mandatory to choose the job and payroll running with the employer1?

          I am also in same boat, two employers filed H1 petition for me. I am going to apply for SSN this week. but I am still not sure to which company I am going to join.
          iS their any linkage between SSN and H1 ? Their is a possibility;ity that I will use I797 of company1 to apply SSN and later join company2 as my employer.

    can anyone help me understand the response timeframe for RFE? i see its 60 days in the uscis site and my doubt is that is it 60 calender dates or 60 working days (assuming Mon- Fri)?

    After a struggle of 9 months waiting on lottery, RFE to approval etc. ..my VISA finally got approved at Mumbai consulate today. This forum has been really great to educate me on different H1b process and tricky things . Following was the interview questions along with answers .Though it was a simple questions with not so many fussy questions ,i am just sharing it for a reference .

    Me:Good Afternoon sir

    VO: No Reply

    VO : Please give me your passport

    VO: Upon observing my passport , he has flipped over the pages and went through all my previous entries to USA .

    VO: What is your job role ?
    ME: I am an IT Consultant and in to Administration of SAP

    VO: Are you travelling with Family ?
    ME: No, travelling single as of now

    VO: How long you been working for your current company name (XYZ)?
    ME:Past 4.5 years

    VO: I see you have visited CostaRica as well .
    ME : Yes sir, i have stayed there for an year and it is a beautiful country

    VO: Smiled up on that and than the most awaiting words were said “Your VISA is approved and you can collect your passport in 2-3 days ”

    ME: Smiled and thanked him

    VO:Bye and have a pleasant stay in USA

So Visa stamping process got delayed, even i am planning to put papers once i get the stamped passport. but my current company is no where present except the current location (india). So i don’t have any option of quitting and taking the new offer (US Employer).

    • Hi ukj, we are still waiting on my husband as well. Been on initial review since April @ vermont centre. We are getting anxious because I thought approval was suppose to be done by October. I have sent an e-request but I got a reply that case is still within processing time. Isn’t it 60 days max? They are having a laugh!

    I have attended H1B visa interview in chennai consulate on sep 17,2014 and received 221g for project documentation,tax return of company .

    We sent same on next day.

    Still i didt get any mail from embassy and status in ceac site says administrative process.

    Still how many days it will take?

    What would be the normal average time taking by chennai consulate for 221g.

    Just want to add a point, i think and agree that your points holds good for those who are traveling to client place or Indian MNC companies in USA.

    But my case is slightly different, currently i am working for indian employer and i will work for US Employer there (Hope will be located in Client place for my assignment). If visa approved, i will quit my job here and will be moving to US as i got the job offer there only.

    • Your Case is same like mine.. I am working with one MNC in Mumbai.. and filed for US employer which is not my current company..Both are altogether Different..so once i stampped probably late October i will resign to my current Compamny in INDIA giving them Option to transfer my LCA if they want me to stay in Same Company..or else will joine the new one in US.

    I am going to India for stamping. My interview is on Oct 20th. I am working as a contractor and my contract is only till Dec 10th. I have a client letter which doesn’t say my contract end date but my purchase order clearly says that my contract will be over in December.
    Do you think it will be a problem during stamping ?
    P.S.: Its my first time H1b stamping.

    • Mine was Aprroved on 5th September 2014 . And my Attorney got it in % days…On top of that They ahave added some Supporting Documenets and Did notary and all took time and they Deklievrd last on 7th October via USPS (United States Postal Service) and it just came on 11 the October 2014 to Mumbai.

      So now will take an appointment for stamping late October…

      So in Your case it depends how speedy your employer is..?

        • Let Them take their time as this documnets are very important and they have to Add on some Supporting documents Without any Minor Mistakes..Becasue mistakes may create a problem during stamping..so be patience..

          but yes you need to keep asking them about the documents..so be in touch with them and keep updated..

          by the way it doesnt make any diffrence if you wait couple of days more…because this wait is not Killing rather waitng for Approval.. 🙂

            How long it ill take to complete That specific document after RFE approval ( just tell about roughly duration)

            coz it was almost 40 days completed (after RFE selection)

          • When you get any RFE against your case. USCIS mentioned teh respponse time depending on the Complecxity of the RFE.Howver once your Attorney/Employer Submit the RFE. USCIS will take decision within 60 Days as per their Website. and evry time ideally they takes the decision within 60 days..BUT if you get RFE again then it will go to the Same Cycle again..
            So once ur Case is in RFE response review.. you can hear good/Bad news within 60 days..

            If you wont get any update ask your pititioner to Contact USCIS..they can ask against your case.

            I got selected and my employer received documents in 8 days.
            Its almost 36 days over but my employer is not Giving any updates.

            I was understand from u that they are preparing special documents.

            Here my question is generally how much time is taken by employers?

          • Mine got approved on 5th september…and they deliverd all documents on 7th oct and i got it in my hand on 11 oct…but yes my hR was on vacation so bit delayed..

            But ideally it should be reach within month…so keep asking and emailing

      2)Original Birth Certificate 0f child if attending
      3)Passports..of all attending
      Better to appear along with H1b holder to make it easy.
      Later they can fly along with or they can fly later.
