- May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
- April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?
USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.
What would be the Cap count for H1B Visa 2015 quota ?
No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.
- Regular H1B Quota : 65,000
- Masters H1B Quota : 20,000
- It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

How soon should I start planning for H1B Visa 2015 ?

How do I find Sponsors for H1B visa 2015 ?

What would be the H1B Filing fee for Fiscal year 2015 ?
There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014. The H1B Visa 2015 filing fee can range anywhere from $1,575 to $4,325 based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet. But, lets say, if it gets passed, the below changes may happen.
- Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
- The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
- H1B Visa fees can up to USD $10,000.
- More stringent rules on H1B visa adjudication.
- Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

If premium processing then attorney will get it in 2-3 (may take 7 days depending upon location) business day and an email in few minutes.
You can fill pay visa fees(if by netbanking then register beneficiary, it will take 24 hrs to be activated by bank) cash option is easy, and will active in 3 hrs. Next fill the ds160. Ask your attorney to verify it before submitting. At the end you need to provide receipt number given in receipt of bank(if cash). then select dates (OFC, interview)

1) my company is planning to send me to a diff location rather than the one that was filed as part of the petition. My petition is currently approved and im waiting for my stamping. Can I initiate the LCA for new location while im waiting for my stamping ie can I perform new LCA process simultaneously while I wait for my stamping slot(assuming that I have received the approved I-129 documents from my attorney).
2) Hows the current stamping slot trend in Chennai. When can I get the next stamping slot in Chennai as of today or the last couple of days.

My Employer sent me two Dockets, out of two one is not suppose to Open by Me and that should be open by VO only.

there is nothing like VO specific. Even Interview rule is, nothing supposed to be sealed also everything in transparent bag/folder.
My attorney sent me, H1B packet, and RFE docs copy. We need to aware from H1B file.. Its our rights, and VO will ask question from that, like Role, Client, Location, Salary.

Ur Ans: I hope you are through an indian employer, then your company name. If an US Employer is offering a job and currently you are associated with an indian employer in india. Then what should be the response? (Currently associated indian employer or US Employer)
It should be still current employer, In your case Indian Company. In case if US employer has filed petition, then he will be your petitioner. Read your I797 thoroughly

I am not sure of any link, you can check your petition copy I129 for that. Generally companies like TCS, TEchM, Infy, CTS etc.. comes under BEP category.

VO asked who is ur employer, so you are going to work an in house project and i said yes. then he asked about salary and then i said and he asked me to explain the project.
then i explained. then he asked do you have project document. i said i dont have it with me . then he asked me to send contract letter btw me and employer, project document, tax return of company and salary and wage report of company to mentioned email id.
thats it. we sent it by next day itself.

I’m in US on L1B visa (expiring date is Mar-10-2015). My company applied H1B cap 2014 for me (COS), its status is RFE review. Because of family problem, I’m booking ticket to go back to my country right now and I have question:
1. Is there any problem with my H1B approval process if I go back to my country?
2. If during the time I’m in my country (2 weeks), my H1B is approved so can I use the current L1B visa to go back to US or I must have visa interview with the approved H1B.

It has been more than 5 months since I got selected and in Initial Review, then finally on Sep 22nd i got an update eamil, saying they sent out a RFE notice!!
Don’t know why it take so long for them just to ask for a RFE…Mine is AD/RP/Vermont, got selected/receipt since April 10th…and now we are still waiting for the rfe notice..It’s so frustrating..
Any idea on how long it takes to receive the notice? any hope that I can get an approval ?

the review took almost 1 month, the RFE was about the client’s info in more details, while my employer was just planning to get the visa then put me in the market!!! so simply he didn’t have a specific client for me.

My H1B petition got approved today — after 58 days of RFE response review wait
and my spouse’s H1B visa stamping interview successfully done at Mumbai consulate.
My case status:
Initial Notice: April 28th
RFE: June 25th
RFE response review: July 31st
Post decision activity: Sept 26th
My spouse’s case status:
Initial notice: April 21st
RFE: May 30th
RFE response review: July 25th
Post decision activity: Aug 4th
OFC & Visa interview: Sept 25 & 26.
Surprisingly OFC & visa interview at Mumbai last 10 & 30 mins respectively.
OFC was scheduled at 10:30 am, we reached there at 10:15 am and straightaway allowed to go inside. Simple process of fingerprinting & photographing lasted 10 minutes.
On 26th interview was at 11:30 am, reached consulate at 11:00 am
There were not many people in queue – may be some 50 persons.
USCIS staff were calling out names of people from 11 am slot.
They told 11:30 slot people to form a separate line and all were allowed in at 11:15
Security check -> OFC check again -> VO interview
Not many questions asked by VO.
She only asked about client company, location, salary, are you going with family, etc.

Here is my situation.
Currently I am on H4 visa. This yr I applied for H1 and it got picked up in lottery
and approved a month ago. And my H1 is valid from Oct 1st 2014 till 30th Sept 2017. But right now
My employer just informed that as he doesnot have any internal or extrenal projects,
he is going to terminate my H1. I only have my Receipt number and donot have any copy of I797.
On 30th Sept 2014, my H4 will expire and i will be out of status as even my employer is terminating my
H1. So If i apply for extension for H4 now and in future if i apply for H1(New petition), will i come
under Cap Exempt or not, even if my employer terminates my H1 ?
Can you work with your employer not to cancel H1b and look for a new jon mean while. Who can transfer your H1?
You may talk to any other consultancies to transfer your H1.. i’m sure they would grab it.

Please ask your employer not to terminate your H1. Getting H1 is big deal and no problem if he does not have any projects. Rather you can find some other employer in your state or any other state and request for a H1 transfer. All the best!

You are cap exempt if you have your I797. Even if your visa is revoked. Using this petition, any employer can file H1B anytime. My husband had a revoked H1B but he was cap exempt and was able to use it later within the next six year. Please do not apply new visa next year again and increase one more application!

The notice explains why the denial decision was made and the options that may be available to you. If you have not received this notice within 15 days of September 25, 2014, please call customer service at 1-800-375-5283 for further assistance.
When i called my employer regarding this, he said no net yet received official confirmation however there is a problem with site as well.

Is arrange or love marriage? how many people attended? what is your husband’s birthdate, what is his favorate color and what is his favorate dish.
Finall he said, Your VISA Is approved.
Just be calm and cool and confident while answering and go in formal dress with tie and company batch if any. that will help a lot.

I think its a waiting of 1 week.
My company booked it on Sept 18 for Sept 25 & 26.
As I said there were not many people in Mumbai consulate.
When we came out after the interview at 12 pm there were no persons standing in queue and those who came were just walking-in for their appointment.
Don’t know whats wrong wit USCIS people. RFE Response Review is more than 2 months now.

I submitted my 2nd RFE response on Aug 18th and the status changed to RFE response review on Aug 28 saying they recvd on Aug 18th. I guess lot of us are on the same boat :D. Interview was at 10AM. Reached consulate at 8.45. Already long queue was there. Even 9AM interview guys were still standing outside. Got inside around 10Am. Came out after 30min approx after the interview.

Visa approved. No qns to spouse and didn’t not ask for any docs other than passport.

For the past few days the only people posting in here are those whose petitions are in “RFE Response Review” state. I am in the same boat, only worse 🙂
My petition is in “RFE Response Review” status since June 11, 2014…thats more than 100 days. I spoke to my lawyer and manager today and my employer is going to file for premium. My RFE was related to CPT and a lot of people in my class got similar RFEs which got approved within few days(with regular processing). I dont know why some petitions get approved and some dont. At this point I am extremely frustrated and have no idea why USCIS cant process applications submitted in June and July 🙁 Good luck to myself and everyone else who is waiting.

Do we stand a chance at getting our H1B approved? Everyone else seems to be getting approved in 2 weeks to a month.

yes, can’t understand process sequence. lot’s of folks getting approval who submitted docs in sept. and getting approval within 10 days and they are regular process file. 🙁
I am in same boat just recevied 2nd RFE regarding CPT. first RFE about project details and looks like its cleared but they sent another one regarding CPT. Can you tell me which school CPT are you on. I am on GBC I heard most of all GBC CPT got same RFE. You mentioned your class mate has approved H1 does it Approved with Change of status or do they need to go for stamping to use H1B.

Thanks Allah my petition is approved today, it was in RFE response review from 5 sept. May I know how many days it wl take 2 receive mailed docs from uscis. You replying and TCS sending might have taken sometime. No updates on any front from TCS. it seems these guys doesnt want to reveal. Or USCIS is delaying TCS’s petitions for reasons only known to them

You may get direct approval or rfe. i got rfe and send docs as well and no update as of now for me.
Even i got RFE on July 9th and sent docs on July 19th. On July 21st got email that docs have been sent to attorney. I don’t know on which date attorney submitted the docs to USCIS. As per the RFE email due date was Aug 7th but still haven’t got any update so far. I called US Visa team and asked if they can atleast check the status on USCIS site with the petition number and provide me the date when the status got changed to Response review but for that too they said its not allowed.
Heard few ppl got their petition number into the 1st email by mistake and when they checked their status its been showing approved since August but still they haven’t got any email from US Visa team.
Definately TCS deliberately not revealing the results and its really impacting employees….
I think so.. I have asked my current project team if someone from Higher management can deep dive into this issue we can atleast get a sigh of relief that the petition is approved.

This is the first time H1 was filed for me and it was approved but my visa validity is showing only for 1 year although we had raised for 3 years, i am not sure why ? So i wanted to know like how many we can go extension and how many years we can stay in US if validity for first time 1 year.
Also please let me know if there could be any reason why validity is for one year

If you have a year of H1B valid then you can stay in the US until that 1 year valid period and you should get your visa extended before the validity expire. You can get your visa extended until 6th year which includes the 1 year you have already got now. Usually pple get 3 years of visa when they apply for extension from the US. All the Best!

After all the process, I’m in front of VO (Chennai Consulate). VO asked 3 questions total. He asked for the passports. I handed over all 3 to him.
Question to me: Who is your client?
Question to my spouse: What’s your highest qualification?
Question to my kid: Do you like soft drinks?
Then the golden words came “Your visa is approved. Have a pleasant stay.”

Now the case status went back to Initial Review. Is this normal or bad news? (I remeber reading questions in these lines in this forum before, but mind compmetely blanks out when it happens to you. Would appreciate if someone answers this a zillion and oneth time 🙂 ).
hey i don think you have to worry about it . it happend to my frnd wen she changed it from normal to premium , first went to initial stage and the next day it was approved 😀 all the best !

My H1b is approved but COS is denied. I was on CPT from 2012 Oct 1st. In the COS denial notice they have mentioned about the CPT status not valid because my college and i both were failed to establish that CT is an integral part of my studies at my University “Sullivan University”. I now believe that i am out of status according to USCIS from 2012. I am confused in this situation as wherther to go to Canada for stamping or not???? Please advise me if any one has been through the same situation…..
I do not think you are out of status. I believe you got a CPT from the first day and got RFE on this was illegal. I knew number of universities who offer CPT from first day and their student getting their H1b after such notices. Did you got RFE and respond to the?
I had my OPT from a different school.After its expiration I did not have no CPT. And then I got into this CPT School. In the COS denial notice they are actually saying that only a person in a valid legal status can get transferred to a new st7atus like H1B…. Now I am in a state of mind that they are assuming me out of status since 2012… Because If according to them i was in legal F1 Status why would they deny my COS.

CA center seems to be processing applications very promptly. I saw a couple of posts where the petition was approved within 2 weeks of RFE response review.
Mine has been in review since July 31st. Does it mean that there are less chances of approval?
