Flash News Update  : 

  • May 5th : USCIS announced today that data entry of all FY15 H-1B cap petitions has been completed. USCIS will now begin returning all H-1B cap petitions that were not selected in the lottery. They have announced it on their twitter and facebook pages.
  • April 18th : USCIS announced that they will begin H1B FY 2015 premium processing from April 28th, 2014. Previously they announced that they will begin, ‘no later than April 28th’. They just clarified that. You can read on USCIS website

When will H1B Visa 2015 Season Begin ?

USCIS accepted H1B Visa 2015 applications from April 1st, 2014. They had the window open for 5 working days. USCIS stopped accepting H1B Petitions for FY 2015 from Monday April 7th as more applications were received than the required cap of 85,000 petitions.

What would be the Cap count for H1B Visa 2015 quota ?

No changes to the H1B Cap for FY15, the immigration reform discussions did not go through, the cap limit remained same as last year.

  • Regular H1B Quota : 65,000
  • Masters H1B Quota : 20,000
  • It is to be noted that 6,800 visas every year are set aside for Singapore and Chile Free trade agreement filings, which is called as H1B1 program.

Would there be lottery for H1B Visa 2015 ?

How soon should I start planning for H1B Visa 2015 ?

[ Updated : H1B Sesaon is over for FY 15, plan for next year FY 2016 ] Well, there is nothing like too early… Getting a good H1B Sponsor can be a challenge these days. You need to find a job that fits your profile and find a sponsor that has a job for you.  Some employers want to test out the capabilities of the candidate before they plan to sponsor H1B Visa. Typically, they would like students with masters from US work for them on internship or co-op.  If they like the candidate then they will sponsor H1B visa.  If you are planning to land in US from overseas countries like India, it could be even challenging to find a good sponsor. Maybe you would need to work with global IT services companies and make your way up. It can involve lot of internal process to get the process initiated… You are never early…. How do I find Sponsors for H1B visa 2015 ?

This is probably the most asked question.  It can be a challenge to find a good sponsor. We have written quite a few articles on this topic. What would be the H1B Filing fee for Fiscal year 2015 ? 

There has not been any changes in the filing fee for the past couple of years. It did not change for fiscal year 2014.  The  H1B Visa 2015 filing fee can range anywhere from  $1,575 to $4,325  based on the size of the company (number of employees ). Also, the attorney fee can range from $700 to $3000. H1B Visa Immigration Reform – CIR – Proposed Changes ? The comprehensive immigration reform has not passed yet.  But, lets say, if it gets passed, the below changes may happen.

  • Annual H1B Cap will be increased from 65,000 per year to 110,000. If exteme demand, it can go up to a maximum of 180,000.
  • The H1B quota for STEM degree holders from American Schools will increase from 20,000 to 25,000
  • H1B Visa fees can up to USD $10,000.
  • More stringent rules on H1B visa adjudication.
  • Mandatory LCA posting on DOL website for at least 30 days, before it is certified.

    • It works in reverse. You asks you to place appointment for visa interview and then asks to pick a date before that for OFC. Please check again.

    Need some help please.
    I got my VISA today and can see that it have a ExpiryDate of Sep-2015.
    So my query is as below :

    1. How difficult is it to get the VISA extension.
    2. Can only my present petitioner apply for the Extension.
    3. Can I change my Job before Sep-2015

    My present Employer is ready to sent me to US by NOV end this year.

    Please help me with above query, I am really worried why I got VISA only for 1 year.

    • 1. visa extension is not difficult, its less difficult than getting a new H1. but yes you and your employer need to file an extension with all required supporting documents like client letter, LCA, SOW etc etc.
      2. Yes, only your present employer can file extension. If any other company want to file your petition that would be a visa transfer from one employer to new employer.Its not that difficult once you are in USA. and the big thing is once you are in USA you wont have to go for stamping…a big relief.
      3. yes you can change you job any time after coming to USA, but i suggest dont do it in first few months of your arrival.

        Why I got VISA only for one year , is it my petitioner applied only for one year and USCIS decided it dependent on the document submitted.

        • any reason out of these:
          1. your employer applied just for 1 year
          OR
          2. depending on the SOW, client letter and project duration USCIS found only 1 year visa is required.
          again dont worry about extension..its easy as compared to getting new H1 but choose your employer consultancy wisely in future if you have doubt about their paper work … many good company and consultancy are ready to transfer your H1 once you are in USA means no visa stamping required….

    I attended the interview at Hyderabad consulate, I want to share my experience.

    OFC(Finger Print) appointment was 5th Sep at 10:30. I reached there by 10:00, they are allowing 15 min prior of the appointment time. they allowed all 10:30 scheduled candidates by 10:15, they asked only appointment letter & passport. I came out by10:25. it was straight forward.

    My Consular appointment was 8th Sep at 9:30. that day was Ganesh Immersion so all the roads have traffic conditions, I got to start 2 hours early, from home.

    I reached consulate by 8:45 am. they just checked my passport & allowed. There were many people waiting on the chairs. Staff asking people to sit and wait who are coming in. I sat almost 1 hour, finally they started calling 8:00 am scheduled candidates, then 8:30, 9:00. They called 9:30 scheduled candidates around 10:15.

    initially they took the passport and attach a code & gave it. then security check same like airport check. After that

    inside there is a big sitting area, there are 4 to 5 monitors are showing the code & window no# to go for an interview. my no# displayed at around 11:00.

    I went to that window. there are 16 windows with Visa Officers.
    3 candidates already waiting at my window. VO took one interview & went inside for 20 min. she came back & took one more interview for 30 min for a couple. looks like it was green card issue. by the time we were passing the time by watching other visa interviews next to our window which is not for H1

    my turn came around 11:45 am,

    Me: Good Morning Miss
    VO: Good Morning, Passport Please
    Me: I gave my passport
    VO: she is looking into the monitor & asked Which company you are working for
    Me: XXX
    VO: How long have you been working for this company
    Me: New employment
    VO: what do they do? is this a Consultant company ?
    Me: Yes
    VO: To whom are you going to work ? emp or client ?
    Me: Client
    VO: Who is your Client ?
    Me: XXX
    VO: Spell it ?
    Me: XXX
    VO: What is their business ? (She was looking into the monitor)
    Me: XXX
    VO: What are the projects they have & in which project are you going to work
    Me: XXX
    VO: in which technology are you going to work ?
    Me: XXX

    Finally she says ‘ YOUR VISA IS APPROVED’
    Huhh… I was relaxed like anything & came out by 12:00.

    She did not ask any document other than my Passport.

    I received an email on 9th Sep that I can pick my passport.

    I picked my stamped passport on 10th Sep. Such a big relief by checking the stamping for the long long process.

    Each & every stage of H1 is crucial & stressful, starting from Filing, Lottery, Approval & Interview

    My H1B got approved and stamped in year 2004 but I did not travel to US on this Visa .
    Now I want to use this petition for cap exempt . Can you please tell me can I use this petition for case exempt after so long ?

    • Hi,

      You can not use the visa.
      The cap exempt rule says “You should be in H1 status in last 6 years”.
      This means, either your petition start date should be within last 6 years OR if you traveled to US on H1, then the return date from US should be within last 6 years.

      You have not traveled to US, so second statement is not valid for you. As per first statement, your petition start date can not be earlier than (considering october 2014) 1-Oct-2008.

      So as per both conditions, you are not eligible for cap exempt to use the petition in 2004

    The status of my H1B turned to RFE a couple of months back and my attorney sent the required documents a few days back. My attorney also informed that, as per my company’s direction they have also upgraded the petition to Premium. I can see that the current status is RFE Response Review though its not mentioned anywhere that its premium. Can someone help me out as to how to find if my application has been upgraded to premium. Will it be mentioned anywhere?

    I came to US in H4 visa and applied for H1 through a consultancy. My H1 has now got approved and i did recieve the I97 document. I have two doubts.

    1. Is there any compulsion that I need to find a job and start working within a month (ie within November)? Will there be any issues if theres a delay in finding a job?

    2. Can i apply for a job in a different firm other than my current consultancy even before i start working on this H1?

  15. Does multiple RFE’s w.r.t a petition can cause denial ??

    Bcoz I did get an RFE on Jun 23,Submitted reqd docs and status moved to RFE Response Review on July 10.
    Now once again went into RFE on ‘Sep 9’.So getting bit tensed !!!

    • No. Multiple RFE means not denial. If your employer/attorney takes the 2nd RFE seriously and reply properly with all the required information, it will be approved. Good luck

  17. Hi, after all the waiting I finally went to the embassy today and my visa got approved. I was Regular processing. Fortunately, against all the odds this year (lot of applicants) my case got selected in the lottery. After that it stayed in “initial review” for nearly 2 months. One day I was notified it got moved to RFE, again it stayed there for 2 more months until it finally got approved. I got all papers from my company and today I had the interview.

    1st August: RFE Submitted
    8th August: RFE response Review
    5th September: Post Descision Activity.

  20. Hi All,

    I did pay my visa fees in axis bank and got the receipt sometime around 11 am to 12 pm today and now when I tried to book my appointment it says error message as ” No valid record can be found for the entered receipt number. Please validate that your receipt number is correct and that you have paid the correct amount for the visa which you are applying for.”

    What could be the issue? receipt is still not activated yet? how much time it required to activate?

    • Nope…still waiting for the update. Submitted docs on July 16th, sent to USCIS on July 22nd. Since then just waiting waiting and waiting….. 🙁

    I am currently on L1B and applied for H1 this year through a consultancy. Apparently this new petition is filed as ‘change of status’. It recieved RFE few weeks ago and attorneys are in the process of sending out the response.
    If my petition is approved, do I have to resign my current company and start new job on new status immediately from the petition start date? I would like to couple of weeks time in my current firm to bring my perm case to a logical transferable state. Do I have that luxury? I am greatful to have made it in the lottery but would like to understand the change of status bit..

    • Yes.you have to resign from the job as soon as your COS is approved.As you visa type will change from L1 to H1b.Your company can’t employee you under L1b

    • why did you apply for H1b instead you could have asked some one to file your GC. Usually it only take few months for your GC to get approved on L1. You had the luxury of benefits 🙁 Anyways everything is for good.All the best!

        My firm started perm but it went to audit. No response from uscis on audit so far. But now i will have to resign and lose the 1.5 yr wait I did for my perm. I couldnt get my firm to apply perm sooner 🙁

        Does longer RFE response review time mean an approval or a denial 🙁

        Completely going mad with all the tension. A lot of H1’s are getting approved after a very short RFE response review time.

  25. Got RFE on 10 July..I sent all required docs to my employer on 16 aug.. When i asked them about sending RFE’s response. Employer is saying that my documents have been sent for evaluation to USCIS. they can respond the RFE as soon as we receive evaluation profile from USCIS.
    As per my view, they should have responded the RFE as they received the required docs from me.
    Can anyone pls tell me what is the meaning of evaluation in RFE respond process?

  28. By god’s grace I got through in the lottery. On May 23rd I got RFE and responded(Client details,Employee n Employer relation chart details). On Aug 13, I got the 2nd RFE requesting my spouse H1B petition and pay stub to verify my H4 status and I responded the next day. Now my case status seems to be response review dated August 18, 2014. I am on H4 with 4 yrs of experience in IT and hold top certifications in the IT . Also , my petition was done in regular process at vermont centre. I hold Bachelors in Engineering degree. Could you please tell me how long does it take for the response review result? I am bit nervous and literally praying to god.

    • Officially it takes 60 days from the date of review. Though, it can even get approved tomorrow. 🙂 On the other case, you can get an RFE on the 60th day. So not to worry as nothing in your hand… 🙂

  31. My petition is approved and I am waiting for documents from my employer. They are saying that they will forward the documents by November as interview slots are not available until then. Can any one let me know when are interview slots available in Hyderabad or How can I check them?

    • I booked my interview on sep 5th and i got my slot on 10th.you ‘ll get your slot within a week or 10days.There is no way to check about the availability of slots unless you pay your visa fee.

    • No, you can’t. You need valid US assignment from the employer who filed your VISA petition. Once the stamping is done, you can even switch employer, but till then, be patient and try to get a valid role.

    • Trust me, don’t throw your money away. USCIS is getting stricter each day and most of these consultancies show fake jobs which ain’t good for your career. Better try to get it through your own company. If not, try to switch to a company which offers such role instead of consultancies. Also, yes, once you clear the lottery, you need to pay whole fees. And then, there is a pretty good chance of rejection during interview due to invalid/incomplete job info. So, as I said, don’t throw your money away. Work hard, live well…

  37. I had my visa interview in Mumbai today. VO asked basic question. However be confident and clear. I almost screwed up when the VO asked me who paid the visa fees and I said I only paid the visa appointment fees and she thought I had paid the entire fees but that confusion was shorted out quickly and VO told me your Visa is approved. It all took 5 mins. Just be very confident. 99% of the time you will get a positive response.

    • Man, go live life.. It is not about saving all the time. How long will you continue chasing money… Whatever you earn, if just stashed in the bank then what is the point in living. Never deprive yourself of any happiness when you can afford. Live happily.

      But just in case you still want to know, your saving depends on the State you’re staying in. Your salary is decided according to the minimum salary slab of the state and is accordingly mentioned in your LCA. So, if you’re going states like Michigan or Ohio, you’ll be able to save more than 50% of the salary if you are ready to compromise in certain areas. But if you’re going to California, you can hardly save anything, just a descent living. Again, statisctics shown here are hypothetical based on my experience.

    Do I need to upload photograph while filling ds160 or photo will be taken at embassy office?

    Do they ask questions, how you got to know about const and what all other possible questions they ask for consultancy application ?

    • If you paid for your h1b, thats not legal. But anyway, never mention these things during interview. If not, you’ve nothing to worry about.
      Just tell them you got that new job offer through this consultancy (don’t mention consultancy word much), instead focus on the company you’re joining there. Tell them what they ask with confidence. Read all your h1b related documents and new job offer several times before you appear for interview.
